THIS DEED OF PARTITION, executed at Chennai on this the

hereinafter called the PARTY OF THE THIRD PART.

The terms PARTY OF THE FIRST PART, PARTY OF THE

SECOND PART AND PARTY OF THE THIRD PART wherever


context, admit, shall mean and include their respective heirs,
executors, administrators, legal representatives, assigns, etc.,
WHEREAS the property being vacant house site bearing
Door No.22/1, Thillai Ganga Nagar, 12 th Street, Nanganallur,
Chennai-600 061, comprised in Survey No.13/6B, No.124,
Pazhavanthangal Village, Alandur Taluk, Kancheepuram District,
admeasuring 2450 Sq.ft. or thereabouts, the property morefully
described in the Schedule A hereunder, was purchased by
Smt.T.Savithri Ammal (mother for the Parties of the First Part,
Second Part and Third Part), by a Deed of Sale dated 30.08.1978,
registered as Document No.1356 of 1978 of Book I, at the Office
of the Sub-Registrar Alandur from P.V.Sridharan;
AND WHEREAS the said Mrs.T.Savithri Ammal was in
absolute possession and enjoyment of the Schedule A mentioned
property ever since the date of her purchase;
AND WHEREAS the aforesaid Mrs.T.Savithri Ammal died
intestate on leaving behind :i)

as her legal heirs to succeed to the Schedule A mentioned


property and on the death of the said Late Mrs.T.Savithri Ammal.
The above said R. Thiyagarajan, who was the husband of Mrs.
T.Savthri Ammal passed away on.. the property
described in the Schedule A hereunder devolved on the Party of
the First Part, Party of the Second Part and Party of the Third
Part equally;
AND WHEREAS the Parties herein are absolute possession
and enjoyment of the property described in the Schedule A
hereunder as co-owners;

AND WHEREAS that the difficulties have arisen between the


Parties herein in enjoying the above said property in the Schedule
A hereunder as co-owners therefore the Parties herein have
decided to separate themselves and had discussions among
themselves and the Parties mutually agreed between themselves
that the property described in the Schedule A hereunder be
partitioned and the Parties herein have divided the Schedule A
property into 3 lots and a common passage to ingress and egress

to the Plots allotted to the Parties herein and each lots have been
described as Schedule-B, Schedule-C and Schedule-D hereunder
and the property described in the Schedule B hereunder shall
be allotted to the Party of the First Part and the property
described in the Schedule C hereunder shall be allotted to the
Party of the Second Part and the property described in the
Schedule D hereunder shall be allotted to the Party of the Third
Part.
NOW THIS
FOLLOWS :-

WITNESSETH

AS

That in pursuance of the aforesaid agreement,


1)

That the property described in the Schedule B hereunder,


has been allotted absolutely to the Party of the First Part
and the Party of the First Part has become the absolute
owner of the property described in the Schedule B
hereunder and the Party of the First Part shall hold and
enjoy the property described in the Schedule B hereunder,
allotted to him with full rights to sell, gift away and
otherwise alienate the same.

2)

That the property described in the Schedule C hereunder,


has been allotted absolutely to the Party of the Second
Part and the Party of the Second Part has become the

absolute owner of the property described in the Schedule C


hereunder and the Party of the Second Part shall hold and
enjoy the property described in the Schedule C hereunder,
allotted to him with full rights to sell, gift away and
otherwise alienate the same.
3)

That the property described in the Schedule D hereunder,


has been allotted absolutely to the Party of the Third Part
and the Party of the Third Part has become the absolute
owner of the property described in the Schedule D
hereunder and the Party of the Third Part shall hold and
enjoy the property described in the Schedule D hereunder,
allotted to him with full rights to sell, gift away and
otherwise alienate the same.

Each of the Parties herein releases, has no manner of right


and interest in the property allotted to others so much so
that each of the parties hereto is the sole and absolute
owner in his / her right of the properties allotted to him /
her in the relevant schedules.

That the Parties herein hereby declare that the division of


the property described in the Schedule A hereunder, have
been effected with mutual consent and without any coercion
and further covenant that the Partition hereby effected shall
be final and irrevocable.

That the Parties herein have agreed that this Partition shall
not be open to challenge even if any party is deprived off any
property or Part thereof by a stranger to this Deed.

7)

That the Parties herein have also agreed that this Partition
shall not be open to challenge as to the value or extent or
quality of the property.

8)

The Parties herein shall have no right to put up any


construction in the common passage and the Parties herein
shall have no right to put any goods obstructing the
common passage.

9)

That the Original Partition Deed has been handed over to


the Party of the First Part. Two duplicates of the deed is
also registered along with the original and the party of
second part and third part shall keep the same
respectively. The First Part, has agreed to allow inspection
of the Original by the Parties of the other Parts and he has
also agreed to produce the original before the Banking
Authorities, Public Sector Undertakings, or before any
Courts or Insurance Company, etc. if so desired by the
Parties herein.

It has been further agreed that each Parties shall execute

any further deed or deeds, and do everything necessary


including the appearance in a Court of Law for a more
effective implementation of this Deed if necessary and for
the perfection of each Parties share under this Deed.
11)

Each Parties shall pay the Land Revenue and other Taxes
payable to the Local bodies for their respective shares today
onwards. The Parties herein have taken possession of the
properties allotted to them.
