The Jefferson Parish Council of Jefferson Parish, Louisiana, met in regular
session on Wednesday, March 2, 2016 at ten (10:00) oclock a.m. in the Council
Chambers, Joseph S. Yenni Building, Jefferson, Louisiana.
Ms. Cynthia Lee-Sheng, Chairwoman of the Jefferson Parish Council presided,
called the meeting to order. Eula A. Lopez recited a prayer. Ms. Lee-Sheng
asked for a moment of silence for Mr. Harry Hardin, an Asst. Parish Attorney
who recently suddenly passed away. Mr. Al Morella lead everyone in the Pledge
of Allegiance to the Flag of the United States of America.
The Chairman then requested the Parish Clerk to call the roll. The following
members were present: Cynthia Lee-Sheng, Chairwoman, and Councilmembers:
Ricky Templet, Paul D. Johnston, Mark Spears, Ben Zahn, and Jennifer Van
Vrancken.
The following members were absent: (1) Christopher Roberts

Michael J. Power Parish Attorney; Directors of the following Departments:

The Chairman called upon the Honorable Michael S. Yenni, Parish President to
address the Council at this time.
The next item of business was adoption of the consent agenda.
It was on motion of Mr. Roberts and seconded by Ms. Lee-Sheng that the
Consent Agenda be adopted.

was offered as amended:

An ordinance submitted under Docket No. CPZ-4-16 approving a requested
variance to the sign regulations of the CPZ at 6601 Veterans Memorial Blvd
on Lots C-9-C-1 and C-9-C-2, Elmwood-Lafreniere Plantation Subdivision,
Jefferson Parish, Louisiana, in the area bounded by Chetta Dr and I-10, as shown
on a survey prepared by Surveys Incorporated dated April 21, 1980 and revised
through 11/11/1981, and title restricting the usage of Lots C-9-C-1 and C-9-C-2,
Elmwood-Lafreniere Plantation Subdivision, in favor of the Parish of Jefferson
pursuant to the requirements of Sec. 40-482 of the Jefferson Parish Code of
Ordinances. (Council District 4)
WHEREAS, All State Financial Company is the owner of Lots C-9-C-1 and
C-9-C-2, Elmwood-Lafreniere Plantation Subdivision, Jefferson Parish,
Louisiana, which it acquired by Act on June 26, 1989, registered in COB 2905,
Folio 42, Parish of Jefferson; and
WHEREAS, All State Financial Company has petitioned to develop said lots

