RULESANDREGULATIONS

DEFAULT:
A.

Memberwillbeindefaultifhe/shebreachesanyoftheseAgreementtermsorconditions,orifhe/shefailstopayanyMonthlydueswithinthirty(30)daysafterthe
scheduledduedate.IfMemberisinDefault,membershipprivilegesmaybedeniedandtheremainingbalanceduenotreleaseMemberfromanyobligationsunderthis
Agreement.
B.
Membershallnotberelievedofobligationstomakeanypaymentsoftheenrollmentfeehereinagreedto,andnodeductionorfromanyofsaidpaymentsshallbemade,
byreasonoftheabsenceorwithdrawalofMemberfromClub,orbyreasonofMembersfailuretoattendoruseClubfacilities.
C.
Membership is not transferable. Member can not sell, assign, or transfer this agreement, his/her membership card or membership in Club shall b e null and void.
Membermaynotloanhis/hermembershipcard/numbertoanyone.
2.
MEMBERSRIGHTTOCANCEL:
A.
IfbyreasonofdeathorpermanentdisabilityMemberispreventedfromusingasignificantportionofClubfacilitiesforwhichhe/shehascontracted,he/sheshallbe
relievedfromtheobligationofmakingpaymentforservicesotherthanthosereceivedpriortotheonsetofthedisabilityortimeofdeath.Ifservicesnotyetreceived
wereprepaid,theproratedamountwillberefundedwithinthirty(30)days.Acopyofthedeathcertificatemustbesent.
B.
The definition of permanent disability is a condition of a nontemporary nature which would preclude Member from physically using a significant portion of the
facilitiesfortheremainderofthetermofthemembershipandisdocumentedinwritingbyaphysicianacceptabletoClub.
C.
EnrollmentfeeentitlesonetobecomeaMember.MembershipduesareforuseofClubfacilityandservices,andareaseparateitem.TheEnrollmentfeeisnota
prepaymentforservices,butisearnedbytheclubatthetimeofenrollmentandpayscapital,computersetupandadministrativecosts,andisnonrefundable.
D.
AnyrequestforcancellationbyMember,mustbeinwritingandmustbedeliveredbymailtoClub.Thisistheonlymannerbywhichcancellationofthismembership
willbegranted,subjeLastctttothetermsandconditionssetforthabove.AMembersrequestforcancellationofmembershipmustbereceivedatleastthirty(30)days
priortothenextscheduledMonthlyDuespaymentdate.
E.
ClubwillnotbeliabletotheMemberfortherefundofanyadditionalpaymentsreceivedfromMemberifthetermsandconditionssetforth#2Aaboveforcancellation
havenotbeenmet.
3.
WAIVERANDRELEASE:
A.
Memberfullyunderstandthathe/sheisengaginginphysicalexercise,equipment,Clubexercisefacilities,andtraininginstructionsbyClubpersonnelwhichmaycause
injury to him/her. He/She hereby agrees that he/she is voluntarily participating in physical exercise, the use of Club facilities, and training and instruction by Club
personnel and that he/she is assuming all risks of injury to him/her on account of these activities. It is further agreed that Club will not perform any evaluation of
Members physical condition, which might result in the identification of risk factors contradicting physical exercise, prior to his/her stating continuing an exercise
activity.
B.
Member hereby warrants, represents and agrees that he/she has no physical disability, impairment of ailment preventing him/her from engaging in any exercise
activity, or that will be detrimental or inimical to his/her health, safety, comfort, or physical condition, or that of others. It is always advisable to consult his/her
physicianbeforeundertakingaphysicalexerciseprogram.
C.
Memberagreesherebytowaiveanyandallclaimsorrightshe/shemightotherwisehaveagainstClub,includingtherighttouseClub,itsemployeesoragents,forany
suchinjuriesorclaimsaforesaid.
D. MemberhascarefullyreadthiswaiverandreleaseandfullyunderstandsitisareleaseofanyandallfutureclaimsagainstCluborinjuriesorriskofinjuryresulting
fromactivitieswhileattendingClubfacility.
E.
MemberfurtheragreestoreleaseClubfromanyliabilityforanylossortheftofpersonalproperty.
F.
MemberunderstandsandagreestoallrulesandregulationsofusingClubfacility.Clubreservestherighttochangeormodifytheserulesandregulationsinthefuture
withoutpriornotificationtoMember.ClubreservestherighttorevokethisAgreementifMemberwillfullyfailsorrefusestoabidebysuchrulesandregulations.
4.
