Definitions&GeneralProvisions

Part1Definitions
Article1:
FortheapplicationoftheprovisionsofthisLaw,unlessthecontextotherwiseprovides,thefollowing
wordsandexpressionsshallhavethefollowingmeaning:
1. Ministry:MinistryofManpower
2. Minister:MinisterofManpower
3. TheDirectorate:DirectorateofLabourorLabourofficeoritsbranches
4. Establishment:Anyundertakingrunbynaturalpersonorbodycorporate,employingoneormore
employeesinreturnforsalary
5. Employer:Anynaturalpersonorbodycorporateemployingoneormoreemployeesinreturnfor
salary.
6. Employee:Anynaturalpersonworkinginreturnforsalarywithanemployerandunderhis
managementandsupervision
7. ContractofWork:Anycontractunderwhichanynaturalpersonundertakestowork,fortheinterest
ofanemployerundertheemployer'smanagementandsupervisioninreturnforsalary.
8. CasualWork:Anywork,whichbyitsnaturedoesnotcomewithintheactivitypractisedbythe
employer,andwhichdoesnotlastlongerthansixmonths.
9. TemporaryWork:Anyworkthenatureofwhichrequiresittobecarriedoutandaccomplishedwithin
afixedperiod.
10. ParttimeEmployee:Theemployeewhoseregularworkinghoursanddaysarelessthanthelegally
fixedhoursanddays.
11. OvertimeWork:Workcarriedoutinthehoursthatexceedtheworkinghoursprovidedforinthis
Law
12. BasicSalary:Theconsiderationagreeduponbetweentheemployeeandtheemployerincashorin
kindasstatedinthecontractofworkinadditiontoperiodicalallowanceifany.
13. GrossSalary:Thebasicsalaryinadditiontoallotherentitlementspayabletotheemployeeinreturn
forhiswork.Thisincludesconsiderationforovertimeworkandwhattheemployeemayreceiveas
gratuitiesorgiftsorallowancesduetohighcostoflivingorsubstitutesexcepttravelling,transport
andresidenceallowances.
14. ProbationaryPeriod:Theperiodduringwhichtheemployee'sfitnessforworkistestedandwhich
enablestheemployerinappraisingtheemployeeeithertechnicallyorethicallyandwhichenablesthe
employeeinacquaintinghimselfwiththeworkconditions.
15. ContinuousService:Uninterruptedservicewiththesameemployerorhissuccessorandperiodsof
absenceauthorisedbytheemployershallhavenoeffectuponconsideringtheserviceascontinuous.
16. Year:365daysfromthedateofsigningthecontractunlessotherwiseprovided.

17. Month:30daysunlessotherwiseprovided.
18. LabourDisputes:Anydisputebetweentheemployerandtheemployeeifconnectedwiththe
recruitmentoftheemployeeorthetermsofhisserviceorconditionsofhiswork.
19. Workinghours:Thetimeduringwhichtheemployeewouldbeavailablefortheserviceofthe
employerbutitdoesincluderestperiods.
20. Nightworkinghours:Thetimebetween09:00p.mand05:00a.m.
21. JuvenileEmployee:Anynaturalpersonwhoattainstheageoffifteenbuthasnotattainedtheageof
eighteen.

PARTIIGeneralandProvisionalprovisions
Article2:
TheprovisionsofthisLawshallnotapplyto:
1. IndividualsoftheArmedforces,publicsecurityorganisations,stateadministrativeorgan
employeesandothergovernmentunitemployees.
2. Membersoftheemployer'sfamilywhoaredependentuponhim.
3. Thosewhoworkinsideoroutsidehomessuchasdrivers,maids,cooksandthelike.The
Ministershallissueadecisionspecifyingtheratesandconditionsofthiscategory.
Article3:
AnyconditionwhichviolatestheprovisionsofthisLawshallbenullandvoid,evenifitprecedesits
implementation,unlessitismorefavourabletotheemployee.
AnydischargeorreconciliationorrenunciationoftherightsemanatingfromthisLawshallbenulland
void,ifitiscontrarytoitsprovisions.
Anyconditionswhichareconsideredmorefavourabletotheemployeeaccordingtothelaws,
regulationsanddecisionsinforceonthedatethislawcomesintoforceshallbeapplicable.
Article4:
Saveincaseswhereitisspecificallyprovidedfor,theprovisionsofthisLawshallapplytoall
employersandemployees,establishmentsofdifferenttypes,theirlocalandforeignbrancheswhich
practicetheiractivitiesintheSultanatewhethertheyarepublicorprivateincludingprivatenational
andforeigneducationalinstitutions.
Article5:
Witheffectfromthedateonwhichthislawcomesintoforceallemployersshallprovideoratleast
maintaintheminimumstandardsandconditionsofservicestatedinthislaw.Thestandardsand
conditionsofserviceunderwhichtheemployeehasbeenemployedbeforetheimplementationofthis
lawshallnotbereducediftheemployeeremainsintheserviceoftheemployerafterits
implementation.
Article6:
Anemployermayestablishschemesbywhichhisemployeesacquirebenefitsmoregenerousthan
thoseawardedbythislaw,ormayprovidehisemployeewithotherbenefitsormayenterinto
agreementswiththemtheconditionsofwhicharemoregenerousthanthoseprovidedforinthislaw.
Ifaconditioninthislawcontradictswithanyoftheconditionsinsuchschemesoragreements,the
condition,whichismoregeneroustotheemployee,shallbeapplicable.

Theemployee'srighttomakeanyclaimundertheprovisionofthislawshallexpireafterlapseofone
yearfromthedateonwhichsuchclaimarises.Asregardscasesinstitutedbeforetheimplementation
ofthislawtheoneyearperiodshallstartrunningfromthedateonwhichthislawcomesintoforce.
Article8:
OfficialsspecifiedbyadecisionfromtheMinisterofJusticeincoordinationwiththeMinisterwillact
inthecapacityofjudiciaryofficersinenforcingthislaw,itsregulationsandexecutivedecisions.The
rulesandproceduresorganisingtheirworkshallbespecifiedbyadecisionfromtheMinister.Such
officialswillhavetherighttoenterintoworkplaces,toinspectthebooksandregistersinorderto
ascertainthatthislaw,itsregulationsandexecutivedecisionsareapplied.Beforestartingtheirwork
thesaidofficialsshallswearbeforetheMinistertocarryouttheirworkwithtrustandhonestyandnot
todiscloseworksecretsorinformationordatawhichtheyknowbyvirtueoftheirwork,evenafterthe
endoftheirservice.
Thesaidofficialsshallmaintainconfidentialityofanyinformationreportedtotheminrespectof
violationoftherulesofthislaw,itsregulationsandexecutivedecisions.
Article9:
Theemployerortheemployer'srepresentativeshalloffertotheofficialsreferredtointhepreceding
Article,thefacilitiesrequiredforcarryingouttheirdutiesandprovidethemwithallstatementsand
informationtheyrequireprovidedthatsuchstatementsandinformationarecompleteandtrueforthe
purposeofimplementingthislaw,itsregulationsandexecutivedecisions.
Nopersonisallowedtodeliberatelyimpedeorobstructthoseofficialsfromcarryingouttheirduties.
Suchofficialsmay,forthesakeofimplementingtheirjob,seektheassistanceofpolicemenpursuant
totheruleswhichwillbedeterminedbyadecisionfromtheMinisterincoordinationwiththe
InspectorGeneralofPoliceandCustoms.
Article10:
Casesfiledbyemployeesorbythosewhobenefitfromthem,shallbeexemptedfromfeesinall
stagesoflitigation.
ChapterTwo

EmploymentofCitizensandOrganizationofForeignersWork

PartIEmploymentofCitizens
Article11:
AnEmployermustemployOmaniemployeestothegreatestpossibleextent.Adecisionfromme
MinisterwillspecifythepercentageofOmanistoexpatriatesinthedifferenteconomicsectorsor
activitiesofeachsectoraccordingtotherequirementsofthecircumstancesandactivityofeach
sectororaccordingtotheavailabilityoftherequiredOmaniemployees.
Employersmustputallemployeesonthesamefootingwhenthenatureandconditionsoftheirwork
arealike.
Article12:
AnyOmanicapableofworkandwishestowork,mayaskforregistrationofhisnameatthe
competentdirectorate,providedetailsofhisage,qualifications,experience,meworkhewishesto
joinandotherinformation,whichwillberequiredbytheMinistry.Thedirectoratemustuponreceipt,
registertheapplicationsunderserialnumbersandgivetheapplicantacertificateofregistrationin
accordancewithaformwhichwillbespecifiedbytheMinistry.
Article13:
ConcernedDirectoratewillundertaketodothefollowinginrespectofOmaniemployment:

1. receiveemployersinformationaboutvacantjobs,occupationsandconditionsrequiredfortheir
filling
2. nominateemployeestojobsandoccupationsiftheysatisfytherequiredconditionsofthem
3. giveadviceandassistancetoapplicantsinrespectofvocationaltrainingandguidanceinorderto
facilitatetheirregistrationforvacantjobsandoccupations
4. AnyothermatterstobespecifiedbytheMinister.Nominationsofthisdirectorateshallbebindingon
employersexceptinrespectofsomeactivitiesorregionstobespecifiedbyadecisionfromthe
Minister.

