Introduction- In today's times, many entrepreneurs are confronted with situations of an automated aspect of their business and whether it can be operational on Shabbos: a. A website that has a commercial element to it. b. An ATM machine. c. An ebay auction that ends on Shabbos. II. Halachic Discussion a. Is this similar to a Shabbos clock in that as long as nobody is performing any specific action on Shabbos it is not a problem? {} i. R. Akiva Eger- You can't set up a transaction before Shabbos that will go into effect on Shabbos. {} ii. R. Shlomo Zalman Pradkin- There is no difference between a transaction and any other form of automation. {} iii. This discussion seems to be rooted in the sugya of whether one can perform a pidyon haben on Shabbos. 1. Rivash-three reason why you can't perform a pidyon haben on Shabbos. {} a. It is similar to a transaction. b. It is similar to paying off a debt on Shabbos. c. The money is muktzeh. 2. Terumas HaDeshen {}- What about setting up the pidyon haben before Shabbos and have it go into effect on Shabbos? There are two problems with this: a. When would you recite the berachos? b. When would you make the seudah? 3. Terumas HaDeshen's ruling seems clear that the transaction itself is not a problem and that one can set up a transaction before Shabbos that will be completed on Shabbos. The only problem with doing this for a pidyon haben is that there is a question when to recite the berachos or eat the seudah. 4. R. Moshe Feinstein- Terumas HaDeshen's ruling does not prove that one can set up a transaction before Shabbos that will come to fruition on Shabbos. {} a. What is the main reason why you can't perform the pidyon haben on Shabbos itself? i. Shach follows the first reason of Rivash that the problem is that it is similar to a transaction. {} ii. Magen Avraham follows the second reason that it is because of paying off a loan on Shabbos. {} b. Analysis of the two reasons: i. Rashi states that there are two concerns with transactions on Shabbos: {} 1. It is a violation of Mimtzo Cheftzecha- the prohibition of dealing in business activities on Shabbos 2. There is a gezeirah that one may write something down ii. Accordingly, pidyon haben should not present a problem of paying off a loan on Shabbos 1. There is nothing to write down or erase 2. The prohibition of mimtzo cheftzecha does not apply to a d'var mitzvah {}. iii. This is why the Terumas HaDeshen himself sees the main problem with performing a pidyon haben on Shabbos as a problem that it is similar to a transaction. iv. Nevertheless, pidyon haben is not an actual transaction, rather it is meant to look like a transaction. Therefore, if you set it up in advance, there is no problem from the perspective of transactions on Shabbos. v. If pidyon haben were an actual transaction, it would be a problem, even if you set it before Shabbos. 5. Kesav Sofer also shows that there is no proof from Terumas HaDeshen (Kesav Sofer is R. Akiva Eger's grandson). {} a. There is a machlokes between Rashi and Rabbeinu Tam whether transactions are permissible for the purpose of fulfilling a mitzvah that otherwise could not be fulfilled. {} i. According to Rabbeinu Tam, there is certainly no problem to perform a pidyon haben on Shabbos ii. According to Rashi you cannot perform a pidyon haben on Shabbos 1. The problem is that it may lead to writing 2. There is no problem of mimtzo cheftzecha b/c for a d'var mitzvah there is no mimtzo cheftzecha iii. Terumas HaDeshen is following Rashi's opinion 1. The only problem vis-à-vis the transaction is to perform the pidyon haben on Shabbos 2. If you perform it on Friday, there is no concern that you are not going to write anything down on Shabbos b/c the activity itself took place on Friday iv. The problem with setting up a transaction that will come to fruition on Shabbos is mimtzo cheftzecha. This is not a problem if it's a d'var mitzvah but it is a problem if it's a regular transaction. 