INSPECTION NOTES
Met with representatives of this employer to discuss the work processes taking place in the Evergreen Tunnel. The work
requirements in the Tunnel, no longer fall under Part 22: Underground Workings of the OH&S Regulation, and has been identified
as a Confined Space.
We discussed the scope of work including what has taken place so for. The rock crush fill work and structural supporting slab for
the track is complete.
Requested & received copies of some of the documentation in place for the tunnel. This included copies of an "Hazard
Assessment" , " Tunnel Air Testing Log" and " Site Inspection Report". Some photos of the North & South Portal and some of the
work process was also received.

INSPECTION NOTES
This inspection report is based on a site inspection of the Evergreen Line Tunnel construction project by WorkSafeBC
Occupational Safety Officer Mark Valastin and Occupational Hygiene Officer Chad Born on March 7, 2016, to determine employer
compliance with the Workers Compensation Act (WCA) and the Occupational Health and Safety Regulations (OHSR).
During this inspection we focused on confined space requirements such as:
Identification
Training
Air quality testing
Calibration of air quality monitoring equipment
Posting of air quality results
Ventilation and flow rates (generally found to be 2,000 cubic meters per hour or higher)
Standby
Rescue
The above topics appeared to be in place at the time of this inspection.
This space was determined to be a "low hazard atmosphere" confined space.
We talked about the requirement to investigate worker exposures to hazards such as silica dust. The employer reported sampling
for respirable silica. The results were significantly below the allowable level (even considering 12 hour work shifts). These results
are available for all workers to review.
We discussed potential exposure to diesel exhaust components which may not be monitored for and / or entirely scrubbed out
(such as: sulfur dioxide, PAHs, nitric oxide, carbon dioxide, and many other minor components). The employer explained that
when they have complaints about air quality they investigate.
The employer reports that, as a last line of defense, (if substitution, engineering and administration can not satisfactorily minimize
the exposures) they have respirators for all workers and can provide a variety of respirators / cartridges for different tasks.
No orders were issued.

INSPECTION NOTES
Responded to an industrial accident at the Coquitlam Sub-station located near the south portal of the Evergreen Rapid Transit
Line. An apprentice electrician made contact inside the energized MCC unit causing an arc flash. The main bus bar capacity was

1600 amps and the voltage was 600/347 VAC - 60 Hz. The worker

At the time of this inspection, the reason the injured worker opened and entered the closed panel was unknown. Discussed the
need to do a thorough accident investigation to identify any unsafe acts, conditions, or procedures which contributed in any
manner to the incident, and to ensure corrective actions are implemented to prevent similar incidents.
An employers preliminary investigation report of the section 173 incident must contain
the following elements, as far as possible:
(a) the place, date and time of the incident;
(b) the names and job titles of persons injured in the incident;
(c) the names and job titles of witnesses;
(d) the names and job titles of any other persons whose presence might be
necessary for a proper investigation of the incident;
(e) a statement of the sequence of events that preceded the incident;
(f) identification of any unsafe conditions, acts or procedures that significantly
contributed to the incident;
(g) a brief description of the incident;
(h) the names and job titles of the persons who conducted the preliminary
investigation of the incident;
(i) interim corrective actions the employer has determined to prevent the
recurrence of similar incidents, for the interim period between the
occurrence of the incident and the submission of the full investigation report;
(j) information about what interim corrective action has been taken and when
any corrective actions not yet implemented will be taken; and
(k) the circumstances of the accident or incident that preclude the employer
from addressing a particular element of the above-listed elements during the
preliminary investigation period.
Implementing Corrective Action
While an employer is undertaking the full investigation report due to WorkSafeBC under
section 176 (see Policy D10-176-1), the employer must also take the corrective action it
had determined was necessary to prevent a recurrence of similar section 173 incidents
during the full investigation period. This interim corrective action must remain in place
until the employer has:
(a) undertaken any further corrective action identified in the full investigation as
necessary to prevent the recurrence of similar incidents following the full
investigation; or
(b) determined that the interim corrective action is sufficient to prevent the
recurrence of similar incidents following the full investigation.
The employer may modify the interim corrective action during the full investigation
period, if it determines that the modified interim corrective action is more effective or as
effective as the interim corrective action originally undertaken.