Article14:
Anemployeroranemployer'srepresentativemusteachyearsendtotheconcerneddirectoratewithin
themonthofJanuary,theformspreparedbytheMinistrywhichshallcontainthefollowing:
1. Detailedstatementshowingthenumberofhisemployeesaccordingtothetypesoftheirjobs,
occupations,salariesandnationalities.
2. Astatementshowingthereasonsfornotfillingthevacantjobsandoccupationsorthosecreated
withinthepastyearifany.
3. Astatementaboutthestatusofworkandwhatrelatestoitinrespectofbothworkandjob
opportunitiesandtheexpectedincreaseordecreaseintheirnumberwithinoneyear.TheMinister
mayamendthefrequencyforcollectingthesestatementsifpublicinterestsorequires.Theemployer
orhisrepresentativesmustprovidethenecessaryinformationbyfieldsurveyortechnicalresearches
fortheplanninganddevelopmentoftheLabourforceinaccordancewithplans,programmesand
projectswhichwillbeimplementedbytheMinistry.

Article15:
Theemployerortheemployer'srepresentativesmustinformthedirectorateinwritingofvacantor
newjobsandoccupationsofanytypebystatingeachoneofthem,thesalaryspecifiedforeachand
thedatescheduledforitsoccupation,withinonemonthfromthedatetheybecomevacantorare
created.
Theemployermust,withinonemonthfromthedateheemploysaworkapplicantpursuanttoArticle
(13)ofthisLaw,sendthecertificateofregistrationofthisemployeetothedirectoratefromwhichthe
certificateisissuedcoupledwithastatementwhichincludesthedateonwhichtheemployeewill
reporttowork,hissalary,andthetypeofworkentrustedtohimThecertificateofregistrationandits
datemustberecordedoppositetheemployee'snameintheestablishment'semployeeregister.
Article16:
Theemployerortheemployer'srepresentativemustrecordinaspecificregisterthenamesof
Omanisemployeesworkingwithhimandtheaddress,age,sex,andthetypeofworkassignedto
eachoneofthem,theirstatus,theamountofsalariesandtheadvantagestheyreceiveincashorin
kind.Suchregistermustbekeptintheplaceofwork.
Article17:
Anemployerwhoemploysfiftyemployeesormoremustappointindividualsofspecialneeds
nominatedbytheconcerneddirectorateprovidedthattheyhavetheprofessionalqualificationswhich
suittheircondition.Theseappointmentsshallbefromwithinapercentagebracket,whichwillbe
determinedbyadecisionfromtheMinister.Individualswithspecialneedswhohavebeenemployed
inaccordancewiththeaboveparagraph,shallenjoythesamerightsenjoyedbytheotheremployees.
PartIIRegulationofForeignersEmployment
Article18:
AnemployerisnotallowedtobringnonOmaniemployeesintotheSultanateofOmanunlesshe
obtainspermitsfromtheMinistry.

Andtheconditionsforgrantingpermitsare:
1. TheremustnotbeenoughOmaniemployeesfortherequiredjoboroccupation.
2. TheemployermustobservethespecifiedpercentageforOmanisation.
3. Paymentofthespecifiedfees.

AndNonOmanisarenotallowedtojoinanyworkintheSultanatebeforeobtainingLabourcardsand
theConditionsforobtainingLabourcardsare:
1. Theemployeemustpossesstheprofessionalqualificationsorthetechnicalskillsorthequalifications
requiredbythecountry.
2. Theemployerispermittedtobringintheemployeeinaccordancewiththefirstparagraphofthis
Article.
3. Theemployermusthaveenteredthecountrybylawfulmeansandsatisfiedtheconditionsprovided
forintheExpatriatesResidenceLaw.
4. Theemployeeismedicallyfit,freefrominfectiousdiseasesandchronicdiseases,whichwillbe
specifiedbytheMinistryofHealth.
5. TheemployeemusthaveenteredintoacontractwithanOmaniemployeroranonOmaniemployer
possessingtherequiredlicencefromtheMinistryofCommerceandIndustryiftheemployeeis
neededtoworkintheestablishment.
6. Paymentoftheprescribedfees.
7. ALabourcardwillbegrantedupontherequestoftheemployer.

Article19:
TheMinistershallissueadecisiondetermining:
1. ThefeesofthelicenceforsupplyingNonOmaniemployeesandthefeesforalabourcardandits
renewalincoordinationwiththeMinisterofFinance,aftertheapprovaloftheCabinetofMinisters.
2. Thelabourcardformanditsduration.Thecardwillberenewableforthesameperiodorforany
periodtobedeterminedbysuchadecision.
3. Thejobsandbusiness,whichNonOmaniswillnotbeallowedtopractice.

Article20:
Nopersonwillbeallowedtopracticethebusinessofsupplyingforeignemployeesunlessheobtains
alicenceforthatpurposefromtheMinistry.Anemployerisnotallowedtoenterintoacontractwith
anypersonforthepurposeofprovidingforeignemployeesunlessheobtainsalicenceforthat
purpose.
AdecisionfromtheMinisterwillspecifytheconditionswhichmustbefulfilledforobtainingthe
licence,therightsandobligationsofthelicensee,theconditionsandtheparticularswhichmustbe
availableinthecontractenteredintobetweentheemployerandthelicensee,andinparticularthe
contractmustbeinwritinganditmustincludethetypeofwork,theclassesandthesalariesofthe
employeesaccordingtothejoboroccupationofeachoneofthem,andtheobligationofthelicensee
toreturntheemployeebacktotheplacefromwhichhewasbrought,ifitisprovedthattheemployee
doesnotsatisfytheconditionsprovidedforinthecontract.
Theemployerorwhoeverispermittedtobringforeignemployeesin,isnotallowedtochargesuch
employeesanyamountinconsideration

ChapterThree

ContractofEmployment

Article21:
ThecontractofemploymentmustbemadeinwritinginArabicandintwocopies,oneforeachparty.

IfthecontractiswritteninalanguageotherthanArabicitmustbeaccompaniedby,atleast,an
Arabicversion,whichmustbeapprovedbybothpartiesandmusthavethesameweightinevidence.
Ifthereisnowrittencontracttheemployeemayprovehisrightsbyallmeansofevidence.The
employeemustbegivenareceiptofthedocumentsandthecertificates,helodgeswiththeemployer.
Article22:
Ifapartytothecontractisunabletoreadorwriteorifhedoesnotknowthelanguageinwhichthe
contractiswritten,thecontractmustbeauthenticatedbythelegallyconcernedauthority.
Article23:
Thecontractofemploymentmust,inparticular,includethefollowinginformation:
1. thenameoftheemployer,thenameoftheestablishmentandtheaddressofplaceofwork
2. thenameoftheworker,thedateofhisbirth,hisqualifications,hisjoboroccupation,hisplaceof
residenceandhisnationality
3. thenatureandtypeofwork,andtheperiodofthecontract
4. thebasicsalary,anyallowancesoradvantagestowhichtheemployeewouldbeentitledunderthe
conditionsofservicecurrentlyeffectiveandthemodeandtimeofpaymentofthesalaryagreed
upon
5. thesuitableperiodofnoticewhichmustbegivenbythepartywhowishestoterminatethecontract.
Providedthattheperiodofnotice,whichtheemployergivestotheemployeemustnotbelessthan
theperiodprovidedforinthislaw.

Anyotherconditionsdeterminedbythelaw
6. Thecontractmustbeaccompaniedbyanundertakingfromtheemployeewhichmustincludethe
following:
1. Toabidebythetermsandconditionsstipulatedinthecontract
2. TorespectIslamicreligion,thelawsofthecountry,itscustomsandsocialtraditions.
3. Torefrainfrominterferinginanyactivitiesprejudicialtothesecurityofthecountry.

Article24:
Anemployeemaynotbeappointedunderprobationforaperiodwhichexceedsthreemonthsfor
thosewhoreceivetheirsalariesmonthly,andonemonthforthosewhoreceivetheirsalaries
otherwise.
Noemployeeshallbeappointedundermorethanoneprobationaryperiodbythesameemployer,and
theprobationaryperiodifsuccessfullypassed,willbecountedintheperiodofservice.
Anypartymayterminatethecontractduringtheprobationaryperiodbygivingtheotherpartyatleast
asevendaynotice.
Article25:
Theemployermaynotdeviatefromthetermsofthecontractorasktheemployeetoperformany
worknotagreeduponunlesssuchworkissonecessaryandtemporary,Nevertheless,theemployee
mayberequiredtoperformaworknotagreeduponifsuchworkdoesnotsubstantiallydifferfromthe
originalwork.
Article26:
Theemployermustopenaspecialfileforeachemployee,containingparticularlythefollowing:
1. thenameoftheemployee,hisage,socialstatus,placeofresidenceandnationality
2. hisjob,occupation,experience,andqualification

3. dateofstartingwork,hissalaryandanydevelopmentsinrespectthereof
4. theannual,sickandspecialleavesgiventohimandanydisciplinaryactiontakenagainsthim
5. dateandreasonsforterminationoftheservice.

