GENERAL
Large scale projects in Indonesia were usually constructed and financed by international lending
institutions, such as the World Bank, Asian Development Bank (ADB), Japan International Cooperation
Agency. They require the use of Conditions of Contract published by Fdration Internationale des
Ingnieurs Conseils (FIDIC), Geneva, Switzerland. FIDIC Conditions of Contract is considered as fair
and balanced by the Multilateral Development Banks and is being used in 85 member countries all
over the world.
How to manage the construction claims (employer's claims and contractor's claims) and how to utilize
the clauses related to those claims should be understood by parties involved in the projects (employers,
engineers and contractors) in aiming to professionally manage the claims and to satisfactorily complete
the project.

THE SPEAKERS

Peter Boswell
PhD (MIT), MA (Cantab), CEng, EurIng.
Peter Boswell became the FIDIC General Manager since 1999. He was born and
educated in Kenya and received a MA and a PhD in materials engineering from
Cambridge and MIT, respectively. He then worked as a process engineer with Boeing
and Ford in their development centers in Seattle and Dearborn. In 1979, he joined
Anglo Americans Johnson Matthey at its development centre in the UK, becoming
Principal Engineer. Following joint projects with Battelle, he joined Battelle Geneva
as the Group Manager, Process Engineering, responsible for designing and
implementing advance materials processing plant. In 1986, he joined the European
Physical Society, Geneva, as the Director responsible for publications and public relations. Dr. Boswell is
a Chartered Engineer (UK), EurIng, and a member of professional materials engineering associations in
the US, UK and Australia. He also belongs to professional associations for association management,
conference organization and publishing and holds some 40 patents, has published over 100 technical
articles and is the co-author of several conference proceedings. He is currently a member of ISO, ITSBE
and UNEP working groups developing standards and best practice for environmental management,
quality management and other management aspects of sustainable development, and he assists in the
development of conditions of contract and procurement best practice.

Geoffrey Smith
BSc, LLDip, CdipAF, FICE, FCIArb, Barrister, Accredited Mediator,
FIDIC International Accredited Trainer.
Since leaving the UK 30 years, Geoff has specialized in contractual problems on
international construction projects. The first seven years were spent in Iraq advising
French contractors. Since then, although based in Paris, he travels about 6 months a
year and handles disputes throughout Europe, Africa, the Middle East and East and
S.E Asia (Indonesia, Philippines, Vietnam, Cambodia, Thailand, PRC, Taiwan). He
acted as Counsel in major international arbitrations and regularly serves as Expert
Witness. He manages the preparation and resolution of claims and cases and currently oversees several
major projects in order to resolve contractual issues as soon as they arise. He provides training on
contracts management to major French companies, has prepared training materials for the OECD and he
UE and for the last year, a significant amount of time has been spent traveling the globe as an accredited
trainer for FIDIC.

Sarwono Hardjomuljadi

Sarwono Hardjomuljadi is the Special Adviser to the Minister of Public Works,
Republic of Indonesia since 2009 - Vice Chairman, National Board for Construction
Services Development of Indonesia. responsible for Professional Development,
R & D, Mediation and Arbitration since 2007. His Professional qualifications are
Water Resources Principal Professional Engineer, ASEAN Chartered Professional
Engineer, Associate Member of Chartered Institution of Arbitrator. Formerly the Vice
President of Indonesian State Electricity Corporation, where he has been working since 1982 and
involved in construction contract administration & claim settlement of the construction of 10 HEPP in
Indonesia, as the Site Engineer, Project Manager for tunnel, dam and infrastructure works of several
hydro electric power plant projects. In the professional organizations, he is the Vice Chairman of
Indonesian Hydro Engineers Association (HATHI); Member of Indonesian Geotechnical Engineers
Association (HATTI); Indonesian National Committee on Large Dams (KNIBB); Indonesian Engineers
Association (PII); Indonesian Renewable Energy Community (METI). He is also lecturer on Contract
Administration at Tarumanagara University and Parahyangan University; Capability Development for
Certification at Indonesian Engineers Association (PII); courses of FIDIC General Conditions of Contract
in Bahasa Indonesia for several professional association; He is the chief editor and translator of Bahasa
Indonesia Version of FIDIC General Conditions of Contract for Construction Harmonised Edition 2006,
EPC/Turnkey Project 1999 and Short Form of Contract 1999, under FIDIC license.
