1. MotionX-GPS Overview
The most accurate and reliable solution for the iPhone, MotionX-GPS embeds the
functionality of an advanced handheld GPS unit into a simple and intuitive iPhone
application.
Use MotionX-GPS with your iPhone 3G to track outdoor activities such as hiking,
running or biking. The application is also ideal for geocaching enthusiasts. It's an easy
to use, full-featured application and provides the ability to share the coordinates of your
geocaches with others.
MotionX-GPS is exclusively designed and optimized for the iPhone 3G. The first
generation iPhone and the iPod touch do not have the necessary GPS chipset to
acquire a GPS signal.
GPS requires a direct 'line-of-sight' to communicate with satellites. Your iPhone 3G
must have a clear view of the sky to locate at least three satellites in order to give
accurate position information. If you are indoors, in a wooded area or surrounded by
buildings, you may be unable to acquire an accurate signal.
The spinning earth icon in the upper right corner of the screen indicates current GPS
signal status. Touch this earth icon at any time to toggle between online and offline
modes. Use offline mode to manage waypoints, tracks and utilities while you are
indoors.

The earth icon has three states:


Blue Spinning Earth
Good signal. Good position information. Online mode.
Red Spinning Earth
Unreliable signal, trying to acquire satellites.
Red Flashing Earth
Offline. MotionX-GPS is not searching for satellites. You can manage waypoints,
tracks and utilities while indoors in this mode.
Touch the earth icon at any time to toggle between online and offline modes.
Bottom Button Bar:
Lock
Locks the touch screen to prevent accidental button presses. When locked,
slide the arrow icon to the right to unlock. When the screen is locked, the
brightness control allows you to adjust screen brightness.
Settings

Global Settings - Select between accelerometrics assisted GPS on/off.


Choose between sound on/off. Select your display to be shown in metric,
nautical or imperial units. Select your preference of coordinate display format
in Degrees/Minutes/Seconds (DMS), Degrees with decimal Minutes (DM),
Degrees in decimal (D) or UTM.

Maps & Tracks - Choose to turn maps on or off (for those concerned about
data usage). Show or hide "My Waypoints", "Init", "Start Nav" and "Points of
Interest" signs on the MotionX-Track and MotionX-Maps page.

Compass & Navigation - Choose between Magnetic North and True North
compass display. Select bearing to be displayed as Rhumb Line or Great
Circle.

Reset - Reset to original factory settings. Reset will restore MotionX-GPS to


its freshly installed state. All content and settings will be erased; please export
any tracks and waypoints you wish to keep (using the Email Now button)

Share - For one-click sharing of tracks and waypoints, enter the email
address you wish to send to. Enter your name or nickname to let others know
that you are the sender. Coming soon: turn on MotionX community sharing to
make tracks and waypoints available to other MotionX users!

before proceeding with Reset. Importing tracks and waypoints back into
MotionX-GPS is not currently supported, but watch MotionX.com for future
releases with more functionality.
New Wypt

Creates a new waypoint. Your current coordinates will be assigned to the


waypoint. The waypoint name, coordinates, altitude and note can be edited at
any time. Editing the latitude and longitude is particularly useful when adding
geocaching locations.
Go To / Stop Nav


Initiates or stops navigation to a waypoint. Touch Go To, select a waypoint


and then touch Start Nav to begin navigating. Once navigating to a waypoint,
touch Stop Nav if you want to end navigation.
Arrows

Cycle through the MotionX-GPS screen views.

2. MotionX-GPS
Latitude and Longitude
Your current latitude and longitude (see an explanation of the geographic coordinate
system). If "?" follows the Lat or Lon values, MotionX-GPS does not have a sufficient
signal to accurately calculate your current position.
Altitude
Your current elevation in feet or meters (depending on set preferences) above or
below sea level.
Waypoint Distance
The estimated distance in miles, kilometers or nautical miles from your current
position to the waypoint selected for navigation. The distance displayed is calculated
using either Rhumb Line or Great Circle, depending on your set preferences.
Waypoint Bearing
This is the bearing in degrees to the waypoint selected. The letter "T" or "M" follows
the bearing value, to indicate True North or Magnetic North. The bearing displayed is
calculated using either Rhumb Line or Great Circle.