in accordance with the development drawings identified as PR-2 Site Plan for
Approval, prepared by Zito Russell and dated, March 2, 2016 and Old Tiffin Inn,
prepared by signworx and dated 1/14/16; and
WHEREAS, All State Financial Company has petitioned for sign variances
to permit one additional detached sign (where one is permitted and four are
existing) and to exceed the maximum permitted area of 300 square feet for all
detached signs, with the proposed additional detached sign having an area of
206 square feet; and
WHEREAS, All State Financial Company has proposed to demolish one of
the existing detached signs on the development site, which said sign currently
advertises A-1 Appliance, thereby reducing the number and area of all detached
signs and the overall degree of nonconformity of these signs; and
WHEREAS, All State Financial Company has agreed to title restrict the usage
of Lots C-9-C-1 and C-9-C-2, Elmwood-Lafreniere Plantation Subdivision,
Jefferson Parish, Louisiana solely for the purposes set forth in the reviewed and
approved site plan drawings referenced above in favor of the Parish of Jefferson;
and
WHEREAS, said property is designated on the Official Zoning Map of Jefferson
Parish as being located in the C-2 General Commercial District/CPZ Commercial
Parkway Overlay Zone, pursuant to the requirements of Articles XXVI and
XXVIII of Chapter 40, Zoning of the Jefferson Parish Code of Ordinances, and
which said map forms part of said chapter; and
WHEREAS, the Planning Director of the Parish of Jefferson has caused to be
duly advertised, as prescribed by law, a public hearing in connection with the
development of said property; and
WHEREAS, a public hearing was held by the Planning Advisory Board in
accordance with law.
NOW, THEREFORE, THE JEFFERSON PARISH COUNCIL HEREBY
ORDAINS:
SECTION I. That the request submitted under Docket No. CPZ-4-16 for a
variance to the sign regulations of the CPZ at 6601 Veterans Memorial Blvd
on Lots C-9-C-1 and C-9-C-2, Elmwood-Lafreniere Plantation Subdivision,
Jefferson Parish, Louisiana, as shown on a survey prepared by Surveys
Incorporated dated April 21, 1980 and revised through 11/11/1981, in the area
bounded by Chetta Dr and I-10, in accordance with the development drawings
identified as PR-2 Site Plan for Approval, prepared by Zito Russell and dated
March 2, 2016, and Old Tiffin Inn, prepared by signworx and dated 1/14/16, is
hereby approved.
SECTION II. That the usage of said Lots C-9-C-1 and C-9-C-2, ElmwoodLafreniere Plantation Subdivision, Jefferson Parish, Louisiana, is title restricted
in favor of the Parish of Jefferson solely for the purposes as set forth in site plan
drawings listed herein: PR-2 Site Plan for Approval, prepared by Zito Russell
and dated March 2, 2016, pursuant to the requirements of Sec. 40-482 of the
Jefferson Parish Code of Ordinances.
SECTION III. That no sign permit shall be issued for said Lots C-9-C-1 and
C-9-C-2 until and after the existing A-1 Appliance detached sign has been
demolished.
SECTION IV. That the Parish of Jefferson has not examined or reviewed the
title of any portion of land shown, or any restrictive covenants or restrictions
placed on said property, and that the action of the Parish in this matter does not
imply (1) that the applicants or owners title or ownership is valid, (2) that there
are or are not any restrictive covenants or other restrictions on said property, or
(3) that any restrictive covenants or restrictions that may be on said property are
enforceable or are not enforceable.
SECTION V. That the Chairman of the Parish Council of Jefferson Parish, or in
his absence the Vice Chairman, is hereby authorized, empowered and directed
to sign all documents and acts necessary and proper in the premises to give full
force and effect to this ordinance.
The foregoing ordinance having been submitted to a vote, the vote thereon was
as follows:

The ordinance was declared adopted on the 2nd day of March, 2016, and shall
become effective as follows, if signed forthwith by the Parish President, ten (10)
days after adoption; thereafter, upon the signature by the Parish President, or, if
not signed by the Parish President, upon expiration of the time for ordinances to
be considered finally adopted without the signature of the Parish President, as
provided in Section 2.07b of the Charter. If vetoed by the Parish President and
subsequently approved by the Council, this ordinance shall become effective on
the day of such approval.

subcontractors involved in each contract; and

Avenue; zoned R-1B Suburban Residential District/OMNCD Old Metairie

WHEREAS, the Jefferson Parish Council authorized the Old Metairie
Commission (OMC) to review certain development proposals within the
OMNCD by Ordinance Number 18547, dated July 1, 1992; and
WHEREAS, the OMC held a public hearing on December 3, 2015 and January

