JUDICIAL AFFIDAVIT

I, BERNADETH D. COMBATE, of legal age, Filipino citizen, single, with home address at No.
15 Blueberry Street Barangay Rizal, Makati City, after having duly sworn to in accordance with law do
hereby depose and say under oath that:
The person examining me is ATTY. JOHN RELLY DELA CRUZ with address at_____________.
The examination being held at the same address. I am answering the questions fully conscious that I do so
under oath and may face criminal liability for false testimony/perjury.
This affidavit is being offered to prove that the ACCUSED murdered JUAN TUAZON on April
30, 2013 by means of treacherously slitting the latters neck with the use of a samurai.

Q1: Please state your name and other personal circumstances for the record.
A1: I am Bernadeth D. Combate, 30 years old single.
Q2: Are you the same Bernadeth D. Combate, eye witness and who help the victims wife to rush the
victim to the hospital?
A2: Yes, sir.

Q3: Are you related to the victim?

A3: No Sir.
Q4: Do you personally know the accused, Mr. Raphael Mari Chaves in this case?
A4: Yes.
Q5: Can you tell us how did you know Mr. Chaves?
A5: We live in the same Barangay, Barangay Rizal and he is the live-in partner of my friend Gissy
Gaudiel.
Q6: Where were you on April 30, 2013 at about 7:15 in the evening?
A6: I was with Gissy Gaudiel, the live in partner of the accused sir and we were just passing time and
seated at Mockingbird St. near Blueberry and Milkweed Sts. in Barangay Rizal, Makati City about two
meters away from Mr. Chaves
Q7: What transpired during that time?
A7: As we were sitting, we saw three girls arrive who handed Chaves a letter. Chaves then left and after
about five to 10 minutes, Chaves emerged from an alley with a two-foot samurai in his hands. He was
very angry, cursing, and hacking plants with the samurai.
Q8: What did you do upon seeing what Chavez was doing?
A8: Gissy and I moved to a store some six to seven meters away from Chavez.
Q9: What happened next?
A9: Juan arrived from Blueberry Street where he left his wife Maria Celine inside a tricycle. Chavez
greeted him and announced that the latter owes him money, at which point Juan gave Chavez PhP50 then
proceeded to the alley.
Q10. What did Chavez do after receiving the Php50 from Juan?
A10. When Juan went out of the alley and returned to Mockingbird St., Chavez suddenly placed his arm
around Juan and slit Juans neck with the samurai
Q11. What did you see that occurred next?
A11 .Chaves then ran away while Juan staggered towards Blueberry St. and fell down bleeding.
Q12: What was your reaction?
A12.I was stunned and was not able to move for a moment sir but when I heard Maria Celine crying for
help, I run toward them and helped Maria Celine rush Juan to the hospital where he was declared dead on
arrival due to loss of blood as a result of the wound on his neck.
Q13 Do you have anything to say Ms. Combate?
A13: No, more Sir.