taken as a result of the findings of the investigation and any orders in this report.
Responded to an industrial accident in the bored tunnel on the Evergreen Line Project. The location of the incident was at Tunnel
Ring 550. A chain fall hoist fell approximately 10 feet from a scissor-lift, striking & injuring a worker. The worker was transported

out of the tunnel,

Discussed the need to do a thorough accident investigation to identify any unsafe acts, conditions, or procedures which
contributed in any manner to the incident, and to ensure corrective actions are implemented to prevent similar incidents.
Implementing Corrective Action
While an employer is undertaking the full investigation report due to WorkSafeBC under
section 176 (see Policy D10-176-1), the employer must also take the corrective action it
had determined was necessary to prevent a recurrence of similar section 173 incidents
during the full investigation period. This interim corrective action must remain in place
until the employer has:
(a) undertaken any further corrective action identified in the full investigation as
necessary to prevent the recurrence of similar incidents following the full
investigation; or
(b) determined that the interim corrective action is sufficient to prevent the
recurrence of similar incidents following the full investigation.
The employer may modify the interim corrective action during the full investigation
period, if it determines that the modified interim corrective action is more effective or as
effective as the interim corrective action originally undertaken.

OHO Robin Van Driel & myself conducted a partial inspection of the north portal of the tunnel.
The main focus of the inspection was the Confined Space procedures put in place for the tunnel. With the center wall just
completed, the employer must ensure that the hazard assessment is still relevant and all the component of Part 9 : Confined
Spaces of the OH&S Regulation are being implemented.
OHO Van Driel will be issuing a separate Inspection Report.
Discussed some rigging issues, previous incidents on site and upcoming work on the project.

If this report has been issued following an incident that is under investigation by WorkSafeBC, further enforcement action may be
taken as a result of the findings of the investigation and any orders in this report.
This inspection was Initiated by WorkSafeBC Occupational Hygiene Officer, Robin Van Driel, at this jobsite on May 3, 2016 to
determine compliance with the Workers Compensation Act (WCA) and the Occupational Health & Safety Regulations (OHSR).
The focus of this inspection was on confined space entry into the two (2) Km tunnel of the Evergreen Line.
The following documents were reviewed while on site:
1. Tunnel Air Testing Logs, May 3 2016 and various dates
2. Tunnel Hazard Assessment - Tunnel Center Wall, Feb 25 2015 (possible typo 2016?)
3. We The Safe - Exposure Monitoring Report - Respirable Crystaline Silica
4. Tunnel Entry Program, Oct 27 2015
5. SDS for Hilti HIT HY 200A/200R
Items discussed while on site during inspection included but was not limited to the following topics:
CONFINED SPACE IDENTIFICATION:
The TBM was removed from the tunnel in December leaving a 2 Km tunnel approximately 9 meters in diameter in its final
structural condition. This employer in consultation with a qualified person classified the space as a confined space regulated under
Part 9 of the Occupational Health and Safety Regulation (OHSR). During finishing construction work the creation of a
floor-to-ceiling concrete wall was built splitting the tunnel in half with 8 passage doors along the 2 Km stretch. This "Tunnel Center
Wall" was completed in April 2016. Phase two of the remaining tunnel finishing construction work is within both sides of the
tunnel, inbound and outbound separated by the center wall. During discussions and review of Tunnel Air Testing Logs it did not
appear that the creation of two confined spaces had been recognized or identified. This was discussed in detail, since both space
environments are separate both are in need of monitoring.
This is evidenced by the lack of duplicate air testing records and air flow readings being recorded on the Tunnel Air Testing Log or
the presence of two Tunnel Air Testing Logs; one for each space inbound and outbound tunnels. Employers are required to identify
all confined spaces at the workplace as per OHSR 9.2 (See Regulations Referenced).
HAZARD ASSESSMENT
A qualified person must prepare a hazard assessment for each confined space (or group of similar spaces) and for the work
activities to be performed. The hazard assessment must consider conditions that may exist in the confined space (before workers
enter) due to the design, location, and use of the confined space. The assessment must also consider the hazards that may
develop during work activity in and around the confined space.
The qualified person will prepare a hazard assessment and develop written procedures to eliminate or minimize all the hazards
likely to prevail. Based on this assessment, the qualified person will rate the confined space as a low-, moderate-, or high-hazard
atmosphere space. The employer must know the hazard rating because it affects the control measures selected, including level of
standby services, entry permit requirements, and rescue.
During this inspection I reviewed two hazard assessments. It appears from the documents that I was provided that this employer
has created various hazard assessments for each type of work activity that may take place inside the tunnel. However, none of
these hazard assessments provided a hazard rating (low, moderate or high). There was also no cumulative hazard assessment
for the combination of work activities that were taking place inside the tunnel on any given day. For these reasons the hazard

