1.0

PART 1. PARAMETERS

1.1

Introduction
The Outward Bound Oman (OBO) currently rents a property in Al Hail but has been granted
permission by the Ministry of Social Development to construct a purpose designed new head
office/base camp at Al Khoud.
This Design Requirement is a guide to the design and gives the requirements and
performance of the building but does not pretend to design the structure (this is the task for
the architectural designer appointed on this project).

1.2

Project Goals & Objectives


OBO would like to be located in their own unique purpose designed head office facility.
The objective is that the building is the main point of entry/contact for many parties, other
than OBO staff, such as:

Students
Trainers
Educational Establishments
Corporate
Journalists (Domestic & International)
Ministry of Social development
Ministry of Tourism
Any public taking an interest in these type of activities

The building must reflect the aspirations of the OBO to impart life experience and aims of
Outward Bound for young people and older people fostering teamwork and problem solving
all set in the beautiful surroundings of Omans nature (Mountains and Desert).
The design should reflect an environmentally friendly and sustainable approach to minimise
future maintenance and running costs.
It should be designed in a modern contemporary way. A reflection of the local life in Oman
is desirable but should not dominate the appearance. The design should be unique and not
follow architectural norms in Muscat over last 30 years.
The Head Office/Base Camp will house the Reception, Staff BOH areas, Training Areas,
Climbing wall, multi-hall use, changing rooms, Board level meeting rooms/lounges along
with other facilities such as a caf, retail for merchandising.

1.3

The Site
The plot size is 2022m, which has Local Authority permission to construct a ministry type
property on the site. Design is to observe any local authority setbacks/building lines. There
should be sufficient parking either underground or at ground level with shading and outside
property line before road carriageway.

The site is located in Al Khoud on current MOSD land adjacent to a new local MOSD office,
the land above sea level and not near a wadi run, this should avoid flooding, designer to
check. It may endure heavy winds and exposure to sunshine with only a few high rise
buildings in close proximity providing protection from these elements.
Due consideration should be given to glazing and general maintenance of the building and
weekly routines such as cleaning the dust from facades & roof and high performance
glazing/insulation against the suns heat.

1.4

The Design Programme


The design programme for the new Head Office building comprises departments and facilities
as listed in Appendix. This will include staff areas, potential rental/retail space and parking.
The requirements regarding space, function, sustainability and symbolic value are set out
through a study taking into consideration local and international trends in modern
office/training design. A schedule of accommodation is also developed on the basis of a
flexible Organisation structure, expected increase in staff strength and in response to urban
design requirements. The design programme also sets out in broad terms symbolic
requirements in keeping with Outward Bound Omans vision of becoming a world class in its
field and an inspiration to Omanis and the wider Middle East.

1.5

Background
The designers may wish to reflect the country of Oman which is unique for usual sunshine,
blue sky, blue and warm sea water, fabulous beaches, wadis, mountains, desert and
historical architecture based from an Islamic background such as mosques, or architecture
based on occupiers reflected in look out posts and forts left by the Portuguese.
The local wildlife includes camels, donkeys, goats, oryx and Arabian leopard, wolves and
hyenas. Along with sea animals such as turtles, dolphins, whales and hammer head sharks.
There is the usual flora and fauna and underwater coral along with date palms.
Omani people have a naturally welcoming and tolerant nature and the culture follows the
Islamic traditions.
The Architecture in Oman during the last 30 years has been predominantly taken the form
of many commercial buildings with small windows, Islamic arches, mashrebia screens and
no account for orientation of the solar or wind factors or environmental considerations. This
has resulted in many similar looking buildings which are typically a level of functionality
rather than aesthetically interesting. Most are not fit for purpose but designed to just make
do rather than exceed expectations.
However there has been a very recent trend set by the Local Authorities to be more open
with modern contemporary design if it can capture an essence of Oman. One example being
the Bank Muscat Head Office at Seeb. This building has given local designers to consider
modernism in a different way.

Uniqueness of Location
In order to ensure the building is unique and reflects the unique attributes of the function.
It should not match appearance of neighbouring Ministry building or residential blocks but
should have a personality all its own due to its unique function. As an educational
establishment it is more akin to GU tech new facilities than conventional office type building.
Predominantly the staff are local (Omani) so you would expect facilities for praying, washing,
areas for discreetness (especially in Ramadan). But Outward Bound is an International
Organisation and there will percentage that will be expatriate and visitors also not from the
region. The design should reflect the forward thinking and flexible and be environmentally
sound. Hence the design must reflect the cosmopolitan nature and the international appeal
that Outward Bound wishes to maintain.

1.7

The Height of Building


The height restriction by Ministry of Housing for this plot of land is not known but
neighbouring residential towers are not exceeding six storeys. It is close to but not directly
under the Civil Aviation flight path. The building is on level ground and unlikely to be
subjected to any significant local flooding when there is a storm. As a guide only the floor
heights could be:

[NB. Avoid such terms as lower ground, upper ground and mezzanine which only lead to
confusion at design stage and in actual use].
The slab to slab included floor thickness raised flooring, suspended ceiling with Air
Conditioning ducting etc hidden between ceiling and underside of slab/beams. This would
give 2.8m floor to ceiling height which was comfortable Class A workplace environment. The
floor layouts for the offices must give as much column free space as possible to allow for
flexible office interior changes in the future.

Symmetry & Shape


The building does not have to be symmetrical. It has to be fit for purpose and make best
use of the available land including building up to the boundary if local authority building
lines permit.
The shape may include curves if deemed architecturally interesting. Curved or slanted
walls/glazing and/or curtain walling can be considered if the designer justifies the design
as architecturally interesting and integral to the overall design form.
The entrance is expected to be grand and possibly covered/canopy especially if its full
height curtain walling and/or spider glass system which would allow in plenty of natural
daylight but the excessive heat of the sun must not be allowed to superheat the internal
spaces.
Consider access through revolving door or other grand entrances to reduce dust, rain and
insect/pest control.

1.9

Style & Use of materials


The style should be modern contemporary with an understated account of local attributes.
The design should be iconic and unique. Old world architecture does not fit with the
training of predominantly youthful students. It is not going to be a museum, historical
reverence or be of religious significance.
The design can use any of the following materials as there is no limit to the imaginative use
of any combination:

Concrete
Metals: Steel, aluminium, copper, tin
Glazing: double/triple glazing, feature walls, spider glazing
Timber: Glulam structures, boarding, shingles
Stone: local or international
Marble: local or international
Porcelain: for use possibly internally
Ceramic: tiles
Earth: external or internal
Plastics: If used externally should be able to withstand severe heat and resist
bleaching.

