10/07/2015 - Checked Zoning approval for shed and lot line has Zero setback. OK to have structure per DValeska but
must legalize by obtaining Zoning approval and permits, inspections and approvals. Discussed with property owner and
she wants to obtain permits to legalize.
1/19/2016 - Called architect regarding issue with firewall at rear shed wall and stairs/deck over unpermitted shed.
Although the shed can be legalized, there is an issue with the deck and stairs that are built on top of the original
unpermitted shed. Plans were submitted as existing shed storage area but recently submitted plans were not correct
because the storage shed was never approved or permitted. Therefore, it should not have been called out as existing.
The owner may have to remove the storage shed and possibly remove a portion of the deck towards the far rear
property line in order to be compliant with current building codes. The architect is going to suggest the owner removes
the unpermitted storage shed to comply with the zoning/building codes. He said he will contact me today for an update
on what the owner will do. Will monitor and allow three days for owner to decide how she will proceed. If no response
by 01/22/2016, will reinspect and submit billing request for non-compliance.
01/19/2016 - Architect called back and said he will come down to discuss condition with Zoning/Planning this week and
then discuss with the property owner her options.
02/03/2016 - Met with property owner, architect and Aubrey Rose of Planning & Zoning Dept. to discuss options to
keep attached storage room at rear. It was determined that the structure can be allowed, however, would need to be
modified to current codes regarding fire. A firewall would have to be constructed at the rear attached room and
stairway area to meet current building codes. Owner has agreed to construct the firewall modifications and to obtain all
permits related to legalizing rear deck, storage room and stairs to the left side of the building. Allowing 2 weeks for the
plans to be revised and to obtain Zoning approval. Following Zoning approval, owner to submit plans and engineering,
if needed, to obtain permits. A completion schedule can then be agreed upon by the City of Oakland and the owner.
03/16/2016 - Received call from architect for the owner who said the plans are ready to submit but they were advised
by TJull since the storage room is being used for the restaurant, they must have a health dept. inspection/approval.
They are waiting for the approval from the health dept. and once approved, will be able to submit the plans. Will
monitor.
04/08/2016 - Called the architect for an update. He said they are still awaiting approval from the Health Dept. but will
contact them Monday to see if they can get a time-frame to give us.
05/06/2016 - Called Architect, Eric, to discuss progress with Health Department approval. Left VM to call me back.

Onsite inspection, photos taken, several violations verified. Tenant showed me what looks to be unpermitted structure

refrigeration.
04/17/2015 - Onsite inspection with property owner and interpreter. Visual inspection of unapproved addition being
used as habitable space on front of building. Contains toilet, shower, washer and dryer, and small sleeping space.

noise and compressor vibration is non actionable. Refrigeration compressors were installed before owner purchased
building. Restaurant was there when owner purchased building. Owner had sheet metal covers made to reduce noise.
Record search for permits shows mechanical inspection for fan back in 2004. CCandell found noise level non actionable
when tested previously to my inspection. Submitting NOV for confirmed violations.

4/30/2015 - Inspection with DCarrillo to inspect walk-in cooler/freezer.
4/30/2015 - Onsite inspection, photos taken, met with tenant's girlfriend at complainant's apartment to re visit noise
and vibration complaint. Vibration and low level noise noticeable in bathroom and dining area next to kitchen when
exhaust fan from restaurant is on. Barely able to detect vibration from walk-in cooler compressors. Discussed installing
isolators at compressors to dampen vibration on wall. Owner said she is going to get estimates to have the isolators
installed. Also states the fan is properly maintained every year. Will follow up with owner on 05/06/2015.
Called Laura Tang to discuss whether the owner has obtained estimates for the isolators. She will discuss with the
owner and call me back today.

Contacted the owner's son to advise we need to have the owner obtain a written service evaluation of the exhaust fan
and compressor to determine if it needs to have new bearings, fan belt, or fan balancing or all items in order to make
sure it is running properly. This has to be completed by 05/20/2015 and if repairs are needed to the fan and
compressor, then a reasonable time frame will be determined to complete the repairs. NOV to follow for the fan and
compressors if determined by the inspecting professional that repairs are needed to minimize noise and vibration levels.
Received email from Laura Tang, interpreter for owner, stating the cooler and freezer equipment and exhaust fan is in
good working order and does not require repairs. I called H & H Refrigeration and spoke to Hong regarding his findings.
He said the cooler compressor is running @ 8.0 Amps and the Freezer compressor is running at 10.2 Amps. He stated 8
- 12 Amps is in the normal range. The reason the compressors may be running more often is the shroud that was
placed over them to quiet them down. I called Laura back to advise she needs to contact the owner to formulate a
compliance plan to abate the violations. Will meet with owner and interpreter to go over compliance plan to abate the
violations.
Onsite inspection W/MTaylor for vibration and sound issue. Sent email to owner's interpreter for compliance plan
meeting for 05/27/15 or 05/28/15.
Meeting W/Laura Tang to discuss reports from mechanical and refrigeration technicians. Advised to obtain more
detailed inspection and reports on exhaust fan and compressors to accurately access if equipment is in need of repairs.
Prior reports do not show allowable tolerances such as the amperages compressors are operating at and whether the
fan blades, bearings, belts and pulleys were also inspected for balancing or wear which would cause fan to vibrate or
produce more noise than normal. Also met architect for the owner regarding rear stair repair and front unpermitted
habitable space. Architect will be starting plans in one week and said will be ready by June 21, 2015 to submit for
permits. Will follow-up on 06/02/2015 for next technical report regarding exhaust fan and compressors.
Received VM from Laura Tang stating they spoke with the technicians that inspected their equipment and were advised
the equipment is functioning properly. Our instructions were for the owner to hire an impartial company to fully inspect
the equipment and give us a detailed assessment of the exhaust fan and the refrigeration compressors. Will consult
ELabayog on failure to have units inspected per our latest request.
Submitting NOV for excessive noise and vibration levels under 15.08.050 General Standards/Maintenance.

07/09/2015 - Spoke to Eric, owner's architect and he advised the plans will be ready Monday and will be here at
9:00AM to submit to Planning for Design Review for rear stairs and deck. I advised he needs to obtain the routing slip
from me first. Also advised no work can be done without permits.
07/13/2015 - Met with Eric Liu, architect for the owner. Plans are near ready to submit. Need stair calcs and title 24
info for windows and removal of small addition room. He said he will be ready to submit plans on Wednesday
afternoon. Routing slip on my desk in Routing Slip folder.
07/16/2015 - Owner will be required to obtain permits for new heater to be installed in unit D also.

advised the tenant is moving out of the apartment in September. Will continue to monitor progress until all violations
are abated.
