Doctrine:
1. Par. 1, Art. IV of RPC The wrongful act done be different from that which he
intended
2. The wrongful act done must be the direct, natural and logic consequence of
felonious act
Facts of the Case:
1. Ilustre was convicted for the death of Magsino
2. Three doctor comfirmed that an event aggravated the condition (Tuberculosis) of
Magsino, which led to his death.
Issue:
1. Whether or not Ilustres blow/punch caused the death of Magsino - YES
Held:
1. [T]hat it was caused by the defendant's blow on the deceased's right
hypochondrium, which bruised the liver and produced an internal hemorrhage.
2. And the circumstance that the defendant did not intend so grave an evil as the
death of the victim does not exempt him from criminal liability, since he
deliberately committed an act prohibited by law, but simply mitigates his guilt in
accordance with article 9, No. 3, of the Penal Code.
