RE: MANIFESTATION OF THE LEGITIMACY OF THE MARRIAGE BETWEEN DANIEL F. KELLEHER
AND MARIVEL L. DE GUZMAN; AND THE DECLARATION OF THE MARRIAGE OF DANIEL F.
KELLEHER AND ESTELA CABRERA NULL AND VOID AB INITIO.
TO ALL WHOM THESE PRESENTS MAY COME:
That the undersigned would like to manifest that she is the only legal and legitimate wife of the late
DANIEL F. KELLEHER, who died last March 13, 2005 at SUMC FOUNDATION, Dumaguete City, Negros
Oriental, Philippines, as shown in the herein attached Photo Copy of their Marriage Contract and Death
Certificate of Daniel Kelleher, marked as ANNEXES A and A-1, respectively;
That after it was verified by the Office of the Embassy of the United States of America in Manila,
Philippines, the person of DANIEL F. KELLEHER was given an authority to contract marriage with me, hence ,
because of that authority a marriage license was issued by the Civil Local Registrar of Dumaguete City, under
License No. 4327670, issued on September 30, 2002. Attached herewith is an affidavit in lieu of Legal Capacity
to marry of Daniel Kelleher, marked as ANNEX B.
That the Vice Consul of the United States of America has recognized the undersigned to be the lawful
spouse of the late Daniel Kelleher for it is I that has registered with the United States Embassy as the lawful
spouse of the late Daniel F. Kelleher. Attached herewith is an Amended Report of an American Citizen Abroad,
marked as ANNEX C, showing that I am the recognized spouse of Daniel Kelleher.
WHEREAS, the alleged marriage of DANIEL F. KELLEHER and ESTELA CABRERA, held on March
7, 2000 at Subic, Zambales is actually NULL and VOID AB INITIO, because at that time of their marriage,
Estela Cabrera is still married to her husband HILARIO P. QUILANA, JR. whom they were married on March
10, 1974 at St. Joseph's PARISH church, Olongapo City, solemnized by Rev. Denis P. Igan. Attached herewith
is a Photo copy of the Marriage Contract of Hilario P. Quilana, Jr and Estela Cabrera, marked as ANNEX D.
And at that time of the marriage of Daniel F. Kelleher and Estela d. Cabrera, the latters husband Hilario P.
Quilana, Jr. is still alive and until the present and their marriage still exist for the said marriage was not
annulled.
THEREFORE, the second marriage of Estela Cabrera to Daniel Kelleher last March 7, 2002 is a
bigamous or polygamous marriage, pursuant to Article 35(4) of the Civil Code of the Philippines, and to quote:
ART. 35. The following marriages are void from the beginning:
1) X x x.. 2). X x x...
3). X x x
4). Those bigamous or polygamous marriages not falling under article 41.
HENCE, the marriage contracted by any person during the subsistence of a previous marriage shall be
null and void (Art. 41, Civil Code of the Philippines). That Hilario P. Quilana, Jr. is very much alive when
Estela Cabrera got married to Daniel Kelleher on March 7, 2000. In support herewith, a Photo Copy of Hilario
P. Quilana, Jrs Transaction Inquiry Details with the Land transportation Office for his drivers License posted
on January 9, 2007 is hereto attached and marked as ANNEX E.
IN VIEW HEREOF, it is most respectfully requested from your good office that the undersigned be
considered as the legitimate wife of Daniel F. Kelleher.
