THE PROBLEM AND ITS BACKGROUND

Taking care of our health, making sure that our vital signs are in good
condition, maintaining a healthy lifestyle and sustaining a strong physique
should be our obligations. We all know that if you are healthy it can help you
live longer and achieve your desires in life. But in order to stay healthy, we
often take risk in picking and trying products that will help us maintain good
health. Evidently, we wake up wishing to always have a wonderful day
ahead, so we take medicines and food supplements that we believe can help
us being physically fit. Taking up dietary supplements is affiliated to anyone
who desires to have a sexier bodyor to loose weight even if they are not sure
if its effective or not. And outof curiosity, people intent to buy medical
products that they usually saw or heard in an advertisement not knowing
that those products can be labeled with No Approved Therapeutic Claims.
Basically, the statement or phrase No Approved Therapeutic Claims
means that there is no scientific study to prove that it can cure diseases. It
could not harm your health but it could help through contributing nutrients
that we dont get much from food. They contain essential vitamins and
minerals that the body needs. They are more about health aides and not for
therapeutic use or should not be taken as a drug substitute. No approved
therapeutic claims serve as a warning for those who would rely solely with
some particular and to consumers to look forward to, but some patients stop
their medications and usually depend on the supplement. Little they know
what these medications particularly endangered or place individuals at risk

because food supplements alone are not enough to keep the person in good
condition.
The dilemma that the researchers have found is on the safety of the
consumers who have lack of knowledge with the No Approved Therapeutic
Claim products that most people disregard yet still continue to take those
for their own satisfaction. They could have been using these products for
decades, their medical supplements could contain varieties of these kinds of
drugs and they might not know that these could harm or could not even
affect them at all, thus this prompted the researchers to conduct this study
aptly entitled: The Lived Experience of the Users of the No Approved
Therapeutic Claim Products.

Background of the Study


Taking medicines is one among all the practices of people to cure and
also prevent disease.
Taking traditional or complementary medicines were used before to
satisfy the health need of an individual; these medicines are the outcome of
different knowledge, practices or methods, based on beliefs, and experiences
of native people in different cultures, it doesnt matter if reasonable or not,
used to prevent, improve, and treat, both physical and mental diseases.

Here, in the Philippines, using spiritual beliefs traditional healers heals
their patients, through prayers, massage, acupuncture, and oil made from
exotic materials with prayers. They also use herbal medicines whether oral
or tropic for treatment. Traditional Filipino culture believes that illness comes
from spiritual reason, such as witchery, and other beliefs.
As we noticed, technologies nowadays are improving; we now have
larger access on information that we need, especially when it comes to
preventing and curing diseases. Most medicines today are made in
laboratories; first it was formed then it undergoes different examinations or
tests to ensure its safety and efficacy. The usual practice before taking
medicines is that the patient or a person should have prescription from a
doctor, because he needs to check first the patient for him to provide a
proper medication that will suit on the patients health condition.

Non-prescription drugs are now present in the market these are drugs
that can be bought over-the-counter, which means these are sold even
without a doctors prescription.
Herbal dietary or food supplements are some examples of nonprescription drugs. These products become popular alternative for the health
needs of many people, mainly because these products are widely advertised
in the market, and are proliferates the pharmaceutical market. Some
manufacturer showsadvertisements of confirmations from people who
become healthy and cured after taking heir products for their. Consumers
engage with these products due to their claimed quick results and for their
low price.
The following are some claims of manufacturer of food supplements;
Akita Herbal Products, they claim that their medicines provide premium
quality of natural and herbal supplements; Atienza Naturale, claims that they
provide a high-quality and affordable dietary supplements and skincare
products for us Filipinos; and Daila Herbal, claim that they provide health
friendly organic and all natural supplements.
Usually these products bearing a disclaimer No Approved Therapeutic
Claim --- this label means that these products didnt undergo a rigid testing
to prove its efficacy because Food and Drug Administration or FDA (formerly
known as BFAD) just examines its safety.

Supplements made form malunggay, ampalaya, banaba, sambong,


wheat grass, alfalfa, and other plants or parts of these plants become
present in daily practices of Filipinos; according to a survey of National
Health Account Statistics P150 Billion was spent by the Filipinos for these
products and it was still growing. These products claim that they provide
essential or necessary vitamins and minerals that the body needs in
preventing and curing diseases.
According to some studies, products with No Approved Therapeutic
Claim is not like medicines which can heal or cure diseases and purchasing
or using these products can be a risk in a persons health because it didnt
undergo to some lab tests; but most Filipino buyers purchased this products
because they were perceived that these products are safe and it is
believed to be natural. Without having enough knowledge that supliment
may have an active ingredient that can cause negative reaction when used
together with prescribed medicine or synthetic drugs. These products might
also have ingredients that might cause harm to organs and major tissues of
an individual. It can also damage our kidneys and may lead to long
hospitalization; also to pregnant woman or those who do breastfeed might
cause harmful effect to fetus or baby. These products may also contain
nutrients in amount higher than the required or necessary intake that may
result to an imbalance inside the body that may also lead to serious
diseases. (FDA)
The label No Approved Therapeutic Claim is abused by some food or
dietary supplements owners and advertisers based on Department of Health,
because they are required to indicate the side effects of their products that is

why some of the manufacturers claimed that their products can cure
diseases which is deceiving.
The label No Approved Therapeutic Claim tends to misinterpret and
didnt mind by many Filipinos, because somehow the terms used is not
familiar to them.
And because of this issue, the researchers pursue this study to know
the experiences of the consumers and what are the factors that influence
them to buy these kinds of products. This study also wants to inform other
people about this label.

Theoretical Framework
The researchers used three theories to explain the factors that affect
the consumers buying decision. The first theory used was the Theory of
Planned Behavior (TPB). It started as the Theory of Reasoned Action that
predicts an individuals intention to engage in a behavior at a specific time
and place. TPB was proposed by Iceck Ajzen in 1985 through his article From
intentions and action; A theory of Planned Behavior. The Theory was
developed from the Theory of Reasoned Action, which was proposed by
Martin Fishbein together with Iceck Ajzen 1975. The Theory was intended to
explain all behaviors over which people have the ability to exert self-control.
The key component to this model is behavioral intention; behavioral
intentions are influenced by the attitude about the likelihood that the
behavior will have the expected outcome and the subjective of the risks and