Accuracy
Displays the horizontal accuracy estimate of your current GPS position in feet or
meters. The vertical position accuracy (altitude) is not reflected in this value.
Last Valid Fix
Displays the time since the last valid GPS signal was acquired.

Signal
A visual representation of the current signal strength. Red indicates a weak signal,
position information may be inaccurate or unreliable. Yellow indicates an average
signal. Green indicates a strong signal. If there is no color present, the iPhone is not
receiving position information.

4. MotionX-Navigation

The compass on the MotionX-Navigation screen acquires


information from "orderly changes in position. Steady directional
motion improves accuracy. For sustained speeds of more than a few
mph or km/h, heading information can be 85% accurate or better. At
slow speeds, heading information is less reliable since the iPhone
does not contain a magnetic compass.

The compass will indicate when heading accuracy is below 85% with
a yellow "inaccurate heading" icon in the middle of the compass.

Wypt Distance
Displays the distance from your current position to the waypoint selected for
navigation. The distance displayed is calculated using either Rhumb Line or Great
Circle, depending on your set preference.

SOG
Speed Over Ground. This is the speed at which you are moving across the surface of
the earth.

Wypt Bearing
This is the bearing in degrees to the waypoint selected. The letter "T" or "M" follows
the bearing value to indicate True North or Magnetic North. The bearing displayed is
calculated using either Rhumb Line or Great Circle.

COG
Course Over Ground. This is the direction of travel across the surface of the earth
relative to True North or Magnetic North.

VMG
Velocity Made Good. This is the effective speed at which you are approaching your
waypoint. This is different from your actual speed unless you are traveling in a
perfectly straight line to your destination.

Wypt
Displays the name of the waypoint or Point of Interest (POI) currently set as your
destination.
ETA
Estimated Time of Arrival. This is the estimated time or date of arrival based on the
distance remaining and speed at which you're traveling to your selected waypoint.
Time to Wypt
This is the estimated time remaining in your journey based on the distance remaining
and speed at which you are traveling to your selected waypoint.
Compass Symbols
When this 'no heading signal' icon is displayed in the middle of the
compass, no heading signal is present. The compass heading will point
North until a heading signal is acquired.





When the 'inaccurate heading' icon is displayed in the middle of the


compass, heading accuracy is below 85%. Sustain a speed of more than a
few mph (or km/h) to maintain an accurate heading.
This red arrow indicates the direction of travel.
This blue arrow indicates the bearing to the selected waypoint. If no
waypoint has been selected, this arrow will not be present.

3. MotionX-Stopwatch
Use the GPS Stopwatch to record a track of your hikes, runs, bike rides, trips, or other
outdoor activities. Once saved, the track is added to the MotionX-Logbook, under "My

Tracks". The plotted track can be shared with others via email for viewing in Google
Earth, Google Maps or any GPX-capable application on your PC or Mac.
Upon pressing the Start button, your track is being recorded. An automatic waypoint is
created (Start Stopwatch) so that you will always be able to get back to where you
started. To store a copy of your plotted track, elapsed time, average speed, distance
and maximum speed to the MotionX-Logbook, press Stop, followed by Save.
Continue by pressing Resume, or reset all the counters by choosing Reset.
Press the camera icon to take photos along your trip. Each time a photo
is captured, a new photo waypoint is created in "My Waypoints". When
the track is saved, the last photo taken is automatically assigned to the
track. The photo assigned to the track can be updated at any time, using
any photo stored on your iPhone.

