When this case was called for pre-trial, Atty. Erika Magpayo appeared for the plaintiff,
and Atty. Ma. Victoria Castillo appeared for the defendant. The plaintiff _____________ and the
defendant ______________ were also in court.
During the pre-trial, and after an earnest effort by the judge, there was no agreement
between the parties as to the possibility of amicable settlement of the case.
The plaintiff, through her counsel and the defendant, through her counsel stipulated on
the following that:
1. The plaintiff is the sole heir of the deceased;
2. That the defendant is an heir in interest as manifested and acknowledged by the
deceased in the formers birth certificate;
3. That a notarial will was fraudulently executed in favor only of the plaintiff
The plaintiff would like the following issues be resolved:
1. Whether or not she has the right, by virtue of a last will and testament, of all the
properties owned by the deceased
2. Whether or not there is a valid proof of filiation between the deceased and the
respondent
The respondent would like the following issues be resolved:
1. Whether or not the notarial will executed by the deceased is valid
2. Assuming for the sake of argument that the notarial will is indeed valid;
a. Whether or not the respondent, as an illegitimate child of the deceased, has no
right to claim any of the properties of the deceased
The plaintiff marked the following exhibits:

Both parties agreed on the trial date to be held on the 18th day of February 2016 in the
afternoon and shall present their witnesses also on the same date.
