CONCEPCION,J.:
AccusedofcounterfeitingPhilippinetreasurynotes,SergiodelRosario,AlfonsoAranetaandBenedictodelPilar
were convicted by the Court of First Instance of Davao of illegal possession of said forged treasury notes and
sentencedtoanindeterminatepenaltyrangingfrom8yearsand1dayto10yearsand1dayofprision mayor,
andpayafineofP5,000,withoutsubsidiaryimprisonmentincaseofinsolvency,aswellasaproportionatepartof
thecosts.Onappeal,thejudgmentwasaffirmedbytheCourtofAppeals,exceptinsofarasthemaximumofsaid
indeterminatepenaltywhichwasincreasedto10years,8monthsand1dayofprisionmayor.Thecaseisbefore
usonappealbycertioraritakenbySergiodelRosario.
Itappearsthat,aftershowingtocomplainantApolinariodelRosariothePhilippineonepesobillsExhibitsC,Eand
G and the Philippine twopeso bill Exhibit H, and inducing him to believe that the same were counterfeit paper
money manufactured by them, although in fact they were genuine treasury notes of the Philippine Government
oneofthedigitsofeachofwhichhadbeenalteredandchanged,theaforementioneddefendantshadsucceeded
inobtainingP1,700.00fromsaidcomplainant,intheCityofDavao,onJune23,1955,fortheavowedpurposeof
financingthemanufactureofmorecounterfeittreasurynotesofthePhilippines.Theonlyquestionraisedinthis
appeal is whether the possession of said Exhibits C, E, G and H constitutes a violation of Article 168 of the
RevisedPenalCode.Appellantmaintainsthat,beinggenuinetreasurynotesofourgovernment,thepossession
thereofcannotbeillegal.Wefindnomeritinthispretense.

It is not disputed that a portion of the last digit 9 of Serial No. F79692619 of Exhibit C, had been erased and
changedsoastoread0andthatsimilarerasuresandchangeshadbeenmadeinthepenultimatedigit9inSerial
No.F79692691ofExhibitE,inthelastdigitinSerialNo.D716326ofExhibitG,andinthelastdigit9ofSerial
No.
D716329ofExhibitH.
Articles160and169oftheRevisedPenalCoderead:
ART. 168. Illegal possession and use of false treasury or bank notes and other instruments of credit.
Unless the act be one of those coming under the provisions of any of the preceding articles, any person
whoshallknowinglyuseorhaveinhispossession,withintenttouseanyofthefalseorfalsifiedinstruments
referredtointhissection,shallsufferthepenaltynextlowerindegreethanthatprescribedinsaidarticles.
ART.169.Howforgeryiscommitted.Theforgeryreferredtointhissectionmaybecommittedbyanyof
thefollowingmeans
1.Bygivingtoatreasuryorbanknoteoranyinstrumentpayabletobearerortoordermentionedtherein,
theappearanceofatrueandgenuinedocument.
2. By erasing, substituting, counterfeiting or altering by any means the figures, letters, words or signs
containedtherein.
It is clear from these provisions that the possession of genuine treasury notes of the Philippines any of "the
figures,letters,wordsorsignscontained"inwhichhadbeenerasedandoraltered,withknowledgeofsuchnotes,

as they were used by petitioner herein and his codefendants in the manner adverted to above, is punishable
undersaidArticle168,inrelationtoArticle166,subdivision(1),oftheRevisedPenalCode(U.S.vs.Gardner,3
Phil.,398U.S.vs.Solito,36Phil.,785).
Being in accordance with the facts and the law, the decision appealed from is, accordingly, affirmed, with costs
againstpetitionerSergiodelRosario.Itissoordered.
