PLEASE TAKE NOTICE THAT, pursuant to 28 U.S.C. $$ 1441 and1446,
defendant Todd R. Howe ("Defendant"), by his undersigned counsel and with a
full
reservation of any and all rights, claims, and defenses of any nature, including by not
limited to defenses related to service of process, jurisdiction, and venue, hereby give notice
that he is removing the action styled COR Development Company, LLC v. Todd R. Howe,
Onondaga County Index No. 2016EF3394, currently pending in the Supreme Court of the
State of New York, Onondaga County, New York to the United States District Court for
the Northern District of New

Supreme Court of New York, Onondaga County (the "State Court"), bearing Index No.

20I68F3394 and entitled COR Development Company, LLC v. Todd R. Howe (the "State
Court Action").

Defendant has not yet been served with the Summons and Complain in the State
Court Action. However, on or about August 17,2016, Defendant obtained a copy of the
Summons and Complaint. A copy of the Summons and Complaint obtained by Defendant
is annexed hereto as Exhibit A.

late fees, and attorney's fees and costs. Defendant denies the allegations but for purposes

is between citizens of different States."

Plaintiff has asserted that the amount owed on the promissory note is $85,000.00
plus contractual interest, late fees, and attorney's fees and costs. Plaintiff has also assefted
that it is a citizen of New York and Defendant is a citizen of V/ashington, D.C.

This Notice of Removal is timely because it is being filed within 30 days of receipt

Venue is proper under proper under 28 U.S.C. $ 1441(a), which provides for
removal to the district court of the United States for the district and division embracing the

Plaintiff, COR Development Company, LLC, by and through its attorneys, Mannion &
Copani, as and for its Complaint against Defendant Todd R. Howe, hereby states as follows:

("COR") is a limited liability company duly organized under the laws of the State of New York
with a principal place of business in the County of Onondaga.

Upon information and beliet and at all times hereinafter mentioned, Defendant
Todd R. Howe ("Defendant') is an individual residing at 4107 Fordham Road N'W, Washington,

promissory note whereby Defendant promised to pay COR on December 3l,20l5,the sum of
eighty-five thousand dollars ($85,000.00) with interest thereon at the rate of one percent (l%) per
annum.

COR and Defendant on or about January 25,2016 amended the promissory note
to extended the maturity date of the promissory note from December 31,2015 to June 30,2016.

The promissory note further provided that Defendant was obligated to pay COR