WHEREAS, the Board of Zoning Adjustments held a public hearing on

for routine engineering services which cost under $300,000.00 for Drainage
Projects, which services will be required to provide professional services for the
Woodlake/Seton Park Drainage Pump Station (Council District No. 4).
WHEREAS, by virtue of Resolution No. 124414 adopted on March 4, 2015, as
supplemented by Resolution No. 125604 adopted on September 23, 2015, preapproved lists of firms for routine engineering and supplemental services for
Drainage Projects were established; and
WHEREAS, the Parish of Jefferson and the City of Kenner have identified a
need to construct a Drainage Pump Station in the Woodlake/Seton Park area,
hereinafter the Project; and
WHEREAS, the City of Kenner will fund design of the Project under a Parish
of Jefferson/City of Kenner Agreement; and
WHEREAS, the Parish of Jefferson and/or the City of Kenner will apply for
construction funds under the Statewide Flood Control and/or the State Capital
Outlay Program; and
WHEREAS, it is necessary to select a firm for professional services associated
with the Project, including assistance in obtaining funding; and
WHEREAS, the engineering fees associated with the selection will not exceed
$300,000.00, excluding resident inspection services; and
WHEREAS, the Parish Council desires to select the firm of MSMM Engineering,
LLC from the pre-approved list for routine engineering and supplemental
services for Drainage Projects to provide Professional Services for the Project.
NOW, THEREFORE, BE IT RESOLVED, by the Jefferson Parish Council of
Jefferson Parish, Louisiana, acting as governing authority of said Parish:
SECTION 1. That the Council does hereby select the firm of MSMM
Engineering, LLC to provide Professional Services for the Woodlake/Seton
Park Drainage Pump Station.
SECTION 2. That in accordance with Ordinance No. 18571 adopted on August
5, 1992, the Administration shall negotiate a contract with the consultant
selected herein and said contract shall be submitted to the Council in complete
form, including all terms and conditions, for ratification by Council resolution
prior to execution of said contract.
SECTION 3. That no work associated with this project shall be authorized by
Jefferson Parish until a funding source is established.
SECTION 4. That when a funding source is established for financing all
necessary services associated with this project, proper account lines will be

A resolution extending the interim development standard in Section 1 of Council
Resolution No. 124631, adopted on March 25, 2015, which amended Resolution
No. 122870, which deleted the requirement that a new monument sign in the
FC-1 district replace an existing detached pole sign, for a period of six (6)
additional months or until the effective date of final Council action, whichever
comes first. (Council District No. 5)
WHEREAS, to promote the public health, safety, and welfare, the interim
development standard should be extended for a six (6) month period or until the
effective date of final Council action, whichever comes first, so that requirements
are in place that support the intent of the study.
NOW, THEREFORE, BE IT RESOLVED by the Jefferson Parish Council,
Jefferson Parish, Louisiana, acting as governing authority of said Parish:
SECTION 1. That the interim development standard in Section 1 of Council
Resolution No. 124631, which deleted the requirement that a new monument

extended for an additional six (6) month period or until such time as the study is

Parish Code of Ordinances providing, in pertinent part, that when a zoning or
land use study has been initiated by resolution of the Jefferson Parish Council
and pending final disposition of said amendment, supplement, change, zoning or
land use study, interim development standards may be established that provide
for reasonable approval conditions for certain types of development applications
that would be otherwise affected by the study for one (1) year, which may
be extended by the Jefferson Parish Council for not longer than one (1), six
(6)-month period.

dollars ($25,000.00) for expenses associated with the construction of a covered
middle school pavilion to be used for assemblies, outdoor classes and student

WHEREAS, Art. VII, Sec. 14(C) of the Louisiana Constitution of 1974 provides
that for a public purpose, the State and its political subdivisions may engage in
cooperative endeavors with each other, with the United States or its agencies, or
with any public or private organization, corporation or individuals; and
WHEREAS, Art. VII, Sec. 14(B) of the Louisiana Constitution of 1974 provides
that public funds may be used for programs of social welfare for the aid and
support of the citizens of Jefferson Parish; and
WHEREAS, the Parish is authorized by Article 1, Section 1 of the Louisiana
Constitution to enter into this Agreement to promote the happiness and general
welfare of the people; and
WHEREAS, the public purpose of the Project is described as: to provide to
Kenner Discovery Health Sciences Academy an amount up to Twenty Five
Thousand and 00/100 dollars ($25,000.00) for expenses associated with the
construction of a covered middle school pavilion to be used for assemblies,
outdoor classes and student activities; and
WHEREAS, the PARISH has a reasonable expectation of receiving the benefits
of an increase in educational and recreational opportunities and a promotion in
the happiness and welfare of Jefferson Parish citizens that is at least equivalent
to the Twenty Five Thousand Dollars ($25,000.00) described in this Agreement;
WHEREAS, the transfer or expenditure of public funds or property is not a
gratuitous donation; and
WHEREAS, the citizens of Jefferson Parish will benefit from the efforts of these
parties working together; and
WHEREAS, PARISH desires to cooperate with Kenner Discovery Health
Sciences Academy in the implementation of the project as provided.
NOW THEREFORE, BE IT RESOLVED by the Jefferson Parish Council of
Jefferson Parish, State of Louisiana:
SECTION 1. That the Cooperative Endeavor Agreement between the Parish
of Jefferson and the Kenner Discovery Health Sciences Academy under which

