Sub-Contract for Equipment Works (Concrete Pump and Concrete Placing Boom)
Particular Conditions of Contract
The Sub-Contract Price shall inter alia include the following:
A. SCOPE OF WORKS
1.

The Sub-Contractor shall supply labor, materials, plant, equipment, machinery, tools, etc., to
execute, complete and maintain the whole of the Sub-Contracts Works in strict compliance to
the following, as described herein, and to be carried out in full compliance to Contract
Drawings, Specifications, Schedules, Preambles, Bill of Quantities and all other relevant
documents of the Main Contract and requirements of any other Authorities having jurisdiction
over the Works, to the reasonable satisfaction of the Main Contractor, the Consultants,
Engineers, Employer and Employer Representative. The Works shall broadly consist of, but
not limited to :

Supply & Installation of Concrete Pump & Air Compressor
Operators and fuel
All necessary maintenance & cleaning
PE calculations & endorsements

2.

The Sub-Contractor shall deploy sufficient equipment and skilled workers to meet the Main
Contractors Master Program and Working Program as required by the Main Contractor and
shall deploy, as a minimum, supervisory staff employed full time on site.

3.

The Sub-contract price shall be inclusive of all ancillary works and expenditures whether
separately or specifically mentioned or described in the Tender Documents and in the Main
Contract Documents or not, which are either indispensably necessary to carry out and bring
to completion the Works described in the Contract Documents, or which may contingently
become necessary to overcome difficulties before completion.

4.

The Sub-Contractor shall hire Senior Staff who is authorized to make decision to attend all
regular site meetings whose attendance is compulsory and absence from any of these
meetings without prior permission from the Main Contractor shall render the Sub-Contractor
liable to a penalty or fine. Full-time representative shall be designated on site to supervise
their workers.

5.

The performance and compliance with all the provisions of the Main Contract in so far as they
relate and apply to the Sub-Contract Works shall be included in the Sub-Contract price.

6.

The Sub-Contractor shall be fully responsible for transportation and distribution of his
equipment & materials.

7.

The Sub-Contractor shall clear and remove debris and waste materials to designated area on
a daily basis. In the event that the Sub-Contractor is unable to carry out the cleaning works to
the satisfaction of the Main Contractor, the Main Contractor shall have the right, upon giving
notice to the Sub-Contractor, to carry out the requisite cleaning works themselves and all
costs and expenses incurred plus 3% administration charge shall be deducted from the Subcontractors payment.

8.

The Sub-Contractor is required to maintain a housekeeping team of sufficient general workers


(number to be ascertained by Main Contractor as and when necessary) on site for general
cleaning works.

9.

If in the judgment of the Main Contractor, the progress of works is delayed due to insufficient
manpower or equipment, then the Main Contractor may deploy additional manpower and/or
equipment at his sole discretion and all costs and expenses incurred plus 3% administration
charge shall be deducted from the Sub-contractors payment.

10.

The Sub-Contract may be terminated at the sole discretion by the Main Contractor if the SubContractor fails to achieve the quality of works in accordance with the specification or the
Sub-Contractor cannot meet the Main Contractors Master Programme after a due notice of 7
days has been given by Main Contractor to the Sub-Contractor.

11.

No Daywork and no overtime claim shall be allowed unless the particular work(s) not covered
under the scope of works cannot be measured or otherwise valued; and have been
specifically requested by the Main Contractor and duly signed and verified by the Main
Contractors Site Manager and Construction Manager.

12.

The space for the Sub-Contractors temporary office and store may be made available at the
sole discretion of the Main Contractor and such office and store shall be erected, maintained
and removed by the Sub-Contractor.

13.

No individual or collective cooking of food will be allowed.

14.

Electricity and water supply for the Sub-Contract Works will be provided by the Main
Contractor. The Sub-Contractor shall arrange for all connections to electricity distribution
panels and water points provided. All lightings, wiring and connection points are to be
provided by the Sub-Contractor and must be of the approved types and safe for use.

15.

The electricity and water consumption for the Sub-Contractors site office shall be charged to
the Sub-Contractor at prevailing market rates.

16.

