COMPLAINT
Plaintiff,throughcounselanduntothisHonorableCourt,mostrespectfully
states:
1. That Plaintiff is of legal age, Filipino citizen, widow, a permanent
employeeofGSISBaguioCityBranch,andaresidentof#432 ndRoad,
QuezonHill,BaguioCity,Philippines,whilehereinDefendantJanice
MontrerasCruzisoflegalage,joblessandpresentlyresidingat#31
MagsaysayRoad,BaguioCitymarriedtohercoDefendantAlbertL.
Cruz,whoisherebyimpleadedpursuanttotheprovisionsoftheNew
Rules of Court; the Register of Deeds of Baguio City is likewise
impleaded in this action in his official capacity as such Register of
DeedsofBaguioCitywithofficeaddressat3 rdFloor,CityHallBldg.,
BaguioCitywheretheymaybeservedwithsummons;
2. That the herein Plaintiff is the sister of Defendant Janice Montreras
CruzwithwhomthesaidDefendantstayedandgrewsinceshewasa
small girl until she got married to her coDefendant Albert L. Cruz
sometimeinOctober2014;
3. ThatsometimeinthemonthofApril2005,hereinPlaintiffwasoffered
tobuythelotshewasrentingfromtheSpousesCocoM.DelaCruzand
ErichG.DelaCruzandafterthesaidPlaintiffconsideredtheoffer,she
decidedtobuythesameforfutureuseofheronlychild,MargauxRose
Rivera,whowasthenonlyabout10yearsofage,thevalueofwhich
propertyismoreorlessONEHUNDREDFIFTYTHOUSANDPESOS
(Php150,000.00);
4. ThatsinceMargauxRoseRiverawasstillaminorthen,thePlaintiff
wasadvisedthatthetitlecannotbetransferredinhernameyet,andso

togivehersistersomesortofencouragementinlifeandinorderto
developthepersonalityofhersister,Janice,shedecidedtotransferthe
titleinhernameasperthehereinattachedphotocopyoftheTitleNo.T
89712withtheunderstandingthatitwillbetransferredinthenameof
MargauxRoseRiveraassoonashereachestheageofmajority;
5. ThatwhenMargauxRoseRivera,theonlychildofthePlaintifffinally
reachedherageofmajority,thehereinPlaintiffsuggestedtohersister
totransferthetitletoherdaughter,butthroughtheconvincingwordsof
Janice when she begged that it be done later for it will be very
embarrassingtohersuitorsandbesides,theyaresistersandshewould
neverfoolher,Plaintiffaccededtotherequestandallowedthesame
propertytoremainregisteredinthenameofhersister;
6. ThathavingconsideredtherequestofJanicetobevalidandherearnest
desiretohelphersisterbygivinghersomesortofencouragementinlife
andtodevelopherpersonality,thePlaintiffwithoutanyslightsuspicion
thathersisterwhomsherearedandcaredforsinceshewasachilduntil
shegotmarriedatthematureageof30yearsoldwouldsomedaybe
afflictedwithgreediness,sheaccededtoallowthesameparcelofland
toremainregisteredinhername;
7. That when the herein Plaintiff bought the property from the above
namedspouses,CocoM.DelaCruzandErichG.DelaCruzandeven
up to the present, Janice Montreras Cruz has never been gainfully
employedsoastobeinthepositiontobuyanypieceofrealproperty
andallthetime,untilshegotmarriedsometimeinOctober2014,she
wasacompletedependentofthePlaintiff;
8. That recently, the herein Plaintiff experienced the biggest and
humiliating surprise in her whole life when the same Defendant
demandedhertovacatethepremisesandthesameDefendantisnow
claimingthepropertytobeherpropertyandevenwentouttotheextent
ofdragginghersisterPlaintifftotheauthorities;
9. That being sister, Plaintiff did almost everything to the extent of
begging from the Defendant Janice Montreras Cruz to cause the
TransferofTitleoftheabovepropertytothenameofheronlychild,
MargauxRoseRivera,asthesamepropertywasreallyintendedforher,
butthesameDefendantvehementlyrefusedandinsteadclaimsinbad
faithabsoluteownershiptheretototheprejudiceofthePlaintiff;
10. Thattheabovearrangementthatledtotheregistrationoftitleinthe
nameofDefendantJaniceMontrerasCruzwasknowntothesellersof
the property and other witnesses then, such as Assistant Prosecutor
JasonG.AraullooftheProsecutorsOfficeofBaguioCity;
11. That despite of the Plaintiff having done everything possible as to
convincehersistertoreturntohertheabovedescribedrealproperty,the
same Defendant failed and vehemently refused to accede, thus, the
Plaintiffwasleftwithnootherchoiceandhadtotakethislastrecourse
ofbringingthecasetotheCourt,andintheprocessshewasconstrained
to engage the services of the undersigned counsel with whom she
agreed to pay a reasonable amount, which we leave to the sound

discretion of this Honorable Court to determine, for and by way of


attorneysfees;
12. ThatbythereasonoftherefusaloftheDefendantJaniceMontreras
Cruz to return the property to the Plaintiff, herein Plaintiff suffered
sleeplessnights,mentalanguish,woundedfeelingsandotherformof
moraldamages,forwhichtheDefendantshouldbeheldliabletothe
Plaintiff for such amount, which we likewise leave to the sound
discretionofthisHonorableCourttodetermineforandbywayofmoral
damages;
13. Thattosetanexampletoothersunderthesamesituation,theDefendant
shouldbemadeliabletopaythePlaintiffacertainsumwhichweleave
tothesounddiscretionofthisHonorableCourttodetermineforandby
wayofexemplarydamages;
14. ThattherebeingnootherwaybywhichhereinPlaintiffcouldenforce
herrightandprotectherinterestasshehadalreadyexhaustedallthe
possibleremediesuntilshewasleftwithnootherchoicebuttobringthe
casetocourt,thesameDefendantshouldbemadeliabletopaythecosts
ofthesuit.
PRAYER
WHEREFORE, in view of the above premises, it is most respectfully
prayedofthisHonorableCourtthatafterduehearingofthiscase,theHonorable
CourtshallrenderadecisioninfavourofthePlaintiffandagainsttheDefendant:
1. By finding the plaintiff to be the lawful owner of the above
describedproperty;
2. Byorderingthedefendant,theRegisterofDeedsofBaguioCity,to
canceltheTransferCertificateofTitleNo.T89712coveringthe
aboverealpropertyinvolved,andthatthesamedefendantRegister
of Deeds of Baguio City be ordered to issue another Transfer
CertificateofTitletorecoverthesamepropertyinfavourofandin
thenameofhereinplaintiff;
3. ByorderingthedefendantsJaniceandAlbertCruztopayjointlyand
severallytheplaintiffofcertainsumtheamountofwhichweleave
to the sound discretion of this Honorable Court to determine as
reasonableasattorneysfees;
4. ByorderingthedefendantsJaniceandAlbertCruztopayjointlyand
severallytheplaintiffofcertainsumtheamountofwhichweleave
tothesounddiscretionofthisHonorableCourttodetermineforand
bywayofmoraldamages;
5. ByorderingthedefendantsJaniceandAlbertCruztopayjointlyand
severallytheplaintiffofcertainsumtheamountofwhichweleave
tothesounddiscretionofthisHonorableCourttodetermineforand
bywayofexemplarydamages;
6. ByorderingthedefendantsJaniceandAlbertCruztopayjointlyand
severally,thecostsofsuit,andplaintifffurtherpraysforsomeother
reliefsthatmaybejustandequitableunderthepremises.