5. MotionX-Maps
This view shows a track of your movement in relation to a map. If there is a cellular
signal available but no GPS signal (e.g. from an indoor location, urban canyon, wooded
area, etc.), cellular network triangulation is used to estimate your current location. The
large blue circle shows the estimated accuracy of your position based on cellular signal
strength. Your actual position could be anywhere inside this circle. When a reliable GPS
signal is acquired, the blue circle disappears and the red arrow is replaced with a green
arrow.
Controls:
Crosshairs: Centers the page around your current location. After touching
the crosshairs, your current position will automatically remain within the
map viewing window.
Plus Sign: Zooms in.
Minus Sign: Zooms out.

The multi-touch interface supports panning and sizing. Simply touch and drag to scroll
the map or pinch in/out to zoom. Using multi-touch may move the view away from
your current position. Use the crosshairs button to re-center your position in the map
viewing window.
To clear old tracks off the MotionX-Maps page, go to the MotionX-Track page and
press the Clear button. This will erase the tracks currently drawn on these two pages,
but does not affect tracks saved to MotionX-Logbook.

Tracks:
A green arrow indicates the current direction of travel. It is accurate only when the
sustained speed is more than a few mph (or km/h). The arrow will change to red and
display "?" when there is no GPS signal or when in offline mode, indicating that the
position of the arrow may be inaccurate or not updated.
A dashed blue line from the arrow indicates the path to the waypoint you have chosen
as your destination using the Go To or Start Nav buttons.
A solid red line represents your path while navigating to a destination or recording a
track. Use the Start/Stop/Save controls on the MotionX-Stopwatch page to record
and save your track.
A dotted red line represents an interpolated path between two points when signal has
been lost.
A solid blue line traces your path while not using the stopwatch nor navigating to a
destination. These segments will not be saved as part of your track.
A dotted blue line represents an interpolated path between two points when signal has
been lost, if you are not using the stopwatch or navigating to a destination.
A solid orange line represents a previously recorded track that's being followed. A
green dot indicates the start of the track and a red dot indicates the end.

Signs:
A yellow rectangular sign is a waypoint or a Point of Interest (POI).
A blue rectangular sign is a waypoint or POI currently being navigated to.
A green rectangular 'Init' sign is the first automatic waypoint acquired since
launching MotionX-GPS.
A green rectangular 'Start Nav' sign is an automatic waypoint added when
the "Start Nav" button is pressed.
A green circular 'Start' sign is the automatic waypoint added when Start is
pressed on the Stopwatch.
A red circular 'End' sign is the automatic waypoint added when Stop is
pressed on the Stopwatch.

6. MotionX-Track
This view shows a track of your movement in relation to your waypoints over a
background of the Earths parallels and meridians, or the UTM grid (depending on your
Settings preferences). Toggle the Course Up/North Up button to change the orientation
of your track view. In Course Up mode, your track progress is always pointed toward the
top of the screen; the grid and compass rose rotate as you change directions. Current
coordinates and the distance scale are always displayed. When navigating to a
waypoint, the bearing and distance to the selected waypoint are displayed in the lower
right corner.
Controls:
Crosshairs: Centers the page around your current location. After touching the
crosshairs, your current position will automatically remain within the map viewing
window.
Plus Sign: Zooms in.
Minus Sign: Zooms out.
North Up/Course Up: Toggles between North Up and Course Up orientations of your
track view.
Clear: Touch this button to clear any track data currently on the page. This button also
clears tracks on the MotionX-Maps page. This does not affect tracks saved to
MotionX-Logbook.

7. MotionX-Logbook
The MotionX-Logbook contains a summary of your tracks. A track is a compilation of
samples or breadcrumbs taken over a period of time during your trip. To record your
tracks and save them to MotionX-Logbook, use the MotionX-Stopwatch (see above).
Touching a saved track in MotionX-Logbook brings up detailed information about the
track.

Track detail page:

Photo
Displays the last photo taken while recording the track. A new photo can be captured
or an existing photo can be selected from your albums. Only one photo can be
associated with each track.

View
Touch the View button to display a plot of your recorded track.