Contractors All Risks Insurance Policy is provided under the Main Contractor. However, SubContractor shall take up whatever additional insurance they may think necessary to cover all
the Sub-Contractors other liabilities, including their own equipment and any exclusions and
excesses under the aforementioned insurances.

17.

The Sub-Contract Works shall be measured (if it is under measurement Sub-Contract Works)
in accordance with the Standard Method of Measurement (SMM) and the Preambles.

18.

No illegal workers are allowed on site. The Sub-Contractor shall be fully responsible for any
fines, summons, charges, penalties and consequences resulting from the violation of the
Employment of Foreign Workers Act or Immigration Act. The Sub-Contractor shall submit a
written undertaking to this effect before commencement of Works on site.

19.

Mobilizations for the Works will be solely decided by the Main Contractor due to and based on
the overall construction schedule of the project and the Sub-Contractors Price is deemed to
have considered all the cost arising from the phased or separate mobilization following the
overall construction progress and the approved construction method. The Sub-Contractor has
comprehended the construction sequence and method which require consistent monitoring
and phased mobilization for the subsequent method of work including coordination, phasing
with other Sub-Contractors Works and assurance to safety/stability.

20.

The Main Contractor reserves the right to impose penalty/ies to the Sub-Contractor for delay
in progress and/or unacceptable quality of the Works due to lack of qualified and competent
staff.

21.

The Sub-Contractor shall mobilize good condition machines with good performance for their
own Works. Any machinery & equipment breakdown shall not compromise the progress of the
Project.

22.

In any event an equipment breakdown occurs, repair works shall be done immediately
otherwise, all the damages caused by the delay of the repair shall be back charged to SubContractor. Any and all machinery & equipment breakdown which is not able to be repaired
within the same day shall be subject to the additional mobilization within the following working
day upon notice from the Main Contractor.

23.

If making good/replacement of the defective machineries, spare parts, etc. is not satisfactorily
carried out within the time stipulated by the Main Contractor, the Main Contractor shall have
the right to execute the said making good works on behalf of the Sub-Contractor and all costs
for doing so shall be borne by the Sub-Contractor.

24.

The Sub-Contractor shall entirely, at his own cost, be responsible for all remedial action if any
of the works fail to meet the inspection requirement by the Main Contractor, Employers
Representative and the Engineer and any other Authorities having jurisdiction over the Works.

25.

The Sub-Contractor shall be deemed to have accounted for and included in his cost possible
standby/idling of equipment/machinery due to adverse weather conditions and/or other
circumstances for overall construction schedule including but not limited to issuance of
approvals/decisions from the Employer and/or directions from relevant Authorities having
jurisdiction over the Project.

26.

Provision of all temporary vehicular and plant access required for the satisfactory carrying out
of the Sub-Contract Works and the removal thereof upon completion of Sub-Contract Works.
Any temporary equipment or access that they make for their own use shall be coordinated
with the Main Contractor prior to their execution on site.

27.

All methods to execute and complete the Sub-Contract Works shall be subject to C&S
Engineers requirements and shall comply with all relevant requirements by the Authority.

28.

Provision for necessary approved methods to minimize the vibration and noise generated by
the Works. Any vibration or noise meter required by C&S Engineer or any Authority is
considered included in the unit rate of the Works considering the surrounding conditions of
the site.

29.

The Sub-Contractor shall allow all costs and time for implementing noise reduction measures
to minimize noise pollution during the carrying out of the Sub-Contract Works. The SubContractor shall immediately cease all noise generating works upon receipt of notice from the
Main Contractor.

30.

The performance and compliance with all the provisions of the Main Contract in so far as they
relate and apply to the Sub-Contract Works shall be included in the Sub-Contract Price.

31.

Sub-Contractor shall secure space and road for installation and dismantling of the equipment
and all related costs shall be reflected in the Sub-Contract Price.

32.

All materials and equipment shall be taken out from the construction site after obtaining
approval from the Main Contractor when dismantling work is finished.

33.

The Sub-Contractor shall include the following under his work scope and all costs of doing so
shall be deemed to be included in his Sub-Contract Price:
A.