benefits of that outcome. The TPB is comprised of six constructs that


collectively represents a persons actual control over the behavior.
1. Attitudes this refers to the degree to which a person has a favorable
or unfavorable evaluation of the behavior of interest. It entails a
consideration of the outcomes of performing the behavior.
2. Behavioral Intention this refers to the motivational factors that
influence a given behavior where the stronger the intention to perform
the behavior, the more likely the behavior will be performed.
3. Subjective Norms this refers to the belief about whether most people
approve or disapprove of the behavior. It relates to persons beliefs
about whether peers and people of importance to the person think he
or she should engage in the behavior.
4. Social Norms this refers to the customary codes of behavior in a
group or people or larger cultural context. Social norms are considered
normative, or standard, in a group of people.
5. Perceived Power this refers to the perceived presence of factors that
may facilitate or impede performance of a behavior. Perceived power
contributes to a persons perceived behavioral control over each of
those factors.
6. Perceived Behavioral Control this refers to a persons perception of
the ease or difficulty of performing the behavior of interest. Perceived
behavioral control varies across situations and actions, which results in
a person having varying perceptions of behavioral control depending
on the situations. This construct of the theory was added later, and
created the shift from the Theory of Reasoned Action to the Theory.
TPB supported by two other theories. These are the Elaboration
Likelihood Model and the Health Belief Model. The Elaboration Likelihood
Model speaks about motivation and John Cacioppo during the early 1980s. it
is based on the idea that attitudes are important because attitudes guide
decisions and other behaviors. While attitudes can result from a number of
things, persuasion is a primary source. The model features two routes of

persuasive influence; central and peripheral source. The ELM accounts for
the differences in persuasive impact produced by arguments that contain
ample information and cogent reasons as compared to messages that rely on
simplistic associations of positive and negative attributes in some object,
action or situation. The key variable in this process is involvement, the
extent to which an individual is willing and able to think about the position
advocated and its supporting materials. When people are motivated and able
to think about the content of the message, elaboration is high. Elaboration
involves cognitive processes such as evaluation, recall, critical judgment, and
inferential judgment. When elaboration is high, the central persuasive route
is likely to occur; conversely, the peripheral route is the likely result of low
elaboration. The receiver is not guided by his or her assessment of the
message, as in the case of the central route, but the receiver decides to
follow a principle or a decision-rule which is derived from the persuasion
situation.
The Health Belief Model (HMB) mainly concerned in explaining health
behaviors. It is a psychological model that attempts to explain and predict
health behaviors. The Health Belief Model was developed in 1950s y social
psychologists Irwin M. Rosenstock, Godfrey H. Hochbaum, S. Stephen
Kegeles, and Howard Leventhal at the U.S. Public Health Service to better
understandand beliefs of individuals.
The HBM is based on the understanding that a person will take a
health-related action (i.e. take food supplements) if that person:
1. Feels that a negative condition (i.e. diabetes) can be avoided,
2. Has a positive expectation that by taking recommended action he/she
will avoid a negative health condition (i.e. taking food supplements will
be effective in preventing diabetes), and
3. Believes that he/she can successfully take a recommend health action
(i.e. he/she can take food supplements ease and without hesitation).

The HBM was spelled out in terms of four constructs representing the
perceived threat and net benefits: perceived susceptibility, perceived
severity, perceived benefits, and perceived barriers. These concepts were
proposed as accounting for peoples readiness to act. An added concept,
cues to action, would activated that readiness and stimulate overt behavior.
A recent addition to the HBM is the concept of self-efficacy, or ones
confidence in the ability to the successfully perform an action. An added
concept, cues to action, would activate that readiness and stimulate overt
behavior.
As what the theories stated above, attitudes and behavior of a person
really affect his/her buying decision. It also said above that even the
constant usage of this person can affect his way of buying, people and the
environment where the person belongs can also be a factor of dealing with
those products in the market. The Theories will support and corroborate the
study entitles: The Lived Experiences of the users of the No Approved

Therapeutic Claim Products.

The conceptual framework aims to demonstrate organized information.


This study was conducted to know the reason behind patronizing No
Approved Therapeutic Claims product and to inform the consumer about the
risk of taking these.
This shows how the researchers will come up to the result of their
study. The conceptual framework was based on the idea of Theory of Planned
Behavior. The buying decision towards No Approved Therapeutic Claim
products is the intention of the customer/consumer that will come up from;
the health beliefs that will stand as the behavioral intention or the
motivational factors that will influence a given behavior and; Attitude
towards behavior, subjective norms and perceived behavioral control that
will stand as the subjective evaluation of the risk and benefits of the
outcome. It will end up to positive and/or negative effects on the users of No
Approved Therapeutic Claim products.

Significance of the Study


The findings of the study can be a source of ideas and information to the
following:
To the Consumers
The results of this study will help the consumers be informed about the
possible effects of taking products with disclaimer No Approved Therapeutic
Claims. The gathered information will also eliminate the misconceptions
regarding it.
To the Advertising Companies
The outcome of the study will serve as a reference to the business.
This can also help in particular on how they will conduct advertisements that
can result for the consumers to be well informed viewers.
To the FDA (Food and Drug Administration)
This study can help them to monitor and regulate all the products and
manufacturing companies that carry out products with No Approved
Therapeutic Claims labels.
To the Government
This study can be an eye opener to the government in order to carry
out appropriate actionsconcerning products with No Approved Therapeutic
Claims especially with risking the health and protection of the public.
To the DOH (Department of Health)
This study can help them to bring awareness to the consumers about
the No Approved Therapeutic Claims products; and to inform the users of
these products about its possible effects.
To the Future Researchers

Scope and Limitations


This study aims to present the lived experiences of the users of the
No Approved Therapeutic Claims product. And this study is conducted to
determine how the consumers are protected against inaccurate, misleading
and false claims on the efficacy of drugs supplement that proliferate in the
market.
The respondent of this study contains forty-five (45) respondents from
Quezon City. This study contains personal information of the respondents and
their experiences about using the products.
The time frame of this study is from June to March of the academic
year 2014-2015.

