Energy Conservation Act 2001


Energy Conservation Act 2001 has been enacted by
the Parliament in October 2001.
This Act provides a legal frame work for an efficient
use of energy and its conservation.
The Act extends to the whole of India except the state
of Jammu and Kashmir.
As per provisions of the Act, the Bureau of Energy
Efficiency (BEE) came into force from March 2002
onwards.

Energy Conservation Act 2001

The Act specify a class of users of energy as


designated consumer for the purposes of the
legislation.

It provides power to Central Government to :


1. Direct any designated consumer to get energy audit
conducted by an accredited / certified energy auditor.
2. Direct designated consumer has to appoint an energy
manager, the in charge of activities for energy
conservation.
3. Prescribe minimum qualifications for appointment of
energy managers.

Provisions for Penalty


If any person / designated consumer fails to comply, the
norms prescribed under different clauses, he shall be liable
to a penalty not exceeding ten thousand rupees for each
failure, provided that no person shall be liable to pay
penalty within five years from the date of commencement
of this Act.
An additional penalty of one thousand rupees for every
day during which such failures continues.
One of the Member of State Commission shall be
appointed as an adjudicating officer for holding an inquiry.
No civil court shall have jurisdiction to entertain any matter
related to the inquiry.
The Central Govt. shall establish an ATEC to hear appeals
against the orders of the adjudicating officer,

Gazette of India - Ministry of Power - The Central Government notifies the 9 energy intensive industries
as designated consumers under The EC Act 2001
1) Thermal Power Stations - 30,000 metric tonne of oil equivalent (MTOE) per year and above
2) Fertilizer - 30,000 metric tonne of oil equivalent (MTOE) per year and above
3) Cement - 30,000 metric tonne of oil equivalent (MTOE) per year and above
4) Iron & Steel - 30,000 metric tonne of oil equivalent (MTOE) per year and above
5) Chlor-Alkali - 12,000metric tonne of oil equivalent (MTOE) per year and above
6) Aluminium - 7,500 metric tonne of oil equivalent (MTOE) per year and above
7) Railways - electric traction Sub-Section(TSS),diesel loco shed, Production units and Workshops of Indian
Railways having total annual energy consumption of 30,000 MTOE or more under Ministry of Railways (as per
table)
8) Textile - 3,000 metric tonne of oil equivalent (MTOE) per year and above
9) Pulp & Paper - 30,000 metric tonne of oil equivalent (MTOE) per year and above
Energy Conversion values used for working out annual energy consumption in terms of metric tonne of
oil equivalant
For the purpose of this table
i) 1 Kg of Oil Equivalant :10,000 kcal
ii) 1 Metric Tonne of Oil Equivalant (MTOE) : 10 x 106 kcal
iii) In case of coal, petroleum products and other fuels in absence of supplier certificate, GCV of the above fuel
(fuel sample) will be considered as per the test Certificate from a NABL Accredited Lab or State Government
Lab or Gov. recoganised Lab .

Directives of CEA / BEE under the Act

1. Energy Auditing of 84 units from different power


plants in India have been conducted through Steag
/ Evonik.
2. Energy efficiency cells are to be established by the
thermal power stations.
3. Energy Management Policy is to be declared.
4. Certified energy managers are to be appointed /
engaged.

Initiatives taken by CEA / BEE under the Act


Detailed survey was carried out at all thermal power
plants to obtain the status on the following:
Establishment of energy efficiency cells.
Declaration of Energy Management Policy.
Engaging of certified energy managers.
Roles and responsibilities of energy managers.
Organizational structure pertaining to energy
efficiency / energy conservation cell.
Present status of procedures to measure energy
efficiency.

Energy Cell & Energy Managers

The energy manager an important position in power


station.
He is the focus point of all the activities pertaining to
energy management in power station.
Energy manager will have certain mandatory duties
& responsibilities to fulfill the provisions of EC act.

Energy Cell & Energy Managers


Duties / Responsibilities of the Energy Cell / Energy
Manager :
Play key role in the framing and formulation of corporate
energy management policy.
Develop an energy management action plan for the
thermal power plant.
Furnish information relating to energy consumption to
the BEE and State level Designated Agency (SDA)
Implement the recommendations of the accredited
energy auditor.
Review and monitor the energy consumption.
Reduce the energy consumption / set new targets.
Bring awareness on energy efficient technologies with in
the plant.

Energy Audit of Units at Panki TPS

1. Energy Audit of Unit no.3 was carried out in July


2006 by Steag (Evonik).
2. Energy Audit of Unit no. 4 was carried out by
Steag (Evonik) in Aug 2008, report of which was
submitted in March 2009 and subsequently
modified in Sept 2009.

Initiatives Required at TPS


1. A separate office / establishment for the cell is to be
provided.
2. Regular meetings (at Project Level / at Head Quarter Level
/ with SDA) / Regular activities of the cell is required to
prepare the power station to meet out provisions of EC Act
2001.
3. Energy management policy is to be declared.
4. Initiatives to be taken to start energy auditing, as most of
power stations already have several certified energy
auditors / energy managers.
5. Equipments / Instruments / Establishment required for
above work is to be arranged at the earliest.

Initiatives required by Gencos H/Q


1. To monitor the establishment of Energy Efficiency cells at
projects level.
2. To monitor Regular meetings / activities of the cell at
project / headquarter level.
3. Energy management policy is to be declared. It may be
declared at project level (individual policy for each project)
or at H/Q level, common for all projects of Gencos / Nigam.
4. Initiatives to be taken to start energy auditing at Thermal
Power Stations.
5. Equipments / Instruments / Establishment required for
above work is to be arranged at the earliest.
6. A Cell at Head Quarter Level may also be established to
execute the above works.
