SECTION101GENERAL
[A]101.1Title.
TheseregulationsshallbeknownastheBuildingCodeof[NAMEOFJURISDICTION],hereinafterreferred
toasthiscode.
[A]101.2Scope.
Theprovisionsofthiscodeshallapplytotheconstruction,alteration,relocation,enlargement,replacement,
repair,equipment,useandoccupancy,location,maintenance,removalanddemolitionofeverybuildingor
structureoranyappurtenancesconnectedorattachedtosuchbuildingsorstructures.
Exception:Detachedoneandtwofamilydwellingsandmultiplesinglefamilydwellings(townhouses)not
morethanthreestoriesabovegradeplaneinheightwithaseparatemeansofegress,andtheiraccessory
structuresnotmorethanthreestoriesabovegradeplaneinheight,shallcomplywiththeInternational
ResidentialCode.

Thepurposeofthiscodeistoestablishtheminimumrequirementstoprovideareasonablelevelofsafety,public
healthandgeneralwelfarethroughstructuralstrength,meansofegressfacilities,stability,sanitation,adequate
lightandventilation,energyconservation,andsafetytolifeandpropertyfromfireandotherhazardsattributed
tothebuiltenvironmentandtoprovideareasonablelevelofsafetytofirefightersandemergencyresponders

TheprovisionsoftheInternationalPropertyMaintenanceCodeshallapplytoexistingstructuresandpremises

InternationalPropertyMaintenanceCode,orasisdeemednecessarybythebuildingofficialforthegeneral
safetyandwelfareoftheoccupantsandthepublic.
PART2ADMINISTRATIONANDENFORCEMENT
SECTION103DEPARTMENTOFBUILDINGSAFETY
[A]103.1Creationofenforcementagency.
TheDepartmentofBuildingSafetyisherebycreatedandtheofficialinchargethereofshallbeknownasthe
buildingofficial.
[A]103.2Appointment.
Thebuildingofficialshallbeappointedbythechiefappointingauthorityofthejurisdiction.
[A]103.3Deputies.
Inaccordancewiththeprescribedproceduresofthisjurisdictionandwiththeconcurrenceoftheappointing
authority,thebuildingofficialshallhavetheauthoritytoappointadeputybuildingofficial,therelatedtechnical
officers,inspectors,planexaminersandotheremployees.Suchemployeesshallhavepowersasdelegatedbythe
buildingofficial.Forthemaintenanceofexistingproperties,seetheInternationalPropertyMaintenanceCode.
SECTION104DUTIESANDPOWERSOFBUILDINGOFFICIAL
[A]104.1General.
Thebuildingofficialisherebyauthorizedanddirectedtoenforcetheprovisionsofthiscode.Thebuilding
officialshallhavetheauthoritytorenderinterpretationsofthiscodeandtoadoptpoliciesandproceduresin
ordertoclarifytheapplicationofitsprovisions.Suchinterpretations,policiesandproceduresshallbein
compliancewiththeintentandpurposeofthiscode.Suchpoliciesandproceduresshallnothavetheeffectof
waivingrequirementsspecificallyprovidedforinthiscode.
[A]104.2Applicationsandpermits.
Thebuildingofficialshallreceiveapplications,reviewconstructiondocumentsandissuepermitsforthe
erection,andalteration,demolitionandmovingofbuildingsandstructures,inspectthepremisesforwhichsuch
permitshavebeenissuedandenforcecompliancewiththeprovisionsofthiscode.
[A]104.2.1Determinationofsubstantiallyimprovedorsubstantiallydamagedexistingbuildingsand
structuresinfloodhazardareas.
Forapplicationsforreconstruction,rehabilitation,repair,alteration,additionorotherimprovementofexisting
buildingsorstructureslocatedinfloodhazardareas,thebuildingofficialshalldetermineiftheproposedwork
constitutessubstantialimprovementorrepairofsubstantialdamage.Wherethebuildingofficialdeterminesthat
theproposedworkconstitutessubstantialimprovementorrepairofsubstantialdamage,andwhererequiredby
thiscode,thebuildingofficialshallrequirethebuildingtomeettherequirementsofSection1612.
[A]104.3Noticesandorders.
Thebuildingofficialshallissuenecessarynoticesororderstoensurecompliancewiththiscode.
[A]104.4Inspections.
Thebuildingofficialshallmaketherequiredinspections,orthebuildingofficialshallhavetheauthorityto