RELATED LITERATURES
LOCAL LITERATURE
Nowadays, many Filipinos are taking alternative medicines, over the
counter drugs or supplements rather than drugs prescribed by their
physicians and one of the reasons why they prefer those products is because
of its cheaper price. According to the most recent information that Food and
Drugs conducted, there are 2588 registered food supplements in the
Philippines most of them promises that youll have a healthier body or claims
that it can treat conditions such as diabetes and arthritis. Another thing is it
also claims that it will helps to improve your metabolism in helping a person
to lose weight or anti-aging by using it regularly. Yet in each carton, bottled
and advertisements often ignored the statement, No Approved Therapeutic
Claim this basically means that food supplements are not yet proven to be
as effective as what they claim or promise to address. In this case, it is
obviously that advertisement is one of the factors that affect the buying
decision of the consumers disregarding the disclaimer means that they still
consider and patronize those products.
The major key players in an advertisement are the product advertisers,
endorsers and owner. These key players are requested by the FDA to seek its
approval to ensure that they provide true and correct information. FDA also
noted that food supplements were granted only as food products and not as
a drug product. All food supplements are required to carry the No Approved
Therapeutic Claim phrase to their label. This label meant that it cant cure
nor intended to treat diseases; drug products that are authorized by the FDA

are the only one who can made all those therapeutic claims. Endorsers
whose tries to persuade people to believe to their products claim through
testimonials or even false claims were associated with the FDA logo and the
Certificate of Product Registration (CPR). It means that it should have enough
information or knowledge about the product or about the advertisement
towards those products.
Self-medication is one of the Filipinos do to treat their illness but
according to the FDA it is not advisable because according to them it might
lead to a serious damage such as permanent mental or physical disability.
FDA encourages the public to be more conscious about our health yet be
wiser in choosing a product to buy. FDA said that patients should consult to
their doctor for proper treatment of their diseases and to know more about
the benefits or risks in taking food supplements.
Purchasing a product is not only a decision of yourself but can also be
an influence of your physical surroundings. Perez, et.al (2004). Individuals
decisions are influenced not only by advertising but also by an individuals
level of education, family beliefs, religion, socio-economic status,
community, personal goals, and other factors.
With all these influences, it might seem that a person can hardly be
blamed for making choices about consumer health products. But this would
deny self-responsibility. Consumers can make informed choices if they desire
to do so. By accepting self-responsibility, consumers can then seek out
information about the product, analyze each in its own merits, and make
wise decisions accordingly.
The variety of food and drugs available means that you must be critical
when buying a product. Some criteria for selecting health products may help
you obtain quality goods. Before buying any health products, ask the
following: does the product protect your health pocket? Who are the
manufacturers of the product? What is the reputation of manufacturing

company? What is the brand size and weight of the product? Has the product
even been tried or tested? Does it bear a seal of acceptance and high quality
standard set by the Philippine Medical Association and Bureau of Food and
Drugs (FDA)? Has the product been recommended or prescribed by the
physician? Knowing all the information before buying a health product should
be practice by the consumers.

LOCAL STUDIES
Supplement which has been labeled with No Approved Therapeutic
Claim offers wide range of varieties that most consumers buy without being
notice. It includes Food and dietary supplements with vitamins and mineral,
amino acids, proteins and other like Herbal supplements which contains
ampalaya, banaba and many more.
According to the study of Ortiz (2006), given the variety of dietary
supplements available in the market, information on the most common used
supplements, the widespread use of vitamins and minerals preparation is
probably due to the fact that these contain the most commonly known
nutrients and people believe nutrients such as vitamins are essentials to
their health. Additionally, taking one pill which contains all or most nutrients
is appealing for most people.
Differences in the study population, a lower income group, less
educated, and prominently non-users and the timing of the study could
account for the difference. This also showed that the type of supplements
used varies according to the population group studied. Differences in the

timing of the study may reflect the popularity of given supplements at a


given time.
Different type of supplement with the same promise of cure all appear
every now and then in the market, and surprisingly many take the promises
in the hope of being cured.
One of the factors that account the difference in choosing among the
varieties of supplements is the lack of education. Less-educated consumer
has different perception and understanding regarding herbal medicine. In the
past few years, the use of medicinal herbs and plants has been gaining and
became more popular in the Philippines and all over the world as more
clinical proof arises that validates the use of the old-aged alternative
medicines by the Filipinos have been passed on. (Bayalan et.al, 2008).
According to the study of Paracale (2010) Medicinal herbs may indeed
be a therapeutic option, but only if used properly and under the guidance of
a professional. We often hear the expression, Since herbal products are
natural, they are safe. Unfortunately, this is not always true, due to a
myriad of factors including that a portion of the information available about
many herbs currently on the market may be exaggerated or misleading. This
is especially true of some individuals and organizations that are mainly
interested in marketing their products only for profit, with little regard for the
personal welfare of the consumer. The consumers believe on their limited
ideas about the product that is why they purchase it without proper
knowledge.

FOREIGN LITERATURE
Health is known to be the state of humans free form illness, injury or
pain. Health is a condition of complete physical, mental, and social well20

being and the absence of disease. This is the definition of World Health
Organization (WHO). Health is very important to every person because a
healthy person can engage in daily activities normally and helps achieve
ones goal.
In general, for an individual to have a healthy lifestyle you must have a
balanced diet with enough fruits and vegetables. Plus the fact that you get
enough sleep, water, exercise and avoidance of vices such as smoking and
drinking alcoholic beverages.
Another way to get a healthy lifestyle is through taking multivitamins.
People take multivitamins because they lack in nutrients or they wanted to
stay ahead and make sure that their body is getting the essential vitamins
that they needed.
However, according to Roize (2006), people nowadays have busier
lives and hectic schedules. Thus, getting a healthy lifestyle is not easy.
According to Cutler (2013), Medical advancements have helped people
to stay healthy and live longer.
Based on World Health Organization, people nowadays are living longer
and having healthier lives than before. Although in the past few years life
expectancy in the United States increased because health hasnt improved
and people are still suffering in chronic diseases due to poor lifestyle. In the
United States healthy life expectancy is currently 79 years. Also in the same
country, healthy life expectancy declined between 1990 and 2012 (it
declined in this index from 4th position to 26th position) despite of having a
big spending in healthcare.
People of today are more educated and more motivated to stay healthy
for a long period of time yet people cant hide the fact that there is
unfathomable and ampant dispersion of diseases that come from individuals

lifestyle and diseases that are somehow caused by environmental factors


that even humans cant stop.
According to Brannon and Feist (2010), in early 1900s peoples
diseases are usually results of contact with impure and contaminated water
and foods, as well as having contacts with sick people. Once they got sick
they tend to seek for medical care, but unfortunately medicines before had
few only few cures to offer. People felt limited responsibility in contracting a
contagious disease because such disease was not controllable. The situation
has changed.

All of these diseases have concerns and have something to do with the
health of the public. According to Dawson (2009), when it talks about the
health of the public it is not just about the health of a particular individual.
Most of the knowledge about health, epidemiology and medicine depends on
data with large numbers of morbidity and mortality figures, life expectancy
rates; to sum it up, it is the data about health and population at large.
According to Caig and Stitzel (1990), people tend to think that nature
alone can remove their pain and diseases, and so they seek medication in
nature, like plants, minerals, and animals. Different medicinal agents are

collected as the basis of their symbolic qualities as well as their relation to


astrological signs and portents.
According to Bannon and Fiest (2010), the major challenge during the
20th century in the United States about health comes from an infectious
disease related in unhealthy lifestyles and behaviors. Effective treatments to
treat and cure are developed.
Health products are medicines, tablets, personal appliances, machines
and any other objects that main purpose is to cure specific condition or
promotes the well-being of an individual. Commonly used in preparations
without the doctors prescription include laxatives, pain killers, nose drops,
vitamin tablets, indigestions remedies, nerve tablets, cough mixtures,
slimming preparations, tonics, and most of these products are sold in every
supermarkets as well as pharmacist. Buyers tend to forget that it can be
dangerous to their health when frequently taken or in too large dose.