Email Track Now


Tracks and associated photos can be emailed for viewing in Google Earth, Google
Maps or your favorite mapping software on your PC or Mac, using the linked GPX file.
A KMZ file is also included, for use with Google Earth or Google Maps. This file format
supports an embedded photo.

Follow
Touch the Follow button to follow previously saved tracks. The track you are following
is represented by an orange line. A green dot indicates the start of the track and a red
dot indicates the end.

To edit the Name and Notes fields, press the Rename button then touch the field you
wish to edit.

8. MotionX-Waypoints
A waypoint is a set of coordinates that uniquely identifies a geographic location (see an
explanation of the geographic coordinate system). A waypoint has a latitude, a longitude
and an optional altitude. If UTM is chosen in Settings, it will be comprised of an Easting,
a Northing, and a Zone.
My Waypoints
Create waypoints by pressing the New Wypt button in any view. MotionX-GPS
automatically assigns a waypoint name, which can be edited at any time.
Automatic Waypoints
Each time MotionX-GPS is launched, an "Init" waypoint is automatically created. A
"Start Stopwatch" waypoint is automatically created when you start the GPS
Stopwatch, so youll never get lost. A "Start Nav" waypoint is automatically created
when the Start Nav button is pressed. These waypoints can be edited and saved as
one of "My Waypoints". However, they cannot be manually deleted.

Points Of Interest (POI)


MotionX-GPS contains a database of standard, named waypoints which can be used
for navigation. These pre-loaded POIs cannot be deleted or edited.
"My Waypoints", "Automatic Waypoints" and "Points of Interest" lists can be collapsed or
expanded by touching the blue arrow next to the category name. My Waypoints and
Points of Interest can be sorted by Name, Date or Proximity.
Selecting an existing waypoint brings up detailed information about that waypoint. The
Name, Lat, Lon, Altitude and Notes can be edited within user-created waypoints. This
can be useful, for example, to establish waypoints for which the coordinates are known
but you have not physically been (ideal for geocaching or navigating to new
destinations). Detailed waypoint buttons:
Photo: associates a photo with a waypoint. A new photo can be captured or an
existing photo can be selected from your albums.
View: view the waypoint on a map.
Email Wypt Now: the waypoint and associated photo can be emailed for viewing in
Google Earth, Google Maps or your favorite mapping software on your PC or Mac
using the attached GPX and KMZ files. The email also contains summary information
such as track distance, average speed, elapsed time, min and max altitude, etc., and
a live link to view the track in Google Maps.
Start Nav: sets the current waypoint as your destination. When Start Nav is initiated,
the Navigation screen appears with the relevant fields populated.

1. General FAQ
1.1. What are the differences between MotionX-GPS Lite and MotionX-GPS?

1.2. Can MotionX-GPS be run on a first generation iPhone or iPod Touch?


MotionX-GPS relies on the GPS chipset present in the 3G iPhone. First generation
iPhones and iPod Touches do not have a GPS chipset and cannot be used to navigate
with MotionX-GPS.
1.3. Where can I find the most recent version of the MotionX-GPS Users
Manual?
The most recent version of the Users Manual will always be available on the
MotionX.com website. A new version will be available with each major update of
MotionX-GPS.
1.4. "Does MotionX-GPS require a cellular network?"
The 3G iPhone uses an A-GPS (Assisted-GPS) chipset which uses cell tower
triangulation to speed up GPS signal acquisition. Cellular coverage is not needed to
acquire a signal, however the signal acquisition will be much quicker if you have data
coverage. Without data services, it can take 15 minutes or longer to acquire a signal.
This is simply because it takes longer to determine which satellites to use out of the 31
available around the world. With data services, it typically takes under a minute, but can
take up to 5 min. You do need data services or WiFi if you want to share your
waypoints/tracks via email or view a waypoint with a background map.

