STATEMENTOFCPNIOPERATINGPROCEDURES

IntroductoryStatement:
GtekCommunications,L.L.C.(the"Company"),isawirelessinternetserviceproviderinTexas.We
resellphoneservicetosomeofoursubscribersthroughanagreementwithBandwidth.com,Inc.
Bandwidth.comprovidesalloftheinterconnectionfacilitiesattheirlocations.TheCompanydoesthe
billingandcollectionforoursubscriberswhoareprovidedtelephoneservice.

CustomerProprietaryNetworkInformation

CPNIisdefinedinSection222(1)oftheCommunicationsActas(A)informationthatrelatestothe
quantity,technicalconfiguration,type,destination,andamountofuseofatelecommunications
servicesubscribedtobyanycustomerofatelecommunicationscarrier,andthatismadeavailable
tothecarrierbythecustomersolelybyvirtueofthecarriercustomerrelationshipand(B)
informationcontainedinthebillspertainingtotelephoneexchangeserviceortelephonetollservice
receivedbyacustomerofacarrier(exceptthatCPNIdoesnotincludesubscriberlistinformation).

Generally,CPNIincludespersonalinformationregardingaconsumer'suseofhisorher
telecommunicationsservices.CPNIencompassesinformationsuchas:(a)thetelephonenumbers
calledbyaconsumer(b)thetelephonenumberscallingacustomer(c)thetime,locationand
durationofaconsumer'soutboundandinboundphonecalls,and(d)thetelecommunicationsand
informationservicespurchasedbyaconsumer.

Calldetailinformation(alsoknownas"callrecords")isacategoryofCPNIthatisparticularly
sensitivefromaprivacystandpointandthatissoughtbypretexters,hackersandotherunauthorized
entitiesforillegitimatepurposes.Calldetailincludesanyinformationthatpertainstothe
transmissionofaspecifictelephonecall,includingthenumbercalled(foroutboundcalls),the
numberfromwhichthecallwasplaced(forinboundcalls),andthedate,time,locationand/or
durationofthecall(forallcalls).

UseandDisclosureofCPNIIsRestricted

TheCompanyrecognizesthatCPNIincludesinformationthatispersonalandindividually
identifiable,andthatprivacyconcernshaveledCongressandtheFCCtoimposerestrictionsupon
itsuseanddisclosure,andupontheprovisionofaccesstoitbyindividualsorentitiesinsideand
outsidetheCompany.

CPNIPolicy

1. ItisthepolicyoftheCompanynottouse,disclose,orpermitaccesstoCustomerProprietary
NetworkInformation("CPNI"),asdefinedintheFCC'srules,foranypurposesotherthanthe
following,allofwhicharepermittedwithoutcustomerapprovalunderFCCrules:

a. ForthepurposeofprovidingormarketingCompanyserviceofferingsamongcategories
ofservice(i.e.,local,interexchange)towhichthecustomeralreadysubscribes.
b. Forthepurposeofprovidinginsidewiringinstallation,maintenance,andrepairservices.
c. Forthepurposeofmarketing"adjuncttobasic"services,suchasspeeddialing,
computerprovideddirectoryassistance,callmonitoring,calltracing,callblocking,call
return,repeatdialing,calltracking,callwaiting,callerID.,callforwarding,andcertain
centrexfeatures.
d. ForthepurposeofprotectingtherightsorpropertyoftheCompany,ortoprotectusers
ofitsservicesandothercarriersfromfraud,abusive,orunlawfuluseoforsubscription
tosuchservices.

2. TheCompanyhasestablishedaprogramtoinformandtrainpersonnelthattheymaynotuse,
disclose,orpermitaccesstoCPNIforanypurposeotherthanthosesetforthabove.Atpresent,
theCompanydoesnotengageinoutboundmarketingusingCPNI.

3. BecausetheCompanydoesnotuse,discloseorpermitaccesstoCPNIexceptasdescribed
above,bydefinition,itdoesnotneedtomaintainarecordofsalesandmarketingcampaignsthat
usecustomers'CPNI,orofinstanceswhereCPNIisdisclosedtothirdparties,orwherethird
partieswereallowedaccesstoCPNI.

4. BecausetheCompanydoesnotuseCPNIexceptasdescribedabove,theCompanydoesnot
utilizeanotificationandcustomerapprovalprocess(i.e.,anOptOutorOptInprocess).Ifthe
Companychangesitsmarketingprocedures,anappropriatecustomernotificationprocesswillbe
Instituted.

5. Withrespecttoacustomer'sonlineaccesstotheirinformation,thecompanydoesnotprovide
onlineaccesstoanyCPNIuntilthecustomerrequestingsuchaccessreceivesapasswordthat
hasbeenestablishedwithouttheuseofreadilyavailablebiographicalinformationoraccount
Information.

6. CustomerswhocontacttheCompanyviainboundcallsarenotabletoaccesstheircalldetail
information.IfinthefuturetheCompanydecidestoconveycalldetailinformationtocustomers
seekingsuchinformationviainboundcalling,thentheCompanywilltakemeasurestosecurethe
customerinformationwithproperauthentication,includingtheuseofpasswordsandother
methodsthatcomplywithFCCrulestoprotectcalldetailinformation.Personnelcanprovide
CPNIdatatocustomersbyauthenticatingcustomeridentityusingapreestablishedpassword,
placingareturncalltothecustomer'stelephonenumberofrecordand/ormailingtherequested
informationtotheaddressofrecord,providedthattheaddressofrecordhasnotchangedwithin
theprevious30days.

7. CustomerswhopresentthemselvesattheCompany'sretaillocationandwhorequestCPNIare
askedforproperphotographicidentification(i.e.,stateissueddriver'slicenseortheequivalent).

CPNIwillbedisclosedonlyifthecustomerpresentsvalidphotoIDmatchingthecustomer's
accountinformation.Anyandallsuchcustomerrequests:(1)mustbemadeinwriting(2)must
includethecustomer'scorrectbillingnameandaddressandtelephonenumber(3)mustspecify
exactlywhattypeortypesofCPNImustbedisclosedorprovided(4)mustspecifythetime
periodforwhichtheCPNImustbedisclosedorprovidedand(5)mustbesignedbythe
customer.TheCompanywilldiscloseCPNIuponaffirmativewrittenrequestbythecustomerto
anypersondesignatedbythecustomer,butonlyaftertheCompanycallsthecustomer's
telephonenumberofrecordand/orsendsanotificationtothecustomer'saddressofrecordto
verifytheaccuracyofthisrequest.

8. TheCompanywillprovideacustomer'sphonerecordsorotherCPNItoalawenforcement
agencyinaccordancewithapplicablelegalrequirements.Bandwidth.comisresponsiblefor
CALEAcompliance.

9. TheCompanywillnotifythecustomerimmediatelyifthecustomer'saddressofrecordiscreated
(exceptatthetimeofserviceinitiation)orchanged.Thisnotificationismadebymailtothe
customer'spreexistingaddressofrecord,anddoesnotrevealthechangedinformation.

10. Intheeventofanybreachofacustomer'sCPNIasdescribedinsection64.2011oftheFCC
rules,theCompanywill,assoonaspracticableandinalleventswithinseven(7)daysof
determinationofthebreach,notifylawenforcementthroughhttp://www.fcc.gov/eb/cpni,and
subsequentlynotifythecustomer(s),inaccordancewiththeproceduresandinthesequence
prescribedbythatrulesection.TheCompanywillmaintainarecordofanysuchbreachesand
notificationsforatleasttwo(2)years.

11. TheCompanyhasinplaceasupervisoryreviewprocessregardingcompliancewithitsCPNI
policy.