assessments do not meet regulatory requirements, as a hazard assessment must determine the hazard rating (or cumulative
hazard) based on all work activities taking place inside the confined space at any given time. SEE ORDER NO. 1
WRITTEN CONFINED SPACE ENTRY PROCEDURES
The qualified person must write procedures specific to each confined space entry based on the hazard assessment. The hazard
assessment takes into account the conditions of the space prior to entry as well the work activities that will take place inside the
space. The written procedures therefore will also consider both. Workers must be trained in the precautions identified in the written
procedures.
As with the hazard assessments, the employer created entry procedures for each work activity occurring in isolation. There were
certain hazards identified on the hazard assessment that was not addressed in the entry procedures. The entry procedures are
also lacking instructions or explanations on how to safely perform atmospheric testing, how to monitor the ventilation system, what
the duties are of a standby person, and several other factors. SEE ORDER NO. 2
SILICA EXPOSURE MONITORING
Silica exposure monitoring had been conducted during this project while working inside the confined space. The monitoring was
being done by a third party consultant, We The Safe. Three reports were provided during inspection for review and in all three
monitoring reports the data was identical. Same, flow rate, volume of air collected, duration of sample collected, and resulting
concentration. These reports did not include the field sampling data collection sheets showing the start/stop flow calibrations, flow
rates, start/stop times, sample durations, filed blanks, sample numbers, etc making it challenging to determine if samples were
collected following acceptable occupational hygiene methods.
CONCLUSION OF INSPECTION WHILE ON SITE MAY 3 / OFF SITE DOCUMENT INSPECTION MAY 4-6
When concluding this inspection onsite, the gaps explained and identified above as written in the Order No. 1 and Order No. 2
were discussed. The employer representative at the time was very cooperative and provided as much information as possible
during the time of this inspection. However, there was some information that we had discussed and was not immediately available
for review. I left site at approximately 12:00PM requesting for any other information they had regarding hazard assessments, safe
entry procedures, silica monitoring, and entry program.
At approximately 14:00 on May 4, 2016 I received several documents that were uploaded to WorkSafeBC's secure transfer site.
However, none of the documents provided at this time provided any new information that was not already seen in the past or
discussed. Additional documents were requested and received at 08:20 on May 6. The employer rep also provided me with
clarification on the names and roles of those who were involved in the confined space entry program, hazard assessment and
entry procedures. Upon further examination of the all documents provided the following deficiencies were noted.
CONFINED SPACE ENTRY PROGRAM
The confined space entry program provided at the time of inspection was the Tunnel Entry Program dated October 27, 2015. This
document did not address key elements of a program or with insufficient detail with respect to verification and testing, standby
persons, and rescue.
QUALIFIED PERSON
The hazard assessment and written confined space procedures were written by the Construction Superintendent for DB Hall
Contracting, and/or the Safey Coordinator for DB Hall Contracting, and/or the Construction Manager for SLCW TFO, and/or a third
party consultant.
Whenever a seriously deficient confined space hazard assessment or work procedure is encountered, this is an indication the
author was not qualified to do the hazard assessment and/or develop the written confined space entry procedures. Considering
the lack of information provided in the hazard assessment, entry procedures, entry program and lack of hazard rating classification

