JUDICIAL AFFIDAVIT OF MICHAEL M. SAMSON

I, Michael M. Samson, 56 years old, single, and living at #143 Maypajo St.
Rockwell Village, Taguig, witness for the prosecution in this case, states under
oath that:

PRELIMINARY STATEMENT

The person examining me is Atty. Edzen Garcia with address at 10

General Avenue, GSIS Village, Quezon City. The examination is being held at
the same address. I am answering his questions voluntarily, to the best of my

knowledge and fully conscious that I do so under oath and may face criminal
liability for false testimony and perjury.

PURPOSE
This affidavit/testimony of witness Michael M. Samson is being offered as
expert witness to explain the concept of intersex and to prove that the petitioner is
a female suffering from partial androgen insensitivity, an intersex condition.

Q: Please state your name and other personal circumstances for the record.
A: I am Michael M. Samson, 56 years old, single, and living at #143

Maypajo St. Rockwell Village, Taguig.

Q: What is your profession?
A: I am a professional surgeon.
Q: When and where did you graduate from medicine?
A: I graduated from UST in 1975.
Q: Where did you practice medicine after graduation?
A: I spent most of my years after graduation as a surgeon in St. Lukes

Medical Hospital in Quezon City before I went abroad.

Q: Where did you go after that?
A: I went to the United States.
Q: When was that?
A: Around 1980.
Q: What did you do in the United States?
A: I went to study more in the field of surgery.
Q: What is that field of surgery?
A: I was fascinated by reconstructive surgery, more so in the field of intersex

surgery.
Q: What is intersex condition?
A: A variety of conditions that leads to atypical development of physical sex
characteristics are collectively referred to as intersex conditions. These
conditions can involve abnormalities of the external genitals, internal
reproductive organs, sex chromosomes or sex-related hormones.

 Q: How common are these intersex conditions?

A: Intersex conditions are not always accurately diagnosed.

Experts

sometimes disagree on exactly what qualifies as intersex condition and

government agencies do not collect statistics about intersex individuals.
Some experts estimate that as many as 1 in every 1,500 babies is born with
genitals that cannot easily be classified as male or female.
Q: What are some examples of Intersex Conditions?
A: Congenital Adrenal Hyperplasia in which overproduction of hormones in
the adrenal gland causes masculinization of the genitals in female infants. 5alpha-reductase deficiency in which low levels of an enzyme, 5-alphareductase cause incomplete masculinization of the genitals in male infants,
Partial androgen insensitivity, which cells do not respond normally to
testosterone and related hormones, causing incomplete masculinization of
the genitals in male infants, etc.
Q: Are these conditions always apparent at birth?
A: Not always. Some intersex conditions cause babies to be born with
genitals that cannot easily be classified as male or female (called ambiguous

genitals). These intersex conditions are usually recognized at birth.

Q: When did you meet the petitioner?
A: It was in 1992 almost two years after I came back from the United States.
Q: Why was she referred to you?
A: She was referred to me by another surgeon in St. Lukes Medical

Hospital.
Q: What was her condition back then?
A: Twinkle was born with a penis; however her male reproductive organs are
underdeveloped. She has an ovary with a potential to develop later in life
but she was born without a vagina.
Q: How do you call this condition?

 A: Partial androgen insensitivity, in which cells do not respond normally to

testosterone and related hormones, causing incomplete masculinization of

the genitals in male infants.

Q: What do you think would be the appropriate intervention?
A: Surgery, of course.
Q: What kind of surgery?
A: I need to provide an opening for menstruation during the puberty stage

and I need to operate on her as an infant for the operation to be successful.

Q: How did the parents reacted when you discussed this to them?
A: Her parents consented to let her undergo surgery.
Q: What happened after the surgery?
A: The surgery was successful since it is usually easier to hide the female

genitalia than the males.

Q: Which is more developed if Twinkle has both reproductive systems?
A: The female reproductive system, except that she has no vagina at the time
of birth.
Q: What about the male genitalia?
A: It was not developed upon birth.

Both testes and penis were

underdeveloped.
Q: In your professional opinion, is Twinkle a male or a female upon birth?
A: Twinkle is a female.