6. R. Tzvi P. Frank offers a different resolution {} a. He posits that if one sets up a transaction on Friday that goes into effect on Shabbos, the only violation is on the buyer because the seller's main participation is in the actual transaction and the seller's is in the result. b. Regarding transactions where there is no real buyer, there is no problem to set up such a transaction. c. Therefore, regarding pidyon haben, where there is no real buyer, it is permissible to set up a transaction before Shabbos that will go into effect on Shabbos. However, an ordinary transaction is a problem because the buyer violates the prohibition of transacting on Shabbos. d. It would seem that according to R. Frank, if the buyer is not Jewish and has no prohibition of transacting on Shabbos, it would be permissible to set up a transaction that comes to fruition on Shabbos. b. Summary i. The issue of setting up a transaction that will come to fruition on Shabbos seems to be a dispute. between Terumas HaDeshen and R. Akiva Eger ii. R. Moshe Feinstein, Kesav Sofer and R. Tzvi P. Frank show that there is no dispute and both agree that it is prohibited. iii. According to R. Frank, it would be permissible to set up such a transaction if the buyer is not Jewish. According to R. Feinstein and Kesav Sofer it would be prohibited. iv. R. Pradkin maintains that it is permissible. v. According to R. Akiva Eger, one must still ask: what is the difference between a transaction which is prohibited and a timer to perform melacha which is permissible? 1. Avnei Nezer- When a transaction comes to fruition on Shabbos, the individual involved in the transaction is part of the transaction. When a melacha occurs by itself on Shabbos, the individual who set it up is removed from the melacha. {} a. He illustrates this with the hypothetical case of someone who set up a transaction and died before the transaction came to fruition. In that case, the transaction would be null and void. If a person set up a timer to perform melacha on Shabbos and then died, the melacha will still happen. 2. R. Hershel Schachter- There are certain rabbinic violations which you can violate passively. This is one of those violations. The concern is that you may write something down even if no action was taken on Shabbos to encourage that action. {} III. Practical Applications a. Vending Machines i. Non-electric vending machines became popular in the later 19th century. A few decades later, we find responsa literature about whether it is permissible to own a machine that will be operable on Shabbos ii. Ostensibly, this question should be contingent on the dispute between R. Akiva Eger and R. Pradkin. According to R. Akiva Eger you cannot be passively involved in a transaction on Shabbos. According to R. Pradkin you can. 1. R. Shimon Greenwald- even R. Akiva Eger will agree that it is permissible to own a vending machine. He only prohibited a transaction that you set up to come to fruition on Shabbos. If you have no awareness that the transaction is taking place it is not prohibited. {} 2. R. Naftali Bombach- Even those who disagree will prohibit owning a vending machine. They only permitted setting up the transaction before Shabbos to come to fruition automatically on Shabbos. With a vending machine, the entire transaction takes place on Shabbos. {} 3. R. Ya'akov Breisch- The main leniency for permitting owning a vending machine is that the non-Jew has the option to buy the merchandise whenever he wants. If he buys it all before Shabbos or after Shabbos it makes no difference to the owner. {} a. As such, it depends on what type of vending machine is being used. If the machine is selling or servicing something finite and the machine will not be replenished on Shabbos it is not a problem. [Some examples include a soda machine or an ATM machine.] If the machine is selling a service and is available 24/7 no matter how much use there is, the Jew benefits from the increased volume on Shabbos. [Some examples include a video game machine or an internet kiosk.] 