Parish of Jefferson, to be held on March 10, 2016. (Council District 4)
WHEREAS, Art. VII, Sec. 14(C) of the Louisiana Constitution of 1974 provides

cooperative endeavors with each other, with the United States or its agencies, or
with any public or private association, corporation or individual; and

March 10, 2016, and shall provide vital and informative health and welfare
initiatives and products for aging residents, with the goal of increasing the
longevity and quality of life for Jefferson Parish senior citizens; and
WHEREAS,, PARISH has a reasonable expectation of receiving a benefit of
disseminating vital health and welfare initiatives and products that will directly
benefit the citizens of Jefferson Parish, and this value is commensurate with the
considerations provided herein; and
WHEREAS, PARISH has entered into an Agreement between The Parish of
Jefferson and Jefferson Council On Aging, Inc., dated September 21, 2015,

Chapter 33 Unified Development Code, Chapter 35 Taxation, Chapter 36 Traffic
and Motor Vehicles, and Chapter 40 Zoning of the Jefferson Parish Code of
Ordinances, with the intent of determining the necessity and, if necessary,
appropriate standards for short-term rental housing, and to provide for related

WHEREAS, new online services have expanded the short-term rental housing
market in many localities nationwide; and
WHEREAS, as a result of the proliferation of such services, local governments
have begun to examine the land use implications of this trend, as part of what is
referred to as the sharing economy; and
WHEREAS, an analysis of the short-term rental industry with consideration of
potential regulatory standards is necessary to promote the general welfare of the
parish and its citizens.
NOW, THEREFORE, BE IT RESOLVED by the Jefferson Parish Council,

RESOLUTION NO. 126656
A resolution ratifying a Cooperative Endeavor Agreement with the Jefferson
Parish Public School System authorizing the Parish to participate in the
Employment Exploration Program by allowing special needs public school
students to work at jobs in the Parish Administration for four (4) consecutive
school years (2016-2017; 2017-2018; 2018-2019; 2019-2020) and to provide for
other related matters. (Parishwide)
WHEREAS, the Jefferson Parish Public School System participates in a special
education program, Employment Exploration, for qualified disabled students
from 15 to 22 years of age;
WHEREAS, the goal is to promote student participation in the community and
help prepare students for entry into the workforce;
WHEREAS, between 1 and 4 students in each group are sent out to community
job-sites including Jefferson Parish Government with supervisors and/or paraeducators;
WHEREAS, from 9:00 a.m. to 11:00 a.m. one day per week students are
assigned simple repetitive skills at various Jefferson Parish job-sites to gain
hands-on, non-paid skills training;
WHEREAS, the jobs include filing, copying, and other office assistant
functions;
WHEREAS, the aim of the program is to teach job skills to qualified students
so that they may ultimately gain employment in the community once they
complete school and the Employment Exploration Program;
WHEREAS, this is a tremendous opportunity for Jefferson Parish to be involved
in a community partnership for the education of Jefferson Parish public school
students with special needs; and
WHEREAS, Jefferson Parish has participated in the program over the past
several years and it is in the best interest of Jefferson Parish to participate in the
upcoming year.
NOW THEREFORE BE IT RESOLVED by the Jefferson Parish Council of
Jefferson Parish, Louisiana, acting as governing authority of said Parish:
SECTION 1. That the attached Cooperative Endeavor Agreement authorizing
the Parish of Jefferson to participate in the Employment Exploration Program
administered by the Jefferson Parish Public School System by allowing special
needs public school students to work at jobs in the Parish Administration for
the school years 2016-2017; 2017-2018; 2018-2019; 2019-2020 is hereby ratified.
SECTION 2. No funds are being provided by Jefferson Parish for these services.
SECTION 3. That the Council Chairwoman, or in her absence the ViceChairman, is authorized to execute any and all documents necessary to give
full force and effect to this resolution.