acceptreportsofinspectionbyapprovedagenciesorindividuals.Reportsofsuchinspectionsshallbeinwriting
andbecertifiedbyaresponsibleofficerofsuchapprovedagencyorbytheresponsibleindividual.Thebuilding
officialisauthorizedtoengagesuchexpertopinionasdeemednecessarytoreportuponunusualtechnicalissues
thatarise,subjecttotheapprovaloftheappointingauthority.
[A]104.5Identification.
Thebuildingofficialshallcarryproperidentificationwheninspectingstructuresorpremisesintheperformance
ofdutiesunderthiscode.
[A]104.6Rightofentry.
Whereitisnecessarytomakeaninspectiontoenforcetheprovisionsofthiscode,orwherethebuildingofficial
hasreasonablecausetobelievethatthereexistsinastructureoruponapremisesaconditionthatiscontraryto
orinviolationofthiscodethatmakesthestructureorpremisesunsafe,dangerousorhazardous,thebuilding
officialisauthorizedtoenterthestructureorpremisesatreasonabletimestoinspectortoperformtheduties
imposedbythiscode,providedthatifsuchstructureorpremisesbeoccupiedthatcredentialsbepresentedtothe
occupantandentryrequested.Ifsuchstructureorpremisesisunoccupied,thebuildingofficialshallfirstmakea
reasonableefforttolocatetheownerorotherpersonhavingchargeorcontrolofthestructureorpremisesand
requestentry.Ifentryisrefused,thebuildingofficialshallhaverecoursetotheremediesprovidedbylawto
secureentry.
[A]104.7Departmentrecords.
Thebuildingofficialshallkeepofficialrecordsofapplicationsreceived,permitsandcertificatesissued,fees
collected,reportsofinspections,andnoticesandordersissued.Suchrecordsshallberetainedintheofficial
recordsfortheperiodrequiredforretentionofpublicrecords.
[A]104.8Liability.
Thebuildingofficial,memberoftheboardofappealsoremployeechargedwiththeenforcementofthiscode,
whileactingforthejurisdictioningoodfaithandwithoutmaliceinthedischargeofthedutiesrequiredbythis
codeorotherpertinentlaworordinance,shallnottherebybecivillyorcriminallyrenderedliablepersonallyand
isherebyrelievedfrompersonalliabilityforanydamageaccruingtopersonsorpropertyasaresultofanyactor
byreasonofanactoromissioninthedischargeofofficialduties.
[A]104.8.1Legaldefense.
Anysuitorcriminalcomplaintinstitutedagainstanofficeroremployeebecauseofanactperformedbythat
officeroremployeeinthelawfuldischargeofdutiesandundertheprovisionsofthiscodeshallbedefendedby
legalrepresentativesofthejurisdictionuntilthefinalterminationoftheproceedings.Thebuildingofficialorany
subordinateshallnotbeliableforcostinanyaction,suitorproceedingthatisinstitutedinpursuanceofthe
provisionsofthiscode.
[A]104.9Approvedmaterialsandequipment.
Materials,equipmentanddevicesapprovedbythebuildingofficialshallbeconstructedandinstalledin
accordancewithsuchapproval.
[A]104.9.1Usedmaterialsandequipment.
Theuseofusedmaterialsthatmeettherequirementsofthiscodefornewmaterialsispermitted.Used
equipmentanddevicesshallnotbereusedunlessapprovedbythebuildingofficial.
[A]104.10Modifications.
Wheretherearepracticaldifficultiesinvolvedincarryingouttheprovisionsofthiscode,thebuildingofficial
shallhavetheauthoritytograntmodificationsforindividualcases,uponapplicationoftheownerortheowners
authorizedagent,providedthatthebuildingofficialshallfirstfindthatspecialindividualreasonmakesthestrict
letterofthiscodeimpractical,themodificationisincompliancewiththeintentandpurposeofthiscodeandthat
suchmodificationdoesnotlessenhealth,accessibility,lifeandfiresafetyorstructuralrequirements.Thedetails
ofactiongrantingmodificationsshallberecordedandenteredinthefilesofthedepartmentofbuildingsafety.