4. As a matter of practical Halacha, many poskim follow the opinion of R. Greenwald: a. Minchas Yitzchak- The machine should not be on Jewish property and the owner should specify that he does not want to acquire the money until after Shabbos. {} b. Shemiras Shabbos Kehilchasa 29:28, also accepts R. Greenwald's position if the machine is in a place where majority of the buyers will be non-Jewish. i. Cites R. Shlomo Zalman Auerbach that there is no problem of s'char Shabbos because the money goes for payment of the merchandise. {} b. E-Commerce i. Owning a website that sells merchandise 1. If one is lenient regarding vending machines, the same leniencies should apply here. 2. There are further leniencies for websites. a. The vendor has the option to choose when he wants to charge the customer's credit card. If the vendor places a hold on the money without authorizing the charge, there is no sale on Shabbos. b. If the website is selling merchandise (as opposed to services), the buyer is not buying a specific item. Rather he is placing a hold on one of the items in the inventory. There certainly is no sale on Shabbos. c. In most cases, the credit card company will not actually deduct until business hours. This will help for Shabbos, but not Yom Tov. i. Note- If you have a Paypal account with a Paypal debit card, the funds will be available to the debit card immediately upon authorization from the buyer. The most problematic situation with e-commerce is when you are selling services (e.g. software or customer support) and the method of payment is Paypal. Even in this scenario, it is no worse than the case of the vending machine. ii. EBay bids that end on Shabbos 1. Background information- When you bid on an item, EBay will display the minimum necessary to win the auction and then increase it as necessary. For example if you bid $10 on an item and the highest bid is currently $4, EBay will place your bid at $4.05. If someone bids $5, EBay will up your bid automatically to $5.05. This will inevitably happen on Shabbos. 2. Maharam Schick discusses a case of an auction whose rules are exactly the same as EBay's and is lenient to place the bid before on Shabbos even though the auction is finalized on Shabbos. He permits it on the basis that the final bid is already submitted before Shabbos and the fact that the final number is revealed on Shabbos is insignificant. {} iii. Automated Stock Transactions 1. NYSE- Still uses actual brokers. Even if you use an online service, there is a broker who executes the trade. a. R. Moshe Feinstein- If an order is filled on Yom Tov (the market is closed on Shabbos) it is a violation of Amira L'Akum. {} 2. If one can trade in a totally automated fashion a. Selling would be similar to a vending machine (i.e. you list the price that want to sell it for and the buyers buys it from you) b. Buying would be much more of a question i. There is no precedent to allow a purchase on Shabbos without your knowledge. ii. According to R. איסור שבות דמו"מ ,אלא דמ"מ חילוק יש בדבר, .9שבת קיג. דהיכא דכל הקנין מתחלה ועד סוף נעשה ונגמר ממצוא חפצך חפציך אסורין חפצי שמים מותרין. בשבת ,בכה"ג יש איסור שבות על המקנה ועל הקונה שניהם שקולים הם לעבור על שבות זה, אגרות משה או"ח ג:מד .10 משא"כ כשהקנין נעשה בע"ש ע"מ שיחול בשבת, יש לדון דאין איסור שבות אלא על הקונה דלגבי המקנה לא יגרע מכל מלאכה דאורייתא שמותר לעשותה מע"ש אע"פ שהמלאכה הולכת ונגמרת ביום השבת ,דעיקר איסורא של המקנה הוא מעשה הקנין והמעשה נעשה בחול ,אבל איסור שבות של הקונה הוא עצם הזכיה והקנין ,ולכן אף כשהקנין נעשה בחול מכל מקום איסורו במקומו עומד ,שהרי כל זכייתו וקניינו הוא בשבת .ולפ"ז נאמר ,דגם אלה האוסרים להקנות בע"ש ע"מ שיחול הקנין בשבת לא אמרו אלא משום דהקונה עביד איסורא בזכייתו ביום השבת ,ונמצא דלא אסרו אלא במו"מ ובמתנה ובקדושין ,משא"כ בהקדש ובהפרשת תרו"מ ,נהי דהושוו בשבות כתב סופר או"ח ס' מו .11 דמו"מ ,ז"א אלא במקדיש ובמפריש תרומה ביום השבת עצמו ,אבל במקדיש ובמפריש תרו"מ מע"ש שיחול בשבת דלא יצויר בכה"ג איסור שבות מצד הזוכה ,אין כאן איסור כלל דמצד המקדיש ל"ש איסור שבות שהוא עשה וגמר כל מעשה ההקדש שמצדו בע"ש וממילא הוא דחל בשבת.
