No. 01-6220
Appeal from the United States District Court for the Western District of Virginia, at Roanoke.
James C. Turk, District Judge.
(CR-97-30041, CA-00-606-7)
Submitted:
Decided:
June 8, 2001
PER CURIAM:
Richard Parrish appeals the district courts order denying his
motion filed under 28 U.S.C.A. 2255 (West Supp. 2000), and a subsequent order denying his motion for a certificate of appealability.
on his 2255 motion, we dismiss the appeal for lack of jurisdiction because Parrishs notice of appeal was not timely filed.
In
Browder v.
Director, Dept of Corr., 434 U.S. 257, 264 (1978) (quoting United
States v. Robinson, 361 U.S. 220, 229 (1960)). The district courts
order was entered on the docket on August 3, 2000. Parrishs notice
of appeal was filed on January 18, 2001.*
Accordingly,
We dis-
pense with oral argument because the facts and legal contentions
are adequately presented in the materials before the court and
argument would not aid the decisional process.
