CONTRACT OF EMPLOYMENT

This contract is included between:


1. AJAY KUMAR VIND herein after named the Employee the Seafarer,

AND
2. Q & R TRADER LTD as Employer,
Art.1.The employee has accepted to work on the Employers vessel M/V ARWA (See Art. 8)
in the capacity of FITTER
Art.2. the Seafarer agrees to serve on board for 9 1 month at Owners option.
a) The employment shall be deemed to commence from signing on board and continued until
Seafarer sign off the vessel.
b) The transportation cost (Airline tickets only) to and from the vessel will be bared by the Owner.
c) Any Seafarer wishing to extend his service period after the expiry date of the existing contract
may do so subject to mutual approval of the Owner and the Seafarer.
d) A Seafarer who wishes to terminate his service on board a vessel prior to expiration of this
contract must give notice to this effect to the master at least 30 days in advance, Traveling
expenses ( including joining ticket + repatriation ticket) as well as the other taxes and charges
related to the repatriation will be n Seafarers account.
e) The Employer will pay repatriation in case of death wife or child of seaman.
f) All Seafarers newly hired under this agreement will undergo two months trial period. If he is
found to be unsuitable for the position to which he was appointed, he may be discharged and his
contract terminated. The Employer will pay only the salary of the actual period served on board,
but all repatriation costs ( including joining ticket + repatriation ticket) will be on the Seafarers
account.
g) Employer is not responsible for any amounts of money Seafarer pay to any crewing agency or any
third party, also Employer is not responsible for any agreement done with any crewing agency
and ant third party.
Art.3. The working time is as per Master instruction.
The wages will be 450 USD in words (FOUR HUNDRED FIFTY USD ONLY) per month including
overtime/Saturday, Sunday).
a) Any other remuneration by way of entitlement to allowances, extra overtime and benefits will be
as the Employer ESTIMATION ONLY.
b) The Owner will provide to the Seafarer all necessary means of living and working on board,
including accommodation, food at suitable standards.
c) The wages will be paid for each month 15th of the next month.
Art.4. The Seafarer undertakes and agrees the following:
a) To show due respect for Arabic Countries, their Flags and its Customs and Religion.
b) To execute the duties required of him in the rank to which he has been appointed in an efficient, honest
and diligent manner.
c) Before joining the Employers vessel each Seafarer must perform a medical visit.
d) To execute all lawful commands issued at him scrupulously and honestly.

Art.5. Sick pay:


The Employer will pay to the Seafarer all medical expenses, hospitalization benefits and Medical expenses for
attention in foreign ports for illness and injuries, arising out of and in the course of employment on board,
until such time the Seafarer is certified medically fit to safely travel to his country
Art.6. In case the Seafarer suffers an accident during the period of employment, including accidents
occurring whilst traveling to or from the vessel request of the Owner or as a result of marine peril and whose
ability to work is reduced as a result thereof, will receive from the Owner an amount of maximum 1000
USD.
Art.7. If the Seafarer dies as a result of an accident during the period of employment, in the same
circumstances as in Art 6, the Owner will pay the amount of maximum 5000 USD to his wife, or if not
available, to his children.
Art.8. Dismissal from service:
The Owner will be entitled to terminate the Seafarers contract for the following reasons:
- criminal offence or activities;
- if the Seafarer is enable ( he suffers of a disease which he didnt declare before signing on) to execute his
work he will sign off and all transportation, medical expenses will be paid by the Seafarer;
- Owners have the right to transfer the Seafarer to another vessel, that the one from this contract, vessel which
they own or have under management, in case of necessity for the rank of the Seafarer;
- excessive drinking;
- gross negligence in the performance of duties:
- receipt of tips and commissions;
- smuggling;
- possession of fire weapon or narcotics;
- endangering the vessel or lives of whose on board;
- Any strike on board, which is proved unfounded.
In such case, the Seafarer is entitled to receive full wages until effective date of his dismissal or discharge from
the vessel and repatriation will be bared by the Seafarer.
Art.9. the Seafarer is entitled to terminate his service contract immediately:
a) if the Employer or its representative does not follow contracted obligations;
b) if the ship carries an illegal cargo
c) In any way without being guilty, the Seafarers life, personal liberty and health has been continuously
threatened beyond normal risk of seaman profession
Art.10. the Seafarer serving the Owners vessels undertake to strictly comply with Owner instructions, rules and
regulation as laid in the COMPANYS REGULATION AND CIRCULARS letter files.
Art.11. the present contract will be governed by English law.
