PROTECT KENYA FROM GENOCIDE; INTERNATIONAL PETITION.

Kenya is on the cusp of a Raila Amolo Odinga politically instigated genocide. A series of violent
demonstrations ostensibly against the Independent Electoral and Boundaries Commission is
raising ethnic tension across the country. Organized violence, deaths, injuries, destruction of
property, ethnic mobilization, threats and attacks against state security machinery, creation of
an exclusionist narrative against the Kikuyu community, and training of militia outside the
country is growing in anticipation of the trigger that is the 2017 general election. We ask you to
recognize these ongoing acts as inimical to regional peace and security and the potential to lead
to a mass atrocity and genocide.

I.

THE URGENT NEED FOR INTERNATIONAL ACTION

Kenya has launched this International Petition to the United Nations Security Council
President and the United Nations Advisor on Genocide Prevention and the Responsibility
to Protect against Raila Amolo Odinga led violence that presents a threat to Kenyan peace and
security and the risk of Mass Atrocities and Genocide in 2017.
The International Policy Group is sponsoring this petition on behalf of the people of Kenya under
the #ProtectKenyaMovement to bring International awareness and action on the continuing

organized violence and the retaliation it is organized to provoke in preparation for large scale
violence and mass atrocity in the lead up to the 2017 General Election.

II.

FACTS UNDERLYING THE PETITION

Raila Odinga has a heritage and history of violence in his quest for power. His political history
since 1966 is documented as a path of violence and bloodshed. His claim to democracy is false
as he has always opted for the violent and bloody way to power even during Kenyas most
democratically robust times. At the heart of this violent path is the 2007-2008 post election
violence where he made a euphemistic call to violence in the name of Mass action.
a. Raila Odinga; A master of political euphemisms.
Raila is the master of euphemism in political rhetoric. The calls he has made over time towards
mass action, peaceful demonstration, democratic protests and other related calls to the streets
have been masked calls towards ethnic political violence. The apogee of these euphemistic
calls is the 2007-2008 call to Mass Action that unleashed Kenyas most notorious and bloody
violence under the banner No Raila No Peace. 1,333 Kenyans died, over 600,000 were
displaced, billions worth of property destroyed that was stopped just on the edge of a worse
mass atrocity.
Out of this period is the slogan No Raila No Peace, which is a summation of the Odinga
strategy to power. As long as Raila isnt in power, Kenya has not known peace and will continue
to suffer this tragedy in as long as democratic elections continue to return electoral losses to his
diverse formations.
b. The unfolding pattern of violence.
In the lead up to 2017, Raila has chosen to completely dismantle all systems critical to a free
and fair election. The Independent Electoral and Boundaries Commission, the national security
system and the Supreme Court are necessary for the conduct of a democratic election is under
attack through a call to violent protest. This ethnic based political protest is aimed at inciting
violent action from his ethnic base and violent retaliation from opposed ethnic groups. Raila is
keen on ensuring there is maximum bloodshed against his own Luo community so he can rise
as a victim and call on the illegitimacy of a government that would have been unable to protect
in order to depose a validly elected government.

Ethnic tensions are already high, up to six people have already died in violent protest and ethnic
based retaliation in speech and action is already underway. The continued escalation is only
going to lead to a mass atrocity sooner rather than later if international action through the
principle of the responsibility to protect is not taken. Attempts by the national security system to
apprehend the proponents of ethnic animosity are under threat from Raila Odinga who has
threatened violent protests to get them from court custody.
As noted, Railas use of his Luo ethnic community to incite violence is already causing the
tragedy of loss of lives and livelihoods to his people. In violence exclusively organized in his
ethnic base of Luo Nyanza and his Nairobi ethnic enclaves of Kibera, Mathare, Huruma and
Kayole, the conflicts currently underway can and will easily escalate into genocide if no
measures to prevent the atrocities are taken.
c. The Odingas history of violence
Raila comes from the establishment Luo Odinga political family of Jaramogi Odinga who was
Kenyas first Vice President from 1964 to 1966. The late Jaramogi from very early on adopted
violence as a means of ascending to power. The family has largely done this through;
1) Attempts at acquiring arms for distribution to civilians for violent revolution.
2) Inciting and organizing coups in the army for violent revolution.
3) Creation of a school of indoctrination and intellectuals in the art of Violent revolution.
4) The more insidious use of mass ethnic provocation to incite violent retaliation from other
communities against his own Luo people to create a swell of anger that would lead to
violent revolution from his own people.
The use of violence by the family has already had deadly consequences since 1964. Over 2,000
people have died, thousands more injured, hundreds of thousands displaced and property worth
billions destroyed. The action by the International Criminal Court in 2010 against six Kenyans
was a response to a mass atrocity incited by Raila Odinga against opposed ethnic groups.
Kenyan politics has become adverse to peace and security with ethnic tensions high and ready
for exploitation into mass atrocity which Odinga is stroking at the moment. The historical
background below demonstrates the use of the four above listed strategies from time to time.
1962-1969: Raila Odinga was given a scholarship to study at Leipzig University in East
Germany where he undertook engineering. However, during his schooling period (1962-1969) in
East Germany, Raila Odinga got himself involved in violent related activities.

