TOWERS 300 RULES AND REGULATIONS Welcome to Winston Towers 300. You have chosen one of the finest condominiums in the great state of New Jersey as your new home. We have prepared this manual to enable you to gain a better understanding of our rules, regulations and procedures so that you may enjoy your new home to the fullest. During your residency here, the Board of Directors and Management would like you to fee! comfortable and safe in a clean and secure building. This book also includes emergency procedures and important telephone numbers, information about the amenities of the property, and rules and regulations which apply to all residents. We recommend that all residents of your unit review this manual carefully and that you retain it in an accessible place for ready reference. In this small city of 676 units, Rules are necessary so that all residents may enjoy their property in harmony. The Management Office is open Monday from 9 AM to 8 PM; Tuesday through Friday from 9 AM to 6 PM. SWIMMING PO TERRACES...., TELEPHONE NUMBER: COMMON ELEMENTS AND LIMITED COMMON ELEMENTS No garbage cans, supplies, milk bottles, carriages, bikes or dog houses or other articles shall be stored in the halls, on the terraces, or on the staircase landings, nor shall any lines, cloths, clothing, curtains, rugs, mops or laundry of any kind or other articles bo shaken or hung from any of the windows, doors or terraces, or be exposed on any part of the common elements. No sweepings shall be ejected from any unit into the corridors. Fire exits shall not be obstructed in any manner, and the common elements shall be kept free and clear of rubbish, debris and other unsightly material. Tho sidewalks, entrances, passages, elevators, vestibules, stairways, corridors, halls and all of the common elements shall not be obstructed or encumbered of used for any purpose other than entrance and exit. No objects of any kind may be left in any public area in the building, including halls, stalways and vestibules, except newspapers left at your door and Association election material left by the candidates. The personal property of all residents shall be stored only within their own condominium unit or storage room. No radio or television aerial shall be attached to or hung from the exterior of the building, and no sign, notice, advertisement or illumination shall be inscribed or exposed on or at any window or other part of the building, except as shall have been approved in writing by the Board of Directors; nor shall anything be projected from any window or terrace of the building without similar approval. There shall be no congregating or loitering in the lobby; nor shall the public halls, elevators, stalways, garage or sidewalks bo used for any purpose other than normal transit, ‘The lobby is Intended to be used as a waiting area for guests of residents of the building. It may also be used by residents waiting for other residents, The time limit should not exceed thirty minutes. It is prohibited to conduct business of any kind in the lobby areas, such as real estate sales, insurance sales, or any other personal business that could otherwise be conducted In a resident's private dwelling. The lobby is not to be used as a lounge area or as. a reading area; the Community Room is open alll day for that purpose, No resident shall make any disturbing noises in the building or on the terraces, nor permit noise by family, guests, servants, employees, agents, licensees or pots, nor permit anything by such persons or animals that will interfere with the rights, comfort or convenience of other residents. No resident shall play a musical instrument, felevision, radio or sound amplifier at an unreasonable volume of sound as to disturb or annoy other occupants of the bullding. No ham radio or short wave radio transmitter may be used at any time. 3 11. 14, (@) Out of respect for the residents whose apartments face the Promenade Deck, congregating is not permitted on the deck after 10 PM, except in the case of tennis (see Page 35 for hours of play), (b) The Borough of Cliffside Park prohibits disturbing or annoying noise between the hours of 11 PM and 8AM. No inflammable, combustible, or explosive fluid, chemical or substance shall be kept in any unit or storage room, except as required for normal household use. Usage of electricity in storage rooms and common areas is limited only to electrical lights, Ball playing is permitted only on the North Promenade area designated for this activity. Only whiffle balls, basket balls, beach balls, and other soft balls that cannot do damage to the property are permitted. No hard ball of any kind is permitted. When a bat is used, the batter must hit away from the building only in the atea of the North Promenade designated for this activity. No public hail, elevator, vestibule, laundry or compactor room shall be decorated or furnished In any manner without written consent of the Board of Directors. Bicycles and tricycles shall not be ridden in any public areas, oxcopt the North Promenade, Bicycles and tricycles must access the Promenade by using only the promenade entrance to leave or enter the building. They may not go through the lobby entrance. Bicycles and tricycles must use freight elevators and may only use the passenger elevator in the event the freight elavator is Inoperable, Biko riding is permitted only on the North Promenade, Guests may not bring their bicycles into the building. Tricycles on rubber wheels ate permitted in the South Promenade areas, outside and adjacent to the “Tot Lot." Bicycles and tricycles are not permitted in the lobby. Roller skating shall be permitted during the hours designated in the Rules and Regulations, and only in those areas of the North Promenade where bicycle riding is permitted. No skates with metal wheels are permitted. No skates are to be worn within the building. These rules apply to all roller skates, skate boards and in-line skates. No one shall be permitted to play on the walks, in the corridors, elevators, stairways, lobbies, roof, driveways, landscaped areas, garage landings, and/or Tamps of the condominium property and areas. Footwear and sultable cover-up attire are required at all times in the lobby, hallways, elevators and other interior portions of the common areas. Housecoats, night clothes, robes or a towel do not constitute appropriate attire. 4 15. 16. 47. 18. 19. 20. 24. 22. 