DEED OF GIFT

THIS DEED OF GIFT is made at .. this day of ., between


Mr. ABC, a Hindu adult, Indian, age about 38 years, residing at .. and having Income Tax
PAN .., hereinafter referred to as THE DONOR (which expression shall unless it be repugnant to
the meaning or context thereof be deemed to mean and include his heirs, successors, executors,
administrators and permitted assigns) of the ONE PART
AND
Mrs. XYZ, a Hindu adult, Indian, age about 33 years, residing at . and having Income Tax
PAN .., hereinafter referred to as THE DONEE (which expression shall unless it be repugnant to
the meaning or context thereof be deemed to mean and include her heirs, successors, executors,
administrators and permitted assigns) of the OTHER PART
WHEREAS
1.

The Donor had purchased the Flat No. . admeasuring about .. square feet, carpet

area, on the Floor in Wing of Building namely .., in the project called as
situated at Division No. 23A, Sub-Division 41/107 of Village Nilje Ghesar bearing Survey No 99/3, 93, 95,
97 in Taluka Kalyan of District Thane along with the right to park one car in open cark park (hereinafter
referred to as the said Flat), more particularly described under Schedule 1 from Lodha Dwellers Private
Limited and other confirming parties vide the Agreement for Sale dated .. registered with the
Joint Sub-Registrar of Assurances, . under serial no. ...

The Donor is well and sufficiently entitled to the said Flat, with a right to use and deal with the

same.
3.

The Donor is the husband of the Donee herein.

4.

The Donor desires to grant the said Flat to Donee as GIFT out of natural love and affection as

hereinafter mentioned.
5.

The Donee has agreed to accept the gift as is evidenced by her executing this presents.

NOW THIS DEED WITNESSETH that the Donor, without any monetary consideration and out of natural
love and affection, which the Donor bear to the Donee, doth hereby grant and transfer by way of way of
gift the said Flat No. admeasuring about square feet, carpet area, on the

Floor in F Wing of Building namely .. in the project called as Casa Rio situated at Division
No. 23A, Sub-Division 41/107 of Village Nilje Ghesar bearing Survey No 99/3, 93, 95, 97 in Taluka Kalyan
of District Thane along with the right to park one car in open cark park, more particularly described in
the Schedule 1 hereunder written together with all and singular things permanently attached thereto or
standing thereon and all the liberties, privileges, easements and advantages appurtenant thereto, and
all the right, title, interest, use, inheritance, possession, benefit, claim and demand whatsoever of the
Donor, to have and hold the same unto and to the use of the Donee absolutely, but subject to payment
of all taxes, rates, assessment dues and duties now and hereafter chargeable thereon to the
Government or Municipality or other Local Authority
AND, the Donor doth hereby covenants with the Donee :
a)

The Donor has now in himself, good right, full power and absolute authority to grant the said
flat, as gift in the manner aforesaid.

b)

The Donee may at all times hereinafter peacefully and quietly enter upon, have, occupy, possess
and enjoy the said flat, and receive the rents, issues and profits thereof and every part thereof,
to and for her own use and benefit without any suit, lawful eviction, interruption, claim or
demand whatsoever from or by the Donor or his heirs, executors, administrators and assigns or
any person or persons lawfully claiming or to claim by, from, under or in trust for the Donor.

c)

That the said flat is free and clear, and freely and clearly and absolutely, and forever released
and discharged or otherwise by the Donor and well and sufficiently saved, kept harmless and
indemnified of and from and against all former titles, charges and encumbrances whatsoever,
had made, executed, occasioned or suffered by the Donor or by any other person or persons
lawfully claiming or to claim by, from, under or in trust of the Donor.

d)

AND FURTHER that the Donor and all persons having or lawfully claiming any estate or interest
whatsoever in the said Flat or any part thereof from, under, in trust for the Donor or his
executors, administrators, assigns or any of them shall and will from time to time and at all
times hereafter at the request and cost of the Donee do and execute or cause to be done and
executed all such further and other acts, deeds, things, conveyance and assurances in law
whatsoever for better and more perfectly assuring the said Flat and every part thereof unto and
to the use of the Donee in the manner aforesaid as by the Donee, her heirs, executors,
administrators and assigns or counsel in law shall be reasonably required.

e)

That the said Donor herby handover the original Agreement for Sale in respect of the said flat.

f)

That on execution of this Gift Deed, the Donee has acquired 100% rights, title and interest in the
said flat and henceforth it shall be exclusive ownership of the Donee.

g)

All out of pocket expenses including stamp duty and registration charges incidental to this Deed
of Gift shall be borne and paid by the Donee.

IN WITNESS WHEREOF the Donor as well as the Donee (by way of acceptance of the said gift) have put
their respective hands, the day and year first hereinafter written.