Temporary works for the Sub-Contractors sole purpose, not otherwise provided by the
Main Contractor.
B. Liaison with the relevant Main Contractors Departments for all requisite coordination
and working schedule and program for the proper execution and interfacing of the
Works.
C. AII necessary PE endorsed design works submissions such as CPB opening size,
reinforcement, piping installation, etc. including liaison with the Statutory Authorities for
all requisite coordination and work approval for the proper execution and interfacing of
the Works.

B. ENVIRONMENTAL, HEALTH & SAFETY


1.

The Sub-Contractor shall comply with the Employers Environmental, Health & Safety (HSE)
System Requirements and the Main Contractors In-house HSE requirements. The SubContractor shall allow costs and time in complying with the aforesaid requirements.

2.

The Sub-Contractor shall provide all necessary measures to ensure the safety and health of
the people at work under Local Regulations. A schedule of Environmental, Health & Safety
violations and the related penalties, finishes and other sanctions will be embodied in and will
form part of the Sub-Contract Document.

3.

The Sub-Contractor shall provide a competent and qualified Safety Supervisor employed fulltime on site during installation of equipment.

4.

The Sub-Contractor shall submit implementation of Risk Assessment at all times.

5.

The Sub-Contractor shall comply with the statutory regulations and pay all charges by any
Authorities having jurisdiction on matters of pollution mosquito control or site hygiene for
Sub-Contractors facilities on site. It is the Sub-Contractors responsibility to ensure the
facilities allocated to them are kept clean and orderly.

6.

The Sub-Contractor shall not provide any equipment with conditions as listed below to secure
the safety.
A. Concrete Pump and Concrete Placing Boom exceeding 5 years after manufacturing.
B. Equipment considered worn out by the Safety Inspector designated by Main Contractor.
C. Equipment having an accident record.

7.

Every parts of equipment (mechanic part, oil pressure part, electric part, structural part,
running gear part, etc.) shall be maintained in order to be operated properly.

8.

All personnel shall have completed safety education and wear safety gears like helmet,
harness, safety shoes, etc.

9.

The Sub-Contractor shall train its operators and repairman and take necessary measures for
securing safety at his own risk and submit the result to the Main Contractor. If the SubContractor does not follow the safety measures stated below, no work shall be executed at
site and the Sub-Contractor shall bear the loss arising due to its failure in doing so.

Designating a personnel in-charge of managing the safety.


Deciding work procedures and methods.
Installing and maintaining safety devices.
Executing daily inspection and reporting.
Preventing fire measures and placing fire extinguishers.
Other safety measures instructed by the Main Contractor.

10.

The Main Contractor can assist during the erection and dismantling works by placing a
Supervisor from a designated company by the Main Contractor and the Sub-Contractor shall
fully cooperate and follow instructions by the supervisor.

11.

In case of defects, the equipment operation shall immediately stop and shall be report to the
Supervisor.

12.

Operators shall inspect the equipment every day after working and submit the report including
safety inspection to the Main Contractor.

13.

The Sub-Contractor shall inspect the equipment every month and submit the report to the
Main Contractor.

14.

In case of other inspections required by the Main Contractor, Sub-Contractor shall cooperate
those inspections actively.

15.

Safety measures about the result of inspections shall be taken immediately and make up for
the delay of Works caused by the setback of dealing with it.

16.

The Sub-Contractor shall not work beyond equipments ability.

17.

The Sub-Contractor shall not operate equipment with eliminated safety devices.

18.

The Sub-Contractor is responsible for proper disposal of scraps & waste during the
construction until taking-over of works wherein he shall be responsible for discharging
environmental hazards, if any.

19.

All workers shall hold safety meeting every morning and the Safety Manager shall check the
health conditions of all workers before attending work.

20.

The Sub-Contractor shall consider throughout the execution and the completion of the Works
and take all reasonable steps to protect the environment on and off the Site and to avoid
damage or nuisance to other people or properties of the public or others resulting from
pollution, noise or other causes arising as a consequence of his methods of operation.

21.

The Sub-Contractor shall not create any problems to the site or the nearby neighborhood due
to carelessness or ignorance while carrying out the Works.