[A]104.10.1Floodhazardareas.
Thebuildingofficialshallnotgrantmodificationstoanyprovisionrequiredinfloodhazardareasasestablished
bySection1612.3unlessadeterminationhasbeenmadethat:
1.Ashowingofgoodandsufficientcausethattheuniquecharacteristicsofthesize,configurationortopography
ofthesiterendertheelevationstandardsofSection1612inappropriate.
2.Adeterminationthatfailuretograntthevariancewouldresultinexceptionalhardshipbyrenderingthelot
undevelopable.
3.Adeterminationthatthegrantingofavariancewillnotresultinincreasedfloodheights,additionalthreatsto
publicsafety,extraordinarypublicexpense,causefraudonorvictimizationofthepublic,orconflictwith
existinglawsorordinances.
4.Adeterminationthatthevarianceistheminimumnecessarytoaffordrelief,consideringthefloodhazard.
5.Submissiontotheapplicantofwrittennoticespecifyingthedifferencebetweenthedesignfloodelevationand
theelevationtowhichthebuildingistobebuilt,statingthatthecostoffloodinsurancewillbecommensurate
withtheincreasedriskresultingfromthereducedfloorelevation,andstatingthatconstructionbelowthedesign
floodelevationincreasesriskstolifeandproperty.
[A]104.11Alternativematerials,designandmethodsofconstructionandequipment.
Theprovisionsofthiscodearenotintendedtopreventtheinstallationofanymaterialortoprohibitanydesign
ormethodofconstructionnotspecificallyprescribedbythiscode,providedthatanysuchalternativehasbeen
approved.Analternativematerial,designormethodofconstructionshallbeapprovedwherethebuilding
officialfindsthattheproposeddesignissatisfactoryandcomplieswiththeintentoftheprovisionsofthiscode,
andthatthematerial,methodorworkofferedis,forthepurposeintended,notlessthantheequivalentofthat
prescribedinthiscodeinquality,strength,effectiveness,fireresistance,durabilityandsafety.Wherethe
alternativematerial,designormethodofconstructionisnotapproved,thebuildingofficialshallrespondin
writing,statingthereasonswhythealternativewasnotapproved.
[A]104.11.1Researchreports.
Supportingdata,wherenecessarytoassistintheapprovalofmaterialsorassembliesnotspecificallyprovided
forinthiscode,shallconsistofvalidresearchreportsfromapprovedsources.
[A]104.11.2Tests.
Wheneverthereisinsufficientevidenceofcompliancewiththeprovisionsofthiscode,orevidencethata
materialormethoddoesnotconformtotherequirementsofthiscode,orinordertosubstantiateclaimsfor
alternativematerialsormethods,thebuildingofficialshallhavetheauthoritytorequiretestsasevidenceof
compliancetobemadeatnoexpensetothejurisdiction.Testmethodsshallbeasspecifiedinthiscodeorby
otherrecognizedteststandards.Intheabsenceofrecognizedandacceptedtestmethods,thebuildingofficial
shallapprovethetestingprocedures.Testsshallbeperformedbyanapprovedagency.Reportsofsuchtestsshall
beretainedbythebuildingofficialfortheperiodrequiredforretentionofpublicrecords.
SECTION105PERMITS
[A]105.1Required.
Anyownerorownersauthorizedagentwhointendstoconstruct,enlarge,alter,repair,move,demolishor
changetheoccupancyofabuildingorstructure,ortoerect,install,enlarge,alter,repair,remove,convertor
replaceanyelectrical,gas,mechanicalorplumbingsystem,theinstallationofwhichisregulatedbythiscode,or
tocauseanysuchworktobeperformed,shallfirstmakeapplicationtothebuildingofficialandobtainthe
requiredpermit.