Indeed due to the sustainable objective of this facility it could lend itself to innovative design
for Glulam or similar systems rather than standard un eco-friendly concrete structure.
Preference would be for locally sourced materials or skills in Oman, then the Gulf area and
finally Internationally.

2.1

Title
The title is the Outward Bound Oman Muscat.

Aim
The aim is to select a fit for purpose concept design to be fully detailed for construction.

2.3

Conditions of Agreement & Language


Sultanate of Oman Form of Agreement and conditions of engagement for consultancy
services for building and civil engineering works 2nd edition march 1987.
All designs, drawings and specifications must be in ENGLISH.

2.9

Copyright and Right of Ownership


The author of an entry shall retain the copyright of his/her work. The Outward Bound Oman
reserves the right to exhibit or publish the design without cost.

Exhibition of selected design


After the selection of the concept design, the Outward Bound Oman reserves the right to
display drawings at the current office and may show on their website.

3.0 PART 3. DESIGN PROGRAMME DESIGN REQUIREMENTS

3.1

Space Requirements

3.1.1

The space requirements for the Head Office/Base Camp building are developed on the basis
of a flexible Organisation structure, expected increase in staff strength. The design shall
address these basic conditions.

3.1.2

A progression of area sizes (9, 16, 24, 30,45,60,90,120 & 150m) with non-overlapping
20% ranges is excepted for office spaces.

3.1.3

The design programme is sub-divided into three parts that shall be distinctly self-contained.

The schedule of accommodation is developed on the basis of combinations of sub-units,


units, wings and floors with respective areas of 100,200,400 & 800m2 covering the range
of functional requirements of operations sections and rental tenancies. A similar approach is
expected from the design solution.

3.1.5 The room sizes in the schedule of accommodation are net areas. It is required that the area
provided not exceed or be less than the given figures by more than 10%. This allowance is
made to cater to reasonable variations due to particular space configurations.

3.1.6 The total gross area indicated in the schedule of accommodation is 2 times the total net area.
This is the maximum allowable margin, but the design solution shall attempt to achieve a
figure of preferably not larger than 1.7 times the total net area as an optimum margin.

3.1.10 The design must include only indicative layouts at this stage. The actual departmental and
furniture layouts will be carried out later.

3.2

Functional requirements (detailed design stage)

3.2.1

A complete building automation system shall be illustrated in the design solution with
particular emphasis to security systems. The design shall enable efficient flood and fire
detection and alarm.

3.3.4

The design may be L.E.E.D. or B.R.E.E.A.M accredited (but only if it is contained within the
limited budget constraints), if it can be proven that this saves energy and costs over time.
Any sustainable consideration is welcome.

3.4

Symbolic Requirements

3.4.1

The design shall represent the Outward Bound Omans aspirations to be at the forefront
of training for teamwork and problem solving utilising life skills in the real and natural
world, in Oman, the Gulf region and internationally, in a manner that portrays
teamwork and avoid being eclectic and overworked.

3.4.2

The design shall represent the Outward Bound Oman in a modern and progressive
contemporary way. Therefore local inferences, Omani and Arabic culture may be reflected
but the adopted design should not match any other building in Oman. The use of overworked
motifs, mashrebia and Islamic arches should be avoided or used sparingly otherwise it will
not be modern contemporary in design. Modern materials such as glass, steel, glulam,
metals can be used as opposed to standard concrete if the design dictates and potentially
mixed with traditional stone and tiling, weatherboarding. The shape does not have to be
rigid with straight walls or roofs; however the design should be practical for maintenance
and internal furniture layouts. Consider window cleaning and roof maintenance at all times.

3.4.3

The design does not have to be symmetrical (left and right vista from the entrance
road) but it should give a sense of order and works with the overall master plan.

3.4.4

The Outward Bound Oman logo shall feature in a prominent place on the front elevation
facing both roads in proximity to the site. This should be in state of the art practice in
signage design and ideally would allow for future changes without leaving visible fixing bolts
after any changes. All signage and way-finding must be in Arabic and English.

3.4.5

The height of the building shall be such that it shall have an imposing presence as it will the
focus of the area. In no case should it be higher than the permitted height of the plot.

3.4.7

Provisions shall be made for sculpture and other works of Art or photographs. This can be
internally in the Reception area, along corridors, landings for lifts and stairs and
externally spaces shall be particularly designated in the design for this purpose

DESIGN CONSULTANCY SERVICES

4.1

Services to be provided:

(a)

The Services to be performed by the Consultant in relation to the Project described during
the kick off meeting include concept design, schematic, detail design, and final detail design,
tender (including tender documentation),
contract documentation,
construction
documentation and construction supervision in relation to the disciplines described below:

The Consultant shall complete the whole of the Services and each part of the services at the
times and within the periods stated in Schedule 3 hereof.

(c)

The Consultant shall in performing the Services take due account of the Client's primary
objectives in relation to the Project as described.

(d)

The Consultant shall cooperate, coordinate and liaise with other consultants/ suppliers
appointed by the Client to provide professional services in relation to the Project.

(e)

The Consultant shall submit reports to the Client on its progress in the performance of the
Services at such intervals and in such form and numbers and with such detail as the Client
may require.

(f)

The Consultant shall in performing the Services use its best endeavours to identify those
technical and economic solutions that are most suited to the requirements of the Project.

(g)

The Consultant shall as requested by the Client from time to time attend and participate in
other meetings held in relation to the Project.

(h)

The Consultant shall participate in value engineering exercises including attending value
engineering.

(i)

The Consultant shall in relation to the project and at the appropriate times obtain all
necessary consents, approvals, no objection certificates, permits (including the Building
Permit and the Work Permit) and the like from all relevant authorities and departments as
applicable to the area or country where the project is, including preparing all documentation
required in relation thereto and making all applications required therefore.

(j)

All designs prepared by the Consultant shall comply with all relevant regulations, codes of
practice and by laws for the time being in force.

(k)

The Consultant shall obtain all relevant information and data necessary to perform its
obligations under this Agreement.

(I)

Provide advice and assistance to the Client in the identification and consideration of
alternative procurement routes i.e. any provisional sum items e.g. AC package, BMS
package, PA system package, IT package and in establishing the most appropriate route for
the Project including the post contract stage while review / approve any MAS submitted by
the contractor.

