Summary of R.A. 87.

92: E-Commerce Act of 2000


Republic Act No. 8792, otherwise known as Electronic Commerce Act of 2000 is an act that
recognizes the use of electronic commercial and non-commercial transactions and documents.
In the entering of the 21st century, technology is rampant and fast progressing. Internet has become
the highway of information, making transactions available to and from any place at real time. Not
only information is transacted through the internet but even money and goods as well. With that said,
this implies the need for the regulation of electronic commerce.
This republic act was approved and signed on June 14, 2000 by the former president Joseph E. Estrada
and overall it has 42 sections grouped into five parts as follows:
Part I: Short title and declaration of policy (Sections 1 to 2)
Part II: Electronic Commerce in General
Chapter I: General Provisions (Sections 3 to 5)
Chapter II:LEGAL RECOGNITION OF ELECTRONIC WRITING OR DOCUMENT AND DATA
MESSAGES (Sections 6 to 15)
CHAPTER III: COMMUNICATION OF ELECTRONIC DATA MESSAGES OR ELECTRONIC
DOCUMENTS (Sections 16 to 24)
Part III: ELECTRONIC COMMERCE IN SPECIFIC AREAS
CHAPTER I: CARRIAGE OF GOODS (Sections 25 to 26)
PART IV: ELECTRONIC TRANSACTIONS IN GOVERNMENT (Sections 27 to 29)
PART V: FINAL PROVISIONS (Sections 30 to 42)
Part one embodies the title and the policy of the act. The policy states the importance of Information
and Communications Technology (ICT) in nation building and the like.
Part two covers the general provisions of Electronic Commerce. It covers the objective, the scope of
application, definition of terms, the legality and authenticity of digital electronic data, the formality
and validity of electronic contracts, and other provisions for both parties involved in an electronic
transaction (e-commerce)
Part three covers everything that there is to know in transacting online I.e. receipts and other
liabilities imposed on both parties involved in the transaction thereof.
Part four covers the provisions for the electronic transactions in the government and Part five covers
the final provisions i.e. the access to electronic data and its lawful access and obligation of
confidentiality, the extent of the liability of a service provider, the penalties in accordance with this
law, etc.