23. The use of any equipment, tools, supplies, tables or chairs belonging to the Association is prohibited for any personal use in residents’ apartments without Management approval, Tho Unit Owner is responsible for all damages to any common element or limited common element caused by any unit owner, resident, family, visitor, guest, employee or pet. Groceries and packages may not be left unattended at the front entrance or in the lobby while cars ate being parked. Terraces are a limited common element, as are the HVAC units, All other appurtenances in the apartment are not, The inside of the walls, which contain the common pipes and common electric lines, are part of the common elements, and are solely the responsibility of the Association. The only exclusion is if a resident has made an alteration and installed new wire or pipes. In that case, the unit ‘owner would then be responsible for the repair. No resident of any unit may make any structural alterations or improvements whatsoever inside any apartment or terrace without prior written consent of the Board of Directors. Notice must be given to the Board of Directors or Manage- ment. An Alteration Agreement must be signed and discussed with the General Manager, and a $1,000 Security Deposit must be paid in advance against any damage. The Alteration Agreement must state clearly what work is to be clone, by whom, and when, No such work may be done unless and until such Alteration Agreement receives specific consent in writing from Management. A Certificate of Insurance for $1 million in tiabllity coverage must be furnished by the contractor. Copies of any permits required by law must be submitted to Management prior to commencement of work. No Alteration Agreement Is required for painting or wallpapering. Outside contractors or workmen may perform work on behalf of any resident only between 9 AM and 6 PM, Monday through Saturday. No such work may be performed on Sunday or any holiday. Sitting outside the pool area is restricted to Association installed benches only. Lying across benches is not permitted. Proper garments and footwear shall be worn at all times. ‘Smoking is prohibited in any part of the bullding's common areas, including the Card Room, Billard Room, Community Room, Conference Room, hallways, lovators, laundry rooms, and Skyroom (except when the Skyroom is rented on a paying basis). No food or beverages are permitted in the Lobby. 24, ‘The bulletin board is available to unit owners of the 200 bullding and 300 building to post apartments for sale or lease as well as items for sale (cars, furniture, household items). We also permit household workers employed by unit owners to post notices of their availability, It has been and will continue to be the policy of the board not to post notices of property for sale at any other location. ELEVATORS Itis prohibited to play or loiter in any elevator. The undue holding and delaying of any elevator at any floor is prohibited. Freight, furniture, heavy loads, supplies, goods and packages of every kind are to be delivered to apartment units only through the Service Entrance of the building and only on the Service Elevator. Residents or their families may be small packages (including hand luggage) through the Front Entrance. Trunks and heavy baggage are permitted in or out of the building only through the Service Entrance. A red emergency alarm button is located in each elevator. In the event an elevator malfunctions, press the red emergency alarm button. This will put you in instant voice communication with the Front doorman, who will summon help. ‘Smoking or carrying lighted cigars, cigarettes or pipes is prohibited in any elevator. Luggage racks, hand pulled shopping carts, and valet carts are permitted on the Service Elevator only. When the Service Elevator call button in the hallway fs not lit, a move Is in progress, FIRE PROCEDURES IF THERE IS A FIRE AT 300 WINSTON DRIVE, THIS IS WHAT YOU SHOULD DO: He If the fire is in your apartment, IMMEDIATELY dial 945-0200 to call the Cliffside Park Fire Department, (Calls to 911 may go to another municipality.) Give the LOCATION of the fire: 300 Winston Drive, floor , apartment, ‘ Do NOT attempt to fight the fire before calling for help. You may be wasting precious time, and that could be fatal. Leave your apartment with the door CLOSED AND UNLOCKED. Contact Building Security (886-1900) with the exact location and nature of the fire (electrical, grease, etc.) If possible, wait NEAR your apartment to direct and inform the firemen. DO NOT use the elevators. When there is a fire, the elevators are automatically removed from service for FIRE DEPARTMENT USE ONLY. Emergency lights are located In all stairwells and In the garage. 2. When you hear the FIRE ALARM ---- REMAIN IN YOUR APARTMENT. WITHOUT opening the door, touch the door frame, IS IT HOT? HitIShot + Filla tub with water. + Put wet towels against the bottom of the door or use duct tape around seal of door. + Open a window for alr. If there is smoke outside, close it. Hang a sheet out of your window so the fire department knows where you are. Make sure flames from another window cannot reach it, + Stay near the OPEN WINDOW. + The FIRE DEPARTMENT will give instructions - by intercom - by bullhorn - by going door to door. REMEMBER . .. SMOKE RISES ... THE BEST AIR IS NEAR THE FLOOR If the door frame Is NOT hot, and the ALARM keeps ringing, STAY IN YOUR APARTMENT IMPORTANT PRECAUTIONS BEFORE A FIRE OCCURS 8 USE THE CHAIN ON THE DOOR. If the chain is attached, firemen know that someone is in the apartment. This is a good precaution at night especially. If there is an INVALID or DISABLED person in your apatiment who will need help to escape, be sure to inform the Management Office, The Manager will keep the list up-to- date and make sure the Fire Department has the latest lst Keys to all locks to your apartment must be available for emergency rescue. New Jersey Supreme Court has upheld the landlord's right to have keys. More important, IT COULD SAVE YOUR LIFE. If your keys are not on file at the Management Office, the FIRE DEPARTMENT WILL USE FORCE TO ENTER YOUR APARTMENT. Note the locations of the fire doors on your floor. If they do not close fully, notify the Manager immediatoly. NEVER use water to put out a grease fire, If you bum toast or other food, open the kitchen window and let the smoke dissipate. Otherwise it will go into the hallway and set off the fire alarms. Do NOT stand under a smoke alarm when smoking cigars, pipes and cigarettes, Winston Towers 300 has a sprinkler system which meets the retrofit requirements of the New Jersey Uniform Fire Code. If the sprinkler system activates, the fire alarms will activate as well. Please follow the same safety procedures, Dial 945-0200 to report a FIRE EMERGENCY. Calls to 911 may go to another municipality. For all other Fire Department business, dial 313-2062. FIRE SAFETY EVACUATION PLAN FOR RESIDENTIAL HIGH RISE BUILDINGS What occupants should know before a fire occurs: 1. Know two exits - When the fire alarm activates, the