According to Allen (2005), drugs are the agent for the purpose of
diagnosis, treatment, mitigation, prevention or cure a disease of human and
animals. Different actions and effects in a human body is one of the qualities
of drugs. This quality only allows a selective use in treating a range of
common and rare conditions.
The four sources of drugs are: animals, minerals and plants, as well as
chemicals (synthetic drugs) by means biotechnology of genetic engineering.
Roots, seeds, and leaves of plants have the ability to cure illness, ease pain,
and affect the mind discovered by our ancestors. In present, many drugs are
extracted from parts of plants (Gauwitz, 2011).
According to Creighton (1975), drugs can be classified in many ways. It
can be medical, non-medical and illegal of restricted drugs. Of course, most
of us probably used medical drugs for the treatment of an illness or to relieve
pain.

Drugs with the main purpose to treat diseases or symptoms are called
medical drugs. On the other hand, drugs or medicines that are available or
can be bought without the doctors prescription are called Non-prescriptiondrugs.
A simple way is to think of medical, non-medical and illegal of
restricted drugs. Most of you have probably used medical drugs at some time
for the treatment of an illness or to relieve pain. While drugs that work on the

process.
First in the approval process is the pre-clinical or drug discovery phase

dosage level, how frequent it should be taken, and the best way of
administering (oral, topical, intravenous, etc.) this product. Toxicology of the
product is also tested in animals and other living tissues during this phase.
This process took three and a half years.

The company who has completed the pre-technical test the y can now
file an Investigational New Drug Application IND with Food and Drugs
Administration. Expedited reviews of a drug which is called Fast Track
Designation that is given to a company whose drug or biologic makes both a

If everIND was approved by FDA the experimental drugs will then
moves to Phase I which is the Human Testing .and this process takes a year.

the drug to the human body, and for the curacy dosing.
Testing the effectiveness of the drugs for a targeted disease and
determining its short-term effects is the objective of the phase II. In this
phase the experimental drug will be administered to 100-300 people; this
process takes about two years.
A large- scale study will be conducted which will test the drugs to
1000-3000 patients to know the effectiveness and the possible side effects of
the drug. The result of the phase III will be submitted to the FDA for the drug
to be approved. Aside from the testing the viability of the drug, the producer

In recent years, many people have become interested in herbal
products. Research shows that most people try an herbal product at some
time in their lives. Health food stores, grocery stores, and pharmacies all
carry some of these products. Some people take these drugs instead of their
prescription drugs, and some use them along with their prescription drugs.
Although research may someday find that these products are safe and
effective, at present these herbal products are not regulated, standardized,
or tested for safety and effectiveness. Government consider herbal products
to be nutritional supplements rather than drugs, there are no regulations to
control how they are made. There is no way to know if one leaf that is ground
up and made up into a pill will work the same as another leaf that is ground
up. Also, you cannot easily tell how much of the herbal product is in each pill,
or even if in each pill in a bottle contains the same amount of the product.
People in the United States are now using these same herbal remedies
in growing numbers, because they wish to prevent disease, treat illness, and
improve health. Because herbal therapies have such a long history in
different cultures, this may have created the impression in the minds of
some consumers that they are safe and natural and lead to a false sense of
safety and effectiveness. The fact that a product is natural does not mean
it is either effective or safe. With the growing scientific research of many
herbal products, there is growing belief on the health care community that if

herbs are effective, then they should be used under the direction of a health
care professional (Edmunds, 2009).
Believing that these products could heal them or even lower the risk of
having some kind of diseases, their beliefs created strong urge to take those
medicinal herbs and supplements. Belief constitutes as one of the
determinants why people tend to patronize a product. It is something that
one holds to be true. Our beliefs continue to be powerful and relevant drives
of human behavior and constitute a central component of the
biopsychosocial approach to explaining illness behavior (White 2005).Belief
must be some sort of association held in the mind and gained through
experience of some internal and external stimuli which predicts a particular
outcome or response. Presumably, then, the acquisition of beliefs comes
about by accumulation of those associations with the usual outcomes or
outcomes overtime (Halligan, 2006).
The power of belief in the medicine is no better illustrated than when
the doctors belief in his treatment and the patients faith (belief) in his
physician, produce a tangible therapeutic effect. (Alyward, 2006)
So with the manifestation of the dietary supplements in the market
where customers have strong faith with those products because of various
influences; because of this alarming situation, an act was passed by the
United States government which requires that the label of a dietary/ food
supplement identify it as such. The said label should state that the claims for
these supplements have not been evaluated by the Food and Drug
Administration (FDA). The list of each ingredient by name, quantity, and total
weight and must identify the parts of the plants from which each ingredients
is derived. (Beers, et.al, 2003)
The outcome of this 1994 law was that the dietary/ food supplement
manufacturers were now free to market a wide variety of products without
fear that the FDA would consider them to be drugs, requiring evidence of
solid premarketing of both effectiveness and safety (Ksir, et.al,2006).

On the other hand, they can be labeled with standardized nutrition


content claims such as high in calcium or good source of fiber. They can
also be labeled with health claims such as the product may reduce the risk
of heart disease if the product qualifies based on nutrition labeling
requirements. Dietary supplements can make other claims on product labels
not approved by the FDA such as supports the immune system or helps
maintain mental health as long as the label doesnt state or imply that the
product will prevent, cure, or treat disease (Hamilton, et.al).
Supplements may cause harm in several ways, it includes overconsumption of the product, particulary of minerals and fat-soluble vitamins
which build-up in the body. Rapid absoption of the products in a short period
of time may also cause harm, quality issues such as contamination, or by
adverse interactions with other foods and medications.
People often consider natural herbs and botanicals to be safe and even
if not effective, then at least harmless. Such is not always the case.
Sometimes, evidence of dangers accumulates only after these products have
been available for sometimes.
People often take supplements as a sort of insurance policy against
problems caused by poor diets. Although multivitamin and mineral
supplements may help fill in some of the nutrient gaps caused by poor food
habits, they cant make a bad diet good.
One of the most serious consequences of supplements results when
they are used as remedy for health problems that can be treated, but not by
vitamins or minerals. Vitamin and mineral supplements have not been found
to be an effective treatment for behavioral problems, dysfunction, hair loss,
autism, chronic fatigue syndrome, obesity, or stress, for example. (Nutrition