Theemployermustkeepthefilereferredtointheprecedingparagraph,foratleastoneyearafter
terminationofservice.
Article27:
Anemployeeshall:
1. Performtheworkbyhimselfaccordingtothedirectionsandunderthesupervisionofhisemployer
andinaccordancewithwhatisspecifiedinthecontract,thelawandtheworksystems.Heshall
exercise,incarryingouthisduty,thecareanddiligenceoftheordinaryperson.
2. Obeytheemployer'sinstructionsinrespectoftheworkagreeduponifsuchinstructionsarenot
inconsistentwiththecontract,thelawandmoralsandiftheobedienceofsuchinstructionswillnot
exposehimtodanger.
3. Lookafterthemeansofproductionentrustedtohimandtoexercise,insodoing,thecareofan
ordinarypersonandshalltakeallthenecessarymeasuresfortheirmaintenanceandsafety.
4. Notdiscloseworksecrets.
5. Undertaketocontinuouslydevelophisskillsandexperienceprofessionallyandculturallyin
accordancewiththerulesandproceduresestablishedbytheemployer.
6. Notusethetoolsofworkoutsidetheplaceofworkexceptafteranapprovalfromtheemployerand
shallkeepsuchtoolsintheirproperplaces.
7. Observetheinstructionsofsafetyandoccupationalhealthadoptedbytheestablishmentwhether
pursuanttothelaworitsexecutiverulesanddecisionsorinaccordancewiththerulesand
regulationsoftheworkanditsinstructions.

Article28:
Anemployerwhoemploysfifteenemployeesormore,shallputinaconspicuousplaceinhis
establishment,theregulationsofworkaftertheirapprovalbytheMinistry.Theseregulationsshall
consistof:theruleswhichorganisetheworkintheestablishmenttherightsandobligationsofthe
employeeandtheemployertherulesorganisingtherelationshipbetweentheemployee,his
colleaguesandhissuperiorstherulesgoverningpromotionifthenatureoftheworksorequiresand
thespecificationofsalarygroups,alltypesofallowancereimbursementsandtheplacewherethey
willbepaid.
AnemployershallamendtheregulationsifrequiredbytheMinistrypursuanttothelaws,regulations
anddecisionswhichwillbeissued.
Article29:
Anemployerwhoemploysfifteenemployeesormoreshallputinaconspicuousplaceinhis
establishmentacharterofdisciplineandtheconditionsofitsapplication.Fortheimplementationof
suchcharter,itsrulesanditsamendmentsmustbeapprovedbytheMinistrywithintwomonthsfrom
thedateitispresentedtotheMinistry.Ifsuchperiodlapseswithouttheapprovalornonapprovalof
theMinistrybeingobtained,theCharterbecomesapplicable.
Article30:
Anemployeecannotbeaccusedofanoffenceaftertheexpiryofmorethanfifteendaysfromthedate
onwhichtheoffenceisdiscovered,likewisenodisciplinarypunishmentshallbeimposedonan
employeeaftertheexpiryofmorethanthirtydaysfromthedateonwhichtheoffencehasbeen
proved,inthecaseofemployeeswhoreceivetheirsalariesonamonthlybasis,andmorethanfifteen
daysforotheremployees.

Anemployermaynotimposeuponanemployeeafinewhichexceedsfivedays'salaryforone
offenceorsuspendhimfromworkanddeprivehimfromallorpartofhissalaryinrespectofasingle
offenceforaperiodwhichexceedsfivedays.
Inallcasesanemployeemaynotbesubjecttomorethanonepunishmentforasingleoffence,nor
mayhissalarybedeductedforpaymentoffinesimposedonhimformorethanfivedays'salaryin
onemonth,normayhebesuspendedfromworkanddeprivedfromallorpartofhissalaryformore
thanfivedaysinonemonth.
Article32:
Ifanemployeeisaccusedofcommittingacrimeinsidetheplaceofwork,theemployermaysuspend
himforaperiodnotexceedingthreemonthsfromthedateonwhichtheconcernedauthoritiesare
notifiedoftheincident.Suchanemployeewillbedeprivedfromhisgrosssalaryforthefirstmonth
andpaidhalfthegrosssalaryforthesecondandthirdmonths,ifthesaidauthoritiesdecidenotto
committheemployeefortrialoriftheperiodofhissuspensionexpiresorifheisfoundinnocent,he
mustbereturnedbacktohiswork.Iftheemployerrefusestoreinstatehim,hisfailuretodosowillbe
consideredasanarbitrarydismissalandtheemployerwillbeobligedtoreimbursewhathasbeen
suspendedfromtheemployees'salaryinallcases.
Article33:
Theemployermustprovidehisemployeeswithaccesstomedicalfacilitiesintheestablishmentand
heshall,ifthenumberofhisemployeesinoneplaceoronecountryexceedsonehundred,employa
qualifiednurseforprovidingmedicalaidandshallassignadoctortovisitandtreatthemintheplace
preparedbyhimforsuchpurpose.Theemployermustprovidetheemployeeswiththemedicine
requiredforthetreatment,allofwhichmustbefreeofcharge.Ifthenumberoftheemployeesismore
thanfivehundredtheemployershall,inadditiontowhatismentionedabove,providehisemployees
withallothermeansoftreatmentincases,thetreatmentofwhichcallfortheassistanceofspecialist
doctorsorsurgicaloperationsorthelikeandalsorequiredmedicinefreeofanycharge,exceptme
costsofdental,opthalmicandmaternitytreatment.
Iftheemployeeistreatedinagovernmenthospitaloraprivateclinic,theemployermustpaythe
costsoftreatment,medicineandimpatientcare,inaccordancewiththeregulationsandfinancial
rulesappliedinsuchhospitals,subjecttotheprovisionsoftheSocialInsurancelaw.
Article34:
Anyemployer,whopracticesworkinareasspecifiedbytheMinister,shallundertaketoprovidehis
employeeswithsuitablemeansoftransport,appropriateaccommodation,propermealsanddrinking
waterinplacestobepreparedforsuchpurposewithineasyreachfortheemployees.
Article35:
Ifanemployeecauseslossordestroysthemeansortoolsofproductionownedbytheemployeror
entrustedtohim,intentionallyorduetogrossnegligence,heshallberesponsibleforthevalueof
suchtools.Theemployermay,aftermakinganinvestigationandnotifyingtheemployee,start
deductingthesaidamountfromtheemployee'ssalaryprovidedthatsuchdeductionshallnotexceed
25%oftheemployee'smonthlysalary.Theemployeemayobjecttotheemployer'sassessment
beforetheconcernedDirectoratewithinonemonthfromthedateonwhichhebecomesawareofthe
deductionandtheobjectionshallbeheardaccordingtotheproceduresprovidedforinthislaw.
Article36:
Ifthecontractisforalimitedperiodandthepartiescontinuetoexecuteitaftertheexpiryofits
period,thecontractwillbedeemedtohavebeenrenewedwiththesametermsandconditionsforan
unlimitedperiod.
Article37:
Ifthecontractisforanunlimitedperiod,anypartymaychoosetoterminateitbygivingtheother
partyathirtydaywrittennoticeofterminationincaseofemployeeswhoreceivetheirsalaries

monthly,andfifteendaysforotheremployeesunlessitisagreedinthecontractforalongerperiod.
Ifthecontractisterminatedwithoutsuchperiodbeingobserved,thepartywhoterminatesthe
contractwillbeobligedtopaytotheotherpartyacompensationequaltothegrosssalaryofthe
noticeperiodortheremainingpartthereof.
Article38:
Noticeofterminationofthecontract,issuedbytheemployertotheemployee,whenthelatterison
leaveorpublicholiday,willnotbevalidexceptfromthedatefollowingtheendofeithertheleaveor
thepublicholiday.
Article39:
Iftheemploymentrelationshipisterminated,theemployer,shall,inrespectoftheemployeeswhodo
notbenefitfromtherulesoftheSocialInsuranceLaw,paytotheemployeeanendofservicegratuity
equaltothesalaryoffifteendaysforeachyearofserviceforthefirstthreeyearsandaonemonth
salaryforeachyearforthefollowingyearsandtheemployeewillbeentitledtogratuityforthe
fractionsoftheyearinrespectoftheperiodhespentinserviceandthelastbasicsalaryshallbethe
basisofcalculatingthegratuity.Thedurationofcontinuousservicewhichbeganbeforethe
commencementofthislawshallbecountedwithintheperiodofservicewhichwillbeconsideredfor
determiningthepayablegratuityperiod.
Article40:
Theemployermaydismisstheemployeewithoutnoticeandwithoutpayingendofservice
gratuityinanyofthefollowingcases:
1. Iftheemployeeassumesafalseidentityorresortstoforgerytoobtaintheemployment.
2. Iftheemployeecommitsamistakewhichresultsingravemateriallosstotheemployer,provided
thatthelatterreportstheincidenttotheconcernedDirectoratewithinthreedaysfromthedateof
hisknowledgeofsuchincident.
3. Iftheemployeedoesnotabidebytheinstructionswhichmustbefollowedforthesafetyofthe
employeesandtheplaceofworkdespitebeingwarnedinwriting,providedthatsuchinstructions
aremadeinwritinganddisplayedinaconspicuousplace.
4. Iftheemployeeisabsentfromhisworkwithoutreasonablejustificationformorethantendaysin
oneyearormorethansevenconsecutivedays,providedthattheemployergivestheemployeea
writtenwarningafterbeingabsentforfivedaysinthefirstinstance.
5. Iftheemployeedisclosesthesecretsoftheestablishmentinwhichheworks.
6. Iftheemployeeisfinallyconvictedofacrimeormisdemeanourinvolvingbreachofhonourortrust
oramisdemeanourcommittedintheplaceofworkorwhiletheworkisbeingperformed.
7. Ifduringtheworkinghourstheemployeeisfounddrunkorintoxicatedbyanarcoticsubstanceora
mindstimulant.Iftheemployeeassaultstheemployerorthemanagerinchargeorgravelyassaults
anyofhissuperiorsduringtheworkorbecauseoftheworkorifhebeatsoneofhisfellow
employeesintheplaceofworkandsuchbeatingresultsinillnessordiscontinuationofworkfora
periodwhichexceedstendays.
8. Iftheemployeegravelybreacheshisobligationstoperformtheworkagreeduponinhiscontractof
employment.