4.2

Basis of Scope of Services:

(a)

The Consultant shall act as the "Engineer" and shall act as the principle and lead design
consultant during all design and construction stages for the Project.

(b)

The Consultant shall provide overall design project management to coordinate all designs,
disciplines and specialties and other requirements defined in the Agreement. The Consultant
shall also coordinate its design with other Contractors/Suppliers appointed directly by the
Client or any other entity or advisor as well as statutory authorities which will be discussed
and mutually agreed.

(c)

The Consultant, in its capacity as the "Engineer", shall supervise, coordinate and manage
the construction of the Project and shall administer the construction contract(s) in full
compliance with the duties and responsibilities contained therein. Any input, assistance,
collaboration or co-ordination that may be required by other consultants, shall not absolve
the Consultant from his obligations to perform the duties of the Engineer during the
construction stage. For the avoidance of any doubt the Consultant shall be ultimately
responsible and shall owe a duty of care to both the Client and the contractor(s) in
performing the duties of the Engineer under the construction stage.

(d)

Prior to the preparation of the Design and Tender Documents, the Consultant shall validate
the Concept Design based on a project design brief and subsequently a report on this study
shall be submitted to the Client for discussions and the Client's approval.

(e)

The Consultant shall provide all Services in accordance with internationally recognised codes,
standards and local authorities. All specified equipment and material shall comply with
recognised codes and standards. The Consultant shall advise the Client in writing of all codes,
standards and recommended practices that he intends to adopt throughout the design for
the written acceptance and written approval of the Client. The client may request to one
hard copy and one soft copy of all intended and approved codes, standards and
recommended practices and associated cost will be paid at actual cost.

(f)

The design shall also cater for the accessibility for the disabled for all services, facilities and
processing and movement throughout the facilities/ building and administration of
Provisional Sum expenditure.

(g)

The design shall take into consideration environmental and ROP requirements and
constraints that may be raised at different stages of the project whenever applicable

(h)

To the extent possible, the Consultant shall maximise the use of local products and materials
in the design, ensuring that state-of-the-art concepts and technologies are applied to the
design.

(i)

The Consultant shall undertake constructability analysis of the design. Constructability is


the process of review, analysis and application of ideas and methods that will result in a final
product that can be built most cost effectively and in the shortest period of time without
sacrificing quality, taking into consideration, such items as schedule, materials, required
construction equipment, available manpower, work methods and required quality control
measures, etc..

The design and construction documents should be developed with consideration for
constructability, to make sure that there are no ambiguities, inconsistencies or other
problems, which could lead to otherwise preventable difficulties during construction.

(k)

The Client may employ other parties to provide services for the Project and the Consultant
shall closely liaise and coordinate with the party (or parties) throughout the Design and
Construction Stages of the Project and provide him with all required information, drawings,
schedules, etc. to enable him to undertake the Services for the Project.

(I)

The Consultant shall initiate and participate in value engineering exercises including
attending value engineering workshops and providing proposals and recommendations.

(m)

The Consultant shall fully liaise with all relevant Service Authorities and provide them with
a description of the Works and all required sets of layout drawings to enable the Service
Authorities to mark on their existing and proposed services in order to resolve any affection
to or by the Project. The Consultant shall satisfy the requirements of the Service Authorities
on the design of the Project. Subject to the approval of the Client, the Consultant shall
incorporate all such requirements in the design of the Project.

(n)

The Consultant, in preparing tender documents, contract documents and documentation


required for the construction of the Project, take care to ensure that these are complete in
all respects and there are no errors or omissions in relation thereto which may necessitate
the issue of variation orders and / or entitle the contractor(s) to additional payments and /
or time under the Construction Contract.

(o)

The Consultant shall submit a monthly report to the Client throughout the design stages.
The content and format of the report shall be agreed by the Client and submitted for Client's
acceptance and approval.

(p)

The Consultant shall, in performing the Services, use its best endeavours to identify those
technical and economic solutions which are most suited to the requirements of the Project.

(q)

The scope of Services to be performed and successfully completed by the Consultant to the
final satisfaction of the Client and in accordance with the Agreement shall include but not
limited to the following stages:

STAGE 0 - PROJECT INITIATION

(a)

The Consultant shall prepare a Conceptual Master Plan and Presentation identifying the
Preliminary
Demonstrate following this Project Design Brief.

The Consultant shall collect relevant data and ascertain in conjunction with the Project
requirements. These shall include the following but should not be limited to:

Project Execution Strategy (will be provided by Driver)

Schedule of Areas identifying zones, components, buildings etc and their respective
Gross as well Net areas

(iv)

Facilities requirements

Programme and area allocations

Special relationship between facilities

4.4

STAGE 1 - CONCEPT DESIGN DEVELOPMENT

(a)

The Design Consultant shall, if so instructed by the Client, carryout a Concept Design
Development of the Project according to the terms of reference provided. At the conclusion
of this stage, the Consultant (Main Consultant), if appointed, shall prepare the Concept
Design Report which shall present a summary of all the work undertaken during this Stage.
It will briefly explain the formulation of the project brief, the study and evaluation of the
original concept and its further refinement.

(b)

The report will also include, with an appropriate graphic illustrations, site development
plan, architectural development, structural
system schematic, conceptual electromechanical systems and special systems, building materials and construction principles, the
report shall also include the proposed procurement strategy and the detailed programme of
the work.

(c)

The Concept Design Report will be submitted to the Client for review and approval.
Necessary feedback and liaison with the Client and other relevant authorities will be
maintained during this Stage.

(d)

Following submission of the Concept Design Report the Consultant shall make a full
presentation of the Project Concept to the Client.

(e)

The deliverables based on the approved Project Design Brief, under the scope of work of this
Stage shall consist but not limited of the following:

STAGE 2: SCHEMATIC DESIGN

This Stage will commence immediately after the Client's written approval of the Concept Design,
The Consultant shall, based upon the approved Concept Design, prepare a Schematic Design that
will define the building in terms of final space layout, construction materials, interior and exterior
finishes and built in furniture and specialists equipment.
The Consultant shall:
(a)

Commence the Schematic Design following receipt of the Client's approved Concept Design
Documentation,

(b)

Hold initial meetings to review the Design Development documentation. The meetings shall
be chaired by the Client and minutes recorded by the Consultant.

(c)

Develop the approved exterior and interior designs, taking into account the Client's design
review comments and recommendations, including Authorities requirements.

(d)

Liaise with all consultants and participate in related meetings as required.