1.5. The parallels and meridians on the MotionX-Track page are great, but do you
have plans to offer maps?
MotionX-GPS version 3.0 now offers integrated mapping. Live tracks and previously
recorded tracks and waypoints can be viewed on OpenStreetMap road maps. A network
connection (Edge, GPS or WiFi) is needed to view maps.
1.6. What datum does MotionX-GPS use?
MotionX-GPS uses the WGS 84 datum.
1.7. Can I get turn by turn driving directions?
At this time the Apple Developers Agreement restricts us from offering this feature.
1.8. What happens when a phone call comes in?
Apple shuts down all third party apps when a call comes in. MotionX-GPS saves your
current state, and once the call is finished, you are returned to where you were. Your
stopwatch will still be running, and we will include the distance between the last point
before the call came in and your current location. However, it will be calculated based
on a straight line since the GPS signal is not available during a call.
1.9. What formats can I use to enter coordinates?
Coordinates can be entered in Degrees/Minutes/Seconds via wheels. Alternately, you
can choose direct entry using the keyboard for greater input accuracy in either degrees
with decimal minutes (DM) or Decimal degrees (D) or Universal Transverse Mercator
coordinates (UTM). In MotionX-GPS Lite, UTM is not available.
1.10. Is MotionX-GPS performance affected by other applications?
Occasionally apps that can run in the background, such as Mail, may affect the
performance of MotionX-GPS. For example, the UI may be slow to respond while large
emails are being downloaded in the background.
1.11. Why does the compass seem to work only when Im moving?
The compass on the MotionX-Navigation page acquires information from orderly
changes in position. Steady directional motion improves accuracy. A sustained speed
of a few mph or km/h is all that is needed to provide an accurate heading. At slow
speeds, heading information is unreliable since the iPhone does not contain a magnetic
compass.
1.12. What does the spinning earth at the upper right of the screen indicate?

2. Troubleshooting
2.1. Why am I having trouble getting a signal?
GPS requires a direct line-of-site to communicate with satellites. Your iPhone 3G must
have a clear view of the sky to locate at least three satellites in order to give accurate
position information. If you are located indoors, or in a wooded area or urban canyon
(surrounded by buildings), you may be unable to acquire an accurate signal.
2.2. I downloaded MotionX-GPS but Im having trouble launching the app...
If you are unable to launch the app, please see Troubleshooting applications
purchased from the App Store by Apple. The "Reinstall the application" section often
addresses the issue.

3. Power/Battery Life
3.1. How long can I run MotionX-GPS before I run out of power?
This depends on what else you have running but typically at least 4 hours. See below
for suggestions on extending battery life.
3.2. How can I increase my battery life while running MotionX-GPS?
Turning off Wi-Fi and Bluetooth when not in use and dimming the screen brightness
from within your iPhone's Settings you can reduce power consumption. In addition,
turning off Accelerometrics Assisted GPS from Settings >> Global Settings will further
reduce power consumption.

4.1 Do I need a network connection to view maps?

Yes. The road maps are streamed over the network. You will need either Edge, 3G or
WiFi to access the maps.
4.2 Can I turn maps off to reduce data usage?
Yes. From Settings (gear icon), go to Maps & Tracks and turn Map Data off.

5. Tracks/Waypoints
5.1. What is a track?
A track is a series of points recorded during your journey.
5.2. How do I record a track?
Tracks are recorded while the stopwatch is running. When the stopwatch is paused or
stopped, the track will not be recorded. You can save a track to your Logbook by
pressing "Save" when the stopwatch is paused.
5.3 How do I clear old tracks from my Maps and/or Track view pages?
To clear old tracks currently drawn on the MotionX-Maps and MotionX-Track pages, go
to the MotionX-Track page and press the Clear button (upper right-hand area). This will
erase the track data from these two pages, but does not affect tracks saved to MotionXLogbook.
5.4. What do the various waypoint sign colors indicate?
See the MotionX-Maps section above (section 5).
5.5. How do I delete a waypoint Ive added?
You can delete a user created waypoint in two different ways. Method 1: Tap on the
waypoint from the MotionX-Waypoints page, select Edit then Delete. Method 2: In list
view, swipe your finger across the waypoint and select the Delete button that appears.
5.6 Can I view the Max Speed recorded during a track?
In version 3.0, Max Speed has been added to the MotionX-Stopwatch page.
5.7. Can I get verticals climbed in a track?
In this version of MotionX-GPS, you can see your current altitude on the MotionX-GPS
page. You can get a summary of the track, including the altitude of the highest and
lowest points, when using the Email feature. In addition, your track contains altitude
data which can be viewed in Google Earth from your PC or Mac. Watch MotionX.com
for future releases with more functionality.
5.8 How do I toggle between North-Up and Course-Up?