Article41:
Withoutprejudicetohisrighttoclaimallhisentitlementsanemployeemay,aftergivingnoticetothe
employerabandontheworkbeforetheexpiryofthecontractualperiodinanyofthefollowing
instances:
1. Iftheemployerortheemployer'srepresentativeusesfraudonhimatthetimeofcontractingin
respectofthetermsandconditionsofwork.
2. Iftheemployerdoesnotperformhissubstantialobligationstowardstheemployeeinaccordance
withthecontractofemployment.

3. Iftheemployerortheemployer'srepresentativecommitsanactcontrarytomoralsagainstthe
employeeoranymemberoftheemployee'sfamily.
4. Iftheemployeeisassaultedbytheemployerortheemployer'srepresentative.
5. Ifthereisaseveredanger,whichthreatensthesafetyoftheemployeeorhishealthprovidedthat
theemployerisawareoftheexistenceofsuchdangerandfailstotaketheprescribedmeasures
imposedbytheconcernedauthoritiesatthematerialtime.

Article42:
SubjecttotherulesofSocialInsuranceLaw,iftheemployeeabandonstheworkforanyofthe
reasonsmentionedintheprecedingArticle,theemployershallbeobligedtopaysuchemployeehis
endofservicegratuity,withoutprejudicetotheemployee'srighttobecompensated.
Article43:
Thecontractofemploymentmayexpireinanyofthefollowingevents:
1. Upontheexpiryofitsperiodorbycompletionoftheworkagreedupon.
2. Uponthedeathoftheemployee.
3. Iftheemployeebecomesincapableofcarryingouthiswork.
4. Uponresignationorabandonmentofworkinaccordancewiththeprovisionsthislaw.
5. Iftheillnessoftheemployeerequiresdiscontinuationofworkforacontinuousorinterruptedperiod
ofnotlessthantenweekswithinoneyear.

Theemployees'incapacityorillnessshallbeprovedbyamedicalcertificateandproofofageshallbe
bythesamecertificateifitcannotbeprovedbybirthcertificateoronofficialprintoutofthesameand
themedicalcertificatemustbeissuedbytheMedicalCommittee,whichwillbeconvenedbya
decisionfromtheMinisterofHealthincoordinationwiththeMinisterforthepurposeofimplementing
thelaw,andsuchdecisionmustcontaintheorganisationofworkprocedures,andthedecisionofthe
saidCommitteeshallbefinal.
Thecontractmaynotbeterminatedbytheemployerunlesstheemployeeattains,theageofsixtyat
least.
Theemployershall,incasethecontractisterminatedforanyofthereasonsreferredtoabove,pay
theendofservicegratuityprovidedforinArticle(39)totheemployeeorhissuccessorsifthe
employeeisnotsubjecttotherulesoftheLawofSocialInsurance.
Article44:
WithoutprejudicetotheLawofSocialInsurance,ifanestablishmenthasapensionfundforthe
employeesandtheregulationsofsuchfundprovidethattheemployer'scontributiontothefundfor
theemployee'saccountispaidinconsiderationofdischargingtheemployer'slegalobligations
pertainingtohispaymentoftheendofservicegratuitytotheemployee,andifthesaidcontributionis
equaltoormorethanthegratuitypayabletotheemployee,theemployermustpaytoemployeethe
saidamountinlieuofthegratuityotherwisetheemployeewillbeentitledtothegratuity.
Iftheemployeecontributestothemoneyofsuchfundhewillbeentitledtocollectwhatisduetohim
fromthepensionfundaswellastheendservicegratuity.
Article45:
ThosewhoestablishpensionfundsintheirestablishmentsmustobtaintheapprovaloftheMinistry
forsuchfundsandtheirinternalregulationsbeforetheirregistration.Lackofanyobjectiontothe
internalregulationsbytheMinistrywithinsixtydaysfromthedateoftheirsubmissionwillbetreated
asanapprovalthereof.
Article46:
Whenthecontractisterminatedtheemployershall,upontheemployee'srequest,givetheemployee

afreeofchargecertificateofserviceshowingthedatehejoinedtheservice,thedateheleftthe
service,thetypeofworkheusedtoperform,thesalaryandtheotherallowancesandadvantagesif
any.
Theemployermustreturntotheemployeethedocumentsandcertificateswhichmayhavebeen
depositedwithhim.
Article47:
Dissolutionoftheestablishment,itsliquidation,closure,bankruptcyormergerwithanother
establishmentoritsconveyancebyinheritanceorsaleorleaseorassignmentorwillorgiftorthe
like,doesnotpreventitfromdischargingallitsobligations.
Saveincasesofliquidation,bankruptcyandfinalapprovedclosure,thecontractofemploymentwill
continuetoexistandthesuccessorswillbejointlyresponsiblewiththeformeremployersfor
dischargingalltheobligationsprescribedbythelawprovidedthatprioritywillbegiventothe
employee'srights.
Article48:
Theemployersshallbejointlyliableamongthemselvesforanyviolationofthislawandthe
transfereesofallorpartofthebusinessshallalsobejointlyliablewiththeoriginalemployerfor
dischargingtheentireobligationsimposedbytherulesreferredtoabove.
ChapterFour

Salaries,LeavesandWorkingHours

PartISalaries
Article49:
Salariesandotheramountsduetotheemployeeshallbepaidbythecurrencylegallyincirculation
unlessitisagreedthatitshallbeinkind
Article50:
TheCouncilofMinistersshalldeterminetheminimumlimitofsalariesaccordingtotherequirements
ofeconomicalcircumstancesanditmaydeterminetheminimumlimitofacertaincategoryof
employeeswhoholdjobsoroccupationsthecircumstancesornatureofwhichrequiresuch
determination.
TheMinimumlimitshallbedeterminedbyadecisiontobeissuedbytheMinister.
Article51:
Salariesshallbepaidononeoftheworkingdayssubjecttothefollowingrules:
1. Employeeswhoreceivetheirsalariesmonthlyshallbepaidonceamonthatleast.
2. Ifthesalaryispaidbypieceandtheworkrequiresaperiodwhichexceedsatleasttwoweeks,the
employeemustbegiveneachweekanadvanceequaltothejobhehasperformedandtheremaining
salaryshallbegiventohiminfullwithintheweekfollowingthecompletionoftheworkassignedto
him.
3. Inothercases,thesalariesoftheemployeesshallbepaidonceeveryweek,however,thesalaries
maybepaidtothemonceeverytwoweeksoronceeverymonthiftheyagreeinwritingtosuchan
arrangementandinallcasesthesalarymustbepaidwithinsevendaysfromtheendoftheperiodin
whichitbecomesdue.