(e)

Carry out Value Engineering exercises during this Stage, which will comprise the
investigation of alternative materials and design solutions to achieve a cost effective and
aesthetic solution

(f)

Hold discussions with relevant statutory authorities and departments

(g)

Organise and supervise site soil investigations and analyse report prepared by specialist
investigation company.

(h)

Prepare General Arrangement drawings and preliminary dimensioned architectural,


structural, mechanical, electrical, plumbing, infrastructure, landscape plans, sections and
elevations covering all areas of design.
(i)

Evaluate various structural, securities, Mechanical, Electrical, Plumbing Infrastructure,


landscape systems and make recommendations on the proposed options and develop
schematic design accordingly.

(j)

Establish the basis of and coordinate the detailed architectural, structural and MEP services
design, interior design etc. and operation of the building in conjunction with the Client, subconsultants and other consultants.

(k)

Prepare fire protection scheme as per design for ROP approvals. If ROP approvals require a
3rd party certified consultant to be appointed to do so than the client will pay the actual cost
for the certified consultant fee.

(l)

Estimate loads and formulate concept design philosophy for infrastructure including HV
distribution. (m) Identify plant room space and bulk MEP requirements. Address services
reserves.

(s)

Make preliminary submissions of all available information to the relevant authorities

(t)

Finalise the recommended construction procurement strategy.

The Consultant shall provide lighting calculations and three dimensional rendering of lighting effects
in selected areas, lighting dimming and control schedules with values of pre-set scenes and power
loading.
At the conclusion of this Stage, the Consultant shall prepare a Schematic Design Report that will
summarise all of the work undertaken during this Stage. The Schematic Design Report shall be
submitted to the Client for review and approval and liaison with the Client and other relevant
authorities will be maintained during this period.
The deliverables under the scope of work of this Stage shall consist of but not limited to the following:

Value Engineering

The Consultant shall carry our Value Engineering exercises throughout the Schematic Design Stage.
These exercises shall comprise the investigation of alternative materials and design solutions to
achieve cost effective and aesthetic solutions.

Permits and Authorities Approvals

The Consultant shall prepare all requisite documents necessary to obtain all approvals and permits
and shall submit same to all Governmental Authorities having jurisdiction over the Project. The
Consultant shall follow up with the various Authorities to review technical matters and shall obtain
all approvals and permits with the assistance of the Client.
The cost of any permits and fees for approval shall be borne directly to the Client, unless additional
fees are required to be paid as a result of the Consultant's underperformance or lack of performance.

Schematic Design Report

The Schematic Design Report shall include, but not be limited to, the following sections, including
the above sections and requirements as listed:
(a)
Executive Summary to include areas of concern, scope changes, major decisions taken
during this stage, etc.
(b)

Updated Managerial Reports

4.6

STAGE 3: DETAIL DESIGN

Upon the approval of the Schematic Design by the Client, the Consultant shall immediately proceed
with the preparation of the Detail Design and Tender Documents of the Project, which shall initially
be submitted in draft form.
The sizes, layouts and routes of all services, structures and spaces shall be finalised, coordinated
and submitted as part of the Detail Design drawings and documents. During this stage:
(a)

The Consultant shall prepare detail design documentation comprising location, assembly and
component drawings, schedules, specifications and Bill of Quantities.

(b)

The Consultant shall prepare comprehensive particular specifications covering all aspects of
the work, noting minimum requirements of Client specifications.

(c)

All drawings shall be fully coordinated across the disciplines, including all other consultants
and shall be signed and checked accordingly by the Consultant.

(d)

The Consultant shall obtain at completion of this stage all required permits including the
main building permit and shall consult with all services authorities, relevant governmental
departments, and secure approval certificates and no objections certificates as required.

(e)

The Consultant shall prepare and submit monthly progress report of design activities,
comprising actual and planned status of completion.

(f)

The Consultant shall prepare comprehensive conditions of particular applications for the
construction contract noting minimum requirements of Client general conditions.

(g)

The Consultant shall review the cost plan prepared at Stage 2 (Schematic Design Stage) and
revise in line with the Detail Design drawings and specifications incorporating approximate
quantities.

(h)

The referencing of documents and drawings shall comply with Client office standards.

components. These shall include quality control requirements, product detail technical specification
and execution and workmanship requirements. The Project Specification shall also include
performance specifications for custom manufactured and assembled systems.
All Specifications of materials, equipment furniture; finishes, etc. shall be with proven performance
and shall ensure high performance and the capability of withstanding repetitive abuse by users.
Specifications of materials shall also be based on being "maintenance friendly".

Draft Final Bills of Quantities

The Consultant (Driver Trett not Designer) shall prepare and submit, in previously approved formats
and in accordance with previously approved Method of Measurement, Bills of Quantities for the
Construction Contracts. The Consultant shall review the Bills of Quantities to ensure all items
designed for are included in the Bills, and shall advise the Client of his comments accordingly.

Draft Tender and Contract Conditions

The Consultant (Driver Trett not Designer) shall prepare and submit draft Tender and Contract
Documents comprising the following:
Instructions to Tenderers
Form of Tender and Appendix to Tender
Conditions of Contract
Any other documents

Draft Final Cost Estimate

The Consultant (Driver Trett not Designer) shall prepare and submit the Draft Final Cost Estimates
for the Project, supported by fully priced Bills of Quantities. Subject to the Consultant having
continuously updated the cost estimates throughout the previous Design Stages, if the Final Cost
Estimate exceeds the Approved Budget for the Project by more than 5%, the Client shall have the
right to instruct the Consultant to amend, without any additional fees, the Final Design to ensure
that the Final Design Cost Estimate does not exceed the Approved Budget.
The Consultant shall carry out a review of the specification and drawings prepared to confirm or
otherwise conformance with the materials and products on which the Approved Budget is based. The
Consultant shall also advise the Client of any non conformance together with estimated cost effect.

Consultant's Design Review

Following submission of the Final Design and Tender Documents, the Consultant shall conduct
and document an internal review and coordination check of the design of disciplines under its scope.
The review shall be conducted by the Consultant's team that was not involved in the design
development. The Consultant shall report to the Client on the findings and recommendations and
shall update drawings (if any) accordingly to be issued to Tenderers as an Addendum.

5.0

STAGES 5 AND 6 TENDERING AND PRE-CONSTRUCTION ACTIVITIES

5.1

STAGE 5: PREQUALIFICATIONOF CONTRACTORS (DRIVER TRETT NOT DESIGNER)

The Consultant shall make recommendations and assist the Client in selecting the preliminary list of
contractors to submit an expression of interest in tendering for the Project.
The Consultant shall prepare draft proposals for pre-qualification criteria and procedures, to be
submitted, discussed and approved by the Client.

