JUDICIAL AFFIDAVIT
PRELIMINARY STATEMENT
The person examining me is Atty. ZMM with address at no. 2 Zerudo Complex, E lopez, St.
Iloilo City. The examination is being held at the same address. I am answering his questions
voluntarily, to the best of my knowledge and fully conscious that I do so under oath and may
face criminal liability for false testimony and perjury.
PURPOSE
This affidavit/testimony of accused is being offered to prove the existence of sufficient
provocation on his part.

Aglalana,Passi City, Iloilo. (I, RICARDO REYES, 40 years old, single and with
residence at Brgy. Aglalana,Passi City, Iloilo.)

Kilala mo bala ang biktima? (Do you know the victim?)
Huo. Si Eduardo Dela Cruz . (Yes. He is Eduardo Dela Cruz)

Paano mo nakilala ang biktima? (How do you know the victim? )

Upod ko siya ga ubra sa construction. (He is my co-worker in construction work.)

Q.
Ano ang posesyon ka biktima sa construction? (What is the position of the victim in the
construction work?)
Foreman siya namon. (He is our foreman.)

Ikaw ya ano imo ubra sa construction? (How about you (the accused) what is your job in
the construction?)
Ako naga bulig sa foreman kung ano man e sugo ya. (I am assisting the foreman
to whatever task he will give me.)

Kilala mo si engineer Paguntalan? (Do you know engineer Paguntalan?)

. Huo, siya na ang engineer nga na assign to sa amon nga construction. ( Yes,
he is the engineer assigned to the said construction.)
Sa diin ikaw sang February 28, 2016? (Where are you last February 28, 2016?)

Ara ako sa payag payag namon nga ginatulugan dira man sa sulod sang
construction site. (I am in the temporary shelter built inside our construction site.)

Pagkatapos sang ubra niyo, ano permi niyo nga ginaubra da sa payag payag? (After your
work, what do you usually do inside that temporary shelter?)
Pagkatapos sang ubra namon kag pang pa kuha kapoy, ga inom inom kami eh.
(After our work in the construction and to unwind ourselves, we usually had a
drinking spree in our temporary shelter.)

Ano oras kamo nag umpisa inom? (What time did you start drinking?)

Ang usual time gid ya namon mag inom mga alas 7 sa gab-I pero sang amo na
nga tyempo mga 8 pm na kami nag umpisa. (We usually start it at 7pm but at that
time we start drinking at 8pm.)

Sang naga inom-inom na kamu, pwedi mo bala ma estorya kung ano ang inyo nga gina
estoryahan? (When you are having the drinking spree, can you narrate to me the conversations
that you had?)

Sang dawsxxn snhhn sirom na kag nagadugay ang amon nga pag inom, inom,
Gin pamangkot ko ang biktima kung ngaa permi lang ga reklamo si engineer
Paguntalan sa akon kag ga hambal sang mga tinaga nga indi maayo. Kag hambal
ni engineer hambal sang biktima di ko kuno kabalo mag ubra kag indi ko bagay
diri sa construction. (As the night and drinking spree go on, I confronted the
victim why is engineer Paguntalan always saying negative comments to my
work. And engineer said that victim said to him that I am not capable of working
as a construction worker.)
Kag amo ni ang dalagan ka estorya namon. (And the conversation goes like this;)

Accused- Ano to ang ginhambal mo kay engineer nga indi ko kabalo mag ubra kag di ko bagay
mag ubra diri? (What did you tell engineer about me that I am not capable of working here?)
Victim Huo, di ka gid man kabalo ya. Bisan mag asintada ka hollow blocks, di pa mayo pang
ubra mo. (Yes, you are not capable, even just piling hollow blocks, you are not good at it.)
Accused- Syempre kabalo ko, anom na ka tuig nga muni lang ubra ko (Of course I am
capable, this is my job for six years already.)
Victim anom na ka tuig ubra mo tapos daw ubra ka bag ohanon pang ubra mo. Yots tinikal na
imo ya (You have been working for 6 years and then still your work is not good enough as if
you are just working as a beginner. Yots, you are just boasting yourself!)
Accused di moko kilala ya, bisan foreman ka imo ya, mas damo nabal an ko kisa simo eh. Bal
an ko man nga ginapakalain mo lang ko kay engineer kay para mapahalin kodi sa ubra kag may
gusto Kaman nga migo mo nga pasudlon di mo. Te kay tungod wala sing bakante, gusto mo isa
sa amon mapa halin di. (You dont know me, even you are a foreman, I have known a lot of
things compared to you. I can just imagine that you are only poisoning the mind of our engineer
for me to be stricken out in this job because you have a friend who wants to work here too.
Since, there is no vacancy you want one of us to be stricken out from this job.
Victim- hoy gago, obra-obra ka naman estorya da nga di man tuod. Wala koya sing migo nga e
pasudlon di ah. Kag wala koya gapakalain simo kay engineer ah. Kag sa tuod lang nakita ya imo
ubra kag wala gid sa na namian. (hoy gago.. You are just making stories that are not true. I dont
have a friend to recommend here. And I am not poisoning the mind of our engineer. In fact, he
saw your work and he is not satisfied with it.)

ACCUSED- YOK! Di ko bala pag tawga gago kay di koya gago mo. (YOK! Just dont call me
gago because I am not gago. )
Tapos nabatian ko ang biktima nga ga hambal sing hinay nga di ka gid man gago pero subra
kappa sa mango. ( Then I heard Victim whispering that you are not gago but you are more than
an idiot)
Q. Tapos pag kabati mo, ano gin ubra mo? (Then when you heard that what did you do?)
Wala kolang ginsapak tapos la lang dugay nag gwa ko para mangihi. (.I just
didnt mind it. After a while, I left them because I need to urinate.)
Q. Tapos pagbalik mo ano natabo? (Then what happened when you came back?)

Sang Pagbalik ko, nagpungko ko sa tupad sang biktima tapos ang biktima
ginkuha niya ang kutsilyo kag ginbuno sa akon pero nakalikaw ko ano pa ang
wala ko nga baga amo ang nakibyasan. Nag agaway kami sang kutsilyo kag sa
subra namon ka pag agaway nabuno ko sa sa liog. Sa sobra ko nga kakulba sa gin
obra ko, te nalagyo koya eh. (When I came back and sat beside the victim, he
,victim, raised the knife and strike me. I tried to escape the strike but it did hit
my left shoulder. We struggled with that knife and in the course of it, I
accidentally plunged that knife on his neck. In great fear to what Ive done, I ran
away leaving the said victim.

Affiant further sayeth naught.