[A]105.1.1Annualpermit.
Insteadofanindividualpermitforeachalterationtoanalreadyapprovedelectrical,gas,mechanicalor
plumbinginstallation,thebuildingofficialisauthorizedtoissueanannualpermituponapplicationthereforto
anyperson,firmorcorporationregularlyemployingoneormorequalifiedtradepersonsinthebuilding,structure
oronthepremisesownedoroperatedbytheapplicantforthepermit.
[A]105.1.2Annualpermitrecords.
Thepersontowhomanannualpermitisissuedshallkeepadetailedrecordofalterationsmadeundersuch
annualpermit.Thebuildingofficialshallhaveaccesstosuchrecordsatalltimesorsuchrecordsshallbefiled
withthebuildingofficialasdesignated.
[A]105.2Workexemptfrompermit.
Exemptionsfrompermitrequirementsofthiscodeshallnotbedeemedtograntauthorizationforanyworktobe
doneinanymannerinviolationoftheprovisionsofthiscodeoranyotherlawsorordinancesofthis
jurisdiction.Permitsshallnotberequiredforthefollowing:
Building:
1.Onestorydetachedaccessorystructuresusedastoolandstoragesheds,playhousesandsimilaruses,provided
thefloorareaisnotgreaterthan120squarefeet(11m2).
2.Fencesnotover7feet(2134mm)high.
3.Oilderricks.
4.Retainingwallsthatarenotover4feet(1219mm)inheightmeasuredfromthebottomofthefootingtothe
topofthewall,unlesssupportingasurchargeorimpoundingClassI,IIorIIIAliquids.
5.Watertankssupporteddirectlyongradeifthecapacityisnotgreaterthan5,000gallons(18925L)andthe
ratioofheighttodiameterorwidthisnotgreaterthan2:1.
6.Sidewalksanddrivewaysnotmorethan30inches(762mm)aboveadjacentgrade,andnotoveranybasement
orstorybelowandarenotpartofanaccessibleroute.
7.Painting,papering,tiling,carpeting,cabinets,countertopsandsimilarfinishwork.
8.Temporarymotionpicture,televisionandtheaterstagesetsandscenery.
9.PrefabricatedswimmingpoolsaccessorytoaGroupR3occupancythatarelessthan24inches(610mm)
deep,arenotgreaterthan5,000gallons(18925L)andareinstalledentirelyaboveground.
10.Shadeclothstructuresconstructedfornurseryoragriculturalpurposes,notincludingservicesystems.

Thebuildingofficialisauthorizedtoacceptreportsofapprovedinspectionagencies,providedsuchagencies
satisfytherequirementsastoqualificationsandreliability.
[A]110.5Inspectionrequests.
Itshallbethedutyoftheholderofthebuildingpermitortheirdulyauthorizedagenttonotifythebuilding
officialwhenworkisreadyforinspection.Itshallbethedutyofthepermitholdertoprovideaccesstoand
meansforinspectionsofsuchworkthatarerequiredbythiscode.
[A]110.6Approvalrequired.
Workshallnotbedonebeyondthepointindicatedineachsuccessiveinspectionwithoutfirstobtainingthe
approvalofthebuildingofficial.Thebuildingofficial,uponnotification,shallmaketherequestedinspections
andshalleitherindicatetheportionoftheconstructionthatissatisfactoryascompleted,ornotifythepermit
holderorhisorheragentwhereinthesamefailstocomplywiththiscode.Anyportionsthatdonotcomplyshall
becorrectedandsuchportionshallnotbecoveredorconcealeduntilauthorizedbythebuildingofficial.
SECTION111CERTIFICATEOFOCCUPANCY
[A]111.1Useandoccupancy.
Abuildingorstructureshallnotbeusedoroccupied,andachangeintheexistinguseoroccupancy
classificationofabuildingorstructureorportionthereofshallnotbemade,untilthebuildingofficialhasissued
acertificateofoccupancythereforasprovidedherein.Issuanceofacertificateofoccupancyshallnotbe
construedasanapprovalofaviolationoftheprovisionsofthiscodeorofotherordinancesofthejurisdiction.
Exception:CertificatesofoccupancyarenotrequiredforworkexemptfrompermitsinaccordancewithSection
105.2.
[A]111.2Certificateissued.
Afterthebuildingofficialinspectsthebuildingorstructureanddoesnotfindviolationsoftheprovisionsofthis
codeorotherlawsthatareenforcedbythedepartmentofbuildingsafety,thebuildingofficialshallissuea
certificateofoccupancythatcontainsthefollowing:
1.Thebuildingpermitnumber.
2.Theaddressofthestructure.
3.Thenameandaddressoftheownerortheownersauthorizedagent.
4.Adescriptionofthatportionofthestructureforwhichthecertificateisissued.
5.Astatementthatthedescribedportionofthestructurehasbeeninspectedforcompliancewiththe
requirementsofthiscodefortheoccupancyanddivisionofoccupancyandtheuseforwhichtheproposed
occupancyisclassified.
6.Thenameofthebuildingofficial.
7.Theeditionofthecodeunderwhichthepermitwasissued.
8.Theuseandoccupancy,inaccordancewiththeprovisionsofChapter3.
9.ThetypeofconstructionasdefinedinChapter6.