The Consultant shall undertake pre-qualification of contractors and shall submit a comprehensive
report to the Client recommending a short list of contractors to tender for the Project. The short
listing of contractors shall be based on predetermined criteria which shall be fully discussed and
agreed in advance with the Client.

5.2

STAGE 6: TENDER SERVICES

Supervisory Personnel for Stages 7 and 8 (Post Contract services)

Upon the issuance of the Invitations to Tender, the Consultant shall submit to the Client for approval
details of the supervisory staff intended for Stages 7 and 8, vis-a-vis Post Contract and
Supervision services together with their qualifications and detailed CV's and an anticipated
deployment schedule for each.
B

Tender Clarifications

The Consultant shall review all Tenderers queries and prepare appropriate responses in a timely
manner so as not to delay the programme, for the Client's approval before issue to Tenderers. All
addenda and bulletins may only be issued with the Client's approval. All correspondence with
Tenderers shall be copied to the Client.
C

Tender Addenda

The Consultant shall, subject to the approval of the Client, prepare any Addendum to the Tender
Documents if and when required. The Addendum shall be issued to all Tenderers for incorporation
into their Tender Offer in a timely manner so as not to delay the programme.
D

Tender Evaluation

(a)

The Consultant, if requested by the Client, shall attend tender openings.

(b)
The Consultant shall evaluate Tenderers' technical offers and shall prepare a Tender Report
with analyses and recommendations.
(c)
At this Stage, the Consultant shall submit for Client approval, final details of proposed PostContract supervisory staff with their qualifications and detailed CV's together with an anticipated
deployment Schedule for each.

Award of Construction Contract

The Consultant shall:

STAGES 7 AND 8 POST CONTRACT AND SUPERVISION SERVICES

During construction, the Consultant shall act as the Engineer, The Consultant's staff for the Post
Contract and Supervision Services will supervise the Works, administer the contract, handle
contractual issues and perform time, and quality controls as well as advise and assist on cost related
issues.
The Post Contract phase of the project is sub-divided into two distinct periods:
Stage 7: Construction Period. (12 months)
Stage 8: Defects Liability Period, (12 months)
A detailed description of the tasks of each of the aforementioned Stages is presented hereafter.

Responsibilities of the Consultant

The Services include, inter alia, acting as the Engineer under the Construction Contracts and the
Consultant shall for this purpose have such powers, discretion, functions and authorities as
prescribed therein.
The duties and authorities of the Engineer in respect of Post Contract and Supervision Services whilst
administering the Construction Contracts shall be as defined therein.
B

Stage 7: Construction Period

The prime objective of Post Contract Administration (PCA) is to obtain quality production as specified
and set by the Contract within the time frame and budget allocation. This objective is deemed to be
achieved through proper and firm administration of the Contract that will render the required control
of quality, cost and time. The Consultant shall carry out the following tasks in accordance with the
Agreement:
Organisation and Mobilisation
Duties include but not limited to:
(a)

Planning and mobilising the Consultant's staff to site.

(b)

If requested by the Client, issuing the notice to commence the Works.

(c)

Establishing the timetable for the mobilisation of the Consultant's' PCA team in accordance
with the agreed work programme.

(d)

Mobilising the PCA team and necessary resources and advising the allocation of duties of the
site staff to the Client and the Contractor.

(e)

Establishing all necessary communication procedures,

(f)

Preparing procedures and forms to be used by the site staff during the construction stage
based, where relevant and applicable, on the Consultants' Manual of Post Contract
Administration that forms part of the Consultants' plan for "Quality Assurance/Quality
Control - Post Contract".

(g)

Reviewing of the contract documentation and drawings and ensuring that the Contractor has
the latest documents to enable him to commence the work.

Review of Contractor's Planning and Programme


The Consultant shall be responsible for liaison with the Client, the Contractor and all concerned
authorities as deemed necessary for the successful completion of the Project.
The Contractor will be required to prepare a detailed programme, using Primavera's P3 5.0 version
or higher, which will be reviewed against the Client's priorities and proposed staffing and plant
schedules, which will become a document for monitoring
progress, evaluating performance and for

reflecting time and cost impact of changes, if and when these occur. Detected irregularities or
inadequacies will be brought to the Contractor's attention to be addressed prior to the actual
commencement of construction. All proposed resource allocations and assumed productivity will be
carefully noted being the basis of the programme.
The Consultant will be required to consider, in the preparation of the programme of works, the
interfaces with other parties such as Service Authorities, other Contractors, etc. and reflect these
interfaces within the programme, which should include any co-ordination requirements. The
Contractor shall participate in discussions of such interfaces and influences on his programme with
the Consultant and mutually affected other parties, as may be required.
A proper resource loading shall be implemented by the Contractor to programme activities to serve
as a tool for measuring performance, productivity and efficiency and anticipate possible deviation
from planned duration and budget cost in case of variations.
The Contractor's programme will be required to include, amongst others:
(a)

Logic Network (CPM) including Critical Paths

(b)

Short construction activities

(c)

Activities tabular schedules

(d)

Bar chart schedules

(e)

Shop drawings and Materials Submission and Approval schedules

(f)

Procurement schedules

(g)

Each activity having a clear defined quantity, duration, cost, manpower and equipment

(h)

Resources schedules and histogram.

(i)

Cost expenditure

This task will include the following activities by the Consultant:


(a)

Review of the Contactor's programme for compliance with Client's priorities, Contract
requirements and major planning standards and techniques. Provide comments to and
discuss the same as necessary with the Contactor. Give consent to the programme.

(b)

Evaluation of the Contactor's detailed plan including equipment mobilisation, material


procurement and delivery of shop drawings.

(c)

Checking the Contractor's arrangements with statutory authorities for the supply for
necessary services.

(d)

Identification of potential problem areas and obstacles that may affect the Works and
progress and recommend appropriate actions.

(e)

Review of the Contractor's Method Statements and Temporary Works' proposals as well as
his personnel deployment schedule and duties allocation.

(f)

Checking the competence and suitability of major subcontractors and suppliers the
Contractor proposes to engage.

(g)

Agreeing with the Client and the Contractor on the format of various forms and reports.

(h)

Agreeing on the schedule for submission and the types of reports to be prepared.

(i)

Defining the need for and agreeing on the schedule of all site meetings.