Article52:
Iftheemploymentrelationshipcomestoanend,theemployeeshallbepaidhissalaryandall
amountsduetohimimmediately,exceptwhentheemployeeabandonstheworkbyhimselfinwhich
case,theemployershallpaytheemployee'ssalaryandallhisentitlementswithinsevendaysfrom

thedateheabandonsthework.
Article53:
Theemployerwillnotbedischargedfrompaymentoftheemployee'ssalaryunlesstheemployee
signstheregisterdesignedforthispurposeacknowledgingthathehasreceivedhissalary,orsigns
thepayrolloraspecificreceiptdesignedforsuchpurposeorunlessthesalaryistransferredintothe
accountoftheemployeeinoneofthelocallyapprovedbanksprovidedthattheparticularsofthese
documentsmuststatethedetailsofthesalary.
Article54:
Salaries,rights,otherbenefitsandallotheramountsduetotheemployeeorhissuccessors
accordingtotherulesofthislawshallhavepriorityoveralltheemployer'sdebtsexceptthe
maintenanceawardedbytheShariaCourt.
Article55:
Anemployeeshallnotbecompelled,tobuyeitherfoodstufforcommoditiesfromcertainstoresorthe
employer'sproducts.
Article56:
TheemployerisunderanobligationtorepatriatethenonOmaniemployeetohiscountryafterthe
expiryoftheworkrelationship,unlesstheemployee'ssponsorshipistransferredtoanother.Ifthe
employerfailstodischargesthisobligationtheconcernedDirectoratemustrepatriatetheemployeeat
theexpenseofthegovernmentandrecovertheamountpaidfromtheemployer.
Article57:
Anemployermaynottransferanemployeewhoreceiveshissalarymonthly,toagroupofemployees
whoreceivetheirsalariesdailyoragroupofemployeeswhoreceivetheirsalariesweeklyorbypiece
orhourly,unlesstheemployeeagreestosuchtransferinwriting.Theemployeeshall,incasehe
agreestobetransferred,enjoyalltherightsacquiredduringtheperiodinwhichhereceiveshissalary
monthlyinaccordancewiththerulesofthislaw.
Article58:
Anemployermaynotdeductmorethan15%oftheemployee'ssalaryinrepaymentofanymoney
borrowedbytheemployeeduringthecontinuationofthecontract,andtheemployershallnotcharge
anyinterestonsuchloanandthisruleappliestosalariespaidinadvance.
TheMinistermayamendthepercentagereferredtoaboveorfixaninterestontheloansifthe
employerintroducesaloansystemapprovedbytheMinistrytoenabletheemployeestobuildtheir
housesprovidedthatitshallnotexceedthemaximuminterestlaiddownbytheCentralBank.
Article59:
Salariespayabletoemployeesshallnotbeattachedorassignedexcepttotheextentofonequarter
thereoffordischargeofShariaMaintenancedebtorpaymentofamountsduefromtheemployeeto
theGovernmentortheemployer,andincaseofcompetitionbetweencreditors,paymentofSharia
Maintenancedebtshallhavepriority.Iftheemployee'sserviceisterminated,Governmentand
employer'sduesifany,shallbedeductedfromtheendofservicegratuityandfromanyother
entitlements.
Article60:
Ifashiftemployeeoranemployeewhosesalaryisdeterminedonan:hourlydaily,weeklyhalf
weekly,oramonthlybasis,isabsentfromworkwithoutpermissionorreasonablejustification,he
shallonlybepaidthesalaryforthehoursheactuallyworked.
Thehourlysalaryoftheemployeewhoreceiveshissalaryonmonthlybasis,shallbecalculatedby
dividingthegrosssalarybytheperiodforwhichhewillbegiventhesalarythendividedbythe

numberoftheoriginalhoursaccordingtothecontractofemploymentoraccordingtolawwhicheveris
lesser.
Thehourlysalaryoftheshiftemployeeshallbecalculatedbydividingthegrosssalaryofthework
shift(upontheassumptionthathehasworkedthefallshift),bythenumberoftheoriginalhours
excludingtheovertimehours.
Thesalaryoftheemployeeshallnotbedeductedwhenheabsentshimselffromworkforanyhouror
dayifheiscalledtoattendbeforethecourtorthepublicprosecutorasawitness.
PartIILeave
Article61:
Anemployeeshall,uponcompletionofoneyearofcontinuousservicewiththeemployer,havearight
toanannualleavewithbasicsalary,foraperiodoffifteendays,tobeincreasedtothirtydaysfor
everyyearthereafter.
Anemployeeshallhavetherighttoafourdayemergencyleavewithgrosssalaryduringtheyearin
emergencycases,anditshallnotexceedtwodayspereachcase.
Thedurationofthecontinuousservice,whichstartsbeforetheapplicationofthisLaw,shallbe
deemedtobepartofthedurationofservice,whichwillbeconsideredwhendeterminingtheleave
periodtowhichtheemployeeisentitledandtheemployeemaynotwaivehisleave.
Article62:
Saveincasesofjuvenileemployees'leave,itispermissibletoscheduletheleaveaccordingtothe
workrequirements.
Theemployermay,pursuanttotheprecedingparagraph,delaytheemployee'sannualleaveforone
year.
Anemployeemustatleasttakeleaveofnotlessthantwoweeks,onceeverytwoyears.
Iftheemployeeagreesinwriting,theemployershallpayhimhisbasicsalaryforthedaysofannual
leave,whichhehasnottaken.
Article63:
Theemployermaydeprivetheemployeefromhissalaryfortheperiodofleave,orrecoveranysalary
giventosuchemployee,ifitisprovedthattheemployeehasworkedforanotheremployerduring
suchleave.
Article64:
Anemployeewillbeentitledtothebasicsalaryoftheremainingleavedaysifheleavesthe
employmentbeforemakinguseofsuchdays.
Article65:
Theemployeeisentitledtohisgrosssalaryduringtheholidaysoffestivalsandoccasionswhichwill
bedeterminedbyadecisionfromtheMinister.
Ifanofficialholidaycoincideswithaprescribedweeklyrestday,itshallbecompensatedbyone
otherday.
However,iftheofficialholidayfallswithintheperiodoftheemployee'sannualleave,theemployee
willnotbeentitledtoanycompensationinrespectthereof.
Anemployeemay,ifthecircumstancesoftheworksorequire,beaskedtoreporttoworkonan
officialholidayinwhichcasehewillbeentitledtoeitherreceivehisgrosssalaryfortheofficial
holidaywithanexcessofnotlessthan25%,ortakearestdayinlieuofit.

Article66:
SubjecttotheprovisionsoftheSocialInsuranceLaw,anemployeewhosesicknessisprovedshall
havetherighttoasickleavenotexceedingintotaltenweeksinoneyearwhethersuchweeksare
continuousorseparateandthesickleaveshallbegrantedasfollows:
Thefirstandsecondweek,withgrosssalary.
Thethirdandfourthweek,withthreequartersofthegrosssalary.
Thefifthandsixthweek,withhalfthegrosssalary.
Theseventhtothetenthweek,withaquarterofthegrosssalary.
Proofofsicknessshallbebyamedicalcertificate.However,incasethereisadispute,thematter
shallbereferredtotheMedicalCommittee,providedforinArticle(43)ofthisLaw.
Asickemployeemaymakeuseoftheremainingannualleaveinadditiontothesickleaveheis
entitledto.
Article67:
Anemployeeisentitledtospecialleavewithgrosssalary,accordingtothefollowingcircumstances:
1. Threedaysformarriage,whichshallnotbegivenmorethanonce,throughouttheperiodofservice.
2. Threedaysforthedeathofasonoradaughteroramotherorafather,orawife,oragrandfather
oragrandmotherorabrotherorasister.
3. Twodaysforapaternaluncle,oranaunt.
4. Fifteendaysforperformingpilgrimage,whichshallbeoncethroughouttheperiodofservice,
providedthattheemployeehascompletedoneyearofcontinuousservicewiththeemployer.
5. FifteendaysinoneyearforexaminationsforOmaniemployeeswhostudyinoneoftheschools,
institutes,collegesoruniversities.
6. AhundredandthirtydaysfortheMuslimmarriedfemaleemployee,incaseotherhusband'sdeath.

Inordertobeentitledtotheleaveprovidedforinparagraphs2,3and6,theemployeemustpresent
proofofdeathfromtherelevantauthorities.
PartIIIHoursofWork
Article68:
Anemployeemaynotberequiredtoactuallyworkformorethanninehoursadayandforamaximum
offortyeighthoursaweekwhichshallnotincludetheperiodsspecifiedfortakingfoodandrest.
ThemaximumhoursofworkduringRamadan,shallbesixhoursadayor36hoursaweekfor
Muslimsemployeesandthetimeforcloseofworkmaybedeterminedbyadecisionfromthe
Minister.
Article69:
Thereshallbeoneormoreperiodsduringworkinghoursfortakingfoodandrest,thetotalofwhich
shallnotbelessthanhalfanhourprovidedthatthecontinuousperiodofworkshallnotexceedsix
hours.
AdecisionfromtheMinistershalldeterminethecasesandworkswhich,fortechnicalreasonsand
operationalcircumstances,requirecontinuationofworkwithnorestperiodandexhaustingandhard
labourforwhichanemployeewillbegrantedrestperiodswhichwillbeconsideredaspartofthe
actualworkinghours.

