LOAN-2626 SRI: CONFLICT-AFFECTED REGION EMERGENCY PROJECT

IMPROVING PROVINCIAL, MUNICIPAL COUNCIL ROADS IN NORTHERN PROVINCE

OUTLINE TERMS OF REFERENCE

SOCIAL & RESETTLEMENT SPECIALIST

1. Introduction

The Democratic Socialist Republic of Sri Lanka has received a loan of US$150 million from the
Asian Development Bank (ADB) to rebuild the NP, affected by armed conflict, to restore the
normalcy in the area and to accelerate the development activities. One component of this loan
is to re-establish the connectivity in the NP and bordering villages to NP. This component will
rehabilitate (i) 100 km of provincial roads in Kilinochchi, Mannar, Mullaitivu and Vavuniya
districts, and (ii) 100 km of municipal and urban council roads in Northern Province and
pradeshiya sabha roads (rural roads) in the bordering villages of North Central Province (NCP).
The Executive Agency for the project is the Ministry of Economic Development and the
Implementation Agencies are the Road Development Department of NP and the Provincial Road
Development Department of NCP.

2. The Objective of the Consultancy

The Northern Provincial Council (NPC) the Project Implementation (PIU) will engage the
consultant for (i) & (ii) in preparation of the social and resettlement requirements for the
provincial and municipal/urban council roads, consisting of rehabilitation, and repairing or
replacing minor bridges and culverts. The Consultants will be permanently stationed in the NPC
Project Office, Trincomalee. However, they will be required to visit the project area for
requirements.

3. Essential Qualifications, Experience, Skills and/or Knowledge

a. The Consultant shall


i. Tertiary qualifications in social science and eligibility for membership of a professional
body in Sri Lanka (or equivalent);
ii. At least 10 years experience in a supervisory or management role, with an equivalent
period of experience in social and resettlement studies;
iii. Excellent technical knowledge in the detailed process and managing teams;
iv. Excellent knowledge of relevant standards and legislation applicable to the region and
a general appreciation of Specifications and Conditions of Contract;
v. Commitment and demonstrated capacity to undertake activities in a participative,
culturally sensitive and consultative manner, ensuring counter-parts actively
participate and develop understanding and ownership;
vi. High level interpersonal and communication skills and a demonstrated ability to
communicate and negotiate effectively with a diverse range of groups;
vii. Demonstrated capacity to work independently as well as contribute positively in a team
environment; and
viii. Competence with a range of computer software programs, including word, excel and
power-point.

b. The Consultant shall


i. Provide adequate training to the provincial staff assigned by the Employer.

4. Scope Of Work

a. General

• Conduct a preliminary social impact assessment for the project including assessment of
possible land acquisition/resettlement impacts for the candidate road alignments in
accordance with ADB’s Involuntary Resettlement Policy (latest) and Operations Manual
(OM)/F2 on Involuntary Resettlement (latest). Prepare and complete screening and impact
categorization form for involuntary resettlement for the candidate road alignments.

• Identify whether the project will be located in, or pass through, areas of significant
indigenous people’s settlements, and if this is the case propose how to specifically include
indigenous peoples in project planning and implementation in accordance with ADB’s
Indigenous Peoples Policy (latest). If relevant, make an overview of population
characteristics in the project area and anticipate project impacts. Prepare and complete
checklist for indigenous people screening and impact categorization for the candidate road
alignments.

• For the whole program, review existing resettlement frameworks (RF) and adjust them to
the project roads as necessary acceptable to the Government and ADB in compliance with
the Government’s National Involuntary Resettlement Policy and ADB’s Policy on Involuntary
Resettlement and Handbook on Resettlement.
b. Strategy and Planning

• Lead and support the development of sector policy and strategies, with proper
consideration for their impact on social development in consultation with relevant
government agencies and Implementing Agencies (IAs).
• Lead and conduct dialogue with government officials on social development.
• Lead or participate in teams and provide substantial inputs around social development
issues.
• Lead and conduct economic, thematic and sector work in the context of sustainable
economic development and poverty reduction.
• Coordinate with IAs for consistency of approach, exchange of experiences, and continuous
improvement of practices and integration of social development to the management of
projects.

b. Project Management

• Incorporate social development dimensions in the Grievance Redress Mechanism in


preparation of Compensation, Assistance and Benefits for Displaced/Affected Persons.
• Preparation of Social Impact Assessment.
• Preparation of Resettlement Plan if required and assist in Land Acquisition issues.
• Provide operational support in incorporating key social development concerns in heritage
and special consideration for the indigenous people.
• Ensure key technical, economic, financial and crosscutting issues are incorporated into
project requirements.

5. Reporting Procedure

The Consultant shall be responsible to the Provincial Director, PRDD (NP) and shall work with
the Chief and Executive Engineers of each District.

Within 2 weeks of commencement and completion the consultant shall submit an inception
report and completion report respectively.

The subject reports shall be submitted District wise for each road or as instructed by the
Employer.
6. Logistic Arrangement

The consultant shall be provided with logistical facilities such as stationeries, and access to
computers, printing etc. The project will provide office accommodation and transport to the
consultant based on his request and requirement for official purposes.

7. Payment

Shall quote expected salary with break-downs as given below:

Important Note:

1. Remuneration is paid based on the certification by User Unit on the actual inputs.

2. Out-of-Pocket Expenses are reimbursable with supporting documents/receipts.

3. Negotiated rates are fixed. Per-Diem is paid only when the Consultant is out of the
Permanent Location.

4. Rates are subject to negotiation.