(j)

Establishing and implementing procedures for giving the Contractor possession of the site
as stipulated by the Contract and in accordance with the agreed programme (otherwise
provide advance notice to the Client of possible delays due to lack of possession).

(k)

Requiring the Contractor to provide a cash-flow projection to assist the Consultant with
monitoring project financing.

(l)

Requiring the Contractor to provide an activity - value schedule to assist in progress


measurement.

(m)

The Consultant to review and provide approval/comments for all kind of submission (shop
drawings, Method of Statement, Material Approval, etc.) within 5 working days.

Survey Check and Material Information


This task includes the following:
(a)

Verification of the staked-out centreline and all traverse points, control points and bench
marks as set out by the Contractor.

(b)

Identification of discrepancies, deficiencies, and omissions in the survey works and providing
advice to the Client to request rectification.

(c)

Verification of the adequacy of borrow pits and quarries.

Review of Contractor's Plan for Site Organisation
The temporary facilities adequacy and organisation should enhance the Contractor's logistics,
efficiency and performance. Accordingly, the Consultant will require the Contractor during the
mobilisation period to submit a layout plan for all temporary site facilities required for approval.
The Consultant will check the site facilities such as site accesses, temporary structures, site office
and accommodation, laboratory, stocking and staging yards, plant facilities, and service roads and
parking areas.
The Consultant will check all aspects of site facilities sufficiency, adaptability, interconnectivity,
suitability, organisation, quality, performance, and their non- interference with the permanent
works.
This task will include, but not limited to the following duties, in accordance with the Contract:
(a)

Verify the optimum location of all site facilities with regards to safe and convenient access,
available and suitable space for operation, storage and parking, as well as strategic
interconnectivity during the present and subsequent stage of the Project.

(b)

Verify that the site office space is adequate and convenient tor the work force operations,
that it is adequately equipped with office machines, communications means, transportation
means, utilities, survey equipment and adequately furnished, maintained and insured.

(c)

Verify that the laboratory layout is as specified: with adequate space for office work, storage
and testing and that the facility is provided with all essential sampling and testing equipment
to conduct the tests specified in the Contract. The facility should also be properly furnished,
maintained, ventilated and provided with essential utilities.

(d)

Verify that all stockyards, staging areas and plant areas are sufficient that they are, safe,
well maintained and secure from theft, damage and vandalism.

(e)

Verify adequate lighting maintenance.

(f)

Verify that the Contractor's work forces are safety conscious and are trained and properly
equipped with flags, barricades, cones, movable delineators, construction signs and that his
equipment is responsibly operated and equipped with safety devices such as back-up alarms.

(g)

Verify the safe placement and maintenance of temporary structures and avoiding adverse
impact on the public safety and convenience.

(h)

Co-ordinate with local authorities regarding issues related to-public convenience and safety
including impaired clearances, work near 41
schools, hospitals, bus stops and pedestrians.

(i)

The consultant should review all relevant documents and provide their comments within 5
working days from the submission date.

(j)

Arrange with concerned authorities for expeditious response to emergency and fire and for
police enfacement when needed.

Construction methods
(a)
The Consultant shall require that, prior to the start of any of the site activities, the Contractor
submits a clearly formulated and well-documented method statement for the Consultant's review
and approval.

Time Control
After reviewing and giving consent to the Contractor's programme, the services listed below will be
regularly and promptly provided:
(a)

Monitoring the programme

(b)

Monitoring the construction activities and resources

(c)

Checking and requiring the Contractor to update and revise, as necessary, his programme

(d)

Conducting regular co-ordination meetings.

These services will include the following integrated duties:


(a)

Establishing procedures for timely submission of shop drawings and samples to be reviewed
and approved.

(b)

Verifying that the schedules of materials and shop drawing submissions and approvals are
tied to the Contractor's programme.

(c)

Close monitoring of activities to ensure adequate performance by the Contractor his


subcontractors and suppliers.

(d)

Monitoring the productivity of labour and plant to verify that sufficient resources are available
to complete the works according to the Contractor's programme.

(e)

Monitoring materials deliveries with special attention to the list of long-lead items, as well
as identifying shortages.

(f)

Informing the Contractor of deficiencies in labour, plant or materials and instructing him to
expedite the progress.

(g)

Obtaining proper feedback from the site on all construction activities in order to check data
in monitoring the Contractor's programme.

(h)

Monitoring regular check on progress by means of the adopted computer techniques, using
actual information feedback.

(i)

Regular monitoring of the Contractor's programme to identify potential variance between


scheduled and actual progress. Once variances are identified, recommendations will be made
with suggestions for rectification.

(j)

Requiring the contractor to update the Contractor's programme on a regular basis and
consequently revising the construction plan accordingly with regard to the critical activities
to meet the prescribed target dates.

(k)

Requiring the Contractor, if it becomes apparent to the Consultant that the Contractor is not
maintaining satisfactory progress in accordance with the approved programme, to produce
a revised programme to show how the Contractor proposes to complete the Works within
the time for Completion.

(l)

Notifying the Contractor, if the rate of progress of the Works is too slow to comply with the
Time for Completion, to take the necessary steps to expedite progress so as to comply with
the Time for Completion.

(m)

Conducting regular meetings for overall co-ordination including, as necessary, the


participation of Client, Consultant, Contractors and other concerned authorities with a view
to ensuring timely completion.

Cost Control
The Cost Control function shall include, but not being limited to, the following services:
(a)

Monitoring the Contractor's procurement of material and equipment from approval of


material submissions through the entire purchase and delivery phases to ensure that
Contractors are expeditiously procuring materials and equipment. Schedules are to
prepared, maintained and updated throughout the construction phase detailing, as a
minimum, the material equipment, the name of the supplier subcontractor, details of
agencies, details of all orders placed, dates of placing of orders, details of Letters of Credit
(if applicable), anticipated and updated delivery dates, dates material equipment is required
on site and delivered.

(b)

Monitoring of material loads delivered to site and remaining to be delivered,

Post Contract Administration


The Consultant shall
(a)

Provide to the Client early warning of any problems arising or decisions required of the Client,
as soon as the problem arising is identified.

(b)

Act fairly within the terms of the Contract when giving a decision, opinion or consent,
expressing satisfaction or approval a determining value.

(c)

Obtain the written approval of the Client prior of carrying out any duties of the Engineer
under the Construction Contract which require such written approval.

(d)

Confirm unwritten decisions or instruction in writing.

