The testimony of the witness, ENGINEER
offered to prove the following:

To prove that an application of building permit was submitted and was

duly approved in compliance with all the requirements thereof;
To prove that the application of the business permit was made by
SPOUSES ANGELA AND CRISPIN SANCHEZ during their marriage ;
To prove other related matters.

PRELIMINARIES
This Judicial Affidavit was taken at the office of Atty. _______ at #33 Scottie
Ewing St., Everlasting Subd., Cebu City. Questions were propounded by Atty.
______ and questions are numbered consecutively and each question is followed
by an answer of the witness.

Question 1: Do you swear to tell the truth and nothing but the truth in this
proceeding?
Answer: Yes, Maam.
Question 2: Being under oath, are you aware that if you tell a lie in this
proceeding, you may face criminal liability for false testimony or perjury?

Answer: Yes, Maam.

Question 3: Please state your name, age, civil status, address and other
personal circumstances.
Answer: I am JONATHAN MORENO, Filipino, of legal age, a resident of F.
Ramos, Cebu City and employed as a city engineer in Cebu City.
Question 4: How long have you been working as a City Engineer?
Answer: I have been employed as a City Engineer since February 18 of 2007. I
have been in the service for nine years now.
Question 5: For the past nine years that you were employed as the City
Engineer, were you involved in any issues of alleged perjury, falsification of
documents or false testimonies?
Answer: No, not at all, Maam.
Question 6: What are your functions and responsibilities as a City Engineer?
Answer: As City Engineer, when there is an application for a building permit, it
is our duty to see to it that there is compliance with the proper construction of
a house or a building following the requirements set by law or the National
Building Code before the permit is issued. Also, to make sure all the proper
technical, mechanical, electrical, and structural plans for the construction of
the building are met.
Question 7: Mr. Witness do you know the plaintiffs in this case?
Answer: Yes , Maam.
Question 8: How did you know them?
Answer: They applied for a business permit for the construction of their house
and I approved the same.
Question 9: Would you be able to identify the Building permit you issued to the
plaintiffs in this case?
Answer: Yes, Maam.
Question 10: Is this the building permit you issued to the plaintiffs of this
case? (referring to the building permit presented by the plaintiffs)
Answer: Yes, Maam.
Question 11: Is this your signature that is appearing in the building permit?

Answer: Yes, Maam.

Question 12: By the way Mr. Engineer just to be clear, who may apply for the
building permit?
Answer: It is the property owners or the licensed contractors.
Question 13: When did they apply for a building permit?
Answer: They applied for a business permit on March 18, 2011.
Question 14: When was the Building permit issued?
Answer: The permit was issued two weeks after on April 23, 2011.

Question 15: Where is the location of the construction?

Answer: In #5 Forest Hills, Banawa, Cebu City.
Question 16: What is the duration of the construction of their house?
Answer: It was constructed on May 10, 2011 and was finished on September 2,
2011.
Question 17: I have no further questions. Do you have anything to add or
retract, Mr. Witness?
Witness: None for the present.
Question 18: Are you willing to sign your statement?
Answer: Yes, maam.