In version 3.0 and later, there is a button in the upper right area of the MotionX-Track
page which you can use to toggle between North Up and Course Up orientation.
5.9. Are my tracks limited in length to the 303 waypoint limit in MotionX-GPS?
The 303 waypoint limit only applies to manually created waypoints (New Wypt or Photo
buttons). Tracks can be thousands of location samples each.
5.10. Why cant I visualize my tracks in Google Maps?
You can use Google Maps to view your track by emailing the track to yourself, then you
can view the track in Google Maps from your PC or Mac by either clicking the live link
embedded in the email, which will be active for 7 days, or byimporting the KML file into
a new Map created under the "My Maps" link. If you have Google Earth installed, simply
drag the GPX file onto the earth to see your track.
5.11. How do I import waypoints and tracks?
In this version of MotionX-GPS, importing of tracks and waypoints is not supported.

6. Sending Tracks/Waypoints
6.1. How do I export my waypoints and tracks?
You can export your waypoints and tracks by email. Go to the MotionX-Logbook or
MotionX-Waypoints, touch the waypoint or track you wish to export and then touch the
"Email Now" button.
6.2. What is included in the email when I use the Email Now feature?
The email contains a link for viewing your track or waypoint in Google Maps on your PC
or Mac. In addition, you will find a photo (if you assigned one to this track/waypoint) as
well as KMZ and GPX files.
The KMZ file can be imported into Google Maps, Google Earth or any other mapping
software which supports KMZ files. The advantage of KMZ over GPX is that it contains
an embedded copy of the photo associated with your track.
The GPX (GPS eXchange Format) file is an open standard that can be imported into
Google Earth and most mapping applications.
6.3. I sent myself a Track/Waypoint and I never received it.
First check to make sure your email address doesn't contain a typo in Settings (gear
icon) >> Email. Next check to ensure the receiving email client didn't file the email as
spam. If neither of these resolve the problem, use the support form to let us know. Be
sure to include the date, time and email address you sent to.

6.4. I emailed a track to myself so I could view it in Google Maps, but when I click
the link, my track is no longer available.
The link to view tracks in Google Maps on your PC or Mac expires one week after the
email was sent. The date of expiration is in the email. You can always use the attached
GPX or KML files to display your track again. Once displayed in Google Maps we
suggest using "Save to My Maps" to save for future use.
6.5. Do you have a website for all my tracks and my waypoints?