informationsupplied,orwhereitisdeterminedthatthebuildingorstructureorportionthereofisinviolationof
anyordinanceorregulationoranyoftheprovisionsofthiscode.
SECTION112SERVICEUTILITIES
[A]112.1Connectionofserviceutilities.
Apersonshallnotmakeconnectionsfromautility,sourceofenergy,fuelorpowertoanybuildingorsystem
thatisregulatedbythiscodeforwhichapermitisrequired,untilreleasedbythebuildingofficial.
[A]112.2Temporaryconnection.
Thebuildingofficialshallhavetheauthoritytoauthorizethetemporaryconnectionofthebuildingorsystemto
theutility,sourceofenergy,fuelorpower.
[A]112.3Authoritytodisconnectserviceutilities.
Thebuildingofficialshallhavetheauthoritytoauthorizedisconnectionofutilityservicetothebuilding,
structureorsystemregulatedbythiscodeandthereferencedcodesandstandardssetforthinSection101.4in
caseofemergencywherenecessarytoeliminateanimmediatehazardtolifeorpropertyorwheresuchutility
connectionhasbeenmadewithouttheapprovalrequiredbySection112.1or112.2.Thebuildingofficialshall
notifytheservingutility,andwhereverpossibletheownerandoccupantofthebuilding,structureorservice
systemofthedecisiontodisconnectpriortotakingsuchaction.Ifnotnotifiedpriortodisconnecting,theowner
oroccupantofthebuilding,structureorservicesystemshallbenotifiedinwriting,assoonaspractical
thereafter.
SECTION113BOARDOFAPPEALS
[A]113.1General.
Inordertohearanddecideappealsoforders,decisionsordeterminationsmadebythebuildingofficialrelative
totheapplicationandinterpretationofthiscode,thereshallbeandisherebycreatedaboardofappeals.The
boardofappealsshallbeappointedbytheapplicablegoverningauthorityandshallholdofficeatitspleasure.
Theboardshalladoptrulesofprocedureforconductingitsbusiness.
[A]113.2Limitationsonauthority.
Anapplicationforappealshallbebasedonaclaimthatthetrueintentofthiscodeortheruleslegallyadopted
thereunderhavebeenincorrectlyinterpreted,theprovisionsofthiscodedonotfullyapplyoranequallygoodor
betterformofconstructionisproposed.Theboardshallnothaveauthoritytowaiverequirementsofthiscode.
[A]113.3Qualifications.
Theboardofappealsshallconsistofmemberswhoarequalifiedbyexperienceandtrainingtopassonmatters
pertainingtobuildingconstructionandarenotemployeesofthejurisdiction.