22.

The Sub-Contractor shall not produce any loud noise and create dusty environment at the
Site or the nearby neighborhood at day and night.

23.

The Sub-Contractor shall implement noise reduction measures such as provision of sound
protection cover, if requested by the Main Contractor, to minimize noise during the operation
of the equipment and shall allow all costs and time for implementing such measures.

C. BILLS OF QUANTITIES, UNIT RATES AND PREAMBLES
1.

The extent of the Works to be carried out shall be ascertained by reference to the Drawings,
Specification and site conditions. In the event of any discrepancies, being discovered between
the documents, the Sub-Contractor shall notify the Main Contractor of such discrepancies or
divergence in writing immediately.

2.

The items and descriptions in the Bills of Quantities attached herein are not fully descriptive
and not meant to limit the scope of the Works. The Sub-Contractor shall determine for himself
the exact scope and the full extent of each items required. No claims whatsoever arising from
the lack of knowledge on his part in the pricing of the items shall be entertained.

3.

The Sub-Contract rates shall include supply, erection, dismantling, working platform, access,
all extra labor involved in external and internal works.

4.

The Sub-Contract rates shall include all necessary costs for packaging, freight, handling and
transportation to site, loading, unloading, unpacking, checking, etc.

5.

The term Contractor referred to in the Preambles, Specifications or any other Tender
Document shall mean the Sub-Contractor. The term Main Contractor shall mean HyundaiNKE Joint Operation. The term Engineer shall mean Wiratman & Associates in association
with KK Lim & Associates Pte. Ltd. The term Employer shall mean PT. Griyaceria
Nusamekar.

* The Letter of Guarantee shall warrant that the concrete pump is capable of pumping concrete in accordance with
the buildings total height and shall include Sub-Contractors Contingency Plan in case of breakdown.

A. Concrete Pump, CPB and Air Compressor shall preserve the shape of original design.
B. Concrete Pump, CPB, and Air Compressor shall be new equipment or less than 5 years
from manufacturing.
C. The Sub-Contractor shall propose concrete pump from Putzmeister (Sany), Schwing,
Junjin, Zoomlion or approved equivalent.
D. The Sub-Contractor can propose concrete pump capacity, pipe, etc. or working system in
accordance with the building total height.
E. The Sub-Contractor shall include PE calculations & endorsements for CPB installation
including opening size, reinforcements, etc.
F. The CPB shall include climbing devices, floor frames and supports.

G. The Concrete Pump shall include piping & its accessories, brackets, bolts, pipeline
supports, etc.
H. Piping lines, pipe diameter, pipe thickness, etc. shall be adequate for the Project.
I. The Sub-Contractor shall employ regular cleaning system including all necessary
machineries & accessories after casting and during blockage situation. The cleaning
system may include provision of air compressor, shut-off valves (2 nos.), concrete
recycling system (hoppers, 2 nos.) or any other method depending on Manufacturer
and/or Suppliers recommendation.

The Sub-Contractor shall ensure that the Concrete Pump and CPB meet the
specifications mentioned above.
The Sub-Contractor shall ensure that the Concrete Pump and CPB keep the shape of
original design. The Sub-Contractor shall submit certification for CPB and Concrete
Pump and shall obtain approval from relevant Authority prior to installation.
The Sub-Contractor shall obtain prior approval to use different types of Concert Pump &
CPB (only with higher quality and performance than originally approved) and shall bear
all additional cost incurred in doing so.
The Sub-Contractor shall review guidelines which will be suggested by Main Contractor
and if there are absurdities, the Sub-Contractor shall inform the Main Contractor and get
inspection. While construction is proceeding, if any Works on site will be stopped due to
some problems with the CPB & Concrete Pump, the Main Contractor can back charge
the related delay cost from the Sub-Contractor and reimburse the delay cost to the other
Sub-Contractor/s who suffered loss/es.
The Sub-Contractor shall employ skilled erectors who have five (5) or more years of
experience.
Pipe thickness, joint, etc. shall be sufficient to properly pump concrete according to
building height.
The Sub-Contractor shall submit its mobilization plan including the installation plan to the
Main Contractor and mobilize after approval by the Main Contractor.
The location of CPB and Concrete Pump shown in the attached equipment lay-out plan is
indicative only and may be changed according to the Main Contractors plan.
Concrete Pump location may be shifted from time to time during the construction period
according to Main Contractors casting plan. Sub Contractor shall bear all the cost arising
from the shift.