END-USER LICENSE AGREEMENT
This is a legal agreement between you and Fullpower Technologies, Inc. (Fullpower)
regarding your use of the MotionXGPS software (the Software). By using the
Software, you agree to be bound by the terms of this End-User License Agreement (this
EULA). If you do not agree to the terms of this EULA, you are not entitled to use the
Software and must de-install the Software from all your devices.
License. Subject to the terms and conditions of this EULA, Fullpower grants you a nonexclusive, non-transferable, non-assignable license (without right of sublicense) to
install and use one copy of the Software on your personal computer system in machine
executable object code form solely for your personal use.
Restrictions. The Software and any related documentation are protected by United
States copyright law and international treaty provisions. You may not copy, modify,
adapt, translate into any language, distribute, or create derivative works based on the
Software without the prior written consent of Fullpower. You may not assign this EULA
or any of the rights or licenses granted under this EULA or rent, lease, or lend the
Software to any person or entity. Any attempted sublicense, transfer, or assignment in
violation of this EULA is void. You acknowledge that the Software contains proprietary
trade secrets of Fullpower. You agree not to decompile, disassemble, reverse engineer,
or attempt to reconstruct, identify, or discover any source code, underlying ideas,
underlying user interface techniques, or algorithms of the Software by any means
whatsoever, except to the extent the foregoing restriction is prohibited by applicable law.
Ownership. The Software is licensed, and not sold, to you under this EULA. You have
no ownership rights in the Software or any related documentation. Fullpower retains all
right, title, and interest in and to the Software (including any changes, modifications, or
corrections thereto) and any related documentation.
Suggestions. If you elect to provide or make available to Fullpower any suggestions,
comments, ideas, improvements, or other feedback or materials related to the Software
(collectively, Suggestions), Fullpower will be free to use, disclose, reproduce, modify,
license, transfer and otherwise distribute your Suggestions in any manner and you will
gain no right, title or interest in or to the Software by virtue of Fullpower doing so.
Uploads. The Software may provide functionality through which you are able to upload
information (such as images, waypoints and tracks) about your use of the Software
(collectively, Uploads) to Fullpowers servers and to notify others about the availability
of your Uploads. If you use such functionality, you authorize Fullpower to retain your
Uploads on its servers, to reproduce, publish and make your Uploads available to
anyone you notify about the availability of your Uploads, and to disclose the user name
you submitted with your Uploads. In addition, if you elect to share your Uploads with the
MotionX community, you authorize Fullpower to retain your Uploads on its servers, to

reproduce, publish and make your Uploads available to any third party, and to disclose
the user name you submitted with your Uploads. Fullpower will have no obligation to
provide such functionality, may cease providing such functionality at any time with or
without notice to you, and will have no obligation to retain your Uploads on its servers or
return your Uploads to you before deleting them from its servers.
Disclaimer of Warranty. THE SOFTWARE IS PROVIDED AS IS AND WITH ALL
FAULTS AND THE ENTIRE RISK AS TO THE QUALITY AND PERFORMANCE OF
THE SOFTWARE IS WITH YOU. SHOULD THE SOFTWARE PROVE DEFECTIVE,
YOU ASSUME THE ENTIRE COST OF ALL NECESSARY SERVICING AND REPAIR.
FULLPOWER HEREBY DISCLAIMS ALL WARRANTIES WITH RESPECT TO THE
SOFTWARE, EXPRESS OR IMPLIED, INCLUDING ANY WARRANTIES OF
MERCHANTABILITY, NON-INFRINGEMENT, OR FITNESS FOR A PARTICULAR USE
OR PURPOSE. FULLPOWER DOES NOT WARRANT THAT THE SOFTWARE WILL
MEET YOUR REQUIREMENTS IN ANY RESPECT, OR THAT THE OPERATION OF
THE SOFTWARE WILL BE UNINTERRUPTED OR ERROR-FREE, OR THAT ERRORS
IN THE SOFTWARE OR NONCONFORMITY TO ITS DOCUMENTATION CAN OR
WILL BE CORRECTED. YOU ACKNOWLEDGE THAT THE PROVISIONS OF THIS
SECTION ARE A MATERIAL INDUCEMENT AND CONSIDERATION TO FULLPOWER
TO GRANT THE LICENSE CONTAINED IN THIS EULA.
USE OF MOTIONX-GPS IS AT THE USER'S OWN RISK. THE SOFTWARE IS NOT
FAA CERTIFIED AND MUST NOT BE USED FOR PRIMARY NAVIGATION. THE
SOFTWARE IS NOT TO BE USED FOR SAFETY OF LIFE APPLICATIONS, OR FOR
ANY OTHER APPLICATION IN WHICH THE ACCURACY OR RELIABILITY OF THE
SOFTWARE COULD CREATE A SITUATION WHERE PERSONAL INJURY OR DEATH
MAY OCCUR.
Limitation of Liability. TO THE EXTENT PERMITTED BY LAW, IN NO EVENT SHALL
FULLPOWER BE LIABLE FOR ANY DIRECT, INDIRECT, SPECIAL,
CONSEQUENTIAL, INCIDENTAL, OR PUNITIVE DAMAGES WHATSOEVER
(INCLUDING, WITHOUT LIMITATION, DAMAGES FOR LOSS OF BUSINESS
PROFITS, BUSINESS INTERRUPTIONS, LOSS OF BUSINESS INFORMATION, OR
OTHER PECUNIARY LOSS) ARISING OUT OF THIS EULA, YOUR USE OF OR
INABILITY TO USE THE SOFTWARE, OR YOUR USE OF OR RELIANCE ON ANY
DATA (INCLUDING GPS DATA) YOU MAY ACCESS IN CONNECTION WITH YOUR
USE OF THE SOFTWARE, EVEN IF FULLPOWER HAS BEEN ADVISED OF THE
POSSIBILITY OF SUCH DAMAGES.
Exclusions. Some jurisdictions do not allow the exclusion of certain warranties or the
limitation or exclusion of liability for incidental or consequential damages. Accordingly,
some of the above limitations and disclaimers may not apply to you. To the extent that
Fullpower may not, as a matter of applicable law, disclaim any implied warranty or limit
its liabilities, the scope and duration of such warranty and the extent of Fullpowers
liability shall be the minimum permitted under such applicable law.

