Section 7c of the Implementing Rules and Regulations (IRR) of Republic Act 8794,
otherwise known as the Motor Vehicle User Charge, provides penalties for overloaded trucks
and trailers and prohibits vehicles that exceed the allowable gross vehicle weights (GVW)
and/or axle load of 3,500 kg. from proceeding on the highway (Table attached).
To ensure the efficient and coordinated use of the weighbridge and portable axle
weighing
of
Transportation and Communications, the Department of the Interior and Local Government
and this Department is hereby circularized for the guidance of all concerned.

in order to ahate this cOIll\ilion, Republic Act (RA) No. X794, entitled "An Act II1Ipusing
A Motor Vehicle User's Charge On Owners or All Types or Motor Vchicles And For Other I'urposes," was

was approved by the I'resident on 27 June 2000;
WHEREAS,
Section 7c of the Implemcnting
Rules and Regulations (IRR) of RA No. 8794 provides
penalties for overloaded trucks and trailers and prohibits vehicles that exceed the allowable gross vehicle \Veighl~;

(DPWII) has installed weighbridge
at strategic locations along national roads whidl can determine the weighls or trucks alllltrailcrs; and
WII EIZEAS, there is a need to provide eJ'/icient and coordinated use of the weighbridge and portahle
axle load weighing stations in order to implement the provisions or ICA. No. ~794 and Section 7c or its IRR so
as to prevent the movement on national lOads nnd bridges or overluaded trucks and trailers;

At each weighbridge or portable lIxle load weighing slat ion,
the DI'WI] starr shall weigh loaded trucks and trailers using the appropriate
equipment, lInd shall
determine and indicate, in the prescribed lorm the actual load per axle and the total allowable gross
vehicle weight. Based ,on these data, the DPWII starr shall identify the overloaded trucks and trailers,
i.e., those that exceed, the allowable vehicle dual-wheel axle load or 13,SOO kg and gross vehicle
weights shown in Annex "A", and shall imlllediately notify the LTO and I'NI'-TMG personnel assigncd
at the station to take appropriate action on these vel)iclc.~--i.i-si)J'i)viilCtrhereunder.
