ETHICAL ISSUES AND CONDITIONS
As a clinical psychologist, I have a duty to keep the all the information about the
client obtained highly confidential. However, the extent of the confidentiality would be
regulated by law or other rules. Before the start of the testing the psychologist must
discuss the informed consent and confidentiality with the client regarding with the
disclosure of the results.
(a) The boys physician; I would give him the results regarding the boys condition
physically because according to APA code of ethics Psychologists disclose
confidential information without the consent of the individual only as
mandated by law, or where permitted by law for a valid purpose such as to (1)
provide needed professional services; (2) obtain appropriate professional
consultations, etc. I believe this would to provide assistance to the physician
in keeping the boy healthy.
(b) The boys parents; I would tell the boys current state of mind, the possible
reasons, and the prevention treatment that will help the boy. The boy is no
longer under their custody since he is married but he is currently saying with
them so I think they have the right to know.
(c) The boys employer; I would tell them about the boys working conditions but I
would avoid the sensitive parts (the parts that the boy would want to keep
from them) According to APA Psychologists disclose confidential information
without the consent of the individual only as mandated by law, or where
permitted by law for a valid purpose such as to obtain payment for services
from a client/patient, in which instance disclosure is limited to the minimum
that is necessary to achieve the purpose.
(d) The attorney for the insurance company; just like with the employer I would
give them the some information. I would avoid the parts the boy is
uncomfortable with to discuss with them. This is because I have obtained the
payment from them so I have to give the information.
(e) The attorney for the boys wife; I would not provide them with any information
because according to ACA code of ethics Psychologists disclose confidential
information without the consent of the individual only as mandated by law, or
where permitted by law for a valid purpose such as to protect the
client/patient, psychologist, or others from harm giving them the information
they want may put my client at a disadvantage.
(f) The attorney that would sue me; As a psychologist I still have a right to
protect myself and if its not mandated by law then I wont give it to them.
Also, I only gave the results of the testing conducted on the boy. As a human I
am not perfect but they cannot sue me for that because I too have a right
according to the law.