IfanemployeeisrequiredtoworkformorethanthehoursprescribedforinArticle68theemployer
musteithergivesuchemployeeextrapaymentequivalenttotheordinarysalarytowhichhisis
entitledfortheovertimework,plusatleast25%,orgranthimapermissionofabsencefromworkin
lieuoftheextrahourswhichhehasdone,providedthatthesaidemployeeagreestosuchan
arrangement.
Withregardtotheworkthattakesplaceatports,airports,onvessels,shipsoraircrafts,theemployer
andtheemployee,may,afterobtainingtheapprovaloftheMinistry,agreeonpaymentofafixed
allowancefortheemployeesinlieuoftheovertimepayments.However,theMinistermayaddany
othersimilarworks.
Article71:
Anemployermustgranttheemployeenotlessthantwentyfourconsecutivehoursofrestperweek
afteratmostsixcontinuousworkingdays.
AccumulationofweeklyrestperiodsfornotmorethaneightweeksmaybepermittedbytheMinister
inrespectofcertainplacesofworkspecifiedbyhimiftheemployerandtheemployeeagreetothisin
writing.Theweeklyrestshall,inallcases,bepayable.
Article72:
TheemployerisnotboundbytheprovisionsofArticles(68)and(69)ofthisLawinthefollowing
cases:
1. Annualinventory,budgetpreparation,liquidation,blockingofaccountsandarrangementsforsale
withreducedprices,providedthatinsuchcases,thenumberofthedaysonwhichtheemployee
worksmorethantheperiodprovidedfor,shallnotexceedfifteendaysperyear,saveincaseswhere
suchlongerperiodsarepermittedbytheconcernedDirectorate.
2. Iftheworkisforthepurposeofpreventingtheoccurrenceofanaccidentormaintainingtheresult
thereofortoavoidingananticipatedlosstoflammablematerials.
3. Iftheworkisdonetomeetanextraordinarypressure.
4. Itisprovidedthat,inthelasttwocases,theconcernedDirectoratemustbenotified,within24
hours,withthenatureoftheemergencycase,theadditionalwork,andtheperiodrequiredfor
completionofsuchwork.
5. Festivals,seasonalandotheroccasions,andseasonalworkswhichwillbedefinedbyadecisionfrom
theMinister.

Article73:
Theemployershallgranttheemployee,inrespectofthecasesprovidedforintheprecedingArticle,
anextrasalaryequivalenttothesalarytowhichheisentitledfortheovertimeperiodplus25%at
leastforedaytimeworkinghours,and50%fornighttimeworkinghours.Ifsuchworkisperformed
duringtheweeklyrestdayorduringtheofficialholidaystheemployeeshall,unlesscompensated
withanotherdayduringthesubsequentweek,beentitledtodoublesalaryforsuchday,unlessheis
grantedanotherdayinlieuthereofwithinthefollowingweek.
Article74:
Anemployershalldisplayonthemainentrances,whichtheemployeesuseforenteringtheirplaceof
work,andonconspicuousplacesintheestablishment,ascheduleshowingthehoursofworkandthe
weeklyperiodsofrestandthetimeoftheweeklyrest.Acopyofthisscheduleandanyalteration
theretoshallbesenttotheconcernedDirectorate.

Itisprohibitedtoemploybothmaleandfemalejuveniles.Suchjuvenilesarenotpermittedtoenter

ofsuchworksorequires.

Juvenileswhoseagesarebelow18shallnotberequiredtoworkbetween6.00p.m.and6a.m.,nor
shalltheyberequiredtoworkformorethansixhoursaday.
Suchjuvenilesshallnotstayintheplaceofworkformorethansevenconsecutivehoursandthere
mustbe,withintheworkhours,oneormoreperiodsforrestandmealswhichshallnotbelessthan
onehourintotal.Suchperiodorperiodsmustbefixedsothattheywillnotworkformorethanfour
consecutivehours.
Article77:
Inallcasesitisnotpermissible,torequirejuvenilestoperformovertimeworkorkeeptheminthe
placeofworkaftertheprescribedtimenorshalltheyberequiredtoworkondaysofrestorofficial
holidays.
Article78:
Theemployershall,whenheemploysoneormorejuveniles:
1. Displayintheplaceofwork,acopyoftherulesrelatingtotheemploymentofjuveniles,providedfor
inthisChapterandforwhichadecisionwillbeissuedbytheMinister.
2. Preparealistshowingthenamesofthejuveniles,theirages,andthedatesoftheiremployment.
3. Conspicuouslydisplay,intheplaceofwork,alistshowingthehoursofwork,periodsandweekly
timesofrest.
4. FurnishtheconcernedDirectorateinadvancewiththenamesofjuvenilesbeforetheiremployment
andthenamesofthoseemployedtosupervisetheirwork.

Article79:
Subjecttotheforegoingprovisions,theMinistermayspecifythesystemofjuvenilesworkandthe
circumstancesandconditionsofemployment,works,jobsandindustriesinwhichtheywork
accordingtothedifferentlevelsofages.
PartIIEmploymentofFemales
Article80:
WithoutprejudicetotheprovisionsofthisChapter,alltherulesregulatingtheemploymentof
employeesareapplicabletofemaleemployeeswithoutdiscriminationinworkbetweenthem.
Article81:
Femalesshallnotbeemployedtoworkbetween6.00p.m.and6.00a.m.saveincases,works,and
occasionswhichwillbespecifiedbyadecisionfromtheMinister.
Article82:
Femalesshallnotbeemployedeithertoperformaworkwhichisharmfultohealthorhardlabouror
suchotherworkswhichwillbespecifiedbyadecisionfromtheMinister.
Article83:
Afemaleemployee,whohasbeenworkingforayearwithheremployer,shallhavetheright,upon
presentingamedicalcertificateshowingdeliverydate,tomaternityleavebeforeandafterdeliveryfor
aperiodnotexceeding,intotal,sixweeks.Howeversuchafemalewillbeentitledtochooseeitherto

considerherperiodofabsencefromworkasamaternityleavewithoutpay,orasasickleave
pursuanttoArticle(66)ofthisLaw.
Article84:
Theemployerisnotpermittedtodismissafemaleemployedforbeingabsentduetosickness,which
willbeprovedbyamedicalcertificatetobeattributabletopregnancyordelivery,andthatshecannot
resumeherwork,providedhoweverthatsuchaperiodofabsenceshallnotintotalexceedsix
months.
Article85:
Theemployershallincaseheemploysafemaleemployeeormore,displayintheplaceofwork,a
copyofthefemaleemployeesrules.
Article86:
Subjecttotheforegoingprovisions,theMinister,shallissueadecisionspecifyingtherulesfor
employingfemaleemployeesandthecircumstancesinwhichtheirworkmaybeperformedaswellas
theworks,jobsandtheindustriesinwhichtheywork.

ChapterSix

IndustrialSafety

Article87:
Everyemployeroremployer'srepresentativemust,beforehiringanemployee,acquainthimwiththe
hazardsofhisoccupationandthepreventivemeasures,whichmustbeadopted.Theemployermust
takethenecessaryprecautionstoprotecttheemployeesduringtheworkfrominjurytotheirhealth
anddangersofworkandmachineryby:
1. Providingadequatesafetyandhygienicconditionsinplacesofworkorthetoolshedeliverstothe
employeesforcarryingouttheirduties.
2. Makingsurethatplacesofworkarealwayscleanandcomplywiththeconditionsofhealth,safety
andoccupationalhealth.
3. Makingsurethatmachineries,piecesofequipmentandequipmentareinstalledandkeptinsafe
condition.

Theemployerisnotallowedtochargetheemployeesordeductfromtheirsalariesanyamountsfor
theprovisionofsuchprotection.
Article88:
Theemployeemustrefrainfromanyactionintendedtoobstructimplementationoftheinstructionsor
themisuseorcausingofdamageorlosstothemeansprovidedfortheprotection,safetyandhealth
ofhisfellowemployees.Hemustusemeansofprotectionandundertaketotakecareofthose
meanswhichareinhispossessionandtocarryouttheinstructionsprescribedforpreservinghis
healthandprotectinghimfromgettinginjured.
Article89:
ThefollowingmaybedeterminedbyadecisionfromtheMinisterincoordinationwiththeconcerned
Governmentalentities:
1. Generalsafetyprecautionsandoccupationalhealthwhichmustbeappliedinallplacesofwork,and
especiallyinrespectof,lightingandventilation,aircirculation,drinkingwater,lavatories,the
expulsionofdustandsmoke,employees'sleepingplacesandfirefightingmeasures.
2. Specialprecautionsforcertaintypesofwork.

TheMinistrymayappointinspectorstocheckthatemployersarecarryingouttheinstructions
mentionedintheMinister'sdecisionsregardingtheprecautionsstipulatedinarticle89.
Suchinspectorsshallhavetherighttoenterplacesofworkandexaminetherecordsofemployees
andquestionwhoevertheywishandtomakereports.TheconcernedDirectorateshallonthebasisof
thesereports,giveawrittenwarningtoanemployerwhoviolatessuchregulations,toremovethe
violationswithinaprescribedperiod.
Ifthereisadangertothesafetyandhealthofemployees,theMinistrymaytakethenecessary
actionstoentirelyorpartiallyclosetheplaceofwork,ortostoptheworkofoneormoreequipments
untilthereasonsofdangerareeliminated.TheMinistrymay,ifnecessary,seektheassistanceofthe
OmaniRoyalPolice.
ChapterSeven

EmploymentofEmployeesinMinesandQuarries

Article91:
FortheapplicationoftheprovisionsofthisChapter,industriesofminesandquarriesshallmean:
1. Operationsforsearchingordiscoveringmineralandhydrocarbonmaterialsordiggingthemoutin
theareaswherealicencehasbeenissuedwhetherthemineralsaresolidorliquid.
2. Operationsfordiggingoutorrefiningormanufacturingthedepositsofmineralmaterialsexisting
outsideorinsidethegroundattheplaceoflicenseortheplaceofcontractoratplacesfarfrom
residentialareas.PlacesfarfromresidentialareasshallbespecifiedbyadecisionfromtheMinister
incoordinationwiththeconcernedauthorities.
3. Constructionworksandinstallationofequipmentsrelatingtotheoperationsreferredtointhe
precedingparagraphs.

