Introduction
Theintentionaltortsmakinguptrespasstothepersonplayanessentialrolein
protect[ing]anindividualspersonorpropertyrightsfromunwantedinterferencebyothers.1
While,trespassorytorts

haveawiderangeofpotentialapplicationsinavarietyofcircumstances

betweencivilians, theyarefrequentlyreliedonforredressincasesofunlawfulexerciseof

executive3andpolicepowers.4Ofparticularimportanceisthetortof
FalseImprisonment.

LuntzandHamblyelaboratedontheimportanceofthisremedialcivicmechanisminthecontext
ofjurisdictions6whichlackaconstitutionalorstatutorybillofrightsinstatingthat:

the tort of trespass has a particular significance in bringing issues of civil liberties
before the courts, where the contest is as to whether trespassory acts by a public
officeragainstacitizenspersonareauthorisedbylaw7

DespitecontinualiterationofitsimportancebyAustraliancourtsofthehighestauthority,8 the
tortof

hasexperiencedsubstantialerosionorfailureintwocontemporarycontexts:
