CHAPTER 545. OPERATION AND MOVEMENT OF VEHICLES
SUBCHAPTER D. RIGHT-OF-WAY
Sec. 545.256. EMERGING FROM AN ALLEY, DRIVEWAY, OR BUILDING. An
operator emerging from an alley, driveway, or building in a business or
residence district shall:
(1) stop the vehicle before moving on a sidewalk or the
sidewalk area extending across an alley or driveway;

Sec. 545.060. DRIVING ON ROADWAY LANED FOR TRAFFIC. (a) An


operator on a roadway divided into two or more clearly marked lanes for
traffic:

single lane;

in a particular direction.
(d) Official traffic-control devices prohibiting the changing of
lanes on sections of roadway may be installed.

Right of Way Scenario #5: Leaving a Driveway


If you are pulling out of a driveway, whether it is a residential driveway or from a parking
lot, and into traffic, you must always yield right of way to the drivers in the street. Any
time you move into the flow of traffic out of a driveway, drivers already moving have the
right of way over your vehicle, and you must wait until the traffic clears to proceed.
Right of way is one of the things that are taken into consideration by both police when
handing out traffic violations and by insurance companies when determining fault in an
accident. When in doubt, always yield the right of way to any vehicle that is already
moving in a forward direction, or any time you are moving from a stopped position into
the flow of traffic. Youll prevent accidents and car insurance rate increases.

Turning Left

When turning left, yield the right-of-way to any vehicle coming straight through from the other
direction.
Private Roads and Driveways

When entering or crossing a road, street, or highway from a private road, alley, building, or driveway
after stopping prior to the sidewalk, you must yield the right-of-way to all approaching vehicles and
pedestrians.

Center turn lanes

(b) If a roadway is divided into three lanes and provides for two-way
movement of traffic, an operator on the roadway may not drive in the
center lane except:
(1) if passing another vehicle and the center lane is clear of traffic
within a safe distance;
(2) in preparing to make a left turn; or
(3) where the center lane is designated by an official traffic-control
device for movement in the direction in which the operator is moving.
Center turn lanes are for use only when preparing to turn left from the main road onto a side
street or driveway only. Only enter the lane just before you are ready to slow down for the turn.
Also, the Federal Highway Administration's "Read Your Road" guide (link at the bottom of this
page) indicates that, when turning from a side street or driveway onto the main road, you may
also use this lane as a temporary refuge to wait for traffic to clear as long as you pull into the lane
and wait and don't use the center turn lane as an acceleration lane. However, it is important to
note that Texas law does not seem to specifically permit this action, and I have had reports that
some folks have been cited for doing this and the court has upheld their citation, so I would
recommend avoiding this maneuver unless you absolutely have to. Finally, although section (b)

(1) above says you can use the center lane for passing, keep in mind that center lanes marked as
left turn lanes cannot be used for passing as the traffic signs and pavement markings indicating
that the lane is for left turns only take precedence.
