PER CURIAM:
Ortez Antoine Propst seeks to appeal the district courts
order accepting a magistrate judges recommendation to deny relief
on his motion filed under 28 U.S.C. 2255 (2000), and a subsequent
order denying his Fed. R. Civ. P. 59(e) motion.
Because Propsts
An appellate court
is left with the definite and firm conviction that a mistake has
been committed.
Pursuant to Fed.
Darby also
stated that special mail procedures for legal mail were in effect
when Propst mailed his notice.

court did not clearly err in finding that Propsts notice of appeal
was untimely.
Propsts failure to note a timely appeal or to obtain
either an extension or a reopening of the appeal period leaves this
court without jurisdiction to consider the merits of Propsts
appeal.