A resolution approving and accepting the attached Louisiana Compliance
Questionnaire required by the State of Louisiana Legislative Auditors Office
as part of the annual audit of the Parish of Jefferson. (Parishwide)
WHEREAS, pursuant to the requirements of Governmental Auditing Standards,
promulgated by the United States Comptroller General, all audit reports shall
contain reports on compliance and internal control; and
WHEREAS, the Compliance Questionnaire is a required part of the Parishs
financial and compliance audit.
NOW, THEREFORE, BE IT RESOLVED by the Jefferson Parish Council,
Jefferson Parish, State of Louisiana, acting as governing authority of said
Parish:
SECTION 1. That the attached Louisiana Compliance Questionnaire required

RESOLUTION NO. 126658
A resolution authorizing the Chairwoman of the Jefferson Parish Council, or in
her absence the Vice-Chairperson, to sign three grant awards on behalf of the
Jefferson Parish Community Justice Agency, accepting fifteen thousand dollars
($15,000) of FY-2013 Justice Assistance Grant Funds, five thousand dollars
($5,000) of FY-2014 Justice Assistance Grant Funds, and twelve thousand two
hundred fifty dollars ($12,250) of FY-2015 Justice Assistance Grant Funds.

WHEREAS, Ordinance 20307 created and charged the Community Justice
Agency with approving and administering grants to benefit criminal justice
activities in the Parish of Jefferson; and
WHEREAS, Section 2-775 of said ordinance specifically enumerates those
functions and duties; and
WHEREAS, the Jefferson Parish Sheriffs Office received funding from the
2013 Fiscal Year Justice Assistance Grant and consequently awarded Jefferson
Parish fifteen thousand dollars ($15,000) to purchase equipment to upgrade
surveillance systems at the correctional facility; and
WHEREAS, the Jefferson Parish Sheriffs Office received funding from the
2014 Fiscal Year Justice Assistance Grant and consequently awarded Jefferson
Parish five thousand dollars ($5,000) to purchase equipment to upgrade
surveillance systems at the correctional facility; and
WHEREAS, the Jefferson Parish Sheriffs Office received funding from the
2015 Fiscal Year Justice Assistance Grant and consequently awarded Jefferson
Parish twelve thousand two hundred and fifty dollars ($12,250) to purchase
equipment to upgrade surveillance systems at the correctional facility.
NOW, THEREFORE, BE IT RESOLVED by the Jefferson Parish Council of
Jefferson Parish, Louisiana, acting as the governing authority of said Parish:
SECTION 1. The Chairwoman of the Jefferson Parish Council, or in her absence
the Vice-Chairperson, is authorized to sign three grant awards on behalf of the
Jefferson Parish Community Justice Agency, accepting fifteen thousand dollars
($15,000) of FY-2013 Justice Assistance Grant Funds, five thousand dollars
($5,000) of FY-2014 Justice Assistance Grant Funds, and twelve thousand two

which includes five thousand dollars ($5,000) of FY-2014 Justice Assistance
Grant Funds plus three thousand five hundred dollars ($3,500) matching funds
to be charge to Account No. 10010-0120-026-7911.21040.
3. A budget account for a total of twenty-four thousand five hundred dollars
($24,500) which includes twelve thousand two hundred fifty dollars ($12,250)
of FY 2015 Justice Assistance Grant Funds plus twelve thousand two hundred
fifty dollars ($12,250) of matching funds to be charged to Account No. 100100120-026-7911.21040.