Because of these sudden harms of the supplements to the people, the
FTC (Federal Trade Commission) becomes the agency responsible for
governing the advertising industry. It focuses mainly to the advertising, it
identifies and eliminates ads that mislead or deceive the consumer. Other

responsibilities of FTC include fairness, deception, violations and consumer


participation.
Regulating Deception- advertisers ultimately want their customers to
trust their advertising and products, so lot of them take precautions to
ensure that their advertising message are not deceptive, misleading or
unreasonable. Making false claims or failure to make full disclosure of
important facts which was intended to mislead the consumers is a deceptive
advertising.
FTC policy on deception contains three basic elements.
1. Misleading- is when there is representation, omission or practice,
there must be a high probability that it will mislead the consumer
2. Reasonableness- is the perspective of the reasonable consumer is
used to judge deception.
3. Injurious- this policy makes deception difficult to prove because the
criteria are rather vague and hard to measure. It also creates
uncertainty for advertisers who must wait for congressional
hearings and court cases, to discover what the FTC will permit.
Regulating Substantiation- it is a claim proof which concerns on Food
and Trade Commission to know if the advertisement is misleading if so, the
advertisers should have adequate basis on their products claims and
undergo the FTC investigation. Therefore the advertiser must have data on
file to prove their claims on their advertisements. And it will be much better
if the research is made by the independent research firm. The FTC will decide
if the claims are reasonable on a case-by-case basis. FTC consider these
factors; types and specificity of claim, product type, possible consequences
of the false claims, reliance degree on consumers claims and the type and
accessibility of the available evidence for making claim. (Moriarty, et.al,
2009)
According to Edmunds (2009) health care providers should tell to the
patients tha basics facts on OTC (over the counter) products, whether it was
given verbally or in writing (prints) it is important for patients to be informed

Medications before uses different parts of plants or herbs without any
chemicals included. As technology develops, forms of our medicines
transformed and develops with the additions of chemicals that are usually
made in laboratories and needs to be approved by Food and Drugs
Administration before releasing in the market.
Those FDA approved drugs can claim or state that the products can
cure, or prevent disease. For the product to be approved, the manufacturer
need to show or prove that the product is safe and effective for the
consumers health condition. Also, in approving these products, wide-range
of preliminary research and the progressively clinical trials with the humans
participation to a three phase series is necessary. (Alzheimers Association,
2004)
Herbal Remedies and botanicals are parts of the Complemantary and
Alternative Medicine (CAM) including ayurvedic medicine. Firenzou (2007)
said that Nutritional supplement is the most commonly used among CAM
approaches.
Nowadays, these herbal medicines and supplements become available
in the market. According to Suleiman (2014), the use of Herbal Medicines
and Dietary Supplements in the world was substantially increasing; and
according to Samoljik et.al, as retrieved by Suleiman (2014). People uses
herbal medicines and dietary supplements for health maintenance, for
preventing and treatment of some chronic diseases or even minor ailments,
and sometimes they often used as a partner of a prescribed drugs while
some uses those products as an alternative to the prescribed medicine for
diseases which considered to be chronic.
When people heard that the product is made from organic ingredients
like supplements, they perceived that the product is safe. People are

attached to these approaches especially on treatments mainly because of


the advertisements with testimonials given by the said users especially
celebrities including newscasters. (Soat 2014), another factor is the
emotional and behavior of a person. (Domn, 2014)
In purchasing or engaging in a product, consumers also engage in
decision making regarding what products is to be purchased. An expression
of the self is considered as the act of choosing. Due to persons positive belief
they become devoted to a treatment by their choice; the chosen option
become imparted with positivity that will make people think that the
treatment they selected is effective. (Rose, 2014)
There are many misconceptions about the health benefits supplements
and herbal medicines offers (Deakin University of Australia, 2012). Because
the active ingredients in dietary supplements determines the quality, safety,
and efficacy of these products but it might contain some active ingredient
that may not be good in the body; and Gahehe et. Al (2011) also revealed
that these products may contain nutrients in amount as high as or higher
than the recommended intake and may lead to chemical imbalance that will
result to more serious problems.

SYNTHESIS
With the reference and sources the researchers had gathered, from
books, internet, newspapers, magazines and journal, we consider that the
literature and study presented strongly supports and are connected and
related to our proposed study which is entitled: The Lived Experiences of the
Users of the No Approved Therapeutic Claims Products. Health is defined
as the state of complete physical wellness in all aspects by the World Health
Organization where Roizen supported that by (Reviewed) being aware of the
amount of foods we eat plus exercise. That showed people in America tend

to be more aware of their health status that made them considered in taking
supplements to stay healthy and made people have recorded longer life span
from around 64 years to 70. But the fact that diseases are just around us and
are easy to disperse, we can prevent from having complicated health status.
Daniel by his Health annual auditions shared the list of top 10 leading killer
diseases including Heart disease, Cancer, Stroke and Chronic Obstructive
Lung Disease.
After listing the top diseases, bacteria are defines as one of the agents
that brings diseases. This brings further information to the people and this
adds to what the medicines includes showing figures of the benefits that
drugs provided.
According to Creighton, the term health products refers to different
types and according to Craig and Stitzel, people tend to accord herbal
products with its ability to remove pain and diseases that are readily
available in the market which can project differently through the eyes of the
consumers and disregard the thought that using those products could be
risky and dangerous especially when frequently used with a large dosage.

products demands to get higher said Halligan. Dietary supplements Health
Education Act (DSHEA) cleared out that these products must be properly
indicated with labels that these are not evaluated by the FDA, list of
ingredients by name, quantity and total weight according to Deers, Hetcher,
Jones, and Porter, which must be observed especially nowadays that dietary
supplements are free to market. It is also stated that most of the reason that

decision of the consumers towards these products, according to a study
conducted by Soat (2014) the main factor that affects consumer behavior is
the advertisements with the testimonials of public figures. But there have
been some misconceptions about these dietary supplements and herbal
medicines, it was said that the active ingredients determines the efficacy of
the product but these active ingredients may have harmful consequences.
And the excessive intake of these products may lead to chemical imbalance.
In the chapter twos Local Literature, it showed that Philippines itself
has a lot of available kinds of registered supplements in the market, 2,588 to
be specific according to the FDA. Greatly presents that our market has a wide
varieties of supplements that every consumers has the need to supply their
selves with these kinds of products, they can easily buy because of the fact
that these are indeed reachable to everyone plus the fact that these are
affordable which are all labeled with No Approved Therapeutic Claim and
not all approved by the FDA.
FDA strongly stated that supplements dont need to be approved by
them before presenting to the market for it is a food product only and not a
drug that guarantees healing. They also added that taking food supplements
rather that prescribed drugs might cause serious damage to tissues and