4.

The Main Contractor can execute the preliminary inspection through its designated machine
inspection company and the Sub-Contractor shall cooperate with the inspection actively.

5.

In case there are major problems in the result of the preliminary inspection, the Main
Contractor can request to change the CPB & Concrete Pump and in case of defects in parts,
the Sub-Contractor shall take all necessary measures to repair by changing the defective
parts and submit report for the repairs works.

6.

Any CPB & Concrete Pump taken from other construction site shall be inspected for any
defective parts, welding and painting issues, as well as, safety devices before mobilization
and measures shall be taken with regards to the defects by other special agency and the cost
shall be borne by the Sub-Contractor.

7.

Sub-Contractor shall employ qualified operators having five (5) or more years of experience
with valid license and shall be advice to obey the rules listed below.

Operators shall operate following instructions from the Main Contractor.


Operators shall stand by on site until designated working time in case of work stoppage
due to bad weather or site conditions.
Operators shall wear personal protective equipments on site such as safety helmet,
safety shoes, safety harness, etc.).
Operators shall not demand additional compensation beyond his contract provision
Operators shall operate the machine after checking the placement of inducers and shall
never operate in case of not placing them.
The Sub-Contractors employees whom neglect their duties shall be replaced at once, if
ordered by the Main Contractor.
Any operators shall not request money/goods and shall not reject to operate without any
rational reason. If the Site Manager of the Main Contractor finds these cases, the Main
Contractor will remove such unqualified operator immediately and the Sub-Contractor will
be in-charge of all the related cost caused by the delay.
The Operators shall be prepared by the Sub-Contractor according to the construction
schedule including overtime, meal, allowance, etc.

8.

The Sub-Contractor shall inspect its CPB & Concrete Pump carefully to prevent any accident
to occur.

9.

The Sub-Contractor shall instruct its Operators to inspect the equipment daily and submit the
report to the Main Contractor regularly.

10.

Sub-Contractor shall coordinate regular inspections with the company designated by the Main
Contractor every 3 month after installation. If there is any problem, the Sub-Contractor shall
eliminate defects immediately.

11.

The Sub-Contractor shall train Operators before deployment and shall cooperate safety
training with the Main Contractor actively.

12.

The Sub-Contractor shall acquire insurance against any accident and submit copy to the Main
Contractor. The Sub-Contractor shall be responsible in dealing any accident involving its
equipment and staff.

13.

In the event of any accident involving CPB, Concrete Pump or the Operators, the SubContractor shall deal with it through its insurance but in case of lack of compensation, the
Sub-Contractor shall compensate any accident at its own expense.

14.

The Sub-Contractor shall secure an alternative operator having certification against vacancies
during holidays.

15.

The Sub-Contractor shall supervise its Operators or Sub-Operators and shall fulfill the Main
Contractors request of workload.

16.

The Main Contractor shall manage the survey work while the Sub-Contractor shall prepare all
the equipment for surveying work and shall be responsible for location, verticality, horizontality
of its equipment.

17.

The Sub-Contractor through its Manager in-charge of Sub-Contract Works shall get
permission one day before the commencement of works.

18.

The Sub-Contractor shall arrange wireless communication between its Operators and the
installation and dismantling team.

19.

The Sub-Contractor shall ensure that main power supply shall be turned off and main power
cable shall be removed before undertaking dismantling works.

20.

The pipeline connected directly to the pump shall be fixed to maintain horizontality. The SubContractor shall provide all the necessary piping accessories, brackets, bolts, pipeline
supports, etc.

21.

The Sub-Contractor shall inspect pipe thickness with Ultrasonic tool per 500 m3 of concrete
discharge.

The Sub-Contractor shall regularly clean the pipe & pump after casting.