IntheeventthatMembershallclaimthathis/hermembershipcardislost,orstolenordestroyed,Clubmayrequireanaffidavitsettingforththerelevantcircumstancesand
thepaymentofaPhp500.00servicefeebeforeissuingareplacementcard.
5.
Thisagreementconstitutestheentireandexclusiveagreementbetweenparties.Anypromises,representations,understandings,and/oragreementspertainingdirectlyor
indirectlytothisAgreementwhicharenotcontainedhereinareherebywaived.ThisAgreementmaybemodifiedonlybyaninstrumentinwriting.However,Clubor
assigneeofthisAgreementisherebyauthorizedtocorrectpatenterrorsinthisAgreement.(andinotherdocuments,ifany,executedinconnectionherewith).AtClubs
option,thisAgreementshallbenullandvoidifitisnotcompletedbyClubsthencurrentpricingandpaymentprograms.
6.
ThisAgreementisgovernedbylawsoftheRepublicofthePhilippines.
7.
IfanyparticularprovisionofthisAgreementisinvalid,thatsameshallnotaffecttheotherprovisionhereof.
8.
ClubcandelayenforcingitsrightsundertheAgreementwithoutlosingthem.
9.
CLUBRESERVESTHERIGHTTOALLPERSONALTRAININGATCLUBFACILITY.UNDERNOCIRCUMSTANCESISANYMEMBERTOTRAINANOTHER
MEMBER.IFANYMEMBERISSUSPECTEDOFTHIS,THESITUATIONWILLBEINVESTIGATEDANDMEMBERBEEXPELLEDFROMCLUBWITHOUTREFUND
OFANYMEMBERSHIPFEESORRELEASEFROMANYAMOUNTSOWEDTOCLUB.
10. MEMBERSHIPRULES:
MemberagreestokeepandobeyallrulesandregulationsnowinforceorinthefutureprescribedbyClubfortheuseofClubfacilitiesandtheequipmentandfacilities
thereinincludingruleswithrespecttolockers,attireandpersonalhygiene.Clubreservestherighttorevokeorsuspendthismembership,formoralturpitudeorfraud.If
Memberissuspended,membersobligationstomakepaymentsunderthisAgreementcontinueasscheduled.UponenteringClub,Membermustregisteratthereception
deskandprovidemembershipidentification(andshowotheridentificationifrequestedbyClubpersonnel).
A.
MembermustcarryatowelwhileusingClubfacilities,andwillcleanuphis/hersweatafterusingequipment.
B.
Absolutelynogymbagsareallowedintheexercisesrooms.Ifhe/shebringsextraclothesorequipment,he/shemustcheckoutalockeranduseit.
C.
THEREISNOSMOKING,TOBACCOCHEWING,BETELNUTCHEWINGINANYAREAOFTHECLUB.Noopendrinkcontainersongymfloors.
D. DamagetoClubpropertyshallbepaidforbyanyMemberwhowillfullyorneglectfullycausessuchdamage.Memberisresponsiblefordamageincurredbydependent
childrenorguests.
MembershallbesubjecttothecontrolandguidanceofClubsstaffandfollowtheinstructionsofthestaffwhileinClubsfacilities.Memberagreestoconduct
himself/herselfinaquietandwellmanneredfashionwheninoraboutClubfacilitiessoasnottocauseanydisturbanceswhichwouldinterferewiththeuse
andenjoymentofClubbyotherMembersandguests.UndernocircumstanceswillMemberusefoul,loud,orslanderouslanguage,orharass,molest,badger,
orsolicitotherMembersorguests,andundernocircumstancesshallMembermoveexerciseequipmentabout,orusetheequipmentinanymannernot
authorizedbyClubmanagement.Anycomplaints,otherthanthoseofanemergencynatureorrequiringimmediateactionbyClubspersonnel,shallbemade
directlytothemanager,nprivate,soastoavoidpossibleembarrassmenttootherMembers.Memberagreestokeepandobeyrulesandproceduresnowin
forceorinthefutureestablishedbytheClub.TheProvisionsofthisparagrapharevitaltothesuccessfuloperationofClub.Aviolationoftheseprovisionsby
theMembercouldcauseinjurytoMemberortootherpersonsusingClubsfacilities,injurytothereputationofClub,damagetopropertybelongingtoClub
andotherpersons,orinterferencewithrightsgrantedtootherstouseClub.
E.
Lockersarefordailyuseonly.Innoeventwillanyonebepermittedtoleavelocksovernightonlockers.Alllocksleftovernightwillberemovedandcontentsdonatedto
charityordiscarded,unlessMemberhasarentallocker.