Termination. This EULA is effective until it is terminated. You may terminate this EULA at
any time by destroying all copies of the Software and related documentation in your
possession or under your control. This EULA will automatically terminate if you violate
any of the terms of this EULA. Upon termination of this EULA, all license rights granted
to you shall immediately terminate. All other provisions of this EULA shall survive such
termination.
Export Laws. You acknowledge that the laws and regulations of the United States
restrict the export and re-export of commodities and technical data of United States
origin, including the Software. You agree that you will not export or re-export the
Software in any form in violation of the laws of the United States or any foreign
jurisdiction. By installing or using the Software, you represent and warrant that you are
not (a) a national or resident of any country to which the United States has embargoed
goods, or (b) on the United States Treasury Departments list of Specially Designated
Nationals or the U.S. Commerce Departments Table of Denial and Prohibition Orders.
U.S. Government End Users. The Software and related documentation are Commercial
Items, as that term is defined at 48 C.F.R. 2.101, consisting of Commercial Computer
Software and Commercial Computer Software Documentation, as such terms are
used in 48 C.F.R. 12.212 or 48 C.F.R. 227.7202, as applicable. Consistent with 48
C.F.R. 12.212 or 48 C.F.R. 227.7202-1 through 227.7202-4, as applicable, the
Software and related documentation are being licensed to U.S. Government end users
(a) only as Commercial Items, and (b) with only those rights as are granted to all other
end users pursuant to the terms and conditions herein.
Miscellaneous. This EULA is the entire agreement between you and Fullpower with
respect to, and supersedes any previous oral or written communications or documents
(including, if you are obtaining an update, any agreement that may have been included
with an earlier version of the Software) concerning, the subject matter of this EULA. In
no event shall any additional or inconsistent term in any purchase order or similar
document submitted by you modify the terms of this EULA. This EULA is governed by
the laws of the State of California, USA, as such laws apply to contracts between
California residents entered into and performed entirely in California (notwithstanding
your place of residency). You agree that any dispute arising from or relating to this
EULA shall be brought exclusively in a court of competent jurisdiction, federal or state,
located within the State of California, County of San Francisco, and in no other
jurisdiction, and you hereby consent to personal jurisdiction and venue in, and agree to
service of process issued or authorized by, such court. This EULA will not be governed
by the U.N. Convention on Contracts for the International Sale of Goods. If any
provision of this EULA is found to be invalid or unenforceable, it will be enforced to the
extent permissible and the remainder of this EULA will remain in full force and effect.
Failure by Fullpower to prosecute any right with respect to a default hereunder will not
constitute a waiver by Fullpower of the right to enforce rights with respect to the same or
any other breach.