elevators will descend to the lobby and cannot be used. Know the locations of the manual pull stations (within 5 feet of each exit). Know the fire resistive features of your building: seif closing, fire rated doors, fire stairwells, etc. Practice home fire safety. Keep heat producing devices away from combustibles. Do not overload electrical outlets. Do not use frayed or damaged electrical cords. Do not store flammable liquids. Watch for carelessly discarded clgarettes. Never throw water onto a grease fire, What to do in the event of a fire: a STAY CALM Do NOT attempt to fight the fire yourself before calling for help and notifying the Fire Department. Get your family out of the area of danger aid to an area of safe refuge (stairwell to the lobby). Close the apartment door as you leave, but DO NOT LOCK IT. THIS IS EXTREMELY IMPORTANT, Stay CALM. Hot, poisonous gases wil rise to the ceiling. Stay low or crawl in smoke, Your visibility will be better and you won't be exposed to the heat and poisonous gases, Close the door between you and the smoke. Seal it with a wet towel if needed. 10 FIRE STATISTICS 70 percent of American homes have smoke detectors; half are not operational. Most residential fires are attributed to human error. 1,300,000 people are injured annually in residential fires. 40 percent of fatal home fires occur between midnight and 4 AM. Four minutes of smoke inhalation can cause irreversible brain damage. Three inhalations of carbon monoxide, the by-product of combustion, can be fatal. PRACTICE FIRE PREVENTION. ‘THE LIFE YOU SAVE MAY BE YOUR OWN. a GARBAGE Refuse, garbage and empty non-aluminum objects, such as tin cans, must be deposited in the compactor chutes. Tinted glass containers, newspapers, magazines, clothing, coat hangers, and all other large materials shall not be deposited in the chutes; they are to be placed neally in the compactor closet. Out of respect for the peace of residents whose units adjoin the compactor rooms, they will be locked between the hours of 11 PM and 7 AM daily. All wet debris Is to be socurely wrapped or bagged in plastic bags sized to fit easily into the hopper panel. Debris must be completely drip-free before It leaves an apartment, and should be cartiad to the compactor closet in a careful manner, in @ diip-proof container; and placed into the hopper so it will drop into the chute for disposal. All residents must depostt their garbage in the proper receptacle in the compactor closet. ‘The law requires hypodermic needles to be broken from the syringe. The plunger and syringe must be separated before discarding. Needles should be collected in a covered plastic container. When it is full, please bring the container to the Management Office. Discarded cartons, appliances, ornamental trees, etc. are not to be left in the compactor closets. They are to be brought down to the Service Area. Construction debris Is to be removed from the premises by the contractor. Cliffside Park Department of Sanitation will not take carpet. Therefore, residents must make their own arrangements for the disposal of carpet. Carpet of any size may not be deposited in the compactor chutes. 12 11. GENERAL Employees of the Association or Management shall not be sent out of the building by any resident, at any time, for any purpose. No resident shall direct, supervise or in any way attempt to assert any control over the employees of the Association of Managemont. No employee shall be solicited or employed to do any work for any resident during said employee's normal working hours. All employees shall act with civilly and proper conduct toward all residents and guests, All residents and their guests shall act with civilly and proper conduet toward employees. All commercial delivery shall be made through the Service Entrance. Deliveries allowed between the hours of 9 AM to 5 PM Monday through Saturday only. Packages shipped via United Parcel Service, Federal Express, etc, are delivered to the Valet, where residents may pick them up during business hours. The delivery service will leave a notice affixed to your mall box. If a small package or envelope is hand delivered for a resident, the Doorman will call to advise. If resident is not home, the delivery will be held at the front desk at resident's risk. Employees of the Association or Management are not permitted to accept delivery of flowers, food or other perlshables if the resident is not at home to accept them, No solicitation will be allowed by any persons, including residents, in the building or common areas, for any cause whatsoever unless specifically authorized by the Board of Directors or Management. All doors between apartments and interior hallways shall be kept closed at all times when not being used for ingress and egress. Any resident who takes a cart or luggage rack from the Service Entrance must leave Winston Towers 300 ID and must retum the cart or rack to the Service Entrance within two hours. Replacement of a Winston Towers 300 ID card is $20. All violations of Rules and Regulations should be reported to an appropriate authority. 13 16. 417. 18. 19. 20. 241. 22. 23. 24. Rubber wheeled shopping carts and small pull carts are permitted anywhere in the building, except through the Front Door. A Unit Owner may rent a unit only if title has been had for at least one year, Leases may be for a one-year term only. ‘An application must be filed with Management for every sale or lease. The fee is $200 for processing a sale and a lease. Avalid lease must be on file at the Management Office at all times. Unit Owner is responsible for any and all damages that may occur to common: ateas caused by their tenants. Washers, diyers and garbage disposals are not permitted in any apartment. ‘Smoking is prohibited in any part of the building's common areas. Payments are due as of the first of the month. The Service Entrance will be closed on Sundays, except for the delivery of pharmaceuticals and food. Tag sales, realtor open house events and other such functions which ate open to the public ate prohibited. ‘Any person within the bullding or on the grounds, Including residents, shall present sultable identification to authorized building personnel upon request. A feo of $50 will be charges to access a key In lock box during business hours and $100 at other times. For a second occurrence $26 will be added to either the $50 or $100 fee. A third occurrence will have an additional $25 added. 