for each confined space entry and failure to consult with the program administrator and the joint committee (or worker health and
safety representative) on all aspects there is evidence that a qualified person is needed. SEE ORDERS NO. 3-4.
The employer has to exercise due diligence in the selection of the qualified person to undertake the hazard
assessment and production of confined space entry procedures.
The Occupational Health and Safety Regulation, section 9.11, states that the hazard assessment and written confined space entry
procedures must be prepared by a qualified person. The following qualifications are acceptable as evidence of adequate training
and experience:
Certified industrial hygienist (CIH)
Registered occupational hygienist (ROH)
Certified safety professional (CSP)
Canadian registered safety professional (CRSP)
Professional engineer (P.Eng.)
Provided that the holders of these qualifications have experience in the recognition, evaluation, and control of confined space
hazards. Others who have experience working with confined spaces and have a combination of education and training acceptable
to WorkSafeBC may qualify to prepare the hazard assessment and written procedures.
VENTILATION
A ventilation system must be designed, installed and maintained according to established engineering principles for the control of
airborne contaminants in a confined space. This ventilation system was not specified in the written procedures. There were no
instructions on how, where, and when to monitor the ventilation to the confined space. The employer was monitoring ventilation in
the confined space using an anemometer. Readings were being recorded at various ring locations on inbound and outbound
tunnels. However, no clear instructions were included on what criteria to look for and how this testing and verification of ventilation
and setup is to be done. SEE ORDER NO.5.
However, the employer did have a ventilation document that showed the required flow rate for various machinery while operating
inside the tunnels.
STANDBY PERSONS
This element of confined space entry is completely absent from both written documentation and observations on site. SEE
ORDER NO.6. If this employer has developed an alternate means of ensuring the safety and well being of all workers entering the
tunnel that do not meet the requirements of the OHSR, a variance request would be required.
RESCUE
The Tunnel Fit Out Emergency Response Plan, must be revisited considering the current nature of the confined space structure
and layout which has changed since the rescue plan was written. The rescue plan and relies on the services of employees from
other agencies such as fire rescue without an arrangement documented in writing. SEE ORDER NO.7
JOINT OCCUPATIONAL HEALTH AND SAFETY COMMITTEE (JOHSC)
This committee must consist of at least four (4) members with half or more than half represented by workers. The names of these
committee members and their work locations must also be posted at the workplace. Each member of the committee must be
trained to understand their roles as committee members and the function and duty of a JOHSC. Refer to Regulations Referenced
for more information.

The written procedures do not make reference to the ventilation design, installation or maintenance requirements according to
established engineering principles. The written procedures make reference to "Tunnel Ventilation Plan". As per the employer this
document refers to the "ABC Tunnel Fit Out Ventilation" which makes reference to minor design specifications for each phase but
does not have any installation, or maintenance procedures.
Design requirements are based on the following equipment operated inside the space:
Cat 730 (qty 4)
D4 Dozer
Cat 563 Packer
Cat 930 Loader
resulting in a required flow rate of 47.526 m3/s (phase 1) or 23.628 m3/s (phase 2)
However, other equipment may be used in the confined space such as a Lafarge Concrete truck as observed during date of
inspection and may not have been accounted for in the ventilation plans.

This is in contravention of the Occupational Health and Safety Regulation Section 9.32(1).
A ventilation system for the control of airborne contaminants in a confined space must be designed, installed and maintained in
accordance with established engineering principles and must be specified in the written procedures.
Measures to Ensure Compliance:
Specific requirements of an adequate ventilation system design, installation and maintenance is required in writing and part of

The employer did not ensure that when a worker entered a confined space containing a low hazard atmosphere that another
worker was assigned as a standby person, there was a continuous means of summoning the standby person, the standby person
was checking on the well-being of workers inside the space at least every 20 minutes, and the standby person had a means to
immediately summon rescue personnel.
This is evidenced by the lack of standby person procedures and role in the confined space entry program. Also, at the time of
inspection, I did not observe a standby person checking on the well-being of workers inside the space.
This is in contravention of the Occupational Health and Safety Regulation Section 9.34.
If a worker enters a confined space which contains a low hazard atmosphere:
(a) another worker must be assigned as a standby person,
(b) there must be a continuous means of summoning the standby person,
(c) the standby person must check on the well-being of workers inside the space at least every 20 minutes, and
(d) the standby person must have a means to immediately summon rescue personnel.

There was no written agreement detailing the services that were to be provided when the rescue persons were employees of
another firm, or an agency such as a fire department. The Tunnel Fit Out Emergency Response Plan on page 10 indicates to
contact fire rescue when a toxic atmosphere exists without an associated contract.
This is in contravention of the Occupational Health and Safety Regulation Section 9.37(2).
If the rescue persons are employees of another firm, or an agency such as a fire department, there must be a written agreement
detailing the services that are to be provided.

members or, if a greater number of members is required by
regulation, that greater number.

Details Discussed

No SDS was available for Hilti HIT-HY 200-R/200-A product


which is being stored at the workplace. The employer
immediately retained a copy of this SDS document before
conclusion of this inspection.

Identify and describe each confined space in the confined


space program and ensure both confined spaces are monitored
equally with respect to atmospheric testing and ventilation air
flow testing.
At approximately 07:50 on May 3, 2016 it was recorded that
there was no continuous ventilation inside the confined space
while workers were inside the space. The Tunnel Entry Program
(page 11) indicates that the space must be immediately
evacuated; however since it was quicker to rectify ventilation
inside the space than it would be to evacuate, this was the
action taken. The program or ventilation procedures must
address what to do in these circumstances. .
Of the four (4) committee meetings held this year there have
only been 3 members (2 representing workers and 1
representing management). At least 4 members is required.

Pursuant to Workers Compensation Act Division 4, the


employer must post any order written under Division 4 and keep
it posted for 12 months.

At each workplace where workers of an employer are regularly


employed, the employer must post and keep posted the names
and work locations of the joint committee members.

Posting of names and work locations for each member on the


committee was not seen.

Pursuant to Workers Compensation Act Division 4, the


employer must post any order written under Division 4 and keep

This was a follow-up inspection to authenticate appropriate compliance with the order(s) noted.
On May 24, 2016 the employer rep had provided compliance action taken with respect to Order No. 6 (stand-by) to this officer via
email. On June 1, 2016 a follow up inspection was conducted with respect to implementation of a new stand-by person role to
confined space entry at this work site. Upon inspection of this new process deficiencies were noted and discussed in person
which included but not limited to:
- the contact person inside the tunnel making calls to the stand-by person while not physically not located inside the tunnel and/or
the stand-by person documented that calls were received when they were not. This was noted when the form completed by the
stand-by person indicated that a person check was done at 10:10 and 10:30 AM, however the individual responsible for person
check inside the tunnel was shown to be out of the tunnel from 10:00-10:40AM according to the turn style pass system.
- the contact person inside the tunnel is not the first person inside the tunnel or the last person out of the tunnel which means
several workers are working inside without a designated rep to monitor their well being every twenty minutes.
- the contact person inside the tunnel had exited the tunnel at 1:00 PM and the stand-by person was under the impression that no
other workers were inside the tunnel at this time so when it was 1:20 PM and he had not heard from the contact person he was
not concerned. However, the turn style pass system software indicated that during this 20 minute period there were potentially up
to 59 workers inside the tunnel at this time.
Following this inspection a meeting was held with this employer rep, their third party consultant (Pallas Athene Consulting Inc.),
and the Track Manager to update OSO Mark Valastin and myself on progress towards compliance with the outstanding orders thus
far and to have some a conversation about some outstanding questions from the employer.
Progress towards compliance for Orders No.1-2 and 5-7 are documented in this report.
Orders 3-4 will be addressed once all other orders have been complied.