(e)

Carry out all the duties specified in the Project contracts

(f)

Notify the Client of any Contractor's notice of insurance events to be covered by the Client's
insurance,

(g)

Promptly inform the Client in writing of anything the likely effect of which would either:
(i)

to vary the Project; or

(ii)

to increase the cost of the Project or change its quality or function; or

(iii)

to increase the time taken to complete the Project. and provide advice and
recommendation in respect thereto,

(h)

In the event of a potential threat to the Project completion dates, identify remedial measures
to correct and provide recommendations to the Client. Arrange for the implementation of
such measures subject to the approval of the Client.

(i)

Co-ordinate and administer all items under provisional sums and prime cost items,

Quality Control / Quality Assurance


The quality control process aims at ensuring full compliance with the Contract requirements for all
site operations. This is achieved through a series of regular reviews, inspections, and testing applied
to the Works, resources, Plant (being machinery, apparatus and the like forming part of the
permanent works), equipment, materials and material sources.
To achieve the aims of this task the following services shall be provided:
(a)

Reviewing, monitoring and auditing the Contractor's Project Quality Assurance/Quality


Control Plan.

(b)

Monitoring Contractor's compliance with safety and environment protection.

(c)

Reviewing and approval of materials, shop drawings and method statements,

(d)

Inspecting operations.

(e)

Inspecting and testing of materials and Plant and recommendations on test results,

(f)

Examining work before covering up.

(g)

Supervise the commissioning of all mechanical and electrical equipment and issue

Reviewing of and submitting to the Client certified "As-Built" drawings and "Operation and
Maintenance Manuals",

(i)

Preparing a list of outstanding works prior to Taking-Over.

(j)

Inspecting the completion of outstanding works and monitoring performance during the
Defects Liability Period,

(k)

Check the Contractor's bar bending schedules and working/shop drawings.

(l)

Carry out all other duties of the "Engineer" as defined in the construction contract.

These services will include the following integrated duties:


(a)

Reviewing and approving proposals relating to materials, equipment and methods of


construction, submitted by the Contactor and advising the Client. This Includes staging
proposals and temporary works for the construction Works.

(b)

Reviewing the Contractor's Quality Assurance/Quality Control (QA/QC) Plan for compliance
with the requirements of the Contract.

(c)

Continuously monitoring the contactor's QA/QC Plan and auditing aspects of the same at
various intervals,

(d)

Obtaining from the contractor and keeping a copy on site of the current safety regulations
and associated equipment, together with first aid and emergency assistance facilities.

(e)

Verifying that the Contractor is constantly complying with the following requirements:
(i)

Safety measures and related local requirements needed not only to cover
workmen/site staff but the public at large,

(ii)

The provision of adequate warning notices, traffic controls and hazard signals to the
benefit of the public, operatives and visitors to the site.

(iii)

The procedural aspects of the Contract and that all laws and statutes on nuisance,
pollution, etc. are observed.

(f)

Monitoring all traffic diversions in co-ordination with the concerned Authorities,

(g)

Monitoring the Contractor's compliance with limiting interference of the construction


operations with public or private thoroughfares or property adjoining the Site,

(h)

Inspecting the environmental control provisions and verifying their compliance with
requirements of the Contract and Government Authorities.

(i)

Monitoring all field-testing and results and certifying and recommending to the Client.

(j)

Verifying the accurate establishment of the necessary field survey control networks.

(k)

Checking the setting out of all alignments, structures and works for accuracy of line, level
and cross-section,

(l)

Progressive reviewing and approving materials and shop drawings submitted by the
Contractor in strict conformity with Contract Specification and Drawings.

(m)

Checking materials received on site for compliance with the Contractor's approved
Submissions,

(n)

Inspecting the construction works, construction methods and operations, sampling and site
activities in order to verify their compliance with the Contract.

(o)

Verifying manufacturer's certificates and independent tests and maintaining orderly and
complete records.

(p)

Responding to the Contractor's queries diligently regarding ambiguities detected in the


Contract documents.

(q)

Examining, measuring and testing materials and Plant before incorporating into the Works,

(r)

Inspecting and testing, as described in the Contract, materials and Plant during manufacture,
fabrication or preparation and assisting the Client in determining the acceptability of the test
results including recommendations on any deficiencies in the test results.

(s)

Determining, as a result of the inspection or testing, materials or Plant that are defective or
not in accordance with the Contract and rejecting the same. Records of inspection and
testing will be kept and analysed in support of any decision to accept or reject the executed
works.

(t)

Examining and measuring any part of the Works before covering up such part by Contractor.

(u)

Issuing instructions to the Contractor to ensure the proper execution and control of the
Works,

(v)

Making periodic visits to the site by Head Office experts for review of construction operation
quality.

(w)

Progressive checking of the as-built drawings prepared by the Contractor for fully completed
or parts of the work and submitting the final set to the Client upon finalisation.

(x)

Reviewing the "Operations and Maintenance Manuals" prepared by the Contractor in


co-ordination with the Client and submitting the final set to the Client upon finalisation.

(y)

Prior to issuance of the Taking-Over Certificate:


(i)

Establishing with the Contractor, during the Completion stage, a schedule for testing
and commissioning of the Works,

(ii)

Witnessing the tests performed by the Contractor.

(iii)

Preparing a list of outstanding works and providing the same to the Contractor.

(iv)

Obtaining a written undertaking from the Contractor to complete any outstanding


work during the Defects Liability Period,

Prior to issuance of the Defect Liability Certificate and during the Defects Liability Period:

(aa)

Inspecting and verifying that the outstanding works have been satisfactorily completed by
the Contractor,

(bb)

Instructing the Contractor to remedy defects detected as a result of the Consultant's


inspection of the Works, The Consultant may require the Contractor to investigate the cause
of defects.

Site Meetings and Record Keeping


The Consultant shall constantly monitor all site activities related to the Works. Such monitoring will
be enhanced by:
(a)

Maintaining a continuous dialogue with the Contractor

(b)

Maintaining a record of the progress of the Works on site on a daily basis.

The above will be realised by providing the following services:


(a)

Arranging an initial site meeting for all relevant parties to discuss and agree on procedures,
means of communication, methods for giving approvals, instructions, variation orders, etc.,
based, where relevant and applicable, on the Consultant's Manual of Post Contract
Administration that forms part of the Consultant's plan for "Quality Assurance/Quality
Control - Post Contract".

(b)

Arranging regular site meetings to monitor performance and progress based on the
Contractor's programme and to discuss problems, co-ordination issues, etc.