14 LAUNDRY Out of respect for the peace of residents whose units adjoin the laundry rooms, they will be closed between the hours of 11 PM and 7 AM daily. Laundry should be removed immediately after the wash or dry cycle Is completed, and all fiters should be cleaned. Care should be taken to insure the machines are not overloaded. A large capacity washer and dryer are located in the basement. Each user is responsible for leaving appliances in a completely clean condition after each use. A person may launder only two loads at a time. The next person waiting in line shall then have the right fo use the machines for two loads. Only non-phosphate soaps may be used. Residents, thelr guests and employees may use the washers and dryers only on the floor of resident's apartment. Residents, their guests and employees may not Use laundry facilities on any other floor, other than the large capacity equipment in the basement, The laundry room is to be used for laundry only. ‘Smoking is not permitted in any laundry room. Any malfunction should be reported to the Management Office immediately. 15 MOVING A move is the use of the Service Elevator for more than one elevator-load of furniture, ete. Prior consent for a move must be obtained from the Manager. Notice of a move must be given to the Manager at least one week in advance of a contemplated move. Only one move (whether in or out) will be permitted on any one day, Each move must have a Seourlty Guard. Mondays through Fridays, moving not more than one elovator-load may be permitted without charge, provided prior written consent is given by the Manager. There shall be no furniture moved in or out of the premises on a Sunday. Special permission for one elevator-load on a Saturday may be granted at Management's discretion. Delivery of new furniture is permitted on Saturdays from 9 AM to 5 PM, provided it is not more than one elevator load. Moves are permitted Mondays through Fridays from 9 AM to 5 PM. A move may go past 5 PM to Its conclusion, providing the concluding hour is reasonable in the opinion of Management. No move may commence after 3 PM. Move In . No move in may take place until after the sale or lease is closed, A statement from the attornoy for the new resident that there is a sale or a signed lease must be delivered to Management, . The Service Elevator must be reserved at the Management Office well in advance of the contemplated move. . One week before the move, Management must be advised of the starting time of the move. A $1,000 Security Deposit against any damage to Association property must be paid in advance as well as a non-refundable fee of $200. If the move goes over the five (5) hours allotted, the charge will bo $40.00 per hour. 16 B Move Oui |. The Service Elevator must be reserved at the Management Office well In advance of the contemplated move, . A $1,000 Security Deposit against any damage to Association property must be paid in advance, by certified check, bank check or money order payable to "Winston Towers 300 Association, Inc." A personal check will be accepted only If it is received by Management at least two weeks prior to the move. A non- refundable fee of $200 is also required. If the move goes over the five (6) hours allotted, the charge will be $40.00 per hour and will be deducted from your deposit. One week before the move, Management must be advised of the starting time of the move. . Security deposits on leases and moving out after a sale will be retumed only after (@) the resident has moved out, and (b) a period of not less than one week has expired, and (c) all Winston Towers 300 ID cards, Palisadium passes, metal security keys and garage stickers have been retumed to the Management Office. Unless all Items in (c) above are retumed to the Management Office, the new lessee or Unit Owner will not be issued Winston Towers 300 ID cards, metal security keys and garage stickers, . Residents moving out should advise Management of a forwarding address to which the Security deposit will be mailed, a7 41. 12. PARKING All outdoor parking will be reserved solely for use by GUESTS of residents of Winston Towers 300. Residents may not park in the Visitors’ Parking Area at any time. Parking is not permitted between 4 AM and 6 AM, Vehicles parked during those hours or any vehicles not displaying the proper pass will be towed at the owner's expense, Guests will be issued a time-stamped pass by the doorman, Indicating the apartment being visited. This will facilitate communication in case of emergency. Any car parked in the Visitors’ Parking Area without a proper parking permit, may be ticketed and towed at the owner's expense. Parking is not permitted in the Visitors! Parking Area in front of building between 4 ‘AM and 6 AM. Overnight guest parking is allowed in the Noith Garage (by the loading dock) for $5.00 per night. A limit of one (1) week overnight guest allowed. All units are entitled to at least one garage parking space. A single car will be assigned a single space; two cars will be assigned tandem spaces. No unit may have more garage spaces than there are cars and registered drivers and residents in that unit. All three criterla must be fulflled: There must be two cars and {wo registered drivers and two residents In a unit to qualify for two parking spaces, No more than two spaces shall be assigned to any unit No patking space shall be shared by two or more units. Parking on the ramps, driveways, ete. is prohibited. Cars in violation will be towed at the owners' expense. Likewise, vehicles parked in unauthorized areas will be towed at the owners' expense. Any dtiver who repeatedly violates the Parking Regulations will be prohibited from the use of any parking facility in or about the building, Drivers are required to comply with all safety precautions and the rules pertaining to speed limits as posted, and shall follow the lawful flow of traffic. Drivers may not pass another vehicle in motion. Headlights must be turned on when entering or leaving the garage, and must be kept on at all times while the vehicle is in motion in the garage. Vehicles in assigned spaces must have a Winston Towers 300 sticker affixed in the rear window, driver's side, Any vehicle parked in an assigned space without a sticker will be assumed to be parked without authorization, and the vehicle will be towed at the owners’ expense. The use of a parking space is limited to the assigned vehicle, and may not be used interchangeably by other vehicles. Aparking lease must be signed by resident when space assignment is made. No resident shall park a vehicle or otherwise obstruct any entranes to or exit from the garage. No one may enter the garage and remove a resident's car for any purpose, without written notification to Management. The use of any inflammable, combustible, explosive or unstable mixture of chemical substances, for any reason whatsoever, Is forbidden in the garage. Maintenance work of any kind whatsoever is forbidden, except in the case of an emergency change of tires. Any and all garage leases are subject to cancellation and termination upon thirty days! notice of breach of any Rule or Regulation affecting the use and occupancy of the garage area. Management shell advise in writing any Unit Owner in arrears of garage rent that failure to receive full payment within five days of the letter shall constitute thirty day notice of expiration of garage lease. If any lien filed by the Association against a Unit Owner has not been satisfied within thinly days of date of filing, written notics shall be given fo the said Unit Owner canceling garage lease and revoking parking privileges. The North garage door may be opened only from 9 AM to 9 PM. in an emergency, a replacement car may be parked in a resident's assigned garage space, ONLY with a proper temporary pass issued by Management. Any car without a valid permit may be ticketed and towed at the owner's expense. A cat is illegally parked in the garage when it has neither the permanently affixed sticker assigned by Management, or a temporary parking permit issued by Management. Any car found to be parked in the garage illegally will be ticketed. No car js to be left unattended in any part of the front driveway. Violators may be ticketed and towed at the owner's expense, 19 27. 28. 29. 30. There shall be no parking between the stated markers of the front driveway. Only vehicles with state-issued handicapped license plate or permit may be parked ina designated handicapped parking space. Violators may be ticketed and towed at the owner's expense. Vehicle motor idling in the garage is prohibited. Playing in the garage and/or use of bioycles, tricycles, skate boards or roller blades in the garage are prohibited. 20 PET REGULATIONS Allpets must be kept on a leash or cartiad at all times while in the Common Areas. No pets are permitted on lawns or on the Promenade Deck. Pets are to be taken to and from the bullding through the Service Entrance and must use only the Service Elevator, Pets may not pass through the lobby. Owners of pets are responsible for cleaning up after them. Pets belonging to guests or visitors will at no time be permitted in the building, Pets are prohibited from all of the recreational areas at all times. All pets must be registered with Management, which will supply an identification tag which shall be worn by the pet af all times. Any pet not wearing the proper identification tag will not be pesmitted into the building Effective with contracts entered into on or after January 1, 1981, no unit may be sold or leased to anyone who has a dog or cat. No deceased pet may be replaced after January 1, 1981. As of January 1, 1981, no new pets may reside in the building. at POLICIES OF THE BOARD OF DIRECTORS ‘The Board of Directors may not be polled for an expenditure unless there is an emergency. If the emergency is of a life-threatening nature, such as an electrical failure or loss of water to the building, the emergency may be acted upon immediately, without polling the Board. Other than at meetings of the Board, no Director may be polled on a vote on any issue by any means of communication. No member of the Board may vote in absentia, whether by mall or by proxy or by any means of communication. The Board of Directors has voted that sales and leases do not have to be voted upon at a Board meeting. They are to be announced by the Secretary; the Board still oversees sales and consents to leases. No member of the Board may vote on any issue where that Director was not present at the discussion of the issue at a Board meeting. No member of the Board may abstain from voting on any matter unless a conflict of interest is involved. No unit owner may leave or deposit any written or printed matetial at the door of any resident, except if unit owner is a candidate for election to the Board of Directors or any Association elective office. No Unit Owner may be gainfully employed in any capacity by the Association. No committee chairperson may call a meeting without giving the committee members three days' notice. The President is the sole communicator to the Association lawyer on Association matters, but may delegate such activity on a specific matter to either a fellow Director or to the Manager. Members of the Board agree to support the majority vote of the Board at all times, having documented their dissent in the Minutes of the meeting. ‘A quorum is defined as the presence of (a) at least five Directors or (b) half the number of Directors currently on the Board plus one. The Board of Directors has the legal authority to impose fines if there has been an infraction of any of the Rules and Regulations, By-Laws or Master Deed. The 22 14. 15. 16. Board may consider the resident's history of Infractions and the severily of infraction when determining the amount of fines and penalties. Any motion for an expenditure exceeding $5,000 must state that the Treasurer confirms there are sufficient funds available, and state from which fund. The Association will maintain an Employee Emergency Fund of $5,000 to be used only for emergencies, at the discretion of Management. Except at the discretion of the President, no unit owner may serve on more than ‘one committee at a time. 23 PUBLIC REST ROOMS Rest rooms, except at the pool, are not to be used for changing attire, All factities must be kept in a clean and sanitary condition, No one shall play or lolter in any of the rest rooms. ‘Smoking is not permitted in any public rest room. Residents’ metal security keys will operate the locks on the public rest rooms off the lobby. Please turn lights off when leaving the public rest rooms. 24 RECREATIONAL FACILITIES The recreational facilities of the Condominium are for the exclusive use of the residents. Guests and relatives of residents may use these facilities, provided they are accompanied by a resident, who must show Winston Towers 300 ID when requested. Arts & Crafts Room 1. Access may be obtained from a Security Guard by a resident signing at the Back Desk and leaving a Winston Towers 300 ID card, All persons entering the Arts & Crafts Room must sign the attendance sheet. 2. The Arts & Crafts Room may be used on Mondays through Fridays, from 10 AM to 4 PM and from 6 PM through 9 PM, and on Saturdays and Sundays, from 10 AM through 4 PM. 3. No one under 15 may use the Arts & Crafts Room. Those under 21 must be accompanied by an adult resident, who assumes responsibility. 4. Use of the Arts & Crafts Room and equipment is at the users’ risk. 5. No food or beverages are permitted in the Arts & Crafts Room. Bicycle Room 4. Acoess may be obtained from a Security Guard between the hours of 8 AM and 9 PM. Alll parsons must sign the log each time they enter and leave the Bicyole Room. 2. Alll bicycles must be registered at the Management Office, which will issue identification tags to be permanently affixed to each bicycle. Billiard Room 1. Access may be obtained from a Security Guard by a resident signing at the Front Desk and leaving a Winston Towers 300 ID card. A resident must also sign for equipment, such as cues, balls, etc. 2 Children under 16 are not permitted to use the Billiard Room unless accompanied by an adult resident using the same table. 25 No food or beverages are permitted in the Billiard Room. When leaving the Billiard Room, the resident shall notify a Security Guard to inspect the area to ascertain whether damage has been done by the resident's group. The resident is responsible for damage. Card Room ‘The Card Room is restricted to use by authorized persons eighteen years or older. Each resident present in the Card Room will be permitted no more than one guest. Food will be permitted under reasonable conditions. The last resident to leave the Card Room shall notify a Security Guard to inspect the area to ascertain whether damage has been done by the resident's group. The resident is responsible for damage. ‘Smoking is not permitted in the Card Room. Violators will lose access privileges to the Card Room, Community Room This room is for the use of residents. Groups that wish exclusive use the room for meetings must obtain the consent of the Board of Directors. Only coffee and cake may be seived in the Community Room by any approved group. If anything more elaborate is desired, the Skyroom may be rented, with Board approval. This applies to all groups that use the Community Room. Smoking is not permitted in the Community Room. Violators will lose access privileges to the Community Room. Conference Room The Conference Room may be used only by the Board of Directors, Committees, and those to whom the Board has granted permission. 26 ‘Skyroom This room may be used by any Association Committee or the Board of Directors for meetings. All meetings must he scheduled through Management. Use by residents for entertaining shall be according to the Rules of the Skyroom listed below. The Skyroom is locked at all times, and may be opened only by a Security Guard or his supervisor. 1. Availability a. The Skyroom, when not reserved for a function, is avallable for a gathering a of residents only. Any resident, whether invited to this gathering or not, shall have the right at all times to visit and use the Skyroom during any such gathering. For a gathering of only residents, the Skyroom may not be reserved more than thirty days prior to such event. Should residents wish to have such a gathering, they will be required to follow the Rules of the Skyroom and will be responsible for cleaning the room thereafter. The Skyroom shall be available on a first come, first use basis for rent by any resident for a party or family gathering. The Skyroom shall be used solely for social purposes; no political or business functions, such as seminats, sales, ete., are permitted. ‘The Skyroom must be rented/reserved no less than thirly days in advance of the scheduled event, except as provided in (¢) above. Use of the Skyroom shall be permitted, one time at no charge, for a bereavement service held within thirty days of the demise of a resident, it the room is available, and providing the resident's family or friends pay for a Security Guard. All Rules regarding damage to the Skyroom and appurten- ances shall apply. Rules for Parties and Unit Owner Gatherings In addition to the following, the host resident must comply with all terms of the Rental Agreement. Residents, their employees or guests are not permitted to enter the roof at any time. 27 Host resident shall inspect the premises in the company of the Manager or Management representative immediately prior to the event, and shall inspect the same in the company of the Manager or management repre- sentative immediately after the event. Host resident will be required to sign an agreement holding the Association harmless, especially against any injury suffered due to drinking of alcoholic beverages on the premises (NJ Dram Laws). All renters of the Skyroom must employ two Security Guatds, chosen by Management. All guests shall remain on the Skyroom floor, unless they are accompanied by the host resident, Furniture may be rearranged within the Skyroom, but must be restored to its original configuration at the end of the event. No food or drink is permitted in the Skyroom without permission of Management, and host resiclent is responsible for cleaning up. Regarding Teenage Parties In addition to Skyroom Rules: a. There shail be four guards for teenage parties, of which at least one shall be female, Host resident must be a parent or legal guardian and must be present in the Skyroom at all times. Liquor or alcoholic beverages of any kind are prohibited at such teenage party. All guests and party members must stay on the Skyroom floor. Violation of any of these Rules is sufficient cause for Management to terminate the gathering immediately. Terms of Rental a. ‘The Skyroom may be rented at a fee of $400 for the evening of any Friday, Saturday, Sunday or holiday, except tho days of New Year's Eve, New 28 Year's Day, Passover, Easter Sunday, Fourth of July, Rosh Hashanah, Yom Kippur, Thanksgiving, Christmas Eve, Christmas Day, or any other day the Board of Directors shall designate. The Skyroom may be rented at a fee of $300 for the afteznoon of any Saturday or Sunday; or for the evening of any Monday through Thursday. The fee for the use of the Skyroom for a teenage party shall be double the stated room rental fee. Rental Agreement forms may be obtained at the Management Office. Security and Deposits a. A security deposit against any damages shall be required from residents, by check for $1,000 payable to Winston Towers 300 Association, to be recelved at least two weeks prior to tho event. This deposit will be returned after satisfactory inspection of the premises after the event. ‘The security deposit for a teenage party shall be double the stated security deposit. Limitations. a. The Fire Code states that maximum occupancy permitted in the Skyroom is ninety (76) persons, including all Security Guards and other employees, This will be strictly enforced. A complete list of guests must be made avaliable to Management at least seven days before the event. Failure to provide such a list may be cause for Management to cancel the event. If, for any reason beyond the Association's control, this event must be canceled by the Association, it shall be liable only for the return of the security deposit and rental fee Any cancellation by the renter less than two weeks prior to the scheduled date shall result in the loss of the security deposit and rental fee. No event may last more than five hours total. Events held Friday or Salurday evenings and holidays must end no later than 1 AM. Events held Sunday through Thursday evenings must end no later than midnight. Afternoon events must end no later than 5 PM. ‘The Association shall not supply any parking spaces for party guests. 