PETITION
COMES NOW, Petitioner, unto this Honorable Office, most
respectfully states;
1. That the Petitioner is DIOFIL GELLA SARENAS, of legal age,
Filipino, married, with residence and postal address at Balintawak,
Pagadian City, Philippines;
2. That Petitioner, owned a parcel of land, situated in the Barrio
of Balintawak, Pagadian City, Zamboanga del Sur, and more
particularly described as follows, to wit:
TRANSFER OF CERTIFICATE OF TITLE NO. T-39,046
A parcel of land, Lot 5873-A-1. bounded on the North along lines 2-3
by National Highway; on the East along lines 3-6 by lot 5873-A-2, of the sudb.
Plan; on the South along line 6-1 by lot 5832, Pls-119; on the West along
line 1-2 by lot 5872, Pls-119, containing an area of TWO THOUSAND FIVE
HUNDRED FORTY (2,540) SQUARE METERS, more or less.

3. That the aforementioned title over the said parcel of land

have the following annotation, to wit the liabilities imposed by Section
4, Rule 74 of the Rules of Court of the Philippines.

That pursuant to Sec. 4 of the Rules of Court of the
Philippines the prescriptive period for presenting a claim against the
estate is two (2) years after which the claim shall be barred;
5. That after the lapse of more than two (2) years, no creditor,
or other persons has ever presented a claim or claims against the said
parcel of land;

6.
That in view thereof, petitioner, having legal interest over the
subject real estate, is now praying for the cancellation of the annotation
printed on the faces of the title (TCT NO. T-39,046) of the afore-described real
estates;
WHEREFORE, premises considered, it is prayed of this Honorable
Office of the Register of Deeds that the annotation printed in TCT NO. T39,046, to wit: the liabilities imposed by Section 4, Rule 74 of the Rules of
Court of the Philippines; be CANCELLED.
Other relief which may be deemed just and equitable under the
circumstances are likewise prayed.