organs that can result to a long hospitalization or permanent damage to vital


organs.
Relying on treatment based on just hype over medical science may
lead to a serious damage such as permanent physical or mental disability it
just says that we cannot and never be solely dependents upon taking up
supplements for an overdose of a supplement could bring health hazards,
though they said that patients could talk to their doctors before directly
using a supplement because purchasing a product is not only a decision of
yourself but can also be an influence of your physical surroundings said Perez
so consumer should be more critical and wise in choosing products to buy.
Lastly, people must be guided and they must know if the products they want
to buy passed the Philippine Medical Association and Bureau of Foods and
Drugs standards.
Ortiz stated very evident that vitamins are essential to someones
health plus the fact of taking pills to fill this vitamins the body needs. Ortiz
had strongly showed and exampled Centrum which is a prominent product
that is labeled with complete A to Z vitamins that people buys both the
product and the trade line. The fact that Centrum is cheaper and very
reachable especially to the commoners makes it demand high in the market.
That is not good at all because there are organizations that are only profit

CHAPTER III:
RESEARCH METHODOLOGY
Research Method and Design
1.1

Qualitative Approach
Phenomenology, as defined by Creswell (2009), is a research strategy

of probing wherein there researcher will identify the essence of human


experiences with regard to a phenomenon as described by participants. The
goal of a phenomenological approach to qualitative research is to describe
clearly accurately the lived experiences of people, and not to create theories
or models of the phenomenon being studied. Researchers use this approach
to identify experiences of consumers taking No Approved Therapeutic
Claim products and it will also determine the level of awareness of
consumers towards No Approved Therapeutic Claim products.

Research Population
2.1 Description of the Respondents
The study is consisting of forty-five (45) participants residing at Quezon
City that are users of products that have No Approved Therapeutic Claim
label.
2.2 Method of Data Collection and Instrumentation

2.2.1 Interview as a method of data collection


Personal interviews were used as the method of data collection for this
study. Welman and Kruger (2001) set the personal interview as the
interviewer visits the participants home or workplace. For this
research, one-on-one interviews were conducted at participants

residence.
2.2.2 Instrumentation

Data are collected through semi-structured, videotaped interview with


participants by asking them open ended questions. The researcher will set
standards for their Key Informant (KI) and for the participants of the Focus
Group Discussion.

Criteria for Key Informant (KI):


Must be 18 years old and above
Must be using the product with No Approved Therapeutic Claim

label for more than 5 years


Must not skipped using the product in the span of 1 month

Criteria for the Participants of Focus Group Discussion (FGD)

Must be 18 years old and above


Must be using the product with No Approved Therapeutic Claim

label for a span of 1-5 years


Must be taking the product regularly

These criteria will serve as a guide in determining the Key Informant


and the participants for Focus Group Discussion (FGD) for this study.
Since the researchers used semi-structured interview, the interview for
the participants

will

be conducted based

upon an interview guide

questionnaire that was developed by the researchers. Interview guides are


developed iteratively, questions are developed, tested, and then refined
based on one learns from asking people these questions (Robert Wood
Johnson Foundation, n.d.). The interview questions will be developed such
that it will address phenomenological lived experiences. But first, the
researchers will be conducting a pilot study, wherein they will be sending a
try-out questionnaire to the prospective participants through house to house
approach and getting their feedback on these questionnaires. Data gathered
through pilot study provides related information about challenges and factors
that may influence experiences of the users of No Approved Therapeutic

Claim products. If the result of the pilot test is vigorous then thats the only
time the researcher can conduct an actual interview.

2.2.3 Procedure
Semi-structured interviews were used to collect accounts from

participants who are using No Approved Therapeutic Claim products. The


researchers formulated an interview guide that will be used in the study it
was focused on their experiences and awareness on No Approved
Therapeutic Claim products.
Participants were asked questions about their lived experiences on the
products with No Approved Therapeutic Claim label. Open-ended questions
were used which allow for more comprehensive individual narration of
experiences.
In order to obtain access and establish understanding, the researchers
approached and arranged to meet with each participant prior to data
collection. During the first meeting, the researchers explained the objectives
of the study, and asked for permission to conduct an interview. As the
prospective participant agreed, the researchers arranged a time and place
for the interview. Interview time schedules were arranged according to
availability of each participant. There were 4 researchers assign for each
respondent, one researcher will interview the participant, and the others will
record

and

write

the

information

gathered.

Each

interview

lasted

approximately 10-15 minutes depending on the response of the participants.

Data Analysis
3.1 Narrative Analysis
A narrative approach presents a storied account of experience and
recognizes the value of stories in the construction of meaning (Labov, 1972;
Mcleod, 1997; Sarbin and Kitsuse, 1994). Narrative analysis is concerned
with probing the means by which experience is represented and interpreted.
Experience is represented in the form of the written and spoken word. A

narrative is a story-based happening, but it contains other forms of


communication in addition to a stories. Narratives are stories which people
tell in order to make sense of their lived experience (Genette, 1998). A
narrator tells a story, but in doing so it offers something over and above the
bare story (Mcleod,1997). As story, narratives offer an in-depth account of
the individuals experience. The narrative text provides access to meaning
which is both personally and socially relevant (Freedman and Combs, 1996;
Terre Blanche and Kelly, 1999). In keeping with the purposes of this study, a
narrative approach to data analysis provides a basis from which to identify
the uniqueness of individual narratives in terms of their experiences in taking
No Approved Therapeutic Claim products. People have no idea and
unconsciously reveal the reasons for their choices and actions, but they
construct justifications and explanations why they come to be how they are
(Watson, 1996, p.260). The researchers worked with the narrative materials
or data gathered, such as the voice of the narrator (tape or text), the concept
and tools for interpretation, and the act of reading and interpretation which
is the voice of the researcher.
3.2 Thematic Content Analysis
In order to obtain a more integrated yet consistent understanding of
combined narrative results, applications of some aspects of thematic content
analysis is included in the secondary phase. Accounts are rearranged under
thematic headings like the results of storied accounts presented by research
questions for the purpose of study. as the discussion of results extends the
use of same themes in providing more comprehensive discussion and
overview results.
In early 1920s thematic is developed from traditions in content
analysis which evaluate media texts. (Eagle, 1998). Content analysis follows
a rule for a systematic process of analysis (Guba and Lincoln, 1994). A
systematic process which find to produce insights and content of data (Eagle,

1998). In adopting this approach to data analysis in this study, analysis initial
phase was focused on written interview like summarized stories from a raw
data. The results will be supported by the remaining data from participants
own words.
The steps for making inferences and analysis as discussed by Van
Manen (1990) have been applied to this study. Firstly transcriptions were
read through several times, until a strong sense of each participants storied
account was grasped. This was followed by going through the text again,
underlining and highlighting words, phrases or sentences in relevance to the
research questions. Individual stories were then rewritten in terms of these
thematic headings and illustrated by reference to participants own words.
This was followed by rewriting a combined account based on individual
stories. As co-narrator, the researchers attempted to retell participants
stories through thematic discussion of the research questions.

