FACTS:
Jocelyn and Angelitos were married on March 3, 1986 in a ceremony
officiated by the Mayor of Bian.
Jocelyn and Angelito lived with Angelitos parents after their marriage. Jocelyn
urged Angelito to find work and violent quarrels often resulted because of
Jocelyns efforts.
Jocelyn left Angelito sometime in July 1987. Angelito thereafter found another
woman with whom he has since lived and had children.
Ten years after their separation, Jocelyn filed with the RTC a petition for
declaration of nullity of marriage on the ground of psychologically incapacity
which was then granted by the RTC.
The Republic appealed the RTC decision to the CA. The CA reversed the RTC
decision.
Jocelyn filed an appeal on the decision of the Court of Appeals that reversed
RTC decision.
ISSUE:
Whether or not the marriage is void under Article 36 of the Family Code
HELD:
The court denied the petition for lack of merit and affirmed the appealed Decision of
the Court of Appeals.
Jocelyns evidence was insufficient to establish Angelitos psychological incapacity
to perform essential marital obligations. Both the psychologists testimony and the
psychological report did not conclusively show the root cause, gravity and
incurability of Angelitos alleged psychological condition.
