Rape with Homicide

SUSPECT: Mr. Leo Echegaray Y Sanchez, married, 40 years old, jobless, native of Samar and
presently residing at Sitio Purok Dos Tanglaw Dela Paz, Antipolo City.
VICTIM :
Ms. Sarah Balabagan Nee Lopez, single, 19years old, student, native of
Pangasinan and presently residing at Block 6 Lot 9 Antipolo Hills Subd. , Antipolo City.
WITNESS : Ms. Sheila Garcia Nee Ramirez, single, 18 years old, student, native of Batangas
and presently residing at Block 1 Lot 3 Antipolo Hills Subd. , Antipolo City.
COMPLAINANT : Mrs. Nelinda Balabagan Nee Lopez, widowed, 55 years old, employed,
native of Pangasinan and presently residing at Block 6 Lot 9 Antipolo Hills Subd. , Antipolo
City.
TIME/DATE/PLACE OF OCCURRENCE (TDPO) : On or about 11:30PM July 24, 2016 along
Upecho Street Brgy. Dela Paz, Antipolo City.
ARRESTING OFFICER/S : PO2 Ezekiel Pena and PO1 Harold Apelado both members of
Antipolo City Police Station.

FACTS OF THE CASE :
Initial inquiry, as the witness walking along the Upecho Street from school going
home. Suddenly, she heard a voice coming from a girl screaming for help. She approach slowly
to the place where the noise coming from and personally witnessed a girl that was been forcely
pulled and laid down by the unknown person she witness how the suspect raped and stabbed the
victim several times. The witness run and immediately proceeded to the nearest police station
and stated the incident. The arresting officers responded immediately to the said location and
were able to seized and apprehend the suspect who has about to escape having the possession of
a knife. The SOCO Team arrived and inspect the victim and was declared dead due to a multiple
stab wounds in different parts of the body. The evidence and cadaver of the victim were brought
to the PNP Crime Laboratory for autopsy and proper disposition. The suspect was brought to the
nearest hospital for medical assistant and later turned over to this station for further investigation
and uprising of his constitutional rights.

On this given date and time, a person one Sheila
Garcia Nee Ramirez, single, 18 years old , student ,
native of Batangas and presently residing at Block 1
Lot 3 Antipolo Hills, Antipolo City. Was appeared and
reported to this station an alleged rape and stabbing
incident transpired on or about 11:30PM of July 24,
2016 along Upecho St. Brgy. Dela Paz Antipolo City.
The witness personally identified the suspect as one
Leo Echegaray Y Sanchez, married, 40 years old,
jobless, native of Samar and presently residing at Sitio
Purok Dos Tanglaw Dela Paz, Antipolo City and the
victim as Sarah Balabagan Nee Lopez, single, 19 years
old, student, native of Pangasinan and presently
residing at Block 6 Lot 9 Antipolo Hills Subd. ,
Antipolo City.
Accordingly, the victim is walking along Upecho
St. going to home. Suddenly, she heard a voice coming
from a girl screaming for help. She approach slowly to
the place where the noise is coming from and
personally witnessed a girl that was been forcely pulled
and laid down by the unknown person she witness how
the suspect raped and stabbed the victim several times
and run immediately to this station.
Upon the receipt of this information, the operatives
composed of PO2 Ezekiel Pena and PO1 Harold
Apelado were immediately dispatched to this station
and responded the incident.
On this ngiven date and time, PO2 Ezekiel Pena
and Po1 Harold Apelado turned over to this station the
above cited suspect and was able to brought first to the
nearest hospital for medical test and was able to well
informed him the nature of his accusation and his
constitution room.

3. The rape with homicide crime transpired on or about 11:30PM of July 24, 2016

III.

FACTS OF THE CASE

Investigation revealed that on or about 11:50PM of July 24, 2016, a person
Sheila Garcia nee Lopez, single, 19 years old, student, native of Batangas and
presently residing at Block 1 Lot 3 Antipolo Hills, Subd., Antipolo City was appeared
and reported to this office regarding the rape with homicide incident she witnessed,
Accordingly, She saw on how the suspect forcely pulled and laid down the victim and
witness how the suspect raped and stabbed the victim several times. The witness
personally identified the suspect who she called as Mang Leo as one Leo
Echegaray Y Sanchez, married, 40 years old, jobless, native of Samar and presently
residing at Sito Purok Dos Tanglaw Dela Paz, Antipolo City. The witness was able to
identified the victim as her schoolmate as one Ms. Sarah Balabagan nee Lopez,
single, 19 years old, student, native of Pangasinan and presently residing at Block 6
Lot 9 Antipolo Hills, Antipolo City. The operatives immediately responded to the said
location and was able to seized and arrest the suspect who was on the act of escaping
having the possession of a knife. The SOCO Team arrived and inspect the body of the
victim and declared as dead on the spot due to a multiple stab wounds. The evidence

and cadaver of the victim were brought to the PNP Crime Laboratory for autopsy and
proper disposition. The suspect was brought to the nearest hospital for medical
assistance and later turned over to this station for further investigation and uprising of
his constitutional rights.
IV.

DISCUSSION
In this instant case under investigation, the suspect was positively
identified by the witness as the primary reliable for the commission of the rape
with homicide and was arrested by the arresting officers to a hot pursuit operation
having on his possession of a knife.

V.

FINDINGS
The result for post mortem examination and autopsy report of the sexual
part of the victims cadaver, yield a positive result for presence of the suspects
semen.

VI.

CONCLUSION
After a careful perusal surrounding this particular incident, probable cause
exists that the herein suspect is criminally liable, for violation of Art. 335 (Rape)
with Art. 249 (Homicide) of the revised penal code, wherein the person accussed.

VII.

RECOMMENDATION
Let this particular case can be furnished to the prosecutors for proper action and
disposition.