Summary
Chapter 3 discussed the research methodology that will be applied in
the qualitative study, which is a phenomenological research design. Also
included in Chapter 3 was information on the data collection process as well
as data analyses, which include the narrative of individuals experiences and
identifying themes from the answers of participating consumers taking No
Approved Therapeutic Claim products to their respective interviews. The
following chapter presents the results for this study, where they will be
examined and assessed.

CHAPTER IV:
RESULTS, DISCUSSION, and ANALYSIS

DEMOGRAPHIC PROFILE

The researchers from the time span of 3 months specifically from the
start of the (December) to (February) gathered data for the research entitled
" The Lived Experience of the Users of the No Approved Therapeutic Claim
Products around the barangays in Quezon City.

Having the total of forty-five (45) participants who are subject to one
on one interview which are all users of No Approved Therapeutic Claim

labelled products is composed of most female participants which are 36 and


remaining participants are male. It is observed that most of the interviewees
were female who stays at home doing chores or doing business.

The participants age ranges from:


Sixteen (16) participants ages from 54 to 59 years old, nine (9) from 60
to 65 years old, 6 ages 42 to 47 years old, nine (9) from 48 to 53 years old,
there are also two (2) from 66 to 71 years old bracket and one (1) user at 36
to 41 years old ,72 to 77 years old bracket and one (1 )user which is the
youngest at 25 years old.
It shows that the users of the NATC labelled products are on the older
brackets, which are users that usually experienced and/or still experiencing
health problems.

According to the participants' employment status, it revealed that


seventeen (17) of the participants are unemployed and twenty-one (21) selfemployed. Most of these unemployed are housewives; the others are
business involved people having sari-sari stores and other small businesses.
Still, there are 6 who are employed.

Among the participants, 33 are married, 8 of them are widowed, 3 are


single and there is a separated also. Some of the married participants were
supplied with NATC products by their sons and daughters and by their family
members; they can afford to buy NATC labelled supplements.

The participants were asked if they use the products regularly, most of
the participants answered yes. There are about 38 participants in total
while the rest of the 7 respondents arent taking it regularly for the reason
that its either expensive or they just consume it only if they have illness.

Most interviewees have been aware of the label No Approved


Therapeutic Claim and are users for span of time.
Almost half of them are users of NATC products for 1 year to 2 years
and 11 months. They are twenty-two (22) in total. Eight (8) of the other
participants are users for 5 to 9 months and is the shortest time for the
record.

There are both six (6) respondents from the span of 3 years to 4 years
and 11 months, three (3) users from 9 years to 10 years and 11 months and
both a user from 7 years to 8 years and 11 months and 11 years and above.
These span of time are the standard limit of years using the products
for qualification to interview. If a user spent 5 years and above using the
NATC products, they are qualified to be the key informant.

As the results of the one on one interviewed came out, we have noticed that
most of the interviewees health problem is having high blood pressure next
is diabetes, Urinary Tract Infection and problem with their prostate.

Participant A: Ang alam ko, hindi pa approved for medicine gaya ng
mga doctor. Ano lang yan, parang substititute lang yan. Pandagdag
ng nutrients sa katawan. Yun ang alam ko, pero hindi nakakagamot,
pandagdag lang. (I think, its not approved for medicine like on the
doctors. Its like a substitute, an additional nutrients for the body.
Thats what I know but it doesnt cure anything it only supplies)
Participant B: naka naka ano dun na gamot na iniinom mo hindi pa
ibig sabihin na nakakagaling yun (It means it doesnt cure anything)
Participant C: Ano ba iyon no approved theraphy ? ano nga ba iyon ?
no approved hindi naaprubahan sa BFAD iyan na nakakagamot parang
ano lang yan food supplement lang, kaya nilalagay na no approved
therapeutic kasi na lang BFAD yan na approved for the medicine as
additional food supplement lang yan. (The FDA doesnt approved that
medicine that it can cure. Its like food supplements only.)
Participant D: ah kasi dapat ang pag inom, diba pag synthetic drugs
kasi, yun talaga kine-claim ng mga doctor nay un ang nakakagaling,
pero pagherbal kasi alternative medicines yan na tintawag so ang mga
umiinom yung consumer dapat yung mga pasyente, hindi sila dun
nakadepends sa alternative medicine na gingagamit nila. (Usually if

herbal its like an alternative medicine and they shouldnt depend on

pala ito (Nothing. I just take it. If there are some good effects on me
then I would say that its effective)

nakakagamot. Parang supplement lang sila.. pantulong lang sila, pero
hindi sila talagang gamut na yung kagaya ng nireresita ng doctor okay
rin pwede na rin( They include it because they cannot really cure any
disease yet. Its like supplements only. It can help but they are not like
those medicine which are prescribed by the doctors, but its ok.)

gumagaling naman sila tinatry ko lang pero hindi lahat ng patalastas
sa tv ay pwede akong maniwala.kase lahat ng pinag attend ko ng
seminar, magaling silang mag influence pero kadalasan nauuwi sa
networking. (Because a lot people are testifying that it can cure thats
why I tried it but not necessarily that all commercials on the tv
influenced me. Because based on what Ive encounter on the
seminars, they are good at influencing people but sometimes it leads
to networking)

kailangan ko ng magherbal para hindi magkaproblema yung kidney ko
dahil sa mga gamot kaya magkakaroon ng sakit sa kidney. Yan ang
sabi ng doctor. (For me? It is needed because before I used medicine
for 2 years. I have high blood, I continuously used the medicine then I
got UTI. I also got complications on my kidney thats why I tried herbal

Participant C: Eh di sabi ng asawa ko, yong mga bawal, yong mga
matataba ayaw niya akong pakainin. Hindi na ano.. yung dati hindi ko
alam na High Blood ako, suka ako ng suka, nahihilo ako, umiikot yung
paningin ko, yon pala mataas ang cholesterol saka High Blood suka ng
suka buti pala nagpatingin ako yon pala High Blood na. yon nakainom
ako ng ano, gumanda na yong pakiramdam ko. Pero ngayon di ako
masyadong umiinom ng ano para sa Cholesterol, ang ginagawa ko na
lang, nagkakakain palagi ng prutas (My husband told me that I shouldt
eat this and that. Before I dont know that I have a high blood, I
continuously vomit, and feel nauseus, then I found out that I also have