A resolution ratifying Amendment Number 4 to the Cooperative Endeavor

Agreement between the Parish of Jefferson and Patrons of Lafreniere Park, Inc.
to extend the term of agreement and for related matters. (Council District 4)
WHEREAS, PARISH and ORGANIZATION entered into a Cooperative
Endeavor Agreement, authorized by Council Resolution No. 123029 adopted
on June 11, 2014; and
WHEREAS, PARISH and ORGANIZATION entered into Amendment No. 1
to said Agreement, authorized by Council Resolution No. 125101 adopted on
June 10, 2015; and
WHEREAS, PARISH and ORGANIZATION entered into Amendment No. 2
to said Agreement, authorized by Council Resolution No. 125746 adopted on
September 3, 2015; and
WHEREAS, PARISH and ORGANIZATION entered into Amendment No. 3
to said Agreement, authorized by Council Resolution No. 126526 adopted on
February 17, 2016; and
WHEREAS, Art. VII, Sec. 14(C) of the Louisiana Constitution of 1974 provides
that for a public purpose, the State and its political subdivisions may engage in
cooperative endeavors with each other, with the United States or its agencies, or
with any public or private organization, corporation or individuals; and
WHEREAS, PARISH is authorized by Section 1.01(15) of the Jefferson Parish
Charter to enter into this Amendment to develop and administer a system of
PARISH parks, playgrounds, recreation programs, libraries, museums, and
other recreation and cultural facilities and programs; and
WHEREAS, the public purpose of the Project is described as to provide
enhanced recreational facilities at Lafreniere Park for the benefit of all citizens
of Jefferson Parish; and
WHEREAS, PARISH has a reasonable expectation of receiving the benefit
of increased tourism and economic growth for Jefferson Parish, which is at
least equivalent to the extension of time for use of the Park provided for in this
Amendment; and
WHEREAS, the citizens of Jefferson Parish have benefitted and will continue
to benefit from the efforts of these parties working together, and the Parish
desires to extend the current agreement.
NOW, THEREFORE, BE IT RESOLVED by the Parish Council of Jefferson
Parish, Louisiana, acting as governing authority of said Parish:
SECTION 1. That Amendment No. 4 between the Parish of Jefferson and
Patrons of Lafreniere Park to extend the term of the agreement through July 24,
2018 is hereby ratified.
SECTION 2. That the Chairwoman of the Jefferson Parish Council, or in
her absence the Vice-Chairman, is hereby authorized to execute any and all

A resolution authorizing the execution of a Cooperative Endeavor Agreement
between the Parish of Jefferson and the Kenner Italian Heritage, Inc. under
which Jefferson Parish will reimburse the Kenner Italian Heritage, Inc. an
amount up to Twenty Five Thousand and 00/100 dollars ($25,000.00) for
expenses associated with the staging of the 2016 Italian Heritage Festival.

WHEREAS, Art. VII, Sec. 14(C) of the Louisiana Constitution of 1974 provides
that for a public purpose, the State and its political subdivisions may engage in
cooperative endeavors with each other, with the United States or its agencies, or
with any public or private organization, corporation or individuals; and
WHEREAS, Art. VII, Sec. 14(B) of the Louisiana Constitution of 1974 provides
that public funds may be used for programs of social welfare for the aid and
support of the citizens of Jefferson Parish; and
WHEREAS, the Parish is authorized by Art. 1. Sec. 1 of the Louisiana
Constitution to enter into this Agreement to promote the happiness and general
welfare of the people; and
WHEREAS, the public purpose of the Project is described as: to sponsor a
three-day Italian Heritage Festival open to all citizens of Jefferson Parish that
will include live music, food vendors, childrens activities, historic photographs
and genealogy, to provide cultural enrichment, increased tourism, and economic
development
WHEREAS, the PARISH has a reasonable expectation of receiving the benefits
of an increase in economic development and promotion of the general welfare
and happiness of all Jefferson Parish citizens that is at least equivalent to the
Twenty Five Thousand Dollars ($25,000.00) described in this Agreement;
WHEREAS, the transfer or expenditure of public funds or property is not a
gratuitous donation; and
WHEREAS, the citizens of Jefferson Parish will benefit from the efforts of
these parties working together; and
WHEREAS, PARISH desires to cooperate with Kenner Italian Heritage, Inc. in
the implementation of the project as provided.
NOW THEREFORE, BE IT RESOLVED by the Jefferson Parish Council of
Jefferson Parish, State of Louisiana:
SECTION 1. That the Cooperative Endeavor Agreement between the Parish of
Jefferson and the Kenner Italian Heritage, Inc. under which Jefferson Parish
will reimburse the Kenner Italian Heritage, Inc. an amount up to Twenty Five
Thousand and 00/100 dollars ($25,000.00) for expenses associated with the
staging of the 2016 Italian Heritage Fest, is hereby ratified.
SECTION 2: That $10,000.00 shall be charged to Account No. 22030-2763126-7680 (20363.000); $10,000 shall be charged to 22030-2764-126-7680
(20364.000); and $5,000.00 shall be charged to Account No. 22520-3552-7680.
SECTION 3. That the Chairman of the Jefferson Parish Council, or in her
absence the Vice-Chairman, is hereby authorized to sign any and all documents

