Human Rights Law Examination (July 15, 2016) I. After the unsuccessful mutiny staged by Capt. Juan, he was immediately detained and charged with the crime of coup detat. Capt. Juan, together other junior officers, were detained in the ISAFP Detention Center. During his custody, Capt. Juan wrote letters to his counsel and family. The custodian officer reads the letter before being mailed or given to the recipients. Capt. Juan now questions the validity of the act of opening his letter, on the ground that it violated his right to privacy. Decide. II. The Commission on Elections issued a resolution prohibiting the posting of decals and stickers except on posting areas authorized by the Comelec. Is the resolution valid? III. Human United and Build Operators Inc. (HUBO Inc.) is a corporation established for selling magazines, video tapes and motion pictures. However, they were charged with selling magazines and video tapes which were deemed pornographic. HUBO Inc. argues that selling pornographic videos and magazine cannot be infringe on the ground of obscenity because they were selling it to adults ages 30 and above. Decide. IV. Father Vidal, a priest, was elected municipal mayor. The losing candidate filed a quo warranto case against him on the ground that being an ecclesiastic, he is disqualified under Sec. 2175 of the Revised Administrative Code to be elected to a municipal office. May Father Vidal be disqualified? V. The National Historical Institute declared the parcel of land owned by petitioners as a national historical landmark, because it was the site of the birth of Felix Manalo, the founder of Iglesia ni Cristo. The government filed an action to expropriate the land. Petitioners argued that the expropriation of the land would amount to the application of public funds for the benefit of the Iglesia ni Cristo.