Thebuildingofficialisauthorizedtoserveanoticeofviolationororderonthepersonresponsibleforthe
erection,construction,alteration,extension,repair,moving,removal,demolitionoroccupancyofabuildingor
structureinviolationoftheprovisionsofthiscode,orinviolationofapermitorcertificateissuedunderthe
provisionsofthiscode.Suchordershalldirectthediscontinuanceoftheillegalactionorconditionandthe
abatementoftheviolation.
[A]114.3Prosecutionofviolation.
Ifthenoticeofviolationisnotcompliedwithpromptly,thebuildingofficialisauthorizedtorequestthelegal
counselofthejurisdictiontoinstitutetheappropriateproceedingatlaworinequitytorestrain,correctorabate
suchviolation,ortorequiretheremovalorterminationoftheunlawfuloccupancyofthebuildingorstructurein
violationoftheprovisionsofthiscodeoroftheorderordirectionmadepursuantthereto.
[A]114.4Violationpenalties.
Anypersonwhoviolatesaprovisionofthiscodeorfailstocomplywithanyoftherequirementsthereoforwho
erects,constructs,altersorrepairsabuildingorstructureinviolationoftheapprovedconstructiondocumentsor
directiveofthebuildingofficial,orofapermitorcertificateissuedundertheprovisionsofthiscode,shallbe
subjecttopenaltiesasprescribedbylaw.
SECTION115STOPWORKORDER
[A]115.1Authority.
Wherethebuildingofficialfindsanyworkregulatedbythiscodebeingperformedinamannereithercontraryto
theprovisionsofthiscodeordangerousorunsafe,thebuildingofficialisauthorizedtoissueastopworkorder.
[A]115.2Issuance.
Thestopworkordershallbeinwritingandshallbegiventotheownerofthepropertyinvolved,theowners
authorizedagentorthepersonperformingthework.Uponissuanceofastopworkorder,thecitedworkshall
immediatelycease.Thestopworkordershallstatethereasonfortheorderandtheconditionsunderwhichthe
citedworkwillbepermittedtoresume.
[A]115.3Unlawfulcontinuance.
Anypersonwhoshallcontinueanyworkafterhavingbeenservedwithastopworkorder,exceptsuchworkas
thatpersonisdirectedtoperformtoremoveaviolationorunsafecondition,shallbesubjecttopenaltiesas
prescribedbylaw.
SECTION116UNSAFESTRUCTURESANDEQUIPMENT
[A]116.1Conditions.
Structuresorexistingequipmentthatareorhereafterbecomeunsafe,insanitaryordeficientbecauseof
inadequatemeansofegressfacilities,inadequatelightandventilation,orthatconstituteafirehazard,orare
otherwisedangeroustohumanlifeorthepublicwelfare,orthatinvolveillegalorimproperoccupancyor
inadequatemaintenance,shallbedeemedanunsafecondition.Unsafestructuresshallbetakendownand
removedormadesafe,asthebuildingofficialdeemsnecessaryandasprovidedforinthissection.Avacant
structurethatisnotsecuredagainstentryshallbedeemedunsafe.

Thebuildingofficialshallcauseareporttobefiledonanunsafecondition.Thereportshallstatetheoccupancy

withinastipulatedtime.Suchnoticeshallrequirethepersonthusnotifiedtodeclareimmediatelytothebuilding
officialacceptanceorrejectionofthetermsoftheorder.
[A]116.4Methodofservice.
Suchnoticeshallbedeemedproperlyservedifacopythereofis(a)deliveredtotheownerpersonally(b)sent
bycertifiedorregisteredmailaddressedtotheowneratthelastknownaddresswiththereturnreceiptrequested
or(c)deliveredinanyothermannerasprescribedbylocallaw.Ifthecertifiedorregisteredletterisreturned
showingthattheletterwasnotdelivered,acopythereofshallbepostedinaconspicuousplaceinoraboutthe
structureaffectedbysuchnotice.Serviceofsuchnoticeintheforegoingmannerupontheownersagentorupon
thepersonresponsibleforthestructureshallconstituteserviceofnoticeupontheowner.
[A]116.5Restoration.
Wherethestructureorequipmentdeterminedtobeunsafebythebuildingofficialisrestoredtoasafecondition,
totheextentthatrepairs,alterationsoradditionsaremadeorachangeofoccupancyoccursduringthe
restorationofthestructure,suchrepairs,alterations,additionsandchangeofoccupancyshallcomplywiththe
requirementsofSection105.2.2andtheInternationalExistingBuildingCode.
