PETITION
Petitioner IMELDA TUMBAGA SALONGA, by herself and unto this
Honorable Court most respectfully alleges that:
1.

Petitioner is of legal age, single, Filipino and a resident of 1436

Kalimbas Street, Sta. Cruz, Manila, where she may be served with summons,
notices and other processes of this Honorable Court.
2.

Respondent VIRGILIO MANUEL FLORES, JR., is also of legal

age, married, Filipino and a resident of ___________ where he may be served


with summons, notices and other processes of this Honorable Court, while
respondent Civil Registrar of Manila, whose powers and duties, among others,
are the registration and recording of all live births, deaths, marriages, annulments
and such other entries pertinent to the civil status of an individual, may be served

with summons, notices and other court processes at the Office of the Local Civil
Registrar, City Hall of Manila.

Petitioner had a relationship with respondent Virgilio Manuel

Flores, Jr. Their relationship flourished and petitioner later became pregnant
without the benefit of marriage.

Thus, on 16 October 1993, petitioner gave birth to Victor Gil

Salonga. A copy of the Certificate of Live Birth of Victor Gil Salonga is attached
hereto and made an integral part hereof as Annex A.

It was petitioners mother who supplied all the pertinent

information in the aforesaid Certificate of Live Birth, and she made it appear that
petitioner got married to the childs biological father on 21 July 1991 in the City of
Manila. It was also petitioners mother who signed the Birth Certificate.

The truth, however, is that no marriage ever took place between

petitioner and the childs biological father. Copies of the Certificate of No


Marriage dated 1 March 2005 issued by the National Statistics Office (NSO),
Manila, and Certificate of No Record of Marriage dated 7 April 2005 issued by
the Local Civil Registry Office of Manila are attached hereto and made integral
parts hereof as Annex B and C, respectively.

Petitioners mother made such representation only to save her

grandson from embarrassment.

In order to avoid confusion as to the true and real identity of

petitioners son and to rectify these mistakes, petitioner files this instant petition
consistent with Rule 108 of the Revised Rules of Court.

PRAYER
WHEREFORE, premises considered, it is most respectfully prayed of this
Honorable Court that after due notice, publication and hearing, an order be
issued granting this Petition and directing the Local Civil Registrar of Manila to
cause the corrections in the Certificate of Live Birth of petitioners son, as follows:

1. To delete the surname FLORES as appearing in Entry No. 1 and to


replace it with SALONGA, the latter being petitioners surname.
2. To cancel the date and place of marriage of parents as appearing in
Entry No. 12
3. To indicate the true and correct status of the child

Other relief and remedies just and equitable under the premises are
likewise prayed for.

I, IMELDA TUMBAGA SALONGA, of legal age, under oath depose and
say that:
1. I am the petitioner in the above-entitled case;
2. I have caused the preparation of the foregoing Petition;
3. I have read and fully understood the contents thereof and affirm that the
factual statements therein made are true and correct to the best of my
own personal knowledge and belief.
4. I have not commenced any action involving the same parties and issues in
the Supreme Court, Court of Appeals or any tribunal.
5. To the best of my knowledge, there is no case involving the same parties
and issues pending before the Supreme Court, Court of Appeals or any
other tribunal. Should I learn of the pendency of such proceedings, I
undertake to inform this Honorable Court within five (5) days from such
knowledge.