(c)

Maintaining a daily diary of the progress of the Works on site, containing weather conditions,
personnel present and work accomplished, resources applied and shortfalls, deliveries,
inspection, survey checks, testing, instructions issued, visits by others, record of meetings
and all other events of significance occurring during the day. Using these records,
supplemented by field measurements, monthly estimates of quantities of work accomplished
by the Contractor will be compiled as a basis for certifying periodic payment.

(d)

Maintaining up-to-date information relevant to progress, performance, quality, quantities,


resources and cost (by the Cost Consultant). This information will be used in preparing

Monthly

Progress

reports

The Consultant shall prepare Monthly Progress Reports on work carried out by the Contractor which
highlights problems, obstacles, shortages and recommendations. The Monthly Progress Report shall
include information on progress, performance measurements, quality control, cost data (obtained
from the Cost consultant), contractual matters, materials, resources, manpower, weather conditions,
variation orders, and meetings, together with selected progress photographs showing various
aspects of the Works.
The report shall include a copy of all relevant Project correspondence (the copy of correspondences
shall be submitted in a separate bound Volume).
Claims and Disputes
Through the performance of the Services, the Consultant shall use his best professional endeavours
to provide the required control over time, cost and quality of the Project and in accordance with the
Contract thereby reducing the potential for claims from the Contractor for extension of time and/or
additional cost.
In this context, the Consultant shall specifically be providing the following services:
(a)

Constantly advising the Client on contractual issues as well as matters related to policy and
programming.

(b)

The Consultant shall provide any necessary support to the Cost Consultant in relation to
financial impacts of the claims. The Cost Consultant shall be responsible for analysing and
reporting on the commercial and cost related aspects of the claims as well as providing
advice to the Consultant on matters of a contractual nature.

(c)

Identifying cases where claims may be a potential or imminent possibility and promptly and
timely notifying the Client of the same.

(d)

Assisting the Client in the settlement of disputes or differences that may arise between the
Client and the Contractor to attempt to resolve claims without resorting to arbitration or
litigation.

(e)

Advising the Client on the implementation methods and procedures to minimise the potential
impact of claims, both financially and time-wise, through prompt and contractual resolution
with minimal disruption to the on-going construction activities. This system shall include
such activities as receiving, reviewing, analysing, evaluating claims and making timely
recommendations to the Client. The Consultant shall obtain contract advice and an appraisal
of the financial claims from the Cost Consultant; however, the overall responsibility with
preparing reports and the "Engineer's" determination pursuant to the provisions of the
construction contract, lies with the Consultant.

(f)

Appraising and advising the Client on requests / claims for additional extensions of time.

(g)

Preparing and submitting to the Client on a monthly basis reports on the status of all claims
for extension of time submitted by the Contractor.

(h)

Adjudicating and evaluating claims submitted by the Contractor in relation with cause-effect
as well as any other method and analysis in relation to time impact.

It is noted that the provision of services during litigation and arbitration is optional and will be offered
to the Consultant as an additional service if so required by the Client.

Completion of Works / Taking-Over


The Consultant recognises the particular importance of the phase when the Project is at the stage
of substantial completion and being prepared for the Client to take-over, The Consultant shall provide
the following services in accordance with the Contract:
(a)

Establishing with the Contractor a schedule for testing and commissioning of the Works.

(b)

Witnessing the tests performed by the Contractor.

(c)

Preparing a list of outstanding works and providing the same to the Contractor.

(d)

Obtaining a written undertaking from the Contractor to complete any outstanding work
during the Defects Liability Period.

(e)

Issuing, after accepting the Contractor's application and agreeing on the same with the
Client, the Taking-Over Certificate to the Contractor.

(f)

Progressive checking and approval of the 'As Built Drawings' prepared by the Contractor for
fully completed or parts of the work and submitting the final set to the Client upon
finalisation.

(g)

Reviewing and approving the 'Operations and Maintenance Manuals' prepared by the
Contractor, in coordination with the Client and submitting the final set to the Client upon
finalisation

(h)

Obtaining warranties and guaranties from the Contractor in favour of the Client as provided
for under the Construction Contracts. Advising the Client of his rights under such warranties
and guaranties including limitation periods.

(i)

Monitoring and co-ordinating the handing-over to the Client of spare parts provided under
the Construction Contract.

(j)

Assisting the Client to effectively take over operation of the Project from the Contractor.

(k)

Verifying that adequate equipment maintenance training is implemented by the Contractor


in accordance with the terms of the Construction Contract.

Stage 8: Defects Liability Period

The main purpose of the Defects Liability Period is to demonstrate under operational conditions that
the requirements of the Contract have been complied with. During this period, the Contractor must
not only complete such outstanding works as are listed in the relevant Taking-Over Certificate but
also remedy any defects that appear.

During this period, and in realisation of the above, the Consultant's duties shall include conducting
regular visits to the Project, at minimum intervals of three calendar months, to inspect the
completion by the Contractor of outstanding works, as well as inspecting the Works in general for
defects that may be detected during this period. The Consultant will prepare an inspection report
following each visit, identifying detected defects and recommending appropriate actions.
At the end of this period, the Consultant will issue to the Contractor the Defects Liability Certificate.
After the issuance of the said certificate and, as per the Construction Contract, the Consultant shall
review the Contractor's Final Statement and issue to the Client the completed form of the Final
Payment Certificate. The Consultant will prepare and submit to the Client the Final Report of the
Project.
Accordingly, the Consultant's duties during this period are outlined as follows:
Inspection of Works during Defects Liability Period
Duties shall include:
(a)

Inspecting and verifying that the outstanding works have been satisfactorily completed by
the Contractor.

(b)

Instructing the Contractor to remedy defects detected as a result of the Consultant's


inspection of such part of the Works carried out under the Construction Contract. The
Consultant may require the Contractor to investigate the cause of defects

(c)

Participating, as applicable, in the mechanism agreed upon for the final inspection of the
Project by the Client at the end of the Defects Liability Period.

Defects Liability Certificate


(a)

This includes issuing the Defects Liability Certificate.

Final Payment Certificate and Final Report


The Consultant's duties shall include:
(a)

Preparing a Final Report in a format agreed upon with the Client. This will summarise all the
relevant aspects of the Project implementation, financial costs obtained from the Cost
Consultant, and specific recommendations for routine maintenance, highlighting locations
requiring special care and attention.

(b)

A suitable selection from the Project photographic records shall be reproduced and included
in the Final Report.
