Dear SE:
‘This is in response to your request that Metro-North Commuter Railroad (“Metro-North”)
provide you with records of “officers’ filming and photographing in Grand Central Station from
‘November 2014 through January 2015,” in connection with Grand Central protests including, but
not limited to:
1. _all pictures, videos, audio recordings, data, and metadata related to Grand Central
Station protests that were collected or received by your agency;
2. records describing the information collected, the dates of collection, and the
official purpose of the collection;
3. copies of files documenting the use of property within Grand Central Station
related to monitoring of the protests;
4. records describing the surveillance equipment used by officers within Grand
Central Station;
5. copies of all communications sent or received by your agency between November
2014 and January 2015 pertaining to protests in Grand Central Station;
6. __ the names of governmental organizations and private security companies who
collaborated in the collection of the information; and
7. the names of all organizations public and private with whom the information was
shared.
Item one of your request seeks pictures, videos and other recordings reflecting officers’ filming
and photographing of protests in Grand Central Terminal during the stated period. Please be
advised that the policing function at Grand Central Terminal is performed by the MTA Police
Department and other uniformed police forces such as the New York City Police Department,
not by Metro-North. Metro-North does not have under its employ police officers assigned to
police duties at Grand Central Terminal and accordingly had no “officers’ filming and
photographing in Grand Central Station from November 2014 through January 2015” protest
activities that occurred in Grand Central Terminal during that period. Films or photographs
taken by police officers, and other police records in connection with the protest activities during

the indicated period that may exist would be the property of, and in the possession of, the
pertinent police force departments.
As noted, your request by its own terms is limited to records of “officers filming and
photographing in Grand Central Station.” To avoid any tisk of confusion, Metro-North notes
that for purposes of enhancing the security of one of the busiest pedestrian crossroads in the
‘world, and what is considered by law enforcement to be a potential leading target of terrorists in
the United States, Metro-North maintains fixed location security cameras within Grand Central
‘Terminal, the locations of which and recording contents of which constitute confidential
information that is not subject to disclosure under the Freedom of Information Law. These
permanently installed security cameras at Grand Central Terminal are not operated by police
Officers and do not fit within the description contained in the FOIL request you submitted.
‘These are fixed location security cameras installed to protect the facility, not hand-held portable
‘cameras used by “law enforcement officials ... trained on protesters” between November
through January. Accordingly, Metro-North does not consider any such fixed security camera
recordings in its possession to be responsive to your FOIL request. Moreover, as noted above
and in Footnote One, Metro-North regards such fixed security camera video recordings as
‘exempt from FOIL pursuant to the indicated statutory exception.”
With respect to the second, third, fourth, sixth and seventh ? items of your request, Metro-North.
reiterates its response above: Metro-North does not have police officers in its employ engaged in
such filming, photographing and “surveillance,” or “collection” of police records, and is not the
‘custodian of police records relating to such filming and photographing by police officers of
protests occurring at Grand Central Terminal during the stated period. To the extent any such
records have been communicated to Metro-North by police officers, we refer you to our response
to Item 5 of your request, below, which addresses copies of such communications.
With respect to the fifth item of your request (denominated as “4” in your request), Metro-North
has reviewed e-mail communications for the relevant period to identify records of “officers”
filming and photographing in Grand Central Station from November 2014 through January
2015” of protest activities, such as are contained in communications that were sent or received

December videos were no longer avaliable atthe time of the requests receipt, as the security camera video
recordings are regularly recycled.

any person.” In accordance with this provision, the location and contact information of the MTA
Police personnel named in the emails, as well as the names of undercover police officers, have
been redacted.