29 f. The renter must sign a contract for the event at the time of reservation, and must timely pay all fees and deposits, g. In the event any damages exceed the security deposit, the Association must receive payment within one week of demand for payment, or a lien may be placed on the renter's property. South Promenade Play Area Hours are 8 AM through 9 PM daily, 2. Children 12 years or younger may use the "Tot Lot" play area facilities. 3. Ball playing, bike riding or the use of skates, skateboards or in-line skates are not permitted in the South Promenade play area. 4. Guests of residents are permitted on the Promenade only when accompanied by a resident. 5, Standing, looping, or twisting chains on swings are not permitted. 6. No food or other refreshments are permitted on the Promenade. 7. Patents of anyone breaking play area Rules will be notified Immediately by Staff. 8 When using the facilities, children under the age of 6 must be accompanied by an adult or a baby sitter 12 or older. 9. Heated talk, abusive or obscene language will not he tolerated, and a penalty may be imposed by the Board. Tennis Courts 1 Proper tennis attire and tennis shoes must be worm on the courts at all times. 2. Bathing suits are not proper tennis attire. 3. Heated talk, abusive or obscene language will not be tolerated and may lead to loss of court privileges. 4. Only Winston 300 residents will be permitted to reserve court time, Winston ‘Towers 300 ID must be available for inspection upon the request of personnel. 5. Reservations may be made at the Front Desk only for the next day's play, starting 30 at7 AM for play beginning at 8 AM. Telephone reservations will not be permitted. 6. A court not occupied by the party that reserved the time within ten minutes after the hour of resorvation will be forfeited, and the court will be “open to first come. 7. Aplayer may reserve only one hour per day, but may play “open time" orf no one is waiting, 8 Aresident may reserve a court one hour a week during regular (not prime) time to take a lasson, 9. Resitients may not give tennis lessons to non-residents on our tennis courts at any time, The use of automatic ball machines and other devices is prohibited at all times. 10. Adult players over 16 have priority during prime time. 11. Adoubles foursome may not sign up for more than two consecutive hours. 12. Ifyou are unable to play at your scheduled time, please cancel your reservation. 13. No food Is permitted in the tennis area. 14, Tennis courts are to be used for the sole purpose of playing tennis, No other activities are permitted on the tennis courts, Definitions: Prime Time - After 5 PM on weekdays, and all day Saturday, Sunday and Holidays, Regular Time- 8 AM to 5 PM on weekdays, Closing Time- No play permitted after 14 PM. 31 Tot Room Along with the privilege of using the Tot Room come certain responsibilities. 1. ra Everyone must sign IN and OUT at the Back Door. Parents or care givers are responsible for cleaning up after each child. Return toys to provided storage. Please dispose of trash in the bins provided. Nothing is to be removed from the Tot Room. For safety, no child is permitted in the Tot Room unless supervised by an adult. Adults should sit on the chairs or benches provided. Smoking is not permitted in the Tot Room. Violators will lose access privileges to the Tot Room. No food, beverages or gum are permitted in the Tot Room. Missing items or damage will be considered the responsibility of the person(s) signed in, Tot Room hours are 8 AM to 8 PM. Children over seven years of age are not permitted in the Tot Room. Rental of Tot Room: All children's partios must be registered at the Management Office. A rental fee of $100 is required and a $1,000 Security Deposit must be pald in advance against any damage. The Tot Room must be left in the condition found. 32 SECURITY Residents and their family members shall present Winston Towers 300 ID or other suitable identification material to authorized security personnel, doormen, or Management, when asked to do so. ‘All guests must be announced upon entering the building, Residents will be responsible for thelr guests’ conduct and for any damages sustained to any of the Association's property caused by their guests, The Doorman shall call the resident to be visited and resident must indicate approval of the visitor. In the event that no one is at home or that no consent to ‘the visit is received, then the visitor shall not be permitted to enter the building. Residents must pre-register at the Front Desk to permit access to the bullding by guests staying with residents and housekeeping personnel when the resident is, not at home, Each resident should report to Security, the Doorman or Management any suspicious persons loitering in the building, or any outright vandalism, Residents shall be responsible for the conduct of their guests, employees, delivery men and other persons acting in their behalf, and for any damages to property caused by their guests. Keys to apartments may not be left with the Doorman at any time. We have been instructed by our insurance company that employees may not accept keys because of possible liability For security reasons, when a resident will be away for an extended period, written notice of permission to allow any person Into your home must be left at the Management Office, Please remember, employees are not permitted to hold keys, All residents are requested to leave duplicate keys with Management for use only in an emergency situation. In tho event of an emergency, it may be necessary to access your apartment. If no one is at home, and if keys are not on file with Management, it may be necessary to break info your apartment [see By-Laws, Article VI, Section 12 - Right of Access}, All employees are bonded. Management has installed a "Key sure System" to safeguard your keys. Each set of keys will be focked in a sealed container bearing a unique identification number, which is then kept in a locked cabinet. The individual sealed container must’ be broken to access the keys, and cannot be reused. 