First, his undergraduate thesis focused on bomb making with a special focus on nail bombs.
To bomb who and for what purpose remains a mystery only Raila himself can explain as quoted
by the Herald on April 27, 2011.
Secondly, during his school day Raila is said to have gone on a drinking spree with a friend
known as Odero Ojwok in the company of white female students. An East German soldier
attempted to flirt with the female students accompanying Raila resulting to a bloody brawl with
Raila and his friend Odero Ojwok. It is said Railas friend stubbed the soldier on the stomach
with a knife spilling out his intestine.
A colleague of the wounded soldier joined the fight and brutally beat Raila and Odero where
Raila was flung against the hotels French window smashing his face, causing the scar on his
forehead. Raila also broke his jaw and lost some teeth causing him to stammer till to date.
January 1964: Less than a month after Independence, Prime Minister Jomo Kenyatta was
convinced his Home Affairs Minister and later his fierce rival Jaramogi Oginga Odinga was
planning to overthrow him. He obtained the information from western intelligence agencies who
cited of a ploy to remove him from power.
January 1964: Lanet Mutiny-Jaramogi Oginga Odinga known for his violence tactics, was
placed under house arrest by President Jomo Kenyatta when Kenya Army (former Kings Africa
Rifles) soldiers in Lanet mutinied demanding better pay, to prevent him from taking advantage
of the situation politically.
November 1964: Railas father Jaramogi Oginga Odinga smuggled a cache of arms into the
country and stored them in the basement of the Ministry of Home Affairs building. The arms as
alleged were meant to overthrow former President Jomo Kenyattas government as reported by
the government.
April 1965: Charles Njonjo the first attorney general after Kenya gained independence in 1963,
informed British High Commissioner Malcom Macdonald of reports that Jaramogi Oginga
Odinga and his associates were plotting a coup and requested the intervention of British troops.
1966: Jaramogi Oginga Odinga fell out with former President Jomo Kenyatta and resigned from
Government. However his son, Raila Odinga hailed stones at the Germany embassy in protest
of his father Jaramogi Odinga for being expelled from the Ruling Party KANU. Jaramogi formed
Kenya Peoples Union (KPU) which later was banned for organizing chaos in Nyanza.

0ctober 25, 1969: Raila Odinga at 24 years of age, mobilized fellow Kisumu youths to throw
stones at President Jomo Kenyatta motorcade after the official opening of the Russian built New
Nyanza General Hospital. The act resulted to the killing of 11 people with scores injured.
1971: Raila Odinga as per media reports allegedly reached out to the army with intention to
cause mutiny. Railas attempt was unsuccessful but claimed the careers of more than 20 senior
military personnel.
July 1982: Raila Odinga and his father Jaramogi Oginga loaned Snr Private Hezekiah Ochuka
the man who led the attempted coup a Peugeot 504, registration number KVZ 042. The car was
used to facilitate Ochuka in his plans to Overthrow President Mois government.
July 18, 1982: Raila Odinga secretly met Ochuka at his house in Umoja Estate to plan for the
failed coup.
July 30, 1982: Raila Odinga subsequently met Snr. Private Ochuka at the Little Aden Bar in
Umoja to make a follow up on their plans to overthrow President Mois government.
August 1982: Raila Odinga admitted to have been the Chief architect and financier of the failed
coup. He revealed his role during the failed coup on his biography the Flame of Freedom which
was published in

2006. Railas led coup, resulted to more than 100 soldiers and 200 civilians

died, including two (West) Germans, an English woman and a Japanese male tourist and his
child. Two Asian women committed suicide after being raped.
March 12, 1992: Raila Odinga physically exchanged punches with a District officer in Mandera
after a rally he had organized was declared unlawful under the law of Kenya at that time.
1992: Raila Odinga was involved in land clashes targeting Kisiis and Kalenjins that left 71
Kalenjins dead and 49 Kisiis, figures given by the Minister of state office of the President on
May 5, 1993. Over 100,000 persons were displaced as reported by the Kiliku report.
1992: Langata Violence: Media reports reveals that Raila instilled fear, used intimidation and
violence to be nominated as the Ford Kenya candidate and subsequent winner of Langata
parliamentary seat against his rival Kimani Rugendo. After the 1992 general elections over 50
Kenyans had lost lives in Langata constituency due to the violence sponsored by Raila Odinga.

1994: Raila Odinga in his quest to succeed his Father Jaramogi Oginga Odinga after his death
as the Ford-Kenya chairman lost the election on the chairmanship triggering a bloody violence
in Thika that left dozens of people injured.
1995: In Kibra constituency, Raila Odinga Luo supporters killed a Nubian youth and dumbed his
body at the Ford Kenya office in Kibera. For Four days violence erupted in Kibera against the
Nubians - majority landlord vs the Luos - majority tenants. The violence resulted to the killing of
7 people. These killings were influence by high level of political posturing between Raila Odinga
and former President Moi.
1997 general elections: Raila Odinga at the time was a Presidential candidate with National
Development Party (NDP) and violence broke out between the Luos and Kisiis in Migori leaving
scores dead. This was because the Kisiis and Kurias supported the reelection of former
President Daniel Moi of the ruling party Kenya Africa National Union and not Raila.
In 2000: Raila Odinga political supporters and majority Luos clashed again with the Kisiis
leaving 4 people dead and thousands displaced from their homes.
October 2001: Raila Odinga the then Langata Constituency Member of Parliament incited the
Luos who were majority tenants at Kibra to pay 50 per cent less of their monthly rent on houses
belonging to the Nubians the majority who are landlords. Violent demonstrations ensued for
three months, by December 2001, over 15 people were killed, over 100 rape cases were
reported and more than 3,000 people displaced.
2005 - 2007: Raila Odinga became very close with Maina Njenga the leader of the Militia group
known as Mungiki that has committed numerous atrocities in Kenya. Their friendship was deep
and when Njenga was jailed at Kamiti Maximum Security Prison before the elections, Raila
visited him and gave him two books, The 48 Laws of Power by Robert Greene and The Art of
War by Sun Tzu.
January 4, 2008: Raila Odinga quest to become president accused president Kibaki for rigging
elections and refused to accept the presidential results. He urged his supporters from ODM to
go to the streets for mass action which resulted to the post-election violence that claimed 1,333
lives and over 600, 000 people were displaced.
On February 28, 2014: Raila Odinga party Orange Democratic Movement (ODM) unsuccessful
conducted their national elections as violence broke out at Kasarani Gymnasium. The violence

is said to have been caused by hired goons known as men in black who were allegedly hired by
George Aladwa the ODM Nairobi County Chairman and close ally of Raila Odinga. Raila Odinga
was present at the time of the violence and all he did was sit down and watch the men in black
in action.
May July 2014-Saba Saba Rallies: Orange Democratic Movement (ODM) organized a home
coming rally for Raila Odinga. During the charged rally, Raila made demands for a national
dialogue with the government to address issues of IEBC reform, devolution, corruption and
insecurity. He warned that there are obvious signs that if the issues are not confronted then the
road to peace will be thorny and difficult.
After President Uhuru Kenyatta failed to heed the dialogue calls, Raila called for nationwide
political rallies. He urged the public to form grassroots groups ahead of the main Saba Saba
rally in July 7, 2014 which was meant to cause chaos.
June 15, 2014: at Tononoka grounds, Raila charged at the crowd and declared that he will not
relent on calling for public rallies. Coincidentally, on the night of Tononoka rally, terrorists
attacked Mpeketoni, Lamu County and killed 48 people. Majority of the victims were Kikuyu men
who were singled out by the gunmen.
October 2014: Raila Odinga abandoned his then ODM Executive Chairman Magerer Langat
and the ODM Deputy Director of communication Masene Machuka when the Cord Coalitions
Members of National County Assembly and some youths dragged them out of Cord
parliamentary group meeting at Orange house. They are alleged to be working against the
Partys interest (ODM) and publicly disparaging the party and its leadership led by Raila Odinga.
January 4, 2015: Railas son Fidel Odinga was found dead at his home in Karen. As the police
investigated the cause of his death, they unearthed a pistol, 3 fire arms, 1,900 bullets and bullet
proof vests in Fidels house.
October 21, 2015: George Aladwa, Railas aide and ODM Nairobi chairman told a Kibera rally,
As 2017 draws near, we as the ODM party have remained with one bullet. I have told party
leader Raila Amollo Odinga, this time round, if we win the 2017 elections and they are stolen,
wacha kiumane (it will be chaos). For Raila to be president people have to die. And there is
nothing wrong with that. He blatantly declared. After Aladwa was arrested for the hate speech
remarks, Raila defended him