Jun 01, 2016 - This item is currently being reviewed and worked on by the project track manager (p.eng) and a hired third party
consultant. The track manager will be working on weekly hazard assessments with oversight from a third party consultant, Pallas
Athene Consulting Inc., to ensure it meets the intent of the regulation.
The main area of concern with respect to the hazard assessments is that it must take into account the combined hazards
associated from each task taking place in the tunnel and have an overall hazard classification rating.
It is expected that this will be complete by June 30th, 2016
Initiating order:
May 03, 2016 - The hazard assessment required by Subsection 9.9(1) did not consider the conditions which may exist due to the
confined space's design, or which may develop during multiple work activities inside the space.
This is evidenced by the following:
- There is no accurate description of the confined space design as two spaces as seen on May 3, 2016 in any of the
documentation provided.
- The employer has provided multiple hazard assessments, each assessed based on single work activities occurring in isolation
but there was no hazard assessment that considered the combination of all work activities taking place inside the confined space
at any given time.
- The hazard classification for the group of work activities taking place on May 3, 2016 was assumed to be moderate as verbally
reported but this was not on any written hazard assessment documentation
This is in contravention of the Occupational Health and Safety Regulation Section 9.9(2)(a).
The hazard assessment required by Subsection 9.9(1) must consider the conditions which may exist prior to entry due to the
confined space's design, location or use, or which may develop during work activity inside the space.
Measures to Ensure Compliance:
Re-evaluate each hazard assessment based on the current design of the confined space and include a hazard classification for
each activity or group of activities occurring inside a confined space at any given time.

- There is no hazard classification rating for each work activity or group of activities
- The Tunnel Entry Program indicates on page 13 that; "Workers entering into the tunnel to perform tunnel finishing construction
Tasks are required to periodically confirm that ventilation is occurring by visually inspecting the direction / condition of the
ventilation tell-tale ribboning." however, this is responsibility of the employer not "workers" performing construction.
- The safe work procedures are lacking detail and specific information with respect to the following
1. who, where, when/frequency and how will atmospheric testing be performed, including how to set up specific air-monitoring
device(s) for the identified hazards (and the contaminants present).
2. who, where, when and how will verification of ventilation and air flow be performed and proper placement of the ventilation
system. A second fan was added to the south portal positioned at the outbound tunnel and there are no instructions on this fan's
required capacity, or position.
3. what PPE is required to minimize workers exposed to hazards, for example, epoxy (Hilti HIT HY 200-R and 200-A) tightly
sealed safety goggles, nitrile rubber gloves greater than 0.12mm thick, and protective work clothing. Also failure to identify PPE
required for potential silica exposure or at least reference to the silica exposure control plan where activities will result in potential

May 03, 2016 - A ventilation system must be designed, installed and maintained according to established engineering principles
for the control of airborne contaminants in a confined space. This ventilation system was not specified in the written procedures.
The written procedures do not make reference to the ventilation design, installation or maintenance requirements according to
established engineering principles. The written procedures make reference to "Tunnel Ventilation Plan". As per the employer this
document refers to the "ABC Tunnel Fit Out Ventilation" which makes reference to minor design specifications for each phase but
does not have any installation, or maintenance procedures.
Design requirements are based on the following equipment operated inside the space:
Cat 730 (qty 4)
D4 Dozer
Cat 563 Packer
Cat 930 Loader
resulting in a required flow rate of 47.526 m3/s (phase 1) or 23.628 m3/s (phase 2)
However, other equipment may be used in the confined space such as a Lafarge Concrete truck as observed during date of
inspection and may not have been accounted for in the ventilation plans.

This is in contravention of the Occupational Health and Safety Regulation Section 9.32(1).
A ventilation system for the control of airborne contaminants in a confined space must be designed, installed and maintained in
accordance with established engineering principles and must be specified in the written procedures.
Measures to Ensure Compliance:
Specific requirements of an adequate ventilation system design, installation and maintenance is required in writing and part of
the written procedures.

May 03, 2016 - The employer did not ensure that when a worker entered a confined space containing a low hazard atmosphere
that another worker was assigned as a standby person, there was a continuous means of summoning the standby person, the
standby person was checking on the well-being of workers inside the space at least every 20 minutes, and the standby person
had a means to immediately summon rescue personnel.
This is evidenced by the lack of standby person procedures and role in the confined space entry program. Also, at the time of
inspection, I did not observe a standby person checking on the well-being of workers inside the space.

If a worker enters a confined space which contains a low hazard atmosphere:
(a) another worker must be assigned as a standby person,
(b) there must be a continuous means of summoning the standby person,

(d) the standby person must have a means to immediately summon rescue personnel.

