WAIVERS SUMMARY
Section Text
5.6.1 (f) At the first Story, Facades along a Frontage Line shall have frequent doors and windows;
pedestrian entrances shall occur at a maximum spacing of seventy five (75) feet and vehicular entries
shall occur at a minimum spacing of sixty (60) feet unless approved by Waiver.
The proposed design is situated on a site that allows for and promotes the use of public transit by its

9.12 Waiver
Unless otherwise required by this Code, as amended, the Code of the City of Miami, as amended, or
the Florida Building Code, as amended; Landscape Ordinance requirements may be modified through
the Waiver process, with mandatory referral to the Planning Director.
Building Configuration
1. Above the eighth floor, the Building Floorplate dimensions shall be limited as follows:
i. 18,000 square feet maximum for Residential Uses.
Additional Residential Floorplate dimensions not to exceed 30,000 square feet maximum
may be obtained by Waiver from transferring an equivalent amount of Floorplate area
located between the third and eighth Story along a Building Principal Frontage.
The proposed design accommodates the intent of the code by seeking to provide as many of the required
street trees and lot trees on site. Please see Landscape calculations on Sheet L-2 regarding number of
trees required. Landscape adjustment per Miami 21 sec 9.5.5.c is proposed under waiver allowed by
section 9.12.
Please see Diagrams on Sheet B-7 of the submitted documents regarding floorplate size. The floor plate
of the south tower above Level 8 utilizes relocated square feet from Levels 3-8 along the Principal
Frontage as allowed by waiver under NRD-1 sec.1.7.2.b.1.i. 67,412 SF of area is available to transfer and
3,400 SF is requested/needed.

The proposed design accommodates the intent of the code by seeking to minimize the coverage of the lot
as much as possible. The portions of the building that come down to the ground are minimized, to allow
for higher percentage of occupancy of the ground level by occupants. However, to allow for covered
areas at the residential lobby and to provide a minimum feasible floor plate area for the parking, a lot
coverage amount of 86% is proposed. Therefore, a waiver is requested to allow the lot coverage to be
86%. Reference Lot Coverage Diagram on Sheet B-5.
8 - Floorplate Area
Notes
The proposed design includes a vehicle drop off at the Eastern extremity of NE 22nd Street. The drop off
intersects with the property line at two locations, with an "island" for the vehicle turnaround. The entire
drop off area is proposed as a large plaza, with pavement that favors pedestrian circulation over vehicle
circulation and detailing that eliminates curbs, providing ultimate accessibility for visitors and residents.
The area provides an inviting public space providing a focus from N Miami Ave towards the railroad,
instead of the empty space left over from the interruption of the street due to the train tracks. To allow for
this drop off area and for a turn around on this narrow dead end street, a waiver is requested to allow two
curb cuts to be separated by less than sixty feet. Reference floor plan on Sheet C-2.
