AN INITIATIVE MEASURE
AMENDING ARIZONA REVISED STATUTES; TITLE 23, CHAPTER 2, BY ADDING A
NEW ARTICLE 2.1; RELATING TO THE FAIR ALIEN LABOR PRACTICES ACT
Be it enacted by the People of the State of Arizona, that Arizona Revised Statutes,
Title 23, Chapter 2 is amended by adding a new Article 2.1 to read as follows:
Article 2.1: The Fair Alien Labor and Residence Practices Act
Section 1. Definitions
A. “Registry” in this article means the roll of registered aliens who have taken up
residence in this state for the purposes of employment, and who also seek to attain
status as either a permanent legal resident or a United States citizens, in order that
they may reside in the state on more than a temporary basis.
B. “Registrant” in this article means any person who has had his or her name placed
on the registry.
C. “Division” in this article means the State Division of Occupational Safety and
Health.
D. “Sealed” in this article means not subject to scrutiny as public record, or subject
to police investigation or subpoena as a direct consequence of an investigation of a
person’s citizenship status. This definition shall not construed to prohibit use of the
registry as an aid in investigating crimes unrelated to residency status. Any such use
of the registry shall require a search warrant.
E. A registrant maintaining the requirements of this article for three consecutive
years shall be deemed a legal resident of this state.
Section 2. Establishment of registry
A. The Division of Occupational Safety and Health shall establish a sealed alien
employment registry to include at least the name, sex and physical residence
address of each registrant.
B. Registration shall be done in confidence, and registrants shall be immune from
arrest when traveling to or from a place of registration, for the express purpose of
entering themselves on the registry or modifying the registration as required by this
section. Registration and modification of registration alike shall be free of charge.
C. A registrant shall update relevant registry information within ten days of any
changes.
Section 3. Right to seek employment; equal pay; protection against exploitation.
A. A registrant shall be entitled to seek employment in this state on the condition
that such employment provides compensation equivalent to that provided to a non‐
registrant legally residing in this state.
B. A registrant shall have the inalienable right to report workplace or other abuses,
and any crimes against him or herself or another person, without consequence of
arrest or prosecution.
C. It shall be a class 6 felony to threaten to report any unauthorized alien registered
under this article to federal or other authorities for purposes of initiating
deportation, as a result of a report of workplace exploitation or any other crime, or
to otherwise extort or coerce a registrant.
D. It shall be a class 6 felony to deny a registrant employment or to terminate
employment solely because he or she is a registrant under this article. Employers
who hire workers registered under this section shall be exempt from the provisions
of Article 2 of Title 23.
Section 4. Responsibilities of registrants.
A. Registrants must dedicate themselves to attaining permanent legal residency or
citizenship. Residents shall be eligible for access to education and other services as
they continue to work, in a manner as the Legislature shall direct.
B. Registrants shall pay property, income and other state and federal taxes, and
generally abide by state and federal laws, apart from those relating immediately to
residency status, prior to the end of the three‐year state probationary period
established herein, and prior to the attainment of federal citizenship or legal
permanent residency status. Failure to abide by any of the requirements of this
section is grounds for termination of registration.
Section 5. Hiring Tax
A. The state shall levy a one‐tenth of one percent income tax on businesses that
employ at least five persons registered under this article.