May 03, 2016 - There was no written agreement detailing the services that were to be provided when the rescue persons were
employees of another firm, or an agency such as a fire department. The Tunnel Fit Out Emergency Response Plan on page 10
indicates to contact fire rescue when a toxic atmosphere exists without an associated contract.

requirements of this violation. An extension was granted to July 11, 2016 from June 30, 2016; however due to vacation schedules
compliance was not yet achieved as of July 13, 2016 when I spoke to this employer's representative via phone.
Based upon the failure to comply with this order, there are grounds for imposing an OHS Citation or administrative penalty. The
amount of an OHS Citation is $505.17 for a first offence and $1,010.33 for any subsequent violations in a three year period. Both
amounts are adjusted annually pursuant to the consumer price index.
A subsequent follow-up inspection to confirm that this order has been complied with will take place no later than July 22, 2016.
Should this employer be found in non-compliance with this order at that time, further enforcement action in the form of an OHS
Citation or administrative penalty will be considered.
Jun 01, 2016 - This item is currently being reviewed and worked on by the project track manager (p.eng) and a hired third party
consultant. The track manager will be working on weekly hazard assessments with oversight from a third party consultant, Pallas
Athene Consulting Inc., to ensure it meets the intent of the regulation.
The main area of concern with respect to the hazard assessments is that it must take into account the combined hazards
associated from each task taking place in the tunnel and have an overall hazard classification rating.
It is expected that this will be complete by June 30th, 2016

May 03, 2016 - The hazard assessment required by Subsection 9.9(1) did not consider the conditions which may exist due to the
confined space's design, or which may develop during multiple work activities inside the space.
This is evidenced by the following:
- There is no accurate description of the confined space design as two spaces as seen on May 3, 2016 in any of the
documentation provided.
- The employer has provided multiple hazard assessments, each assessed based on single work activities occurring in isolation
but there was no hazard assessment that considered the combination of all work activities taking place inside the confined space
at any given time.
- The hazard classification for the group of work activities taking place on May 3, 2016 was assumed to be moderate as verbally
reported but this was not on any written hazard assessment documentation
This is in contravention of the Occupational Health and Safety Regulation Section 9.9(2)(a).
The hazard assessment required by Subsection 9.9(1) must consider the conditions which may exist prior to entry due to the
confined space's design, location or use, or which may develop during work activity inside the space.
Measures to Ensure Compliance:
Re-evaluate each hazard assessment based on the current design of the confined space and include a hazard classification for
each activity or group of activities occurring inside a confined space at any given time.

May 03, 2016 - Written procedures specifying the means to eliminate or minimize all hazards likely to prevail in the confined
space were not developed, based on the hazard assessment required by section 9.9.
This is evidenced by the missing information regarding:
1. who, where, when/frequency and how will atmospheric testing be performed, including how to set up specific air-monitoring
device(s) for the identified hazards (and the contaminants present). What the required alarm settings are on gas monitors for
various air contaminants.
2. who, where, when and how will verification of ventilation and air flow be performed and proper placement of the ventilation
system.
3. what PPE is required to minimize workers exposed to hazards, for example, epoxy (Hilti HIT HY 200-R and 200-A) tightly
sealed safety goggles, nitrile rubber gloves greater than 0.12mm thick, and protective work clothing. Also failure to identify PPE
required for potential silica exposure or at least reference to the silica exposure control plan where activities will result in potential
silica exposure (such as saw-cut concrete on the tunnel invert slab hazard assessment).
4. no mention of standby person duties or procedures
5. no rescue plan and no mention of rescue personnel
This is in contravention of the Occupational Health and Safety Regulation Section 9.10.