Article92:
TheemployershallnotallowanyemployeetoworkintheoperationstowhichthisChapterapplies
exceptaftersubjectingsuchanemployeetomedicalexaminationandprovinghisfitnesstoworkin
suchoperations.However,thiswillbeinaccordancewiththerulesandconditionswhichwillbe
issuedbyadecisionfromtheMinisterincoordinationwiththeMinisterofHealth.ThesaidMinisterial
Decisionmustprovidethattheemployeewillbesubjecttoaperiodicalmedicalexaminationatleast
onceayeariftheemployeeisfromthosewhoworkinsidethegroundorcarryingoutdrillingworks.A
medicalexaminationmustalsobecarriedoutontheemployeeuponexpiryofhiscontractof
employment,toascertainhisconditionandverifywhetherhehascontractedanyoccupationalillness.
Article93:
Entryinplacesofworkandrelatedpremisesisnotpermissibleexceptfortheemployeesorthe
officialswhoareauthorisedtoinspecttheminesorquarriesandotherpersonsholdingalicencefrom
theconcernedgovernmentauthoritiesorfromthemanagementoftheestablishment.Anemployeeis
notpermittedtoentertheplaceofworkandrelatedpremisesattimesotherthanworkinghours.
Article94:
Employersshallprepareaspecialregisterforrecordingemployeesentryinandexitfromtheplaces
ofwork.
Article95:
Itisnotpermissibletoletemployeesstayinplacesofworkwhetheronthesurfaceofthegroundor
insidetheground,foraperiodthatexceedseighthoursaday.However,suchperiodshallincludethe
timetheemployeespendsinreachingtheplaceofworkinsidethegroundfromthesurfaceofthe
groundandthetimehespendsinreturningbacktothesurfaceoftheground.
Thereshallbeoneormoreperiodsfortakingmealswhichshallnotbelessthananhour,intotal.

Article96:
NoncompliancewiththeprovisionsofArticle(95)maybeexceptionallyandtemporarilypermittedif
theworkisintendedtopreventtheoccurrenceofanaccidentortheavoidanceofdanger,orrepairing
thedamagewhichresultstherefromorforthepreparationsormaintenanceprovidedthat:
1. TheconcernedDirectorateisnotifiedwithin24hours,byexplainingtheemergencysituation,and
theperiodrequiredforcompletingtheworkandthenumberofemployeesrequiredforits
performance.
2. Theemployeeisgrantedextrasalaryequivalenttothesalaryheisentitledtoforovertimeinaddition
toatleast50%iftheworkisaftersixa.m.and100%iftheworkisaftersixp.m..However,ifthe
workisduringtheweeklyrestdaysortheofficialholidays,theemployeeshallbepaidforeachhour
anamountequaltothesalaryheisentitledtoforsuchhourinadditionto100%apartfromsucha
day'ssalary.

Article97:
TheordinaryleaveprovidedforinArticle(61)above,willbecalculatedfromthetimewhenthe
employee(havingleftthemine),reachesthenearestcitywherepublictransporttohishometownis
available,andexpireswhentheemployeereturnstothatsamecity.
Article98:
Theemployerortheemployer'srepresentativeshalldrafttheregulationsofsafetyprecautionsand
occupationalhealth.
Article99:
Themineorthequarrymanagerorhisrepresentativeshall:
1. Issuedailyinstructionsregardingsafetyandoccupationalhealth.
2. Preventthepresenceofemployeesintheplaceofexplosionexceptafterthedangerperiodisover.
3. Notpermittheuseofanythingotherthansafetylamps,inplacescontainingflammablegasesor
gaseswhichcauseexplosion.
4. Providetheemployeeswithprotectiveclothesandequipment.
5. Adjusttheventilationandthedegreeofheatwhethernaturallyorartificially.
6. Dailyexaminetheplaceofworkbeforetheworkstartsandstatehisremarkstotheleaderincharge
inorderforhimtoimmediatelycompliedtherewith.
7. Conductinspectionduringworkatleastonceaweekandprepareareportcontainingthedateand
timeofinspection,thenumberofemployees,theexistenceofharmfulgases,thestateoftheposts,
thesides,theceiling,thesignsoflighting,ventilation,andthetoolsofrescueandheshallmakea
fullsummaryofsuchreportsinaregistertobedesignedforsuchpurpose.

Article100:
Theemployeroremployer'srepresentativemustestablishafrontrescuepointneartheplaceofwork
whichshallbeequippedwithrescueequipmentandthenecessaryaidandtheremustbeasuitable
meansofcommunicationinsidethisplacefitforimmediateassistanceandshallappointamedically
trainedemployeetosuperviserescueoperationsandfirstaid.
Article101:
Theemployermustallocateinanymineorquarryinwhich,atleast,fiftyemployeesareworking,a
suitableplacecontainingaroomequippedwithmeansofrescueandfirstaidandanotherroomfor
nursinginadditiontoaroomormoreforchangingdressings.
Minesandquarriestheemployeesofwhicharelessthanfiftyandlocatedincirclesthediameterof
whichreachtwentykilometers,mustparticipateinestablishingaplaceforrescueandaidinacentral
location.

WithoutprejudicetotheprovisionsofArticle(33),themeansofrescueandaidshallbespecifiedbya
decisionfromtheMinister.
Article102:
Drinkingwatermustbekeptinspecialcontainersperfectlysealedtopreventpollution.Such
containersmustbeputinplaceswithineasyreachfortheemployees.Thewatermustbechanged
dailyandcontainersshallbecleanedatleasttwiceaweekinahygienicapprovedmanner.
Article103:
AnemployerwhoconductsaworkasdefinedinArticle(91),must:
1. Providetheemployeeswithsuitableaccommodations.Theconditionsandspecificationsofsuch
accommodationsshallbespecifiedbyadecisionfromtheMinisterincoordinationwiththeconcerned
governmentauthorities.
2. Providehisemployeeswiththreemealsperdayinrestaurantstobepreparedforthispurposeandto
becleanandmustsatisfyhealthrequirements.Thetypeandthequantityoffoodforeachmealshall
bedeterminedbyadecisionfromtheMinisterincoordinationwiththeMinisterofHealthandincase
allorpartofthemealsareprovidedtotheemployeesinsidethemines,thesamemustbe
hygienicallypackedorputinwellsealedcontainers.Theprovisionofmealsmaynotbewaived
againstanymonetaryallowance.
3. Supervisethecleaninginsidetheplaceofworkandtheresidentialareaandtheemployee's
bathroomsfacilities,withoutanyexpensetotheemployees.

TheMinistermayissueadecisionstatingtheplacesfromwhichtheemployeesmayreturntotheir
residences.

ChapterEight

LabourDisputes

Article104:
Theprovisionsofthischaptershallapplytoanydisputeconcerningworkorworkconditions,which
takesplacebetweenanemployerandoneofhisemployeesorbetweenoneormoreemployersand
alloranyoftheiremployees.
Article105:
Anyemployeremployingfiftyormoreemployeesmustputinaconspicuousplaceaproceduresfor
complaintsandgrievancestobeapprovedbytheconcernedDirectorate.
Theaforesaidproceduresmustprovidethattheemployeeshallhavetherighttosubmithiscomplaint
orgrievancetotheemployerortheemployer'srepresentative.
Article106:
AnemployeewhohasbeendismissedfromworkmayapplytotheconcernedDirectoratewithin15
daysfromthedatehehasbeennotifiedofthedismissalofhisnotice,tocancelthedecisionof
dismissal.Theconcernedauthorityshalltakethenecessarymeasurestosettlethedisputeamicably.
Thedirectoratemustreduceittowritingandfollowupitsexecution.Iftheemployerrefusesto
executetheagreedsettlement,heshallbeobligedtopayanamountequivalenttotheemployee's
salaryfortheperiodfromthedateofsettlementuntilthedateheexecutesthesame.Ifthedisputeis
notsettledwithintwoweeks,orifsettledandanyofthepartiesrefusetoexecuteit,theconcerned
authorityshallreferthemattertothecompetentcourtwithinaperiodnotexceedingtwoweeksfrom
thedateoftheexpiryoftheaforesaidperiodorfromthedateoftherefusaltoexecuteit,togetherwith
amemorandumcontainingasummaryofthedisputeandtheparties'arguments.
TheSecretariatofthecourtshall,withinthreedaysfromthedatethematterisreferredtothecourt,
presentthesametothepresidentofthecourttofixadateforahearingwithinaperiodnotexceeding
twoweeksfromthedateofreferral.Asummonsforthedateofhearing,withenclosedcopyofthe