April 2, 2016: Raila is alleged to have been behind the chaos that were witnessed at Masinde
Muliro grounds in Kakamega during the launch of Moses Wetangula Presidential bid. Youth
dressed in orange t-shirt allied to Orange Democratic Movement attacked other youths allied to
Ford Kenya a coalition partner.
May 23, 2016 IEBC Demos: The Anti-IEBC demos called by Raila Odinga resulted to 3 people
dying and 9 others shot and hospitalized. 11 police officers were also injured in Kisumu and
Siaya demos.
June 6, 2016 IEBC Demos- Raila Odinga continued to lead his CORD coalition supporters to
eject IEBC commissioners. However, the demonstrations continued to be violent resulting to the
death of 1 protester and 17 others getting injured including a 4 year old Jeremy Otieno who was
shot in the back. This notwithstanding, Railas supporters destroyed property in Kisumu Town
and Migori while other demonstrators opted to block the main bridge linking Kenya and
Tanzania paralyzing transport of goods between the two countries.
Also, 1 Public service vehicle (bus) was set on fire by Railas hooligan demonstrators while
others burnt tires, blocked roads and threw stones at vehicles causing damages worth millions
of shillings
III.

ANALYSIS FRAMEWORK OF THE CURRENT SITUATION IN KENYA THAT


REVEALS THE RISK OF GENOCIDE

1. Inter Ethnic tension is rising in Kenya as violent mass protest by Raila Odinga is inciting
violent action, reaction and retaliation by other ethnic communities.
2. The credibility of the police is being undermined and being rendered incapable of dealing
with the situation in a narrative where their management of the violent protests is being
cast as police brutality therefore having their public standing and institutional capacity to
deal with violence weakened.
3. The presence of illegal arms in the hands of protesters as evidenced by the cache of
arms discovered and the gunshot wounds police officers suffered during the violent
protests. The national government has also raised alarm on militias being trained in
neighbouring countries.
4. The underlying political narrative by Raila Odinga that is aimed at casting the political
and violent contest as one exclusively against the Kikuyu ethnic group.
5. The escalation of violence in certain regions and the targeting of property specifically
owned by the Kikuyu ethnic group in the protests. The retaliation Raila is facing from

some members of the Kikuyu ethnic group in Nairobi and the Rift Valley who are
mobilizing youth to heckle and disrupt his movements.
6. The killings already taking place, violent protests and destruction of property.
7. Intent to destroy the whole electoral system institutions to ensure Kenya gets to
constitutional electoral timelines without systems in place to conduct a free and fair
election in a highly charged ethnic environment.
8. The 2017 elections which is the trigger factor.
Based on that established history of violence as the preferred path to power for Raila Odinga as
opposed to democratic processes, the factors listed above increase the risk of genocide.
The Protect Kenya Movement is asking the United Nations Security Council President and the
United Nations Special Adviser on Genocide and the Responsibility to Protect to immediately
undertake the following to ensure that a mass atrocity and genocide is prevented in Kenya
1. Recognize the ongoing violent mass action by Raila Odinga is a threat to regional peace
and security and is a preparation towards a mass atrocity and genocide in Kenya
2. Organize high level investigations, briefings and hearings on the case presented here
specifically against Raila Odinga as the cause of the current violent chain of events.
3. To activate international protection mechanisms on behalf of the people of Kenya
against the Raila Odinga led threat to mass atrocity and genocide.
4. Raise Awareness within the United Nations System, International Community and civil
society to work collectively towards preventing Raila Odingas continuing violent
polarization of the country towards genocide as is currently underway.
5. Develop the capacity of the Kenyan state, which has the primary responsibility in
preventing genocide to deal with the situation using best practices.
6. Collect information on the developing situation in Kenya that if not prevented or halted
will lead to genocide.
7. Immediately provide advice to the UN Secretary General and the Security Council on
Kenyas situation through advisory notes and briefings.
8. Mobilize the UN system and other agencies taking into account the urgency of the
situation and conduct an advocacy and investigative mission to Kenya.
IV.

KENYA HAS NO OTHER AVAILABLE REMEDY

Any domestic remedies would be subject to violent retaliation by Raila Odinga, unreasonably
prolonged, subjected to local political intrigues and therefore completely ineffective. In this case
no effective domestic remedy is available. Any attempts to obtain justice as was the 2007-2008
indictments by the International Criminal Court were subject to Raila Odingas political
manipulation and thereby left him out of their indictments making him the biggest beneficiary of
the violence. Attempts to seek redress through the state would lead to accusations of bias and
further degrade the credibility of the state institutions should they take action. Kenya has no
other recourse but the United Nations systems.
V.

CONCLUSION

Kenya has for far too long been the victim of the Odinga violent political machine. Thousands
have died as a result and the spectre of a real mass atrocity and genocide looms large for
Kenya in 2017 if Raila Odinga is not stopped. The United nations systems should therefore
consider this petition and undertake a thorough investigation into the ongoing Raila Odinga led
political violence that is a threat to regional peace and security and presents a path towards a
mass atrocity and genocide.
