SIR: we discussed rules of proceedings right? So what is the provision on rules of proceedings.
Sec. 16 [c]- each house may determine the rules of its proceedings, punish its members for
disorderly behavior and with the concurrence of the of all its members, suspend or expel a
member. A penalty of suspension, when imposed shall not exceed 60 days.
Sec 21. The senate or the house of representatives or any of its respective committees may
conduct inquiries, in aid of legislation in accordance of its duly published rules of procedure. The
rights of persons appearing in, or affected by, such inquiries shall be respected.
So what happened in the case of Pimentel?
STUDENT: in the case of pimentel. There was a privilege speech delivered by sen. Panfilo
lacson, in his speech he alleged that there was alleged corruption by senator villar about the
200 million budget appropriated for the construction of the c5 road. In his speech sen. Lacson,
that is was villar.

STUDENT: senator panfilo lacson alleged that sen. Villar used his influence to cause the
realignment of the C5 road to ensure his properties in this certain places will be financially
benefited in the construction of the new road. So, it was said that senate president was in direct
violation of the constitution and the anti-graft and corruption act and the code of conduct and
ethical standards of public officer. So, the committee on ethics was created and the case of
prosecuting senator villar was then investigated by this committee. However, senator villar
refused and said that he will not answer the accusations asked before him by the ethics
committee. It was also alleged that senator villar that this is a violation of his right to due
process and of the majority or *not audible* under Art.6 sec 16.
SIR: QUESTION, if you look at the constitution, it is as if the house of congress know the rules.
Right? What are the requisites for this rules to be in order? The question is when can the
supreme court look into or declare invalid the rules of proceedings initiated by the house of
congress. So long as the rules observe the requirements of quorum, voting and publication
when required. These are the limitations set upon the congress to set its own rules.

SIR: when is it a joint session? Joint session means under one room. For example, SONA. naa
didto si de lima, si pimentel, si alvarez...that is a joint session. You are under one room, one hall.
That is the idea of joint session. The two houses can vote separately. There is only one session
where the two houses can vote jointly--we will explain that later.