Participant F: Oo.Ayun nawawala ang mga dati naming
nararamdaman na hindi normal sa isang tao uhmmm... uncomfortable
ka, kapag natake mo na yung medicine na yun mapapansin mo
magaan na mawawala na yung problema mo.. pati pagtulog mo
pagkain mo kasi yung tao kung may sakit yan ang unang naapektuhan
pagkain at pagtulog kasi yung tao hindi na makakain pag ang tao...
magana kawala ng... highblood na lang ang katapat katatakutan mo
nun. Ah ayun nga syempre kaya ginagamit mo siya as maintenance

usually buy it on Generic Drugstores and use our senior citizen card)
Participant D: hmm, wag mo lang pilitin yong sarili mo. Pagka
kunyari meron kang pambili na instead na ibibili mo ng tunay na
gamot, na sinasabi nating mga synthetic, dun mo na lang ipalit kase
mas ano siya eh. sa synthetic may inaantay ka pang sakit eh. Di ba
nagtake ka ngayon? Mag hintay ka lang ng 4 months 5 months may
another ka na namang sakit na nangyari sa akin. Yes. Oo grabe. Muntik
na rin ako sa bato kase yong synthetic na iniinom ko grabe. May
650mg, may 700, may 1000 muntik na ko sa atay ko. Sakit sa bato.
(Dont force yourself. For example, you have a money, instead of

approval na kakagamot sa ano yan, na gagaling ka. kasi wala naman
din dumaan sa kwan yan eh sa mga ano tawag dyan sa mga medical
ano yun. (It seems like theres no approval that it can heal anything,
that you will be healed, since it doesnt undergo on medical process)
Participant C: ok naman, wala naming problema (Its ok, theres no

Participant D: Diba yung Kumbaga sa ano hindi siya epektib kung
no approved oh kasi kung epektib yan is ano eh ap apru aaprubahan

explained in the seminar that this is a cure for this and that kind of
illness, even if you take prescribed medicine you should also take this
product since it can help you. Thats what I do, and it really do helped

Most of the participants are aware with the products labeled No


Approved Therapeutic Claims, they become familiar with it through T.V
commercials and they usually encounter these products at the mall.
Most of the participants perception and or ideas correspond with the
real meaning of the label No Approved Therapeutic Claims, however some
of them are not confident or sure about their answers. Data also shows that
some participants misunderstood the said disclaimer, and few of them are
using the product even if they dont have any idea regarding the label.
Advertisements of these products affect the buying decision of the
participants, companies that are engage in manufacturing and or selling
these kinds products features testimonies of the users on their T.V
commercials that greatly attract the target market. Based on the interview it
also shows that pyramiding (networking) companies a great part in
advertising the products which affects the buying decisions of the
participants , most of them bought the products from drugstores, a dealer
which is a part of a networking company, and they also bought it after
attending the seminars conducted by the said company.
Most of the participants show high frequency of usage of the products
because they used the products regularly for a long time, it was supported
by the demographic profile of the participants which shows that they already
used the products for years and most of them continuously take these
products until now.
Most of the participants experience positive effects in their health
condition while using the products, they say that it cured their diseases and
improved their health; however some of them claimed that it only provides a
temporary healing and has a side effect. Some of them said that these
products are not effective at all. In terms of the effects of the products on
their lives, some participants said that through these products, they achieve
a healthy living in the cheapest way, and they also generated income with
these products because they also becomes dealers. However, some of them
still found the products expensive, and some of them didnt affect their lives
in any way.

And also the researchers noticed that even if they know the real meaning of
the No Approved Therapeutic Claim label they still use the product as a drug
substitute

CHAPTER V:
RECOMMENDATIONS
1. As part of selling, advertisements were used in promoting the products.
Food supplements advertisements commonly show testimonies regarding the
effectiveness and other attracting details about the product for them to
make a sale.
But we noticed that some of these advertisements contain false claims such
as claiming that their products can cure specific diseases such as cancer,
hypertension, diabetes and many more; but these products are not allowed
because food/dietary supplements are not scientifically proven to treat
diseases.
The said activities obviously violates the Consumer Protection Act (Book 2,
Article 5, Section 2a) which states that: No claim in advertisements,
promotion and sponsorship, and other marketing activities shall be made
other than those contained in the approved label or packaging of the health
product, or as duly approved by FDA;
The researchers recommend that CFDR (under FDA) must pre-screen the
advertisements before submitting to Advertisement Standard Council (ASC),
to protect the consumers from the dissemination of false information.
FDA should have a strict regulation on the limitations of the food
supplements before you make advertisement to prevent misconception
about what the product. The ff. are the misconceptions encountered:

The illegal use of logo is proliferated in advertisements of No


Approved Therapeutic Claim products.
The use of false claims in advertisements about the effectiveness of
the products.
The use of testimonies to mislead the people about the effect of the
product to attract more consumers.

Any person, association, partnership or corporation who shall violate any of


the provisions of Articles 110 to 115 shall, upon conviction, be subject to a
fine of not less than Five Hundred Pesos (P500.00) but not more than Five
thousand pesos (P5, 000.00) or an imprisonment of not less than one (1)
month but not more than (6) months or both upon the discretion of the court(

Article 123; a). The said amount is too small for big businesses, for the DTI
and/or DOH, to increase the responsibility and penalties of those who violate.

Food/Dietary supplements are widely offered in the market, some of them


are not legally registered. We can see No Approved Therapeutic Claim
labelled products that are FDA approved which leaves confusion to the users
and most of the time can deceive the users. There are also cases that these
kinds of products were not absolutely registered to FDA. They do the same
activities like what registered company does, and the consumers have no
idea regarding this. According to article v. Sec. 2.a. unregistered products
are not allowed to be advertised. FDA is the agency responsible in
registration of such products and also has the power to regulate it, but
despite of the presence of these law and agency, manufacturer can still
manage to offer their product in dishonest way.
For the protection of the consumers against unregistered food supplements,
the FDA could create a standard mark to determine the legitimacy of the
product may be in any form, text, symbols etc., that can be easily
understand by the consumer. They should also specify if the registered
product is appoved as food o dugs. To avoid ambiguity.
Users of No Approved Therapeutic Claim products fail to understand the
meaning of the disclaimer. The FDA, they could create new label that is easy
to understand, much better if it is in Filipino language. This is to give the
consumers the right to be informed.
The following are the suggested label:
