1. What is Constitution?

The words Constitution comes from the Latin wordsConstituo meaning fixed
established settled.
According to Charles Bargeaud- a Constitution is a high authority on the
subject of constitution.Is the fundamental Law according to which the
government of a state is organized and agreed;y to which the relations of
individuals or moral person to the community are determined. It may be a
written instrument a precise text or series of text enacted at a given time by
a sovereign power, or it may to the mote or less definite result of a series of
legislative acts, ordinaries, judicial decisions,precident and customs of
diverse origin and unequal value and importance
Judge Cooley defines a constitution as the fundamental aw of the state
containing the principle upon which government is founded regulating the
division of the sovereign powers and directing to what persons each of these
powers is to exercised.

2.What are the role of Constitution?


The role of constitutions is to define the organization of the government to
determine the distribution of governmental powers,to establish certain fixed
principles governing the operation of the government to define the right of
individual citizens and to hold the state together
They are several principles role of Constitutions. They may be classified as
follows:
a). According to the type of government for which they provide as
democratic,Aristocratic,Oligarchic, or autoctratic.
b).According to their form as written or unwritten.
c).According to the difficulty of the amending process as flexible or right and,
d).According to their origin as follows:
1Those which like the English constitutions are the product of growth through
a long period of time.
2.Those which like the Frussian instrument of 1850 or the Japanese
Constitution of 1899 are granted by a rulling prince or monarch.
3.Those which like the Constitution of U.S have been created by the
deliberate act of a sovereign people.

3.What are the requisites of good written Constitution?


Requisites of good written constitution must be a constitution broad, brief and
definite.
A constitution must be broad in its scope because it must attire an organization of
government for the whole state. A statement of the province and functions of
government and of the relations between the governing bodies and the governed
requires a comprehensive document.
A constitution must be brief because it is not the place in with the details of
organizations should be set forth.Some constitution have been mared by the
inclusion of pure legislation.
According to Mr.Chief Justice Marchal:
A constitution to certainon accurate into exertion would subdivision of which
they may be carried into execution would partake of the prolixity of a legal code,
and could scarcely be embrased by the public. Its nature therefore requires thsat
only its great outlines should be marked its important object be decided from the
nature of the object themselves.
Lastly. The constitution must be definite in a statement of principles underlying the
essential nature of two state any vegueness without may lees to opposing
interpretative of discruption of the state may imcalculable harm. Civil war and the
discruption of the state may conceivably follow from ambiguous expression in a
constitution.

4.What is the difference between statute and Constitution?


A Constitution is legislation direct from the people
A constitution usually state general principles and Constitution is intended to
meet not only existing but also future conditions while Statute is legislation from the
people representatives.
Statute must provide the details of a subject of which it treats.
Statute is intended to meet present conditions.
