What Is Asylum Claim?

The concept of an Asylum is that protection is given to by a sovereign country to an individual who is
escaping some form of harsh mistreatment or persecution in their own country of origin. Under the 1951
convention of the United Nations, it shed some lights on the meaning of a displaced person. It
mentioned that as a displaced person, the individual is more likely than not left your nation and be not
able retreat since they have a very much established dread of oppression.

The United Kingdom, being an active member of the European Union; and by extension, a signatory to
the European Convention on Human Rights. The European convention on Human rights restricts powers
of member nations in sending an individual back to a country where there is genuine harm that they will
have to be tormented with on their return; or a cruel or corrupting treatment or discipline.

In the event that an asylum seeker does not fit the description and requirements for an asylum seeker,
but the secretary of State have some reason to believe that there are other important reasons why they
think that such an individual needs protection, the Secretary of State may give such an asylum seeker a
temporary permit to stay in the United Kingdom as an asylum.

From the United Kingdoms Immigration rules, the definitions of an asylum seeker or applicant is
someone who either: -

Had made a request recognisable as a refugee as per the Geneva Convention on the basis
contrary to the UKs responsibilities based on the Geneva Convention for such an applicant
to be removed or required to leave the UK.

2.

Has made a request for application seeking for asylum in the United Kingdom

For an asylum application, the applicant has every right to make the application for and on behalf of
himself.

Granting an Asylum Application

Based on the Immigration rules, the United Kingdoms Secretary of State will approve an asylum
application of they are satisfied that: -

1.

The asylum seeker is in the United Kingdom as at the time of the application or has arrived
at the port of entry;

2.

The applicant is a refugee based on the definitions from regulation 2 of the Refugee or
Person in Need of International Protection Regulations of 2006.

3.

That there exist no reasonable grounds where the individual may be considered as a danger
or compromise the safety and security of persons in the United Kingdom.

4.

The individual has not been convicted by a final judgement of a very serious crime and the
applicant does not pose any form of danger to the United Kingdom.

If the application is refused the applicant would have to go back to the place where his life or
freedom is in serious danger and/or his freedom would be threatened. This may be on the basis of his
age, religion, nationality, political opinion or membership of a particular social group.