saidDirectoratememorandum,shallbeservedontheemployee,theemployerandtheconcerned
Directorate.Thecourtshallmakeadecisioninrespectoftheapplicationforstayingtheexecutionof
suchdismissal,ifany,withinaperiodnotexceedingtwoweeksfromthedateofthefirsthearing
sessionandthecourtjudgmentshallbefinal.Ifthecourtdecidestostoptheenforcementofthe
dismissal,theemployershallbeboundtoreinstatetheemployeeortopayhimanamountequalto
hissalaryuntilthesubjectmatterofthedisputeisadjudicated.Thecourtshallpassitsjudgmenton
thedisputewithinaperiodnotexceedingonemonthfromthedatetheenforcementofthedismissalis
stayed.
Ifitisprovedtothecourtthatthedismissaloftheemployeeortheterminationofhisserviceswas
arbitraryorcontrarytotheLaw,itmaydecidetoeitherreinstatetheemployeeorobligetheemployer
topayhimfaircompensationinadditionto:
1. Theendofservicegratuitytowhichtheemployeeislawfullyentitledandallotherbenefits
prescribedbythelaworthecontractofemployment,whicheverisgreater.
2. Thebasicsalarytogetherwiththeotherallowances,ifany,forthenoticeperiodprovidedforbythe
Laworthecontractofemployment,whicheverisgreater.

Theamountswhichtheemployeemayhavereceivedinexecutionofthejudgment,shallbededucted
fromthecompensationamountawardedtotheemployeeorfromanyotheramountsduetohim.
Article107:
Anemployeewhohasacomplaintshallfirstadoptthesystemappliedbytheemployer.Ifsuch
systemdoesnotexistsorifitexistsbuttheemployeefindsnosolutionforhiscomplaint,hemay
submitanapplicationtotheconcernedDirectorateforthesettlementofhisdisputewiththeemployer.

ChapterNine

RepresentativeCommittees

Article108:
Theemployeesofanyestablishmentmayestablish,amongthemselves,aRepresentative
Committeeforthepurposeofprotectingtheirinterestsanddefendingtheirlegallyestablishedrights
aswellasrepresentingtheminallmatterspertainingtotheiraffairs.
Article109:
RepresentativeCommitteesinestablishmentsmayselectaPrincipalRepresentativeCommitteefor
representingtheminmeetingsandthelocal,regional,andinternationalconferences.
Article110:
TheMinistermayissueadecisionestablishingtherulesappertainingtotheformationandtasksof
theRepresentativeCommitteesandthePrincipalCommittee.

ChapterTen

Penalties

Article111:
Notwithstandinganymoreseverepenaltyprovidedforinanyotherlaw,theviolationsreferredtoin
thefollowingarticlesshallbepunishedbythepenaltiesprovidedfortherein.
Article112:
Theemployerortheemployer'srepresentativewhorefusestoprovidethenecessaryfacilitiesor
accurateinformationorwhoprovidesfalsestatementstoofficialemployees,willbeimprisonedfora
periodnotexceedingonemonthandwithafinenotexceedingRO100orbothorbyoneofthetwo
penalties.

Article113:
WhoeverviolatestheprovisionsofArticles14,15and16ofChapterOneinPartIIwillbepunishedby
afineofnotlessthanR.O10andnotmorethanR.O100foreachemployeeandforviolationof
Article(17)byafineofnotlessthanR.O50andnotmorethanR.O100.Suchpunishmentshallbe
doubledifsuchviolationisrepeated.
Article114:
WhoeveremploysnonOmaniemployeeswithouthavingalicenseforthatwillbepunishedwithafine
ofnotlessthanR010andnotmorethanRO100.Thenumberofsuchpenaltiesshallbemultiplied
proportionatelywiththenumberofsuchemployeesinwhoserespecttheviolationsarecommitted.
Suchanemployershall,athisownexpense,givetheemployeethecostsofhisrepatriation.Further,
theemployerwillnotbeallowedtobringintotheSultanateofOman,anynonOmaniemployeesfora
periodofnotmorethanoneyear.
AnonOmaniemployeewhoworksintheSultanate,withoutalicencefromtheconcerned
Directorate,orworkswithanyemployer,otherthantheemployer,whoobtainedalicencetobringhim
toOman,shallbepunishedbyimprisonmentforaperiodnotexceedingonemonthandpunishedwith
afinenotexceedingR0100orbyoneoftheboth,inadditiontothecancellationofthelicenceissued
totheemployerifany.
Anyemployerwhowillfullyallowsanyofhisemployeestoworkwithanotheremployerwillbe
punishedbyimprisonmentforaperiodnotexceedingonemonthandfinenotexceedingR0200,for
eachemployeeorbyoneofthesetwopunishmentsandthepunishmentwillbemultipliedbythe
numberoftheemployeesinrespectofwhomthebreachhasbeencommitted.Suchemployermay
notbeallowedtobringintoOmananynonOmaniemployeeforaperiodnotexceedingoneyear.
AnyemployerwhodoesnotcomplywiththeprescribedpercentageofOmanisationshallbepunished
withfineequalto50%oftheaverageofthetotalsalariesofthenonOmaniemployees,who
representthedifferencebetweenthepercentageofOmanisationwhichwillbeobservedbythe
employer,andthepercentagewhichtheemployeractuallyachieves.
AnyrecruiterofforeignemployeeswhocontravenestheprovisionsofArticle(20)andthedecisions
whichorganiselabourpermitsandtheirconditions,willbepunishedbyimprisonmentforaperiodnot
exceedingonemonthandafinenotexceedingRO200orbyoneofthesetwopenaltiesbothin
additiontothecancellationofthelabourpermitoritssuspensionforaperiodnotexceedingoneyear.
AnyemployerwhoviolatestheprovisionsofArticle(29)willbepunishablewithafineofnotlessthan
RO50andnotmorethanR0200.
Article115:
WhoeverviolatestheprovisionsofChapterThreeandthedecisionissuedforitsexecutionshallbe
punishablewithafineofnotlessthanR.O10andnotmorethanR.O100.However,such
punishmentshallbemultipliedaccordingtothenumberoftheemployeesinwhoserespectthebreach
iscommittedandthepunishmentshallbedoubledincaseofrepetition.
Article116:
WhoeverviolatestheprovisionsofPartIandnofChapterFourshallbepunishedwithafinenot
exceedingR.O.100.Howeversuchpunishmentshallbemultipliedaccordingtothenumberofthe
employeesinwhoserespectthebreachiscommittedandthepunishmentshallbedoubledincaseof
repetition.
Article117:
WhoeverviolatestheprovisionsofPartThreeofChapterFourshallbepunishedbyafineofnotmore
thanR.O.100.However,suchpunishmentshallbemultipliedaccordingtothenumberofthe
employeesinwhoserespectthebreachiscommittedandthepunishmentshallbedoubledincaseof
repetition.

Article118:
WhoeverviolatestheprovisionsofChapterFivewillbepunishedwithafinenotexceedingR.O100.
Suchpunishmentshallbemultipliedaccordingtothenumberofthejuvenilesandthefemale
employeeswhohavebeenemployedinbreachofsuchprovisions.
Ifsuchviolationsarecommittedagainwithinoneyearfromthedateofjudgment,theemployermay
bepunishedinadditiontothefine,withimprisonmentfornotmorethanaweek.
Article119:
AnyemployerwhoviolatestheprovisionsofArticle(92)shallbepunishedwithimprisonmentfora
periodofnotlessthanaweekandnotmorethanonemonthandanyemployerwhoviolatesanyother
provisioninChapterSevenshallbepunishablewithafineofnotlessthanR.O100foreach
employee.Suchpunishmentshallbedoublediftheviolationisrepeated.
Article120:
AnyemployerrefusingtolaydownaprocedureforcomplaintsandgrievanceasstipulatedbyArticle
(105)willbepunishedbyafineofnotlessthanR.O.100andnotmorethanR.O.300.
WhoeverrefusestoexecutetheamicablesettlementprovidedforinArticle(106)shallbepunishedby
afineofnotlessthanR.O50andnotmorethanR.O.100,suchpunishmentsshallbemultipliedby
thenumberoftheemployeesinwhoserespecttheviolationiscommitted.
Article121:
Anyemployeewhodisclosesanyjobsecret,duringthecourseofhisemployment,shallbepunished
byafinenotexceedingR.O100andanimprisonmentfornotmorethanthreemonthsorbyanyofthe
twopenalties.
Article122:
Anypersonwhodeliberatelyobstructsorinterruptsagovernmentofficialfromexercisinghispowers
orperforminghisdutiesshallbepunishedbyafinenotexceedingRO100andanimprisonmentfora
periodnotexceedingonemonthorwithbothpenalties.Suchpenaltywillbedoublediftheviolationis
repeated.