33 10, Eee 12. SWIMMING POOL Proper cover-ups and footwear must be worn to and from the pool area. All persons using the pool are required to take a cleansing shower using warm water and soap, and shall thoroughly rinse off all soap before entering the pool. The same procedure muist be followed by any bathers who leave and re-enter the pool area. No person showing evidence of skin disease, sore or inflamed eyes, cold, nasal or ear discharge, or any communicable disease shall be admitted to the pool. No person with excessive sunburn, open blisters, cuts or bandages shall be admitted to the pool, Pets are not permitted in the pool area. Food is nt permitted in the pool area. Beverages may be brought info the pool area only in unbreakable containers, The lifeguard has been assigned the responsibilty for maintaining appropriate conduct and environment in the pool area. If, in the opinion of the lifeguard, any porson Is found to be engaging in unnecessary expectoration, spouting of water, rowdyism, roughness, or other conduct affecting the safety and comfort of others, such person will be asked to leave the pool area immediately. Decisions of the lifeguard on duty are final Running, pushing, horseplay, abusive language or any misconduct in general are not permitted in the pool area. Violations may result In suspension of pool access privileges. All non-swimmers are required to remain at the shallow-depth part of the pool. Should an emergency occur, the lifeguard will sound a continuous blast of the whistle. All swimmers must immediately leave the pool until permitted to return. During thunderstorms, all swimmers must leave the pool until permitted to roturn, Smoking is permitted in designated area only (behind poo! house). Please put butts/stubs in the receptacles provided. Violations may result in suspension of pool access privileges. Anyone with shoulder length hair must wear a bathing cap while in the pool, This 34 ai. 22. 23. requirement is made solely to reduce damage to the filtering system. THERE WILL BE NO EXCEPTIONS, Hair must be tucked into the bathing cap. Ifthe cap keeps coming off, a strap must be worn. ‘There is to be no rinsing of hair in the pool, If, in the opinion of the lifeguard, a rest period Is Indicated, younger swimmers: must spend a reasonable time out of the water. Floating objects, such as rafts and plastic water toys, may not be used in the pool. (Lifeguards may use their discretion when pool 1s not crowded.) Noodles are allowed, Underwater masks and snorkel equipment may be used only with the authorization of the lifeguard, All swimming is done at residents’ own risk. Children under 10 may use pool facilities ONLY if accompanied by a resident 16 years or older. Exceptions may be granted when the child is a member of an instructional class or has passed a safety swimming test to the satisfaction of the lifeguard. The level of achievement must be at least that of “advanced beginner." In addition, the child must show continuous satisfactory behavior in order to maintain these privileges. A resident bringing another resident's children to the pool assumes full responsibility for those children. Itis the responsibility of the poo! staff to devote their time to all those present, and they cannot be expected to assume the role of "baby sitter" while on duty. The maintenance of cleanliness is the responsibility of all residents and thelr guests, Trash containers are provided in the pool area. Please use these containers and Instruct your children to do so. Fitst Aid Is available. Any injury, regardless how slight, should be reported to the lifeguard and records should be submitted to Management. Bermucas, shorts, gym trunks, cut-offs (hemmed or unhemmed) ate not permitted in the pool. Residents will be charged for damages that result from their actions or those of their guests. ‘The pool will be closed at the discretion of the lifeguard or Management in the ‘event of continuous rain, extreme cold or high winds. This area is designated Code 7 - high wind velocity area - by the U. S. Weather Bureau. Children under the age of three years will not be permilted in the adult swimming pool at any time. Children in diapers must wear rubber pants over diapers in the children's pool. No child will be permitted in the children’s poo! without the immediate supervision of an accompanying adult. Each unit may receive four guest coupons for each weekend of the pool season. Each coupon will bear the unit number and will indicate the dates it may be used. Resident must accompany guests, and present Winston Towers 300 ID showing corresponding unit number. No additional weekend passes will be provided. Mondays through Fridays, residents are permitted four guests per day. Guests shall be permitted entry to the pool area only if accompanied by a resident, unless otherwise authorized by Management. No one is permitted in the pool unless a lifeguard is present. Swimming in the pool after hours is prohibited. All residents must show Winston Towers 300 ID to be admitted to the pool area. No lounge chairs will be permitted under any of the sunshades on Saturdays, Sundays or holidays. No chairs may be reserved for any resident or guest. Radios, cassettes or other music playing devices are permitted in the pool area, ONLY if they are used with headphones. 36 tt. TERRACES All terraces are limited common elements. No resident shail allow anything to fall or to be thrown from any window or door ot terrace. No sweepings shall be ejected from any unit into the corridors or other common elements or off any terrace. Shaking of carpets, rugs or mops Is not permitted. If any object is thrown from a terrace or a window of any apartment, the unit owner shall be subjected to incur any and all costs for repairs and damages to common areas as well as the neighbors. No resident shall be permitted to use barbecue or cooking equipment of any kind ‘on the terrace. No resident shall paint the exterior surfaces of the windows, doors, walls, or ceiling of any terrace (except using the authorized color of paint, which may be purchased from Management), without the written consent of the Board of Directors. No resident shall enclose any terrace in any way other than in accordance with plans and specifications approved in advance by the Board of Directors in writing. No resident shall decorate any terrace (ceiling, walls or railing) with any potentially dangerous object such as flower boxes or electrical wiring. Terrace floors may be filed or painted. After June 1, 1993, no carpeting of any kind may be replaced or installed. Any other terrace floor covering must have Management approval. No permanent structure is to be built on any terrace without the written consent of the Board of Directors. Feeding of birds is not permitted from any window or terrace. Installation of an electric fan or lighting in the ceiling of a terrace Is permitted only if a licensed electrician is employed, and the terrace is enclosed, and written permission is obtained from the Board of Directors.