RESOLUTION NO. 126661
A resolution authorizing Jefferson Parish to consent to the Jefferson Parish
Economic Development and Port District assigning and transferring to the City
of Westwego a tract of land located along Bayou Segnette commonly known as
the Parish Wharf located within the corporate limits of the City of Westwego
and to provide for related matters. (Council District 2)
WHEREAS, a tract of land located along Bayou Segnette, commonly known as
the Parish Wharf, was annexed into the City of Westwego in 1993; and
WHEREAS, the said land, more particularly described in an act of sale by
Missouri Pacific Railroad Company to the Parish of Jefferson, dated December
12, 1963 and recorded at COB 583, Folio 470, was transferred by Jefferson
Parish to the Jefferson Parish Economic Development and Port District
(hereinafter JEDCO) January 23, 2002 recorded at COB 3068, Folio 760 for
the sole purpose of developing and maintaining a marina complex and/or boat
harbor; and
WHEREAS, said boat harbor has been constructed and JEDCO now desires to
turn the Wharf over to the City of Westwego to further the previous goals of
development, maintenance, and policing of said property; and
WHEREAS, Westwego is in the best position to maintain, control and operate
the property and the activities thereon as the property is located within
the corporate limits of the City of Westwego, is not contiguous to any land
of unincorporated Jefferson Parish and has become a burden on JEDCO to
maintain and control; and
WHEREAS, as per the terms of that certain CEA entered into by and between
JEDDO and Jefferson Parish, Jefferson Parish needs to consent to the transfer;
and
WHEREAS, the Parish has determined it is in the publics best interest to
consent to the proposed assignment and transfer of all rights and interests in
said property by JEDCO to Westwego; and
WHEREAS, in the event the City of Westwego ceases to use the property as
set forth herein, the rights and interests of the property will revert to JEDCO.
NOW, THEREFORE, BE IT RESOLVED by the Jefferson Parish Council, the
governing authority of said Parish:
SECTION 1. The Jefferson Parish hereby consents to the proposed assignment
and transfer by the Jefferson Parish Economic Development and Port District to
the City of Westwego of all rights and interests in the tract of land, commonly
known as the Parish Wharf, located along Bayou Segnette in the City of
Westwego and more particularly described in an act of sale by Missouri
Pacific Railroad Company to the Parish of Jefferson, dated December 12, 1963,
recorded at COB 583, Folio 470.
SECTION 2. The Council Chairman, or in his absence the Vice-Chairman, is
authorized to sign any and all documents required to carry out the provisions
of this resolution.

