Captulo II
De los bienes que constituyen el
Patrimonio Cultural de la Repblica
ARTCULO 6 El Patrimonio Cultural de la Repblica a los efectos de esta Ley,
est constituido por los bienes de inters cultural as declarados
que se encuentren en el territorio nacional o que ingresen a l
quien quiera que sea su propietario conforme a lo sealado
seguidamente:
1. Los bienes muebles e inmuebles que hayan sido declarados o
se declaren monumentos nacionales;
2. Los bienes inmuebles de cualquier poca que sea de inters
conservar por su valor histrico, artstico, social o arqueolgico
quo no hayan sido declarados monumentos nacionales;
3. Los bienes muebles de valor histrico o artstico, propiedad del
Estado o de otras personas jurdicas de carcter pblico, que
se encuentren en museos nacionales, estadales o municipales
o en otros lugares pblicos o privados, incluidos los de valor
numismtico o filatlico;
4. Los bienes muebles de cualquier poca que sea de inters
conservar por su excepcional valor histrico o artstico;
5. Las poblaciones y sitios que por sus valores tpicos,
tradicionales, naturales, histricos, ambientales, artsticos,
arquitectnicos o arqueolgicos, sean declarados dignos de
proteccin y conservacin. Los centros histricos de pueblos y
ciudades que lo ameriten y que tengan significacin para la
memoria urbana;
6. Los testimonios histricos y sitios arqueolgicos vinculados con
el pasado;
7. El patrimonio vivo del pas, sus costumbres, sus tradiciones
culturales, sus vivencias, sus manifestaciones musicales, su
folklore, su lengua, sus ritos, sus creencias y su ser nacional;
8. El
patrimonio documental
y bibliogrfico, archivos,
bibliotecas, fototecas, mapotecas, fonotecas, videotecas,
cinematecas y dems instituciones de igual naturaleza;

Captulo II
Del Consejo Consultivo del Instituto
del Patrimonio Cultural
ARTCULO 11.- El Instituto del Patrimonio Cultural contar con un Consejo
Consultivo, rgano asesor de alto nivel, en el cual podr
recomendar al Instituto del Patrimonio Cultural los instrumentos,
procedimientos y mecanismos necesarios. Este Consejo
asegurar una representacin genuina de todos los sectores
nacionales interesados en los fines para los cuales se crea dicho
Consejo.
ARTCULO I2.- El Consejo Consultivo estar integrado por:
1 El Presidente del Instituto, quien presidir sus deliberaciones.

ARTCULO 33.- En las poblaciones, sitios y centros histricos a que se refieren los
artculos anteriores, el Instituto del Patrimonio Cultural, regular,
con la colaboracin de las autoridades competentes, todo lo
relativo a la colocacin de anuncios, avisos o carteles y a la
ubicacin de garajes, estacionamientos de vehculos, expendios
de gasolina y lubricantes, kioscos, templetes o cualesquiera otras
construcciones,
ya
sean
permanentes,
temporales
o
provisionales, conforme a las exigencias establecidas en esta
Ley.
ARTCULO 34.- El Instituto del Patrimonio Cultural elaborar un censo de las
poblaciones y sitios que por sus valores tpicos, tradicionales,
naturales, histricos, artsticos o
ambientales as lo requieran; y
levantarn, igualmente, planos de los mismos en los cuales
deber demarcar las zonas de proteccin.
Los programas de planificacin y desarrollo que se proyecten en
esas zonas, debern hacerse del conocimiento del Instituto del
Patrimonio Cultural.
TITULO IV
DEL PATRIMONIO ARQUEOLGICO Y
PALEONTOLGICO DE LA REPUBLICA
ARTCULO 35.- Son propiedad del Estado todos los bienes culturales declarados
Patrimonio Cultural de la Repblica, relativos al patrimonio
arqueolgico, prehispnico, colonial, republicano y moderno,
as como los bienes del patrimonio paleontolgico que fuesen
descubiertos en cualquier zona del suelo o subsuelo nacional,
incluidas las zonas subacuticas, especialmente las
submarinas.

ARTCULO 39.- Todo trabajo que tienda a descubrir, explorar, estudiar o excavar
yacimientos arqueolgicos o paleontolgicos, deber ser
previamente autorizado por el Instituto del Patrimonio Cultural.
La autorizacin anterior slo ser concedida a arquelogos o
paleontlogos profesionales, as como a renombradas
instituciones cientficas, nacionales o extranjeras.
ARTCULO 40.- El Instituto del Patrimonio Cultural podr permitir la salida de
colecciones de duplicados de objetos arqueolgicos a favor
de instituciones cientficas extranjeras cuando no se juzguen
tiles para los museos o instituciones nacionales, estadales o
municipales; igualmente permitir la salida de aquellas piezas
que requieran tratamiento especial para conservacin,
restauracin o examen.
TITULO V
DISPOSICIONES COMPLEMENTARIAS
ARTCULO 41.- La exportacin de los bienes a que se refiere esta Ley, sin
autorizacin del Instituto del Patrimonio Cultural, ser
considerado como contrabando y penado conforme a la
legislacin nacional, obligando su devolucin al territorio de la
Repblica.
ARTCULO 42.- Todos los bienes de inters cultural declarados como tales, cuya
propiedad no pueda ser demostrada al requerirlo as el
Ejecutivo Nacional, pasarn a la custodia y proteccin de la
Repblica.
ARTCULO 43.- Las gobernaciones de los Estados y las municipalidades podrn
establecer servicios de proteccin y defensa de los bienes
ubicados en su territorio y que llenen las condiciones
establecidas en el artculo 6 de esta Ley.

TITULO VII
DISPOSICIONES FINALES
ARTCULO 49.- Sin menoscabo de lo que dispongan las legislaciones protectoras
de derechos intelectuales, se considera delito contra el
Patrimonio Cultural de la Repblica, la utilizacin lucrativa del
nombre de sus artistas, sin las autorizaciones suyas o de sus
herederos o causahabientes, conforme a lo previsto en esta ley.
ARTCULO 50.- El Instituto del Patrimonio Cultural podr someter al Ejecutivo
Nacional los proyectos de reglamentos correspondientes a esta
Ley.
ARTCULO 51.- Se derogan todas las disposiciones legislativas y reglamentarias
que colindan con esta Ley.
ARTCULO 52.- Se deroga la Ley de Proteccin y Conservacin de
Antigedades y Obras Artsticas de la Nacin, publicada en la
Gaceta Oficial de los Estados Unidos de Venezuela No. 21.787
del 15 de agosto de 1945.
