This is to inform you that on the above date and time 1000H , while
conducting a regular site inspection prior to PMC site visit near the
Shaft 14, the undersigned inspected a telescopic fork lift equipment as
per procedure , and asked if the operator has his documents with him
such as, license, estimara and third party certificate, as requirements,
the operator immediately admitted that he has no license and TPC with
him. Immediately I stopped the said equipment following the HSE
procedures policy and Qatar Law, that driving without license/Third
party certificate is a crime. The said equipment was already reported
last February 20,2016 by HSE officer Faisal Butt , with reference
number HSE/INSP/156, concerns are the same issues; ( Please see
attached HSE inspection report ).
While doing the inspection to the operator, Engineer Carlos Cabezas
and Foreman Jose from SACYR confronted the undersigned uttered
why you are stopping this equipment ? and Me explained because
the operator has no license to operate the equipment and it is illegal,
currently there are visitors representative from PMC/ASHGAL that
conducting inspection on site, and will cause big issue if they found the
said equipment also if any accident cause by this operator I will be
accountable and so I will go to jail or lose my job. Mr. Carlose, became
angry and shouted to me, said send mail to the construction manager
but not to stop the work of the operator, we had arguments about
that I said to Mr. Carlose I already inform this issue to construction

manager , we had arguments about that there then Foreman Jose

push me away and told that operator to resume his work Mr. Carlose
call Mr. Jaime Tricas and him invited us to discussed the said issue to
Mr. Jaime Tricas
( Project Construction Manager ) at his office, they obliged with
shouting and Mr. Jose and Eng. Carlos took their car and hurriedly
having their way to site office, while Mr. Jose cut me in front of my car
that caused near missed to accident of their vehicles. Foreman Jose hit
me to my chest and my head and removed my helmet from my head
forcefully(Witness : Mr. Bilal & Mr. Julius) With his fist and begun to
stich and pointed his finger on my face and acting to strike him in his
head again.
As an HSE Manager to this project JV is paying me to do my duty and
this is my duty to stop any activity is not safe or not comply with the
standard and law. This is not the first time Foreman Mr. Jose is
physically assaulting a safety professional , last year he push Mr. John
Pablo, who was working as a HSE professional in al kheesa site. That
incident happened in balancing tank area.
And Eng. Carlose always refusing to follow site safety rules which is not
acceptable. I know we have to make adjustments to finish this project
which we are doing with all other engineers and foremans and will
continue to do so also.
But for this we need cooperation from Eng. Carlose also, I am
accountable for any unwanted incidents happening to this project so
need action for such behavior. Mr. Jose and Eng. Carlos displayed Rude
Behavior against their coworkers,
by swearing in front of my
colleagues and other labors surrounded them, pushing and physical
assault, not following the Safety Rules and regulations on site that may
affect both to the company and its people, the said personnel violated
the QCS 2014 standard pertaining to provision of equipment and
company rules and policy. Physical assaulting an individual is
punishable by law.