A resolution authorizing the Chairwoman of the Jefferson Parish Council, or in
her absence the Vice-Chairman, to execute a Cooperative Endeavor Agreement
between the State of Louisiana, Office of Facility Planning and Control (FP&C)
and the Parish of Jefferson, on behalf of the Jefferson Parish Recreation
Department, to secure $805,000.00 for various construction projects at Kennedy
Heights Playground; State Project No. 50-J26-15-06. (Council District 3)
WHEREAS, Act 26 of the 2015 regular session of the Louisiana Legislature
(Act) contains an appropriation for Jefferson Parish entitled Kennedy Heights
Playground Improvements, Planning and Construction, in the amount of
$805,000.00, payable from General Obligation Bonds; and
WHEREAS, the appropriation will be applied towards Planning and Construction
of the improvements as outlined in the State Capital Outlay Request; and
WHEREAS, the Act provides that all of the funds appropriated, in the absence
of express language to the contrary, shall be considered as having been
appropriated directly to FP&C and shall be administered by FP&C under a
Cooperative Endeavor Agreement with the Local Entity (Jefferson Parish); and
WHEREAS, the Omnibus Bond Act of the Louisiana Legislature (OBA),
adopted in accordance with Article VII, Section 6 of the Louisiana Constitution
of 1974, provides for the issuances by the State Bond Commission (Bond
Commission) of State General Obligation Bonds for the projects contained in
the Act including this Project, which bonds are to be secured by a pledge of the
full faith and credit of the State, as well as by monies dedicated to and paid into
the Bond Redemption and Security Fund as provided in Article VII, Section 9
of the Constitution, which authorization includes the issuance, if applicable, of
State General Obligation Bonds for the Project (Project Bonds) as set forth in
Exhibit B of the Cooperative Endeavor Agreement; and
WHEREAS, in order to secure State Funds, it is necessary to designate an
official of the Parish of Jefferson to act on behalf of the Parish of Jefferson in
all matters pertaining to this project, including certifying requests for State
disbursements.
NOW, THEREFORE, BE IT RESOLVED by the Jefferson Parish Council, the
governing authority of said Parish:
SECTION 1. That the Chairwoman of the Jefferson Parish Council, or in her
absence the Vice-Chairman, is hereby authorized to execute a Cooperative
Endeavor Agreement between the State of Louisiana, Office of Facility Planning
and Control (FP&C) and the Parish of Jefferson, on behalf of the Jefferson Parish
Recreation Department, to secure $805,000.00 for various construction projects
at Kennedy Heights Playground; State Project No. 50-J26-15-06.
SECTION 2. That the $805,000.00 in State funds shall be budgeted to Account
44670-4014-7454 (46716.005).
SECTION 3. That C.J. Gibson, Director of Jefferson Parish Parks and

act on behalf of the Parish of Jefferson in all matters pertaining to this project,
including certifying requests for State disbursements but excluding any matter
that requires Council approval which will be signed by the Council Chairman.

WHEREAS, Act 26 of the 2015 regular session of the Louisiana Legislature (Act)

Improvements, Planning and Construction, in the amount of $570,000.00,
payable from General Obligation Bonds; and
WHEREAS, the appropriation will be applied towards Planning and Construction
of the improvements as outlined in the State Capital Outlay Request; and
WHEREAS, the Act provides that all of the funds appropriated, in the absence
of express language to the contrary, shall be considered as having been

A resolution ratifying the 1st Amended Cooperative Endeavor Agreement
between the State of Louisiana, Office of Facility Planning and Control, and
Jefferson Parish for Avondale Booster Club and Playground Upgrades, Planning
and Construction, to add $200,000.00 in Capital Outlay Cash and a $200,000.00
Non-Cash Line of Credit; State Project No. 50-NPW-12-01, thereby increasing
the total State Funding from $400,000.00 to $800,000.00 (Council District 3)
WHEREAS, there is a Cooperative Endeavor Agreement between the State
of Louisiana and Jefferson Parish for Avondale Booster Club and Playground
Upgrades, Planning and Construction, State Project No. 50-NPW-12-01 as
authorized by Council Resolution No. 122352 dated February 5, 2014; and
WHEREAS, the additional appropriation will be applied towards Construction
of the Avondale Booster Club and Playground Upgrades; and
WHEREAS, the local match requirement remains at 25%.
NOW, THEREFORE, BE IT RESOLVED by the Jefferson Parish Council, the
governing authority of said Parish:
SECTION 1. That the Jefferson Parish Council does hereby ratify the 1st
Amended Cooperative Endeavor Agreement between the State of Louisiana,
Office of Facility Planning and Control, and Jefferson Parish for Avondale
Booster Club and Playground Upgrades, Planning and Construction, to add