May 03, 2016 - The employer's hazard assessment and written confined entry procedures were not prepared by a qualified
person who has adequate training and experience in the recognition, evaluation and control of confined space hazards.
Evidence that a qualified person did not write the hazard assessment or confined space entry procedures is based on the
following:
- There is no hazard classification rating for each work activity or group of activities
- The Tunnel Entry Program indicates on page 13 that; "Workers entering into the tunnel to perform tunnel finishing construction
Tasks are required to periodically confirm that ventilation is occurring by visually inspecting the direction / condition of the
ventilation tell-tale ribboning." however, this is responsibility of the employer not "workers" performing construction.
- The safe work procedures are lacking detail and specific information with respect to the following
1. who, where, when/frequency and how will atmospheric testing be performed, including how to set up specific air-monitoring
device(s) for the identified hazards (and the contaminants present).
2. who, where, when and how will verification of ventilation and air flow be performed and proper placement of the ventilation
system. A second fan was added to the south portal positioned at the outbound tunnel and there are no instructions on this fan's
required capacity, or position.
3. what PPE is required to minimize workers exposed to hazards, for example, epoxy (Hilti HIT HY 200-R and 200-A) tightly
sealed safety goggles, nitrile rubber gloves greater than 0.12mm thick, and protective work clothing. Also failure to identify PPE
required for potential silica exposure or at least reference to the silica exposure control plan where activities will result in potential
silica exposure (such as saw-cut concrete on the tunnel invert slab hazard assessment).
4. no mention of standby person duties or procedures
5. no rescue plan and no mention of rescue personnel
6. failure to identify that the tunnel project consists of two confined spaces
7. what the required alarm settings are on gas monitors for various air contaminants

Initiating order:
May 03, 2016 - A ventilation system must be designed, installed and maintained according to established engineering principles
for the control of airborne contaminants in a confined space. This ventilation system was not specified in the written procedures.
The written procedures do not make reference to the ventilation design, installation or maintenance requirements according to
established engineering principles. The written procedures make reference to "Tunnel Ventilation Plan". As per the employer this
document refers to the "ABC Tunnel Fit Out Ventilation" which makes reference to minor design specifications for each phase but
does not have any installation, or maintenance procedures.
Design requirements are based on the following equipment operated inside the space:
Cat 730 (qty 4)
D4 Dozer
Cat 563 Packer
Cat 930 Loader
resulting in a required flow rate of 47.526 m3/s (phase 1) or 23.628 m3/s (phase 2)
However, other equipment may be used in the confined space such as a Lafarge Concrete truck as observed during date of
inspection and may not have been accounted for in the ventilation plans.

This is in contravention of the Occupational Health and Safety Regulation Section 9.32(1).
A ventilation system for the control of airborne contaminants in a confined space must be designed, installed and maintained in
accordance with established engineering principles and must be specified in the written procedures.
Measures to Ensure Compliance:
Specific requirements of an adequate ventilation system design, installation and maintenance is required in writing and part of
the written procedures.

May 03, 2016 - The employer did not ensure that when a worker entered a confined space containing a low hazard atmosphere
that another worker was assigned as a standby person, there was a continuous means of summoning the standby person, the
standby person was checking on the well-being of workers inside the space at least every 20 minutes, and the standby person
had a means to immediately summon rescue personnel.
This is evidenced by the lack of standby person procedures and role in the confined space entry program. Also, at the time of
inspection, I did not observe a standby person checking on the well-being of workers inside the space.
This is in contravention of the Occupational Health and Safety Regulation Section 9.34.
If a worker enters a confined space which contains a low hazard atmosphere:
(a) another worker must be assigned as a standby person,
(b) there must be a continuous means of summoning the standby person,
(c) the standby person must check on the well-being of workers inside the space at least every 20 minutes, and
(d) the standby person must have a means to immediately summon rescue personnel.
Measures to Ensure Compliance:
A Standby person must be designated and perform the appropriate duties of a standby person.

Coquitlam Fire Departments); as such the employer was asked to submit a variance request. The variance has been granted see

Initiating order:
May 03, 2016 - There was no written agreement detailing the services that were to be provided when the rescue persons were
employees of another firm, or an agency such as a fire department. The Tunnel Fit Out Emergency Response Plan on page 10
indicates to contact fire rescue when a toxic atmosphere exists without an associated contract.
This is in contravention of the Occupational Health and Safety Regulation Section 9.37(2).
If the rescue persons are employees of another firm, or an agency such as a fire department, there must be a written agreement
detailing the services that are to be